In this article, we suggest an alternate approach to interpreting the US Constitution, using founding-era translations. We demonstrate how both symmetries and asymmetries in structure and vocabulary of the languages involved can help in deciding nowadays’ problems of constitutional interpretation. We select seven controversial passages of the US constitution to illustrate our approach: Art. I, § 8, cl. 3 ; Art. II, § 1, cl. 5 ; Art. II, § 2, cl. 3 ; Art. I, § 6, cl. 1/Art. I, (...) § 8, cl. 10/Art. IV, § 2 ; and Art. IV, § 2, cl. 1. Since these passages have recently been debated by constitutional scholars, reassessing them using our method can establish the additional value of our approach to constitutional practice. We presume that our approach is not limited to interpreting the US constitution, but suggest that constitutional hermeneutics in general could profit from adding a translation approach to the toolkit. The basic idea of the particular way of understanding mental phenomena that has inspired the "cognitive revolution" is that, as a result of certain relatively recent intellectual and technological innovations, informed theorists now possess a more powerfully insightful comparison or model for mind than was available to any thinkers in the past. The model in question is that of software, or the list of rules for input, output, and internal transformations by which we determine and control the workings of a (...) computing machine's hardware. Although this comparison and its many implications have dominated work in the philosophy, psychology, and neurobiology of mind since the end of the Second World War, it now shows increasing signs of losing its once virtually unquestioned preeminence. Thus we now face the question of whether it is possible to repair and save this model by means of relatively inessential "tinkering", or whether we must reconceive it fundamentally and replace it with something different. In this book, twenty-eight leading scholars from diverse fields of "cognitive science"-linguistics, psychology, neurophysiology, and philosophy- present their latest, carefully considered judgements about what they think will be the future course of this intellectual movement, that in many respects has been a watershed in our contemporary struggles to comprehend that which is crucially significant about human beings. The sensitive period for phonetic learning, evidenced by improved native speech processing and declined non-native speech processing, represents an early milestone in language acquisition. We examined the extent that sensory encoding of speech is altered by experience during this period by testing two hypotheses: early sensory encoding of non-native speech declines as infants gain native-language experience, and music intervention reverses this decline. We longitudinally measured the frequency-following response, a robust indicator of early sensory encoding along the auditory pathway, to a (...) Mandarin lexical tone in 7- and 11-months-old monolingual English-learning infants. Infants received either no intervention or music intervention randomly between FFR recordings. The language-experience group exhibited the expected decline in FFR pitch-tracking accuracy to the Mandarin tone, while the music-intervention group did not. Our results support both hypotheses and demonstrate that both language and music experiences alter infants’ speech encoding. (shrink)

The current study assessed the extent to which the use of referential prosody varies with communicative demand. Speaker–listener dyads completed a referential communication task during which speakers attempted to indicate one of two color swatches (one bright, one dark) to listeners. Speakers' bright sentences were reliably higher pitched than dark sentences for ambiguous (e.g., bright red versus dark red) but not unambiguous (e.g., bright red versus dark purple) trials, suggesting that speakers produced meaningful acoustic cues to brightness when the accompanying (...) linguistic content was underspecified (e.g., “Can you get the red one?”). Listening partners reliably chose the correct corresponding swatch for ambiguous trials when lexical information was insufficient to identify the target, suggesting that listeners recruited prosody to resolve lexical ambiguity. Prosody can thus be conceptualized as a type of vocal gesture that can be recruited to resolve referential ambiguity when there is communicative demand to do so. (shrink)

A realist theory of truth for a class of sentences holds that there are entities in virtue of which these sentences are true or false. We call such entities ‘truthmakers’ and contend that those for a wide range of sentences about the real world are moments (dependent particulars). Since moments are unfamiliar, we provide a definition and a brief philosophical history, anchoring them in our ontology by showing that they are objects of perception. The core of our theory is the (...) account of truthmaking for atomic sentences, in which we expose a pervasive ‘dogma of logical form’, which says that atomic sentences cannot have more than one truthmaker. In contrast to this, we uphold the mutual independence of logical and ontological complexity, and the authors outline formal principles of truthmaking taking account of both kinds of complexity. Preference, according to many theories of human behaviour, is a very important phenomenon. It is therefore some what surprising that philosophers of mind pay so little attention to it. One question about preference concerns its variety. Is preference always preference for one option or state of affairs rather than another? Or is there also, as ordinary language suggests, object-preference – preferences for one person rather than another, for one country rather than another, for one value rather than another? Another question (...) or rather group of questions concerns the nature of preference. Is it a mental state, disposition, act or episode, a theoretical construct, a purely behavioural phenomenon? If it is a mental state or act, is it an intellectual, affective or a conative phenomenon? If it is an affective phenomenon, does it enjoy a positive or negative “valence”? The philosophical work of Jean-Luc Marion has opened new ways of speaking about religious convictions and experiences. In this exploration of Marion’s philosophy and theology, Christina M. What is the relation between the intentionality of states and attitudes which can miss their mark, such as belief and desire, and the intentionality of acts, states and attitudes which cannot miss their mark, such as the different types of knowledge and simple seeing? Two theories of the first type of intentionality, the theory of correctness conditions and the theory of satisfaction conditions, are compared. It is argued that knowledge always involves knowledge of formal objects such as facts and values, (...) that emotions are reactions to (apparently) known values and that beliefs are reactions to known or apparently known facts or to the objects of relational states. The proposal on offer is a radical form of egalitarianism. Under it, each citizen receives the same income, regardless of profession or indeed whether he or she works or not. This proposal is bad for two reasons. First, it is inefficient. It would eliminate nearly all incentive to work, thereby shrinking national income and leaving all citizens poorly off (albeit equally poorly off). I illustrate this inefficiency via an indifference curve analysis. Second, the proposal would be regarded as unjust by (...) almost everyone. The empirical work on justice makes this plain. Equal pay for equal work is desirable; equal pay no matter what is something else entirely. It is an idea not likely to find adherents. (shrink)

