Although rationing is not unprecedented, never before has the American public been faced with the prospect of having to ration medical goods and services on this scale.

After discussing de Sousa's view of emotion in akrasia, I suggest that emotions be viewed as nonconceptual perceptions of value (see Tappolet 2000). It follows that they can render intelligible actions which are contrary to one's better judgment. An emotion can make one's action intelligible even when that action is opposed by one's all-things-considered judgment. Moreover, an akratic action prompted by an emotion may be more rational than following one's better judgement, for it may be the judgement and not the (...) perception which is in error. By contrast, "cool" akrasia is genuinely puzzling; it is not clear whether it exists. (shrink)

What is the relation between the concept good and more specific or ‘thick’ concepts such as admirable or courageous? I argue that good or more precisely good pro tanto is a general concept, but that the relation between good pro tanto and the more specific concepts is not that of a genus to its species. The relation of an important class of specific evaluative concepts, which I call ‘affective concepts’, to good pro tanto is better understood as one between a (...) determinable and its determinates, whereas concepts such as courageous can be analysed in terms of affective concepts and purely descriptive concepts. In recent years, an increasingly assertive People’s Republic of China (PRC) leadership has sought to extend the PRC’s influence globally. To this end, it has developed diverse strategies ranging from soft power to more coercive means. The more visible strategies include the Belt and Road Initiative, the Chinese Dream, and ‘wolf warrior’ diplomacy. At the soft power end of the spectrum, Chinese overseas students are at the nexus between two strategies of soft power – the Chinese diaspora and the internationalisation (...) of higher education. While there is an established literature analysing China’s soft power worldwide, relatively little has been done on the role of higher education, particularly where this concerns overseas Chinese students. The article will examine China’s use of overseas students to project its soft power. It then identifies the strategies that support this, viz. ideological and political education to prepare young people for this role and, once overseas, an appeal to a conception of the Chinese diaspora, as well as the organisations (e.g. embassies and student associations) that form potential channels to students and monitor and support them in their role. Despite extinction-based processes demonstrating efficacy in the animal extinction and human anxiety literatures, extinction for substance use disorders has shown poor efficacy. Reasons for this lack of success include common threats to extinction, such as renewal and reinstatement. In recent decades, research on mindfulness for SUD has flourished, and a key aspect of these mindfulness-based interventions includes teaching individuals to stay present with whatever experience they have, even if unpleasant, without trying to change/escape/avoid it. Similarly, CET teaches individuals to not (...) escape/avoid conditioned responses by engaging in drug use behavior. This paper discusses how mindfulness-based research and practices could positively influence CET through future research, with the long-term goal of improving SUD treatment. (shrink)

