How can digitised assets of Galleries, Libraries, Archives and Museums be reused to unlock new value? What are the implications of viewing large-scale cultural heritage data as an economic resource, to build new products and services upon? Drawing upon valuation studies, we reflect on both the theory and practicalities of using mass-digitised heritage content as an economic driver, stressing the need to consider the complexity of commercial-based outcomes within the context of cultural and creative industries. However, we also problematise the (...) act of considering such heritage content as a resource to be exploited for economic growth, in order to inform how we consider, develop, deliver and value mass-digitisation. Our research will be of interest to those wishing to understand a rapidly changing research and innovation landscape, those considering how to engage memory institutions in data-driven activities and those critically evaluating years of mass-digitisation across the heritage sector. This paper proposes that the meanings of some natural language expressions should be thought of as functions on their own continuations. Continuations are a well-established analytic tool in the theory of programming language semantics; in brief, a continuation is the entire default future of a computation. I show how a continuation-based grammar can unify several aspects of natural language quantification in a new way: merely stating the truth conditions for quantificational expressions in terms of continuations automatically accounts for scope displacement (...) and scope ambiguity. To prove this claim, I exhibit a simple finite context-free grammar with a strictly compositional semantics in which quantificational NPs are interpreted in situ but take semantic scope over larger constituents. There is no Quantifier Raising (nor any use of a level of Logical Form distinct from overt syntax), no Cooper Storage (or similar mechanisms used in many recent HPSG, Categorial, or Type-logical treatments), and no need for type-shifting (as in Hendriks' Flexible Types account). Continuations also provide a natural account of generalized coordination that does not require either type-shifting or type polymorphism. Compositionality issues are discussed in some detail. Reproductive genetic technologies allow parents to decide whether their future children will have or lack certain genetic predispositions. A popular model that has been proposed for regulating access to RGTs is the ‘genetic supermarket’. In the genetic supermarket, parents are free to make decisions about which genes to select for their children with little state interference. One possible consequence of the genetic supermarket is that collective action problems will arise: if rational individuals use the genetic supermarket in isolation from one (...) another, this may have a negative effect on society as a whole, including future generations. In this article we argue that RGTs targeting height, innate immunity, and certain cognitive traits could lead to collective action problems. We then discuss whether this risk could in principle justify state intervention in the genetic supermarket. We argue that there is a plausible prima facie case for the view that such state intervention would be justified and respond to a number of arguments that might be adduced against that view. Classical acquaintance theory is any version of classical foundationalism that appeals to acquaintance in order to account for non-inferential justification. Such theories are well suited to account for a kind of infallible non-inferential justification. Why am I justified in believing that I’m in pain? An initially attractive (partial) answer is that I’m acquainted with my pain. But since I can’t be acquainted with what isn’t there, acquaintance with my pain guarantees that I’m in pain. What’s less clear is whether, given (...) classical acquaintance theory, it’s possible to have non-inferential justification to believe something false. Classical acquaintance theorists try to make room for such a possibility, but I argue that the attempts of Richard Fumerton, Ali Hasan, and Evan Fales are inadequate. I’ll focus on introspective justification, but similar issues arise for a priori justification as well. (shrink)

Most studies of the so-called proportion problem seek to understand how lexical and structural properties of sentences containing adverbial quantifiers give rise to various proportional readings. This paper explores a related but distinct problem: given a use of a particular sentence in context, why do only some of the expected proportional readings seem to be available? That is, why do some sentences allow an asymmetric reading when other, structurally similar sentences seem to require a symmetric reading? Potential factors suggested in (...) the literature include the distribution of donkey pronouns, certain uniqueness implications, and focus structures. I argue here that the use of an adverbial quantifier presupposes HOMOGENEITY: all individual situations that get lumped into a single case for the purposes of evaluating the quantification must agree on whether they satisfy the nuclear scope. For instance, in order for a token of Usually, if a farmer owns a donkey, he beats it to be felicitous when construed under a farmer-dominant asymmetric reading, the context must be consistent with the proposition that each farmer either beats all or none of his donkeys. Thus proportional sentences are indeed systematically ambiguous, but only some readings will be felicitous in a given context. (shrink)

The intuitions at the core of environmental ethics and of other neglected value realms put pressure on traditional anthropocentric ethics based on monistic value theories. Such pressure is so severe that it has led many to give up on the idea of monistic value theories altogether. I argue that value monism is still preferable to value pluralism and that, indeed, these new challenges are opportunities to vastly improve impoverished traditional theories. I suggest an alternative monistic theory, Richness Theory, and show (...) how it provides an opportunity to capture the needs of both environmental ethics and of our traditional ethics. (shrink)

