After discussing de Sousa's view of emotion in akrasia, I suggest that emotions be viewed as nonconceptual perceptions of value (see Tappolet 2000). It follows that they can render intelligible actions which are contrary to one's better judgment. An emotion can make one's action intelligible even when that action is opposed by one's all-things-considered judgment. Moreover, an akratic action prompted by an emotion may be more rational than following one's better judgement, for it may be the judgement and not the (...) perception which is in error. The aim of this paper is twofold: In its first part, we work out the key features of constitutivism as presented by Christine Korsgaard. This reconstruction serves to clarify which goals Korsgaard wants to achieve with her account and which of its central claims she has to defend in particular. In the second part, we discuss whether Korsgaard can vindicate constitutivism's most central claim. To do this, we analyse two important arguments - the argument from unavoidability and the argument (...) from the abstract constitutive principle - that have been made in support of constitutivism. We show how both these arguments go amiss and conclude that at least for now, constitutivism's most central claim has not been successfully argued for. (shrink)

The way in which one understands information and concepts, and the way a student works to develop this, is an individual aspect of learning that cannot be universally defined as (at least manifested) the same for everyone. ‘Understanding’ is a broad term, and the way one achieves understanding is dependent on the way that material is presented. In this article, we argue that the philosophy of science can be important to nursing education—in particular, by showing that the way we imbue (...) understanding might depend on the meaning of ‘understanding’. Diagrams and concept maps are meant to guide newly formed knowledge and connections to develop proper thinking (e.g., the order in which nursing students must prioritize data) that a student requires in the field. We argue that whether or not an image/diagram/concept map confers understanding will depend on both what the object is and what we mean by ‘understanding’. (shrink)

According to Aristotle, Plato's efforts at metaphysical explanation not only fail, they are nonsensical. In particular, Plato's appeals to Forms as metaphysically explanatory of the sensibles that participate in them is "empty talk" since "'participating' means nothing". I defend Plato against Aristotle's charge by identifying a particular, substantive model of metaphysical predication as the favored model of Plato's late ontology. The model posits two basic metaphysical predication relations: self-predication and participation. In order to understand the participation relation, it is important (...) first to understand how Plato's Forms are self-predicative paradigms. According to the favored model, Forms are self-predicative paradigms insofar as they are ideal, abstract encoders of structural essences. Sensibles participate in Forms by exemplifying the structures encoded in the Forms. Given plausible conditions on metaphysical explanation, Plato's appeals to abstract Forms as metaphysically explanatory of sensibles is a reasonable competitor for Aristotle's appeals to natural, substantial forms. Much of the debate around temporary foreign worker programs in recent years has focused on full or partial access to rights, and, in particular, on the extent to which liberal democratic states may be justified in restricting rights of membership to those who come and work on their territory. Many accounts of the situation of temporary foreign workers assume that a full set of rights will remedy moral inequities that they suffer in their new homes. I aim to show two (...) things: first, and based on experiences reported by former Live-in-Caregivers in Canada who now have access to the full set of citizenship rights, and German citizens who are descendants of Kurdish guestworkers in Germany, I have proposed that even after gaining citizenship, many of them experience social stigma and a sense of exclusion. Second, I have argued that this neglects a basic need that individuals have, which is to have access to relational resources within society in order to be protected against social deprivation. This need is seemingly immune to be effectively protected through the known catalogue of social, civic and political rights. Instead, I argue that social deprivation needs to be analyzed through the lens of institutional vulnerability to yield an analysis of the moral obligations of liberal democratic states. (shrink)

