Ethics and compliance officers (ECOs) are organizational agents who are responsible for ensuring employees’ ethical and legally compliant behavior. In their ethical organizational roles, ECOs impose ethical expectations on others. In our study, we find that doing so provokes a challenging interpersonal dual threat dynamic where ECOs are perceived as threatening and feel threatened in return, which is a dynamic that ECOs must navigate to be successful. To better understand how ECOs navigate this dynamic, we explore the ethical role identity (...) work that ECOs engage in and demonstrate how ECOs make sense of and respond to the threat dynamic that occurs as they enact their roles. We found two types of identity work: (1) tensions that pull role incumbents toward personalized or impersonalized approaches in their interactions with others and (2) tactics that address the threats and tensions. We also find that ECOs’ identity work facilitates ethical and identity growth for the role incumbent. To make these contributions, we employ grounded theory methods and draw primarily upon a rich qualitative dataset of interviews with ethics and compliance officers. The model we derived from our research contributes to the behavioral ethics literature by illustrating the challenges yet growth possible in enacting ethical organizational roles. (shrink)

The book symposium will appear in the St. Luis University Law Journal, 62 St. Louis U. L.J., -- (2018), with commentaries on Gowder's book by colleen Murphy, Robin West, Chad Flanders, and Matthew Lister, along with replies by Paul Gowder.

The Reader's Guide to Lesbian and Gay Literature identifies key resources for topics important to the theory and practice of lesbian and gay politics, literature, religion, and more. The book contains hundreds of entries that summarize key issues at stake and then identify (mostly) book-length analysis of this topics. The topics range from activism, to age of consent, to legal history as well as individual entries on key authors and regional areas.

Cross-sector partnerships are currently praised as capitalism’s key governance instrument to address development challenges. Although some concern has been raised about the effectiveness of such partnerships, little is known about their actual impact. Often it is assumed that partnership outputs transform straightforwardly into societal impact such as poverty alleviation. This article problematizes this assumption. Employing a critical micro-level study, which draws on a qualitative case study of a nongovernmental organization (NGO)–business partnership in Ghana, we examine how outputs provided by a (...) partnership are put to use and perceived as beneficial from the point of view of its beneficiaries. The findings show that the partnership results in what we term “competences without agency” since it provides new resources and knowledge to the beneficiaries but fails to generate the conditions for these to be transformed into significant changes in their lives. Drawing on the concept of empowerment, we propose a new framework, which conceptualizes “impact as empowerment” and highlights currently unrecognized dynamics, which contribute to shaping the ability of a partnership to serve as a development agent. This paper looks at an argument strategy for assessing the epistemic closure principle. This is the principle that says knowledge is closed under known entailment; or (roughly) if S knows p and S knows that p entails q, then S knows that q. The strategy in question looks to the individual conditions on knowledge to see if they are closed. According to one conjecture, if all the individual conditions are closed, then so too is knowledge. I give a deductive argument (...) for this conjecture. According to a second conjecture, if one (or more) condition is not closed, then neither is knowledge. I give an inductive argument for this conjecture. In sum, I defend the strategy by defending the claim that knowledge is closed if, and only if, all the conditions on knowledge are closed. After making my case, I look at what this means for the debate over whether knowledge is closed. (shrink)

It is argued that core areas of philosophy can benefit from reflection on cross-disciplinary research (CDR). We start by giving a brief account of CDR, describing its variability and some of the ways in which philosophers can interact with it. We then provide an argument in principle for the conclusion that CDR is philosophically fecund, arguing that since CDR highlights fundamental differences among disciplinary research worldviews, it can be used to motivate new philosophical problems and supply new insights into old (...) problems. We close by providing an argument by example that uses the epistemology of peer disagreement to establish the potential of CDR for core philosophical areas. With this argument, we aim to demonstrate how the complex research contexts that CDR affords can point the way toward important avenues of epistemological research by highlighting potential limitations of key epistemological components, such as peerage and uniqueness. Some have suggested that Jon Stewart of The Daily Show with Jon Stewart (TDS) and Stephen Colbert of The Colbert Report (TCR) represent a new kind of journalist. We propose, rather, that Stewart and Colbert are imitators who do not fully inhabit the role of journalist. They are interesting because sometimes they do a better job performing the functions of journalism than journalists themselves. However, Stewart and Colbert do not share journalists' moral commitments. Therefore, their performances are neither motivated nor (...) constrained by these commitments. Using a virtue theory framework, we suggest that this distinction between journalists and their imitators is morally significant because it implies differences in the kinds of excellence these moral agents are pursuing in their work. Rather than evaluating the work of Colbert and Stewart in the role of journalists, we propose analyzing their contributions to media ethics in the role of media critics. (shrink)