It is generally accepted that there are two kinds of normative concepts : evaluative concepts, such as good, and deontic concepts, such as ought. The question that is raised by this distinction is how it is possible to claim that evaluative concepts are normative. Given that deontic concepts appear to be at the heart of normativity, the bigger the gap between evaluative and deontic concepts, the less it appears plausible to say that evaluative concepts are normative. After having presented the (...) main differences between evaluative and deontic concepts, and shown that there is more than a superficial difference between the two kinds, the paper turns to the question of the normativity of evaluative concepts. It will become clear that, even if these concepts have different functions, there are a great many ties between evaluative concepts, on the one hand, and the concepts of ought and of reason, on the other. The ‘no-difference problem’ challenges us to explain in which way the occurrence of an aggregate effect gives us reason to act in a specific way, although our individual actions make no difference to the effect’s occurrence. When discussing this problem, philosophers usually distinguish between so-called ‘triggering cases’, where the aggregate effect in question is brought about upon reaching a precise threshold, and ‘non-triggering cases’, in which no such precise threshold exists. However, despite their relevant differences, it is widely assumed not (...) only that both categories of cases confront us with the same moral problem, but also that this problem should be solved in the same way no matter which category we are considering. In this paper, I argue that this assumption is mistaken by showing that non-triggering cases pose very different moral problems than triggering cases unless very specific and, arguably, unlikely assumptions in neighbouring debates about causation and decision-making under indeterminacy hold. How do we know if people are equal? Contemporary philosophers consider a number of issues when determining if the goals of egalitarian distributive justice have been achieved: defining the metric of equality; determining whether the goal is equality, or simply priority or sufficiency; establishing whether there should be conditions, e.g. bad brute luck, for the amelioration of inequality. In all this, most egalitarians contend that what is to be equalized is not people’s actual shares of the good in question, but (...) rather, the opportunities to have such shares. I counter this view with an ‘egalitarian flourishing’ approach that, in seeking to make people equal in actual well-being, takes exception to the role of opportunity in contemporary argument. The flourishing view means a focus on outcomes, on how people live, in order to enable people to live equally flourishing lives. I argue that if we consider the complex dynamics of choice and circumstance, the role of nonmaterial considerations and the ideal of an egalitarian community, equality of opportunity proves to be an inadequate approach to the realization of the egalitarian ideal. To answer foundational questions in physics, physicists turn more and more to abstract advanced mathematics, even though its physical significance may not be immediately clear. What if we started to borrow ideas and approaches, with appropriate modifications, from the foundations of mathematics? In this paper we explore this route. In reverse mathematics one starts from theorems and finds the minimum set of axioms required for their derivation. In reverse physics we want to start from laws or more specific results, and (...) find the physical concepts and starting points that recover them. We want to understand what physical results are implied by which physical assumptions. As an example of the technique, we will see six different characterizations of classical mechanics, show that the uncertainty principle depends only on the entropy bound on pure states and recast the third law of thermodynamics in terms of the entropy of an empty system. We believe the approach can provide greater insights into both current and new physical theories, put the physical concepts at the forefront of the discussion and provide a more unified view of physics by highlighting common patterns and ideas across different physical theories. This phenomenological case study investigates how planning community-centered civics inquiries can prepare elementary pre-service teachers to better address inequities facing rural communities, including those located on Indigenous reservations. Specifically, the study addresses this research question: How does community-centered planning inform pre-service teacher readiness to support place-conscious and anti-colonial civics education within elementary contexts? Findings suggest that guided, community-centered planning leads to enhanced pre-service teacher confidence in preparing to facilitate equity-oriented elementary education, particularly as related to evolving understandings of civics content (...) competence, relational commitments, and responsibilities of rural teachers. This article uses elements of autoethnography to theorize an in/formal support relationship between a friend with a physical disability, who uses attendant services, and me. Through thinking about our particular “frien-tendant” relationship, I find the common scholarly orientations toward “care” are inadequate. Starting from the conversations between feminist and disability perspectives on care, I build on