Girard has said it expressly in his interviews: There is no "Girardian system" but at the outset, a very compact intuition that fertilized all his research. This book seeks to remedy the contempt for law prominent in socialist writings. While political thinkers on the left are indisputably concerned with justice, they dismiss those legal institutions which, in liberal capitalist societies, have ensured some minimum measure of justice in citizens' lives. Marxists in particular have tended to reduce law to a capitalist apparatus necessary to mediate conflict between egoistic wills or social classes. The book argues against this doctrine by showing that however ideal a society socialists envisage, (...) legal institutions would be necessary to fairly adjudicate conflict between private and public interests. Each chapter takes up an issue in liberal jurisprudence to see how it would fare in a socialist theory which takes a constructive approach to law. The rule of law, natural and legal rights, obligations, and the sources of law are among the subjects covered. The book concludes that a socialist concept of law would enrich, not only debates about the nature of socialism, but also debates about community and justice which preoccupy `mainstream' political theory and jurisprudence. This essay argues for a conception of law as a normative practice, a conception which departs from traditional, particularly positivist, conceptions. It is argued that Dyzenhaus's book (Dyzenhaus 1991), with its fascinating case study of unjust judicial decisions in South Africa, makes a compelling argument for such a conception. However, the essay takes issue with Dyzenhaus for romanticising the liberal tradition, and inflating the power of law and legal theory. Nonetheless, the essay agrees that positivist accounts tend to downplay the (...) emancipatory promise of law, and ends with some remarks about promise. (shrink)

How do we know if people are equal? Contemporary philosophers consider a number of issues when determining if the goals of egalitarian distributive justice have been achieved: defining the metric of equality; determining whether the goal is equality, or simply priority or sufficiency; establishing whether there should be conditions, e.g. bad brute luck, for the amelioration of inequality. In all this, most egalitarians contend that what is to be equalized is not people’s actual shares of the good in question, but (...) rather, the opportunities to have such shares. I counter this view with an ‘egalitarian flourishing’ approach that, in seeking to make people equal in actual well-being, takes exception to the role of opportunity in contemporary argument. The flourishing view means a focus on outcomes, on how people live, in order to enable people to live equally flourishing lives. I argue that if we consider the complex dynamics of choice and circumstance, the role of nonmaterial considerations and the ideal of an egalitarian community, equality of opportunity proves to be an inadequate approach to the realization of the egalitarian ideal. BackgroundFrontal brain dysfunction is a major challenge in neurorehabilitation. Neurofeedback (NF), as an EEG-based brain training method, is currently applied in a wide spectrum of mental health conditions, including traumatic brain injury.ObjectiveThis study aimed to explore the capacity of Infra-Low Frequency Neurofeedback (ILF-NF) to promote the recovery of brain function in patients with frontal brain injury.Materials and methodsTwenty patients hospitalized at a neurorehabilitation clinic in Switzerland with recently acquired, frontal and optionally other brain lesions were randomized to either receive NF (...) or sham-NF. Cognitive improvement was assessed using the Frontal Assessment Battery (FAB) and the Test of Attentional Performance (TAP) tasks regarding intrinsic alertness, phasic alertness and impulse control.ResultsWith respect to cognitive improvements, there was no significant difference between the two groups after 20 sessions of either NF or sham-NF. However, in a subgroup of patients with predominantly frontal brain lesions, the improvements measured by the FAB and intrinsic alertness were significantly higher in the NF-group.ConclusionThis is the first double-blind controlled study using NF in recovery from brain injury, and thus also the first such study of ILF NF. Although the result of the subgroup has limited significance because of the small number of participants, it accentuates the trend seen in the whole group regarding the FAB and intrinsic alertness (p = 0.068, p = 0.079, respectively). We therefore conclude that NF could be a promising candidate promoting the recoveryfrom frontal brain lesions. Further studies with larger numbers of patients and less lesion heterogeneity are needed to verify the usefulness of NF in the neurorehabilitation of patients with frontal brain injury (NCT02957695 ClinicalTrials.gov). À partir des sources normatives, picturales et hagiographiques, cette cérémonie est détaillée, notamment la scénographie de l’avant/après, gommant toute marque féminine (présence de cheveux, soins pour un teint pâle, vêtement ajusté, usage de soieries, de bijoux, etc.). Certaines pratiques témoignent de la mise en impatience de ce passage de la soie au drap, qui se traduit (...) par des prises d’habit clandestines, prématurées ou des portraits de mondaines usurpatrices en habit de carmélites. Il est vrai que le modèle absolu de La Madeleine, compte tenu des origines le plus souvent princières des postulantes, n’est pas étranger au prestige de la métamorphose. Réalité et construction représentative permettent de montrer comment le Carmel s’est approprié une cérémonie, qui, dans le contexte compétitif entre les ordres de la liturgie tridentine, valorise la femme, par le biais de la moniale, affranchie des attributs de son sexe. Mais surtout, la vêture a su rendre spectaculaire et désirable ce qui a priori ne l’est pas, la pauvreté et la pénitence du corps et de ses attributs, dans le but avoué du recrutement de nouvelles postulantes. Otto Neugebauer’s early academic career was marked by a series of transitions. His interests shifted from physics to mathematics, and finally to the history of ancient mathematics and exact sciences. Yet even from his early years in Graz, Neugebauer was strongly attracted to the mathematical culture of Göttingen. When he arrived there in 1922, he quickly established a strong personal friendship with Richard Courant, the newly appointed Director of the Mathematics Institute. Neugebauer and Courant worked together closely up until 1933, (...) when the Nazi government decimated the Göttingen scientific community. In this essay, Neugebauer’s historical work and his vision for a new approach to the study of the exact sciences are viewed through the prism of these events. By so doing, one can easily appreciate how Neugebauer’s scholarship reflects the ideals he and Courant shared as leading representatives of the Göttingen mathematical tradition. (shrink)