Philosophical dialogue has the power to improve interdisciplinary scientific research. The Toolbox Dialogue Initiative (TDI) conducts workshops that foster philosophical dialogue among interdisciplinary researchers. This chapter focuses on 20 of these workshops, all of which used the Toolbox STEM (Science, Technology, Engineering, and Mathematics) instrument and were conducted with interdisciplinary research teams of scientists. We analyze data from some of these workshops and demonstrate that philosophical dialogues conducted using the Toolbox method have two salutary effects. In _Contemporary Philosophical Theology_, Charles Taliaferro and Chad Meister focus on key topics in contemporary philosophical theology within Christianity, Islam, and Judaism, as well as Hinduism and Buddhism. The volume begins with a discussion of key methodological tools available to the philosophical theologian, such as faith and reason, science and religion, revelation and sacred scripture, and authority and tradition. Critics allege that justice as mutual advantage excludes vulnerable people and is thus inadequate as a conception of justice. Building on Peter Vanderschraaf’s Strategic Justice, this paper considers three distinct vulnerability objections. After Sect. 1 clarifies the “vulnerable,” Sect. 2 discusses an objection according to which it is impossible for a mutual advantage view to protect the vulnerable. Answering this objection only requires a possibility proof, such as that Vanderschraaf provides. Section 3 discusses an objection according to which it is (...) merely contingent whether, not guaranteed that, a mutual advantage view protects the vulnerable. Mutual advantage theorists indeed cannot provide such guarantees, so they must argue that such guarantees are too much to demand from a conception of justice. Section 4 discusses an objection according to which it is improbable that a mutual advantage view will protect the vulnerable. Addressing this concern opens paths for future fruitful research, including considering the conditions that make including the vulnerable more or less likely as well as the conditions that facilitate cooperative ability or create vulnerability. Section 5 builds on the foregoing by emphasizing the diversity of vulnerabilities along with the broader social contract tradition’s diversity of strategies for addressing vulnerability. (shrink)

This paper reports on a study of large U.S. based corporations concerning the status of formal ethics statements. Almost all responding firms (91%) have promulgated a formal code of ethics while one-half have published values statements and about one-third have a corporate credo. Analysis of these statements concentrated on to whom they are communicated; whether codes of ethics contain information pertinent to the industry, include sanctions for violations and provide specific guidance regarding gifts. Even the briefest and most superficial perusal of leading mainstream economics journals will attest to the degree that mathematical formalism has captured the economics profession. Whereas up to the early 20th century virtually all of the output of the dismal scientists was in the literary format, by the early 21st century this is not at all any longer the case. Mathematical formalism is supposed to serve economics, and yet now true economic insight has been crowded out by the math. ABSTRACT When patients refuse to receive medical treatment, the consequences of honouring their decisions can be tragic. This is no less true of patients who autonomously decide to refuse treatment. I distinguish three possible implications of these autonomous decisions. According to the Permissibility Claim, such a decision implies that it is permissible for the patient who has made the autonomous decision to forego medical treatment. According to the Anti‐Paternalism Claim, it follows that health‐care professionals are not morally permitted to treat (...) that patient. According to the Binding Claim it follows that these decisions are binding on health‐care professionals. My focus is the last claim. After arguing that it is importantly different from each of the first two claims, I give two arguments to show that it is false. One argument against the Binding Claim draws a comparison with cases in which patients autonomously choose perilous positive treatments. The other argument appeals to considered judgments about cases in which disincentives are used to deter patients from refusing sound treatments. (shrink)

In Prodigal Nation, Andrew Murphy investigates the jeremiad's historical roots and probes the ways in which it continues to illuminate themes and tensions in American social and political life.

This work serves as an introduction to both the theoretical and practical aspects of using computers to improve the delivery of social services. Though many practitioners believe that computerization dehumanizes clients and should be avoided, John Murphy and John Pardeck demonstrate how, through a holistic approach to computer use, this problem, and others like it, can be averted. By providing practitioners the opportunity to sharpen their conceptual skills in computer technology, this book promotes a rational understanding of the possible (...) uses and limitations of computers in social service agencies. Unlike other, technically-oriented works in this field, Murphy and Pardeck's work focuses on the philosophical justification of computer use, along with the conceptual or symbolic nature of computerization. They fully illustrate how to create the organizational conditions necessary for computers to improve social-service delivery, and they do so in a manner that is easily accessible for both general classroom and professional use. Among the topics addressed are the technological world-view, Western philosophy, and knowledge; computer mediated therapy; ethical issues related to computerized service delivery; and construction of a socially responsible technology. This work will be a unique and important resource for courses in computer applications, policy analysis, and social service administration, as well as a useful reference source for human service agencies and practitioners. The great work of the psychotic judge Daniel Paul Schreber, namely Memoirs of My Nervous Illness, has received predictable and rather unimaginative interpretations as the discourse of a lunatic. The work has not been studied as a theory of law. Schreber, it is argued here, was an extreme lawyer, a radical melancholegalist, a black letter theorist, a critic avant la lettre, and a radical theorist of an impure jurisprudence.

In this book, Chad Jorgenson challenges the view that for Plato the good life is one of pure intellection, arguing that his last writings increasingly insist on the capacity of reason to impose measure on our emotions and pleasures. Starting from an account of the ontological, epistemological, and physiological foundations of the tripartition of the soul, he traces the increasing sophistication of Plato's thinking about the nature of pleasure and pain and his developing interest in sciences bearing on physical (...) reality. These theoretical shifts represent a movement away from a conception of human happiness as a purification or flight of the soul from the sensible to the intelligible, as in the Phaedo, towards a focus on the harmony of the individual as a psychosