Contract-based approaches have been a focus of attention in business ethics. As one of the grand traditions in political philosophy, contractarianism is founded on the notion that we will never resolve deep moral disagreement. Classical philosophers like Hobbes and Locke, or recent ones like Rawls and Gaus, seek to solve ethical conflicts on the level of social rules and procedures. Recent authors in business ethics have sought to utilize contract-based approaches for their field and to apply it to concrete business (...) dilemmas. However, the application of contractarianism to management contexts can cause difficulties. Our article discusses this conceptual problem of contractarian business ethics and presents the idea of order ethics as an alternative. Order ethics, as we argue, can make a difference by conceptually bridging the gap between contractarianism and business ethics. (shrink)

Welche Rolle spielen in diesem Prozess die Maschinen? Ohne ihre Erfindung wäre es nicht zu diesem Prozess mit (...) seinen zahlreichen Nebenwirkungen gekommen. Ihre Entwicklung reicht von der Dampfmaschine über die Prothetik bis zur Robotik. Ein wichtiger Motor der Entwicklung sind heute die digitale Kultur und die Künstlichen Intelligenz. Lassen sich diese auch für die nachhaltige Entwicklung nutzen? Ohne die Digitalisierung wäre es nicht zu den Entwicklungen der Gentechnologie gekommen. Mit der Erfindung und Nutzung der CRISPR-Technologie werden Eingriffe in die Evolution möglich, die sich als eine Zuspitzung der Dynamik des Anthropozäns begreifen lassen. Gibt es Möglichkeiten, die Gefährdungen und die negativen Auswirkungen dieser Entwicklungen zu vermeiden oder sie sogar zu kompensieren? Hier entstehen viele nicht einfach beantwortbare anthropologische Fragen, die für ein historisch und kulturell reflexives (Selbst-)Verständnis des Menschen von zentraler Bedeutung sind. (shrink)

_Nietzsche: Naturalism and Interpretation_ offers a resolution of one of the most vexing problems in Nietzsche scholarship. As perhaps the most significant predecessor of more recent attempts to formulate a postmetaphysical epistemology and ontology, Nietzsche is considered by many critics to share this problem with his successors: How can an antifoundationalist philosophy avoid vicious relativism and legitimate its claim to provide a platform for the critique of arguments, practices, and institutions? Christoph Cox argues that Nietzsche successfully navigates between relativism (...) and dogmatism, accepting the naturalistic critique of metaphysics and theology provided by modern science, yet maintaining that a thoroughgoing naturalism must move beyond scientific reductionism. It must accept a central feature of aesthetic understanding: acknowledgment of the primacy and irreducibility of interpretation. This view of Nietzsche's doctrines of perspectivism, becoming, and will to power as products of an overall naturalism balanced by a reciprocal commitment to interpretationism will spur new discussions of epistemology and ontology in contemporary thought. Assertion is the central vehicle for the sharing of knowledge. Whether knowledge is shared successfully often depends on the quality of assertions: good assertions lead to successful knowledge sharing, while bad ones don't. In Sharing Knowledge, Christoph Kelp and Mona Simion investigate the relation between knowledge sharing and assertion, and develop an account of what it is to assert well. More specifically, they argue that the function of assertion is to share knowledge with others. It is this function that (...) supports a central norm of assertion according to which a good assertion is one that has the disposition to generate knowledge in others. The book uses this functionalist approach to motivate further norms of assertion on both the speaker and the hearer side and investigates ramifications of this view for other questions about assertion. Pritchard and Vaesen have recently argued that robust virtue epistemology does not square with the extended cognition thesis that has enjoyed an increasing degree of popularity in recent philosophy of mind. This paper shows that their arguments fail. The relevant cases of extended cognition pose no new problem for robust virtue epistemology. It is shown that Pritchard’s and Vaesen’s cases can be dealt with in familiar ways by a number of virtue theories of knowledge.