: Public toilets are a key part of the urban environment. This paper examines and evaluates the pervasive sex segregation, throughout North America, of public toilets. The issue is situated within a larger context—the design and management of the urban environment; larger assumptions about sexuality, reproduction, and privacy that govern that environment; and continuing compulsory sex identification and segregation which still define key areas of "public" space. I examine seven groups of arguments in favor of sex segregation, arguing that all (...) of them are inadequate. I then present reasons showing why ending the sex segregation of public toilets is justified. (shrink)

This chapter argues that the differences between Nietzsche and Aristotle are easily exaggerated. It discusses Nietzsche's “perspectivism.” The chapter focuses on three central basic universal virtues which the author argues Nietzsche both endorses and describes: forgetfulness, justice, and wisdom. In order for a genuine virtue of justice to be strong and tempered by grace, a strong “forgetfulness” is necessary. Virtues are described as “overflowing,” have extreme enthusiasm and passion at their core, and practical wisdom is nowhere or hardly to be (...) seen. The chapter describes the universal virtues as basic virtues and also discusses the issue of their differentiation. Two more forms of differentiation apparently create problems for understanding Nietzsche as a virtue ethicist: his idea that virtues are “individual” and his idea that there are virtues of the “convalescent” by contrast with virtues of the strong. Socrates expresses at least some interest in the knowledge of knowledge as an ability “to divide things and say that one is knowledge and the other is not knowledge”. If Hugh Benson’s characteristically lucid and careful book succeeds in its portrayal of Socrates as epistemologist, then the Charmides text is perhaps more optimistic than is often conceded. For unlike Gregory Vlastos’s Socrates, who was “no epistemologist, ” Benson’s promises “a philosophically complex, fundamentally coherent, and remarkably influential model of knowledge, ” (...) a model Socrates arrives at, at least in part, by means of a reflective epistemological perspective. The allocation of any scarce health care resource, especially a lifesaving resource, can create profound ethical and legal challenges. Liver transplant allocation currently is based upon urgency, a sickest-first approach, and does not utilize capacity to benefit. While urgency can be described reasonably well with the MELD system, benefit encompasses multiple dimensions of patients’ well-being. Currently, the balance between both principles is ill-defined. This survey with 502 participants examines how urgency and benefit are weighted by different stakeholders. Liver transplant patients (...) favored the sickest-first allocation, although all other groups tended to favor benefit. Criteria of a successful transplantation were a minimum survival of at least 1 year and recovery of functional status to being ambulatory and capable of all self-care. An individual delisting decision was accepted when the 1-year survival probability would fall below 50%. Benefit was found to be a critical variable that may also trigger the willingness to donate organs. The strong interest of stakeholder for successful liver transplants is inadequately translated into current allocation rules. (shrink)

The “motive of justice” is ambiguous between three quite different categories of motivation. These are: the motive to perform a particular just act; the motive to set up institutions of justice, most particularly the conventions or “artifices” which regulate and establish property; and a motivational disposition, or essential part of a complex of motivational dispositions, that is characteristic of a person with the virtue of justice. The question now arises: Can justice as a basic virtue be understood as having at (...) its core a natural motive which is expressed in its various differentiated forms? More particularly, could Hume find such a motive? This chapter argues that compassion can be seen as just that natural motive. It considers two problems for the understanding of compassion as the natural motive for justice in sense, in relation to Hume's theory of the passions. (shrink)