A number of hugely valuable natural resources fall outside of the borders of any nation state. We can legitimately expect political theory to make a contribution to thinking through questions about the future of these extraterritorial resources. However, the debate on the proper allocation of rights over these resources remains relatively embryonic. This paper will bring together what have often been rather scattered discussions of rights over extraterritorial resources. It will first sketch some early modern contributions to thinking through rights (...) over the ocean. It then discusses the guidance available within more contemporary contributions to debates on resources beyond the state. Finally, it concludes by emphasising the key questions with which future work on this topic must engage. (shrink)

An epistemologist tells you that knowledge is more than justified true belief. You trust them and thus come to believe this on the basis of their testimony. Did you thereby come to know that this view is correct? Intuitively, there is something intellectually wrong with forming philosophical beliefs on the basis of testimony, and yet it's hard to see why philosophy should be significantly epistemically different from other areas of inquiry in a way that would fully prohibit belief by testimony. (...) This, I argue, is the puzzle of philosophical testimony. In this paper, I explore the puzzle of philosophical testimony and its ramifications. In particular, I examine the case for pessimism about philosophical testimony—the thesis that philosophical belief on the basis of testimony is impossible or is in some way illegitimate—and I argue that it lacks adequate support. I then consider whether the source of the apparent intellectual wrongness of testimonial‐based philosophical belief is grounded in non‐epistemic norms and goals of philosophical practice itself and argue that such norms are implausible, don't conflict with testimonial‐based philosophical belief, or else are mere disciplinary norms, lacking substantial normative force that would make it wrong to form testimonial‐based philosophical belief. The Oxford Handbook of the History of Physics brings together cutting-edge writing by more than twenty leading authorities on the history of physics from the seventeenth century to the present day. Background: In the last two decades, nursing authors have published ethical analyses of palliative sedation—an end-of-life care practice that also receives significant attention in the broader medical and bioethics literature. This nursing literature is important, because it contributes to disciplinary understandings about nursing values and responsibilities in end-of-life care. Research aim: The purpose of this project is to review existing nursing ethics literature about palliative sedation, and to analyze how nurses’ moral identities are portrayed within this literature. Research design: We (...) reviewed discussion papers, written by nurses about the ethics of palliative sedation, which were cited in MEDLINE, CINAHL, Nursing and Allied Health, or Philosopher’s Index (search date March 2018). Twenty-one papers met selection criteria. We performed a comprehensive review and analysis (using the Qualitative Analysis Guide of Leuven), of the values, responsibilities, and relationships reflected in authors’ portrayal of the nursing role. Findings: Two different tones are apparent in the extant nursing ethics literature. One is educational, while the other is critically reflective. Irrespective of tone, all authors agree on the alleviation of suffering as a fundamental nursing responsibility. However, they differ in their analysis of this responsibility in relation to other values in end-of-life care, including those that depend on consciousness. Finally, authors emphasize the importance of subjective and experience-based understandings of palliative sedation, which they argue as depending on nurses’ proximity to patients and families in end-of-life care. Discussion and conclusion: Based on our findings, we develop three recommendations for future writing by nurses about palliative sedation. These relate to the responsibility of recognizing how consciousness might matter in (some) peoples’ moral experiences of death and dying, to the importance of moral reflectiveness in nursing practice, and to the value of a relational approach in conceptualizing the nursing ethics of palliative sedation. In this paper we consider the concept of a self-aware agent. In cognitive science agents are seen as embodied and interactively situated in worlds. We analyse the meanings attached to these terms in cognitive science and robotics, proposing a set of conditions for situatedness and embodiment, and examine the claim that internal representational schemas are largely unnecessary for intelligent behaviour in animats. We maintain that current situated and embodied animats cannot be ascribed even minimal self-awareness, and offer a six point (...) definition of embeddedness, constituting minimal conditions for the evolution of a sense of self. This leads to further analysis of the nature of embodiment and situatedness, and a consideration of whether virtual animats in virtual worlds could count as situated and embodied. We propose that self-aware agents must possess complex structures of self-directed goals; multi-modal sensory systems and a rich repertoire of interactions with their worlds. Finally, we argue that embedded agents will possess or evolve local co-ordinate systems, or points of view, relative to their current positions in space and time, and have a capacity to develop an egocentric space. None of these capabilities are possible without powerful internal representational capacities. (shrink)