previous work to further develop the theoretical framework of accessible care. Accessible care takes a critical, engaged approach that moves beyond understanding “accessibility” as merely (...) concrete solutions to create more inclusive forms of care. Care, in this context, is positioned as an unstable tension among competing definitions, including that it is a complex form of oppression. Accessible care draws on feminist disability perspectives and the feminist political ethic of care to build bridges in four areas: from daily experiences of disability and support to theoretical discussions; across feminist care research and disability perspectives; across divisions and anxieties within disability communities; and from the local to transnational applications. These bridges do not aim to resolve debates but allow us to travel back and forth between differing perspectives and demonstrate the tenuous possibility of accessible practices and concepts of care. It offers a new theoretical perspective on power since it underlines that (...) power is foremost about guidance and conduct. Foucault’s work on governmentality parallels very similar endeavours and recent developments in Marxist theory and is also of great critical interest to analyse contemporary neoliberal forms of government. In recent years, there has been an intense debate about the concept of “biological” or “genetic citizenship.” The growing literature on this topic mostly refers to the importance of patients’ associations, disease advocacy organizations, and self-help groups that are giving rise to new forms of subjectivation and collective action. The focus is on the extension of rights, the emergence of new possibilities of participation, and the choice-enhancing options of the new genetics. However, this perspective tends to neglect the potential for (...) exclusion and restriction of citizenship rights based on biological traits. We aim to broaden and complement the existing theoretical discussion on biological citizenship, which so far has concentrated on the medical sphere, by investigating a new empirical field. The article analyzes the use of DNA analysis for family reunification and shows that biological criteria still play an important role in decision making on citizenship rights in nation-states. Presenting Germany as an exemplary case, we argue that the use of parental testing endorses a biological concept of the family that is mobilized to diminish citizenship rights. The argument is based on documentary analysis and on interviews with representatives of nongovernmental organizations and immigration authorities, lawyers, geneticists, and applicants for family reunification. Even if the writing of mimetic theory has undergone the turbulence of world history and the biography of its author, the whole determines its parts; the whole comprehends the boundaries of the work, the first writings and the last, in both senses of the word: to be taken altogether, understood as a whole, or discarded altogether. Moreover, its radical nature prohibits any form of readjustment or compromise. Girard has said it expressly in his interviews: There is no "Girardian system" but at the outset, a very compact intuition that fertilized all his research. This same intuition allowed Girard to profit from the work of his contemporaries and to maintain real relationships with the thought leaders of his time, such as Goldmann, Deguy, Foucault, Lacan, Barthes, and Derrida, without ever turning away from his own path. What is cognition? Despite the existence of a science of cognition there is no clear agreement on what makes certain phenomena cognitive, and others not. Within cognitivism the issue was neglected. Human intelligence was used as a standard, and any process—natural or artificial—that fitted this standard sufficiently could be considered ‘cognitive’. For post-cognitivist psychology the situation is different. It cannot rely on the ‘human standard’ in the same way. One might even say that the need for a post-cognitivist psychology arose (...) because cognitivism began with this most complex of all cognitive systems without a good understanding and appreciation of more basic, biological cases. Embodied cognition approaches remedy this anthropocentric bias by addressing a more varied set of processes that are not strictly limited to humans. Under these circumstances the question what we take cognition to be is more urgent. Are phenomena like insect walking (Brooks) and goal-seeking missiles (O’Regan and Noë) examples of cognition or not? What criteria do we use to answer such questions? Given this problem, the notion of perception-action coupling (or sensorimotor contingencies) becomes an important and fairly obvious option to provide a foundation for the notion of cognition. However, and intriguingly, the same problem occurs again: What are perception-action couplings? What would make something an example of perception-action coupling? Where are we to draw a line, if anywhere? It is self-evident that O’Regan and Noë’s (2001) example of a goal-seeking missile is controversial, but why exactly? What is missing? Can we ever do more than making intuitive judgments here? A way out of this dilemma may be found by developing the claim that perception-action coupling must be grounded in a biological context (Keijzer, 2001), and following what Lyon (2005) calls a biogenic approach. This option raises a whole new field of issues and topics that is of central concern for a postcognitivist psychology. (shrink)