The interlocutors of Plato’s Cratylus agree that “it is far better to learn and to inquire from the things themselves than from their names”. Although surprisingly little attention has been paid to these remarks, at least some commentators view Plato as articulating a preference for direct, nonlinguistic cognitive access to the objects of inquiry. Another commentator takes Plato simply to recommend first-hand, yet linguistic, experience in addition to instruction from experts. This paper defends, in contrast to both interpretations, the view (...) that inquiry without names is dialectical, linguistic inquiry into metaphysical first principles. As such, inquiry without names is prior to inquiry from or through names. Inquiry without names is a form of transcendental metaphysics. (shrink)

The Cratylus contains Plato's most extensive study of the relation of language to reality and to the pursuit of wisdom. Yet the dialogue has remained relatively neglected in efforts to understand Plato's deepest metaphysical and epistemological commitments. The blame for such neglect lies largely in the dialogue's extensive, difficult, even mysterious etymological section. Recent attempts to make sense of the bulk of the Cratylus are shedding much welcome light on the important roles that the etymological analyses play in the dialogue (...) and in Plato's philosophy more generally. Some concepts, such as colour concepts or value concepts, seem to bear traces of the mind's own make-up. For instance, the character of perceptually-determined colour concepts seems in some sense derivative from the character of the visual system. Thus, it has seemed plausible to claim that the corresponding colour properties are dispositions to elicit certain visual experiences in normal observers under suitable conditions. Much the same has been suggested for value concepts. An extreme position would be that colours and values (...) therefore are not in the world at all, they instead are mere projections that tell us more about the users of response-dependent concepts than about the world they inhabit. But even setting aside such extreme views, a number of important philosophical and psychological questions remain open. What exactly is response-dependence, and does any concept have this feature? What is the appropriate metaphysics for properties represented by response-dependent concepts, and for these concepts themselves? What determines the extension of such properties? How are we to account for knowledge expressed in terms of response-dependent concepts? What mechanisms correctly explain the origins of response-dependent concepts, and their role in representation? He breaks this task into two parts. In the first, Stiltner offers an introduction to the field of ethics in its personal, communal, and social dimensions. He discusses the three normative ethical theories most prominent in the West (deontological, consequentialist, and virtue ethics) and then applies these theories to a case study to examine the strengths and weakness of each. He then argues that, while applied ethicists often recommend employing all three approaches into the decision-making process, a person who wishes to make [End Page 198] formal ethical arguments must ultimately choose which framework to favor. In Stiltner's view, the framework of virtue ethics is best able to address the social and communal dimensions of ethics, which is the focus of the second part of the book.In the latter half of the first part, Stiltner describes the cultivation of virtue and examines specific categories—namely, virtues of care, respect, purpose, perceiving and reasoning, and acting and relating. The lynchpin between the first and second parts of the text is Stiltner's elucidation of human flourishing, in which he begins to link individual flourishing with the flourishing of communities. Finally, he argues that some groups perform as "mediating institutions" wherein "the pro-social influences of the virtues instilled in people in one communal context transfer to other contexts as the individuals participate in many associations," thereby influencing society as a whole (105).Following the primarily theoretical first part, the focus of the second part is how to apply those theoretical principles to actual communities. He describes his objective here as "recommend[ing] ethical principles and concrete practices that will help persons, groups, and societies to flourish" (131). He examines four specific types of mediating institutions—families, schools, work, and service—and follows the same pattern of analysis for each. He provides a brief sociological account of the group, then scrutinizes the ethical impact of the reciprocal relationships of persons to groups and groups to society. He then discusses a case study that highlights some of the challenges in each particular institution and what resources are available to individuals and institutions that could overcome those challenges.Stiltner's text is an excellent introduction to the field of virtue ethics for an undergraduate audience. One particular strength is his discussion of many contemporary voices from the fields of ethics, philosophy, and sociology—from Nussbaum to Robert Putnam, his reliance on fields outside of ethical theory proper strengthens and broadens his analysis significantly. In addition, he provides ample resources along the way for the reader. Each chapter begins with a boxed overview of the chapter and ends with questions for review and discussion as well as resources for further research. The text does not specifically address the