In this chapter, I discuss some ways in which debates about temporal experience intersect with wider debates about the nature of perception in general. In particular, I suggest that bearing in mind some general questions about the nature of perception can help with demarcating different theoretical approaches to temporal experience. Much of the current debate about temporal experience in philosophy is framed in terms of a debate between three specific main positions sometimes referred to as the extensional model, the retentional (...) model and the cinematic model. It is typically assumed that the differences between these three models are obvious. Yet, on closer inspection, it turns out to be surprisingly difficult to make out what exactly distinguishes the cinematic model from the extensional one, on the one hand, and from the retentional model, on the other. I criticise some existing ways in which the models are sometimes demarcated from one another, before suggesting that the differences between the three views become clearer if the debate between them is seen as turning on contrasting pictures of the nature of perceptual experience they embody. This paper aims to develop a novel account of the normativity of assertion. Its core thesis is that assertion has an etiological epistemic function, viz. to generate knowledge in hearers. In conjunction with a general account of etiological functions and their normative import, it is argued that an assertion is epistemically good if and only if it has the disposition to generate knowledge in hearers. In addition, reason is provided to believe that it makes sense to regulate the practice of (...) assertion by a speaker rule—and, more specifically, by a knowledge rule—as so regulating assertion contributes to ensuring that assertion fulfils its etiological function reliably. Promotion of pro-social attitudes and moral behaviour is a crucial and challenging task for social orders. As traditional ways such as moral education have some, but apparently and unfortunately only limited effect, some authors have suggested employing biomedical means such as pharmaceuticals or electrical stimulation of the brain to alter individual psychologies in a more direct way — moral bioenhancement. One of the salient questions in the nascent ethical debate concerns the impact of such interventions on human freedom. Advocates argue (...) that moral bioenhancements do not pose a serious threat to freedom. This contention, however, is based on an overly narrow, if not impoverished, sense of freedom, which comprises only freedom of action and freedom of will. Mind-altering interventions primarily affect another sense of freedom: freedom of mind, a concept that has not received much attention although it should rank among the most important legal and political freedoms. The article introduces three senses of mental freedom potentially infringed upon by moral bioenhancement and places it in a broader perspective. Ignorance of mental freedom has far-ranging consequences for the shape of the political and legal order at large. As many advocates are apparently not aware of the freedoms they seek to undermine, their calls for moral enhancement programmes are dangerously premature. (shrink)

According to what I term the Dependency Thesis, the ability to grasp the concept of the past depends on possession of episodic memory, i.e., the capacity to recollect particular past events. I consider two questions regarding the Dependency Thesis. First, suppose the Dependency Thesis is true. How exactly should we think of the role that episodic memory plays in grasp of the concept of the past? Secondly, is the Dependency Thesis actually true?

La grande idée que Hegel a présentée et développée dans la Phénoménologie de l’Esprit, est la découverte de la signification de la négativité. Celle-ci est alors plus qu’une procédure formelle. Qui plus est, la négativité est un concept qui marque la réalité même. D’une part, la négativité montre la réalité comme quelque chose de subjectif, car la négativité en tant que principe formule la position du réel en relation avec soi-même à travers un processus de négation. D’autre part, la négation (...) montre une réalité tendue, douloureuse et éphémère. Hegel arrive à cette idée dans ses débats avec Fichte et Schelling avant tout. Malgré l’interrogation justifiée sur le fondement de la critique de Hegel, la force argumentative de ce concept est pourtant estimable: elle dépend de l’attention portée aux phénomènes concrets, à leurs différences spécifiques et à leur unité substantielle que cette attention rend abordables à une compréhension raisonnée. In elaborating his phenomenological project, Michel Henry refers to Søren Kierkegaard. After a brief survey of Henry’s phenomenology of the self, we will inquire whether this appropriation is accurate. It will be argued that Kierkegaard’s dialectics of existence can operate as a therapy or corrective in order to save Henry’s project of a radical immanent and passive self. If not, it suffers from incoherence both from a phenomenological as well as from a theological perspective. In a number of recent papers Duncan Pritchard argues that virtue epistemology's central ability condition—one knows that p if and only if one has attained cognitive success (true belief) because of the exercise of intellectual ability—is neither necessary nor sufficient for knowledge. This paper discusses and dismisses a number of responses to Pritchard's objections and develops a new way of defending virtue epistemology against them.