The recent trend toward privately owned and operated prisons calls attention to a variety of issues involving human rights. The growing number of corporatized correctional institutions is especially notable in the United States, but it is also a global phenomenon in many countries. The reasons cited for privatizing prisons are usually economic; the opportunity to outsource prison services enables local political leaders to save tax revenue, and local communities are promised a chance to create new jobs and bring in a (...) new industry. This article will address the history of prisons and the recent trend toward privatizing prisons and the perception of prisons as a for-profit enterprise. This new economic order brings with it a set of human rights concerns, including the relationship of for-profit prisons to increased numbers of incarcerated persons and increased sentences, racism and classism. The contractual relationship between political leaders and prison corporations will be addressed, noting that conditions of liability frequently mean that prison administrations lack motivation to safeguard the human rights of prisoners. The human rights issues often extend outside of the private prison itself, having a negative effect on the local community. (shrink)

Williams Syndrome provides a striking test case for discourses on disability, because the characteristics associated with Williams Syndrome involve a combination of “abilities” and “disabilities”. For example, Williams Syndrome is associated with disabilities in mathematics and spatial cognition. However, Williams Syndrome individuals also tend to have a unique strength in their expressive language skills, and are socially outgoing and unselfconscious when meeting new people. Children with Williams are said to be typically unafraid of strangers and show a greater interest in (...) contact with adults than with their peers. This apparently keen social knowledge is a counterexample to the discussion of disability among academic philosophers, especially philosophers of the early modern period. Locke infamously used the example of disability to claim that Descartes’ arguments in favor of innate ideas were incorrect. On the contrary, Williams Syndrome may stand as an example of innate social knowledge; something that could benefit current discourse in philosophy, disability theory, and medical ethics. (shrink)

Disability has been a topic of heightened philosophical interest in the last 30 years. Disability theory has enriched a broad range of sub-specializations in philosophy. The call for papers for this issue welcomed papers addressing questions on normalcy, medical ethics, public health, philosophy of education, aesthetics, philosophy of sport, philosophy of religion, and theories of knowledge. This issue of Essays in Philosophy includes nine essays that approach the philosophy of disability in three distinct ways: The first set of three essays (...) provide a careful analysis of John Rawls, and the application of his work in ethics and justice to societies in which persons with disabilities, especially cognitive disabilities, can take active part in the processes of civil society. In the recent past a number of empirical studies provided evidence that increasing genetic knowledge leads to new forms of exclusion, disadvantage and stigmatisation. As a consequence, many states have inaugurated special legislation to fight "genetic discrimination".This article focuses on some theoretical, normative and practical problems in the scientific and political debate on genetic discrimination. It puts forward the thesis that the existing antidiscrimination approach is based on the implicit idea that genes are the essence of (human) life. Since genes (...) are held responsible for individual development and personal identity, genetic discrimination is granted a privileged legal status in comparison to other forms of discrimination. As a result the analytical and political concentration on processes of genetic discrimination may reinforce the "geneticization" of body, illness and deviance. (shrink)

Scholars have often taken Foucault by his words and insisted that his philosophy is completely at odds and opposed to Sartre’s—and Beauvoir’s—existentialism. However, it is my contention that Foucault’s own appreciation and intense critique of existentialist philosophy stems from a series of misunderstandings with regards to the notions of the subject, freedom, and historicity. The purpose of my essay will be to explore affinities between Foucauldian and existentialist philosophy as found in Sartre and Beauvoir’s works, focusing particularly on the ethical (...) notions of authenticity and distantiation from oneself. Recent feminist and postmodern thought has critiqued traditional conceptions of masculinity, describing the effect that the distinctive masculinity of the "man of reason" has had on the history of philosophy, on consciousness, and on the academy. A common characteristic of the recent literature on masculinity is that it reflects the historical and cultural context in which it is written -- a context of binary, hierarchical dualisms which involve certain symbolic associations. These dualisms, such as Man-Woman, masculine-feminine, and reason-emotion, arguably find (...) their roots in Pythagorean philosophy and can be traced through the Renaissance to our current historical context. One example is our conception of reason: the association of maleness with a clear, determinate mode of thought, i.e. reason, was incorporated into the form-matter distinction that was central to Greek thought. This paper will show that in cases where women attempt to redefine the dichotomy by revaluing the traditionally feminine (like feelings and emotions) over the traditionally masculine (like reason) their work is often mistakenly criticized for being purely political; conversely, when men attempt to redefine the same dichotomy in an attempt to allow men to "get back in touch with their feelings," to be nurturers, their work is described in terms of providing a better epistemology. The current literature on masculinity explores alternatives to rewriting or redefining Woman that try to avoid the problem of status remaining with redefinition. This alternative is rewriting or redefining Man. Through redefining Man, one may be able to reconceptualize the privileged side of the hierarchical dualism in such a way that it is no longer privileged. Deprivileging, as well as redefining Man, is argued by theorists of masculinity to be possible because while the devalued status of the inferior side of a hierarchical dualism tends to keep the same status when redefined, it may be possible to redefine the privileged side of the dualism in such a way that it loses its privileged status. Unfortunately, many of these attempts to rewrite or redefine masculinity have detrimental faults of their own. Finally, this paper will discuss more promising possibilities for new definitions of Man, as well as a vision for better interaction between the work of women and men in general. (shrink)