"Meritocracy" has historically been understood in two ways. The first is as an approach to governance. On this understanding, we seek to put meritorious (somehow defined) people into public office to the benefit of society. This understanding has its roots in Confucius, its scope is political offices, and its justification is consequentialist. The second understanding of "meritocracy" is as a theory of justice. We distribute in accordance with merit in order to give people the things that they deserve, as justice (...) demands. This understanding has its roots in Aristotle, its scope is social goods broadly, and its justification is deontological. In this article, I discuss the differences--especially the conceptual differences--between these two, prima facie distinct, meritocratic traditions. I also argue that despite their differences Eastern Meritocracy and Western Meritocracy are harmonious. In Section I of the article I introduce the two meritocratic traditions through, in part, a highly abbreviated history of talk about "merit" and "meritocracy" in Chinese and Western philosophy. In Section II, I discuss a number of conceptual issues and partition meritocratic theories in accordance with their scopes and normative justifications. I also discuss two scenarios. In one scenario, Eastern Meritocracy appears to deliver the right result and Western Meritocracy, the wrong result. In the other scenario, vice versa. Finally, in Section III, I argue that Eastern Meritocracy and Western Meritocracy are each special cases of a single, compelling notion of "meritocracy.". (shrink)

Phenomenology as practised by Adolf Reinach ( 1883-191 7) in his all too brief philosophical career exemplifies all the virtues of Husserl's Logical Investigations. It is sober, concerned to be clear and deals with specific problems. It is therefore understandable that, in a philosophical climate in which Husserl's masterpiece has come to be regarded as a mere stepping stone on the way to his later Phenomeno logy, or even to the writings of a Heidegger, Reinach's contributions to exact philo sophy (...) have been all but totally forgotten. The topics on which Reinach wrote most illuminatingly, speech acts (which he called 'social acts') and states of affairs (Sachverhalte ), as well as his realism about the external world, have come to be regarded as the preserve of other traditions of exact philosophy. Like my fellow contributors, I hope that the present volume will go some way towards correcting this unfortunate historical accident. Reinach's account of judgements and states of affairs, an account that precedes those of Russell and Wittgenstein, his 1913 treatment of speech acts, his reinter pretation of Hume and aspects of his legal philosophy are the main philosophical topics dealt with in what follows. But his analysis of deliberation as well as his work on movement and Zeno's paradoxes get only a passing mention. (shrink)

Disagreement is a ubiquitous feature of human life, and philosophers have dutifully attended to it. One important question related to disagreement is epistemological: How does a rational person change her beliefs (if at all) in light of disagreement from others? The typical methodology for answering this question is to endorse a steadfast or conciliatory disagreement norm (and not both) on a priori grounds and selected intuitive cases. In this paper, I argue that this methodology is misguided. Instead, a thoroughgoingly Bayesian (...) strategy is what's needed. Such a strategy provides conciliatory norms in appropriate cases and steadfast norms in appropriate cases. I argue, further, that the few extant efforts to address disagreement in the Bayesian spirit are laudable but uncompelling. A modelling, rather than a functional, approach gets us the right norms and is highly general, allowing the epistemologist to deal with (1) multiple epistemic interlocutors, (2) epistemic superiors and inferiors (i.e. not just epistemic peers), and (3) dependence between interlocutors. The paper seeks to develop an account of indexical phenomena based on the highly general theory of structure and dependence set forth by Husserl in his Logical Investigations. Husserl here defends an Aristotelian theory of meaning, viewing meanings as species or universals having as their instances certain sorts of concrete meaning acts. Indexical phenomena are seen to involve the combination of such acts of meaning with acts of perception, a thesis here developed in some detail and contrasted with accounts of (...) indexicals suggested by Frege, Wittgenstein and by the later Husserl himself in his Ideas I. Implications are drawn also for our understanding of the categorial grammar sketched by Husserl in his 4th Logical Investigation, as also for our understanding of the nature of proper names and other candidate indexical expressions. ‘What is characteristic of every mental activity’, according to Brentano, is ‘the reference to something as an object. In this respect every mental activity seems to be something relational.’ But what sort of a relation, if any, is our cognitive access to the world? This question – which we shall call Brentano’s question – throws a new light on many of the traditional problems of epistemology. The paper defends a view of perceptual acts as real relations of a subject to (...) an object. To make this view coherent, a theory of different types of relations is developed, resting on ideas on formal ontology put forward by Husserl in his Logical Investigations and on the theory of relations sketched in Smith's "Acta cum fundamentis in re". The theory is applied to the notion of a Cambridge change, which proves to have an unforeseen relevance to our understanding of perception. (shrink)

A definition of emotion common to the affective sciences is an urgent desideratum. Lack of such a definition is a constant source of numerous misunderstandings and a series of mostly fruitless debates. There is little hope that there ever will be agreement on a common definition of emotion, given the sacred traditions of the disciplines involved and the egos of the scholars working in these disciplines. Our aim here is more modest. We propose a list of elements for a working (...) definition of emotion and discuss the justification for the inclusion of elements from our respective perspectives (philosophy and psychology). This working partial definition may at least serve as a litmus test to examine theories of emotion, old and new, across disciplinary boundaries. (shrink)