Overdiagnosis is an emerging problem in health policy and practice: we address its definition and ethical implications. We argue that the definition of overdiagnosis should be expressed at the level of populations. Consider a condition prevalent in a population, customarily labelled with diagnosis A. We propose that overdiagnosis is occurring in respect of that condition in that population when the condition is being identified and labelled with diagnosis A in that population ; this identification and labelling would be accepted as (...) correct in a relevant professional community; but the resulting label and/or intervention carries an unfavourable balance between benefits and harms. We identify challenges in determining and weighting relevant harms, then propose three central ethical considerations in overdiagnosis: the extent of harm done, whether harm is avoidable and whether the primary goal of the actor/s concerned is to benefit themselves or the patient, citizen or society. This distinguishes predatory, misdirected and tragic overdiagnosis; the degree of harm moderates the justifiability of each type. We end with four normative challenges: methods for adjudicating between professional standards and identifying relevant harms and benefits should be procedurally just; individuals, organisations and states are differently responsible for addressing overdiagnosis; overdiagnosis is a matter for distributive justice: the burdens of both overdiagnosis and its prevention could fall on the least-well-off; and communicating about overdiagnosis risks harming those unaware that they may have been overdiagnosed. An argument that science is indeed 'socially constructed' but in a way that exposes it to a Darwinian version of variability and selection which ensures its success.

The ocean is central to our lives, but many of our impacts on the ocean are highly unsustainable, and patterns of resource exploitation at sea are deeply inequitable. This article assesses whether the objectives encapsulated in the UN's Sustainable Development Goal for the ocean are well equipped to respond to these challenges. It will argue that the approach underpinned by the SDG 14 is largely compatible, unfortunately, with ‘business as usual’. SDG 14 is undoubtedly intended as a starting point rather (...) than a final destination; but it is nevertheless important to be clear about how far we still need to travel on the road to oceanic justice. Most significantly, SDG 14 leaves several key challenges inadequately addressed or simply unaddressed. It fails to specify adequate principles for the fair sharing of benefits and burdens flowing from the ocean, including the burdens of tackling pressing environmental problems. Neither does it address the underlying causes of inequality in the ocean economy. It neglects to properly address, furthermore, the fragmented institutional context which significantly impedes effective action to advance the goals of justice and sustainability at sea. Finally, whereas SDG 14 correctly identifies a series of necessary reforms to the ocean economy, it fails to engage with important issues of transitional justice which will arise if these policies are implemented. Vital first step though it is, promoting a just and sustainable ocean will require us to set our sights considerably higher than the targets endorsed as part of SDG 14. (shrink)

Over the past decade, Nancy Fraser has developed a sophisticated theory of social justice. At its heart lies the principle of parity of participation, according to which all adult members of society must be in a position to interact with one another as peers. This article examines some obstacles to the implementation of that principle. Concentrating on the contemporary status order, it asks two specific questions. Is it possible to produce a precise account of how the status order might need (...) to be ordered for parity of participation to be realized? And is it possible to derive a detailed and coherent political strategy capable of achieving such parity within the status order? The argument of this article is that, while Fraser has recognized the difficulties that the complexity of the contemporary status order poses for achieving parity of participation, she has nevertheless underestimated those difficulties. If parity of participation requires status equality, important and difficult work remains to be done in delineating the nature, and demands, of equality in the contemporary status order. (shrink)

The Toulmin diagram layout is very familiar and widely used, particularly in the teaching of critical thinking skills. The conventional box-and-arrow diagram is equally familiar and widespread. Translation between the two throws up a number of interesting challenges. Some of these challenges (such as the relationship between Toulmin warrants and their counterparts in traditional diagrams) represent slightly different ways of looking at old and deep theoretical questions. Others (such as how to allow Toulmin diagrams to be recursive) are diagrammatic versions (...) of questions that have already been addressed in artificial intelligence models of argument. But there are further questions (such as the relationships between refutations, rebuttals and undercutters, and the roles of multiple warrants) that are posed as a specific result of examining the diagram inter-translation problem. These three classes of problems are discussed. To the first class are addressed solutions based on engineering pragmatism; to the second class, are addressed solutions drawn from the appropriate literature; and to the third class, fuller exploration is offered justifying the approaches taken in developing solutions that offer both pragmatic utility and theoretical interest. Finally, these solutions are explored briefly in the context of the Araucaria system, showing the ways in which analysts can tackle arguments either using one diagrammatic style or another, or even a combination of the two. Popper's definition looked initially promising provided that the restriction of classical logic was removed. As we have seen, this promise is not fulfilled. The search for a satisfactory verisimilitude ordering must therefore be pursued along more mainstream lines. The present exercise ought, however, to make us aware of the possibility that breakdowns of proposed definitions might only occur because of strictly classical assumptions.