Robots have been introduced into our society, but their social role is still unclear. A critical issue is whether the robot’s exhibition of intelligent behaviour leads to the users’ perception of the robot as being a social actor, similar to the way in which people treat computers and media as social actors. The first experiment mimicked Stanley Milgram’s obedience experiment, but on a robot. The participants were asked to administer electric shocks to a robot, and the results show that people (...) have fewer concerns about abusing robots than about abusing other people. We refined the methodology for the second experiment by intensifying the social dilemma of the users. The participants were asked to kill the robot. In this experiment, the intelligence of the robot and the gender of the participants were the independent variables, and the users’ destructive behaviour towards the robot the dependent variable. Several practical and methodological problems compromised the acquired data, but we can conclude that the robot’s intelligence had a significant influence on the users’ destructive behaviour. We discuss the encountered problems and suggest improvements. We also speculate on whether the users’ perception of the robot as being “sort of alive” may have influenced the participants’ abusive behaviour. (shrink)

This study offers a detailed systematic comparison of Fichte's and Hegel's philosophies with regard to their conceptions of freedom. It explains and compares the place of practical freedom within the two thinkers' overarching systems of ethical, legal, and political philosophy. In the process, it shows not only Hegel's debt to Fichte but also the essential difference between understanding freedom as origin as opposed to result.

Practical arguments for actions are arguments which, besides their epistemic function, shall motivate an addressee to execute the justified action. First, a strategy is developed how this motivational and other requirements can be met. Part of this strategy is to identify a thesis for which holds that believing it motivates in the required manner. Second, relying on empirical decision theory, such a thesis is identified. Finally, precise validity criteria for the respective arguments are developed.

Perfectionism is a new player in the field of political philosophy. It is often rejected by liberal philosophers for it seems to have a conservative or paternalist bias. However, this paper argues first that perfectionism can have different political tendencies: it can be both liberal and illiberal, equalizing or anti-egalitarian, and be based on both limited or open conceptions of human nature. So perfectionism is not intrinsically conservative. Secondly, the paper aims to show that a strong case can be made (...) for a liberal and egalitarian perfectionism, based on a rereading of Karl Marx. From this perspective it is not only unnecessary to criticize perfectionism from a liberal or egalitarian perspective, perfectionism may also help in justifying liberal egalitarianism in a new way. This paper considers challenges resulting from the use of advanced artificial judicial intelligence (AAJI). We argue that these challenges should be considered through the lens of value alignment. Instead of discussing why specific goals and values, such as fairness and nondiscrimination, ought to be implemented, we consider the question of how AAJI can be aligned with goals and values more generally, in order to be reliably integrated into legal and judicial systems. This value alignment framing draws on AI safety and (...) alignment literature to introduce two otherwise neglected considerations for AAJI safety: specification and assurance. We outline diverse research directions and suggest the adoption of assurance and specification mechanisms as the use of AI in the judiciary progresses. While we focus on specification and assurance to illustrate the value of the AI safety and alignment literature, we encourage researchers in law and philosophy to consider what other lessons may be drawn. We study straightforward embeddings of propositional normal multimodal logic and propositional intuitionistic logic in simple type theory. The correctness of these embeddings is easily shown. We give examples to demonstrate that these embeddings provide an effective framework for computational investigations of various non-classical logics. We report some experiments using the higher-order automated theorem prover LEO-II.

The introduction summarizes the main arguments formulated in the six papers of this special issue on Constitutivism and Kantian Constructivism in Ethical Theory. We highlight the unifying theme addressed in the essays, i.e., the question of whether constitutivism is able to fulfill the promise of providing an account of normativity starting from relatively slender assumptions, including the avoidance of realist presuppositions.

Duncan Pritchard has recently argued against robust virtue epistemology on the grounds that it gets caught up in a fatal double bind: There is a type of case suggesting that the central robust virtue theoretic condition on knowledge is too strong to be necessary for knowledge as well as a type of case suggesting that it is too weak to be sufficient for knowledge. He does concede to the robust virtue epistemologist that his argument will be fully convincing only if (...) it really is a double bind the view gets caught up in, i.e. if robust virtue epistemology faces both types of case. This paper shows that Pritchard’s argument fails to fulfil its promise. I consider the two major ways of interpreting the virtue theoretic condition and argue that while it is plausible that for each interpretation of this condition one problematic type of case arises, for neither interpretation both problematic types of case arise. In consequence, by his own lights, Pritchard’s argument turns out unconvincing. (shrink)