spiritual dimension of ethical development or the role of religion as a mediating institution; while this is not necessarily a weakness, one should know this is not specifically a Christian ethical analysis. The first, my daughter's boyfriend, argued that someone with talent and motivation could become as creative a composer without formal musical training as with it. The other, my daughter, vigorously countered that while someone might compose well on one's own, (...) the result would not be as versatile or thoughtfully developed as it could be with good formal instruction. I saw the musical educations of the debaters reflected in their arguments. My daughter had accumulated fourteen years of formal instruction in violin, cello, voice, and dance and took part in high school choral, theatrical, and orchestral performances. Her studies continued into college and from time to time she performs in community theater. Her boyfriend was the only musically trained member of his family. At his own request he studied piano for five years, later channeling his musical energies into a rock group. Though he did not study music in college, he continues to play keyboard and guitar. Both agree that the ongoing debate between them illustrates the strong connection between musical training and musical valuing. The life-world of their experiences shaped their judgments of musical quality and left imprints on their views of what matters more, talent or training. I will return to this scenario later.I find solid points of agreement with Eva Alerby and Cecilia Ferm starting with their premise that music learning is most effective when taught within a context. While some students prefer learning in a linear, rule-oriented setting, more often than not a musical concept will be comprehended best if it is first experienced within a variety of works. Regarding extra-musical contexts, furthermore, recent evidence supporting the integration of subject areas at the elementary level appears to extend the boundaries of musical learning in a positive direction. Additionally, the authors' description of embodied musical learning holds great interest. Their argument that musical learning must be appropriated within the body resonates strongly within me as I reflect upon performing and teaching piano. Experience with beginning level adult pianists suggests to me that once the awkwardness of newly-learned movements fades with time and effort, students often discover a close interaction between their physical and conceptual knowledge of music. Of related interest is the authors' definition of musicality as taking embodied musical knowledge and making it one's own. This surpasses physical mastery of an instrument and describes a personal [End Page 208] and emotional investment in music. It is at this point in the essay that the recognizable link between mind, body, and emotion in music is most clear.Alongside these engaging ideas, however, are statements throughout the essay that invite further questions or comments. First among these is the statement that the knowledge resulting from learning is not always what was intended or planned. While this is often the case, elaboration upon modes of knowledge in question would help clarify the authors' ideas. Since knowledge takes a variety of forms, as the authors imply, these forms should be explored, defined, and applied to the process of teaching and learning music.Related to that suggestion is my response to the statement that the aim of music education is to produce musical knowledge. I am assuming that musical knowledge includes an age-appropriate blend of performance skill, reading ability, ear training, historical and cultural connections, basic theoretical and stylistic understanding, and acquaintance with creative processes. In many regions of our country, public arts education has been de-valued to the extent that we must convince administrators, parents, and sometimes students, of its importance. Until this situation improves, I must personally consider the aim of music education as producing, alongside musical knowledge, the desire for music as a lifelong pursuit, be it active or passive. Without this desire, musical knowledge gained often goes unused. Referring to my opening anecdote, my daughter is not participating in music while her less extensively trained boyfriend is. I know of several students like her who gained expertise on an instrument and who have now stopped playing for... (shrink)

Background Teaching ethical competencies is an essential component of professional and postgraduate curricula. Developing practical–ethical problem-solving competencies as well as appraising program-specific studies and related research ethics are topics typically addressed. However, assessment of these ethical competencies poses a challenge. Written or oral assessment formats addressing relevant learning objectives is mainly limited to knowledge testing alone, often not capturing relevant skills or attitudes pertinent to those competencies. Aim During the reaccreditation of the masters of science program in Nursing Science at (...) Witten/Herdecke University, this challenge was addressed by implementation of an innovative examination format for postgraduate education. Procedure For the module “Ethics in nursing practice and research” a format based on the Objective Structured Clinical Examination format was developed. This assessment method incorporates evaluation of acquired skills and attitudes of nursing students. Conclusion The article demonstrates development and adaption of the OSCE format for this purpose.