Rousseau’s life and his work are notoriously paradoxical. This certainly applies to his work on property which includes one of the most powerful of all denunciations of private property (the Second Discourse) and an affirmation of private property as ‘the most sacred of all citizens’ rights, and in some respects more important than freedom itself’ (in the essay on political economy in the Encyclopedie). In this paper, I explore the reasons for this seeming paradox, focusing upon Rousseau’s twin concerns with (...) inequality (rather than equality) and sincerity. In the end, Rousseau’s treatment is not entirely consistent, but it does make sense. (shrink)

In this article we address the question of how many impossible images Escher produced. To answer requires us first to clarify a range of concepts, including content, ambiguity, illusion, and impossibility. We then consider, and reject, several candidates for impossibility before settling on an answer.

Typically, case histories are used to illustrate assertions or arguments or to stimulate debate about an issue within business ethics. This volume examines that role, illustrating the link between case histories and more general theoretical approaches to business ethics.

In Canada, there have been a growing number of criminal HIV nondisclosure cases where public health records have been subpoenaed to aid in police investigations and/or to be presented in court as evidence against HIV-positive persons. This has led some to suggest that nurses provide explicit warnings about the limits of confidentiality in relation to crimes related to HIV nondisclosure, while others maintain that a robust account of the limits of confidentiality will undermine the nurse–client relationship and the public health (...) goals of reducing HIV/sexually transmitted infection transmission. This article engages with this issue by exploring whether and how public health nurses endeavor to control information about the limits of confidentiality at the outset of HIV posttest counseling. The data indicate variation in practices, as nurses pragmatically balance ethical and professional concerns; although some nurses intentionally withhold information about the risk of subpoena, others report talking to clients about confidentiality in ways that focus on the risk of harm associated with criminalization. The discussion argues that practice variation also illuminates medico-legal relations between health care and the criminal justice system. While fidelity is a crucial aspect of Jacques Derrida’s thinking as it pertains to issues of faith, ethics, and responsibility, this key position in deconstructionist discourse has hardly yet been brought to light. Less still have the biopolitical resonances of Derrida’s work, with its careful attention to the terms and stakes of life particularly in his later writing, been considered as a deconstructionist practice of fidelity and infidelity in its own right. In pursuing these threads, this essay argues that thinking (...) a deconstructionist ethics through fidelity and biopolitics makes possible the crafting of a new philosophical weave for catching our responsibilities to others – to the very otherness of life itself – that Derridean hospitality opens up. Taken together in this way, a deconstructionist fidelity to life otherwise, to a biopolitics to come, makes possible an infidelity to political order as we know it that explodes the limitations of biopolitical theory. In squinting, blinking, tearing up, and listening, the borders of life are blurred in an ambivalent ethics of a transness within which life itself is made to waver and arrive anew. (shrink)

In this paper we give an example of intertranslatability between an ontology of individuals (nominalism), an ontology of properties (realism), and an ontology of facts (factualism). We demonstrate that these three ontologies are dual to each other, meaning that each ontology can be translated into, and recaptured from, each of the others. The aiin of the enterprise is to raise the possibility that, at least in some settings, there may be no need for considerations of ontological primacy. Whether the world (...) is made up of things, or properties, or facts, may be no more than a matter of how we look at it. (shrink)

A principle of continuity due to Leibniz has recently been revived by Graham Priest in arguing for an inconsistent account of motion. This paper argues that the Leibniz Continuity Condition has a reasonable interpretation in a different, though still inconsistent, class of dynamical systems. The account is then applied to the quantum mechanical description of the hydrogen atom.

Hypothetical Consent Situations are widely employed in normative argument as if they help to justify normative claims or to explain normative facts. Historically, however, there is plenty of suspicion about them. In this light, there is a tendency to prefer theories of political obligation that do not depend upon hypothetical consent to explain political obligations – those that appeal, for instance, a general moral principle or to actual consent. This paper makes no full-throated defense of hypothetical consent. But it does (...) try to identify more carefully than is usually done what sorts of cases they represent and to show that at least two concerns about them are unwarranted. (shrink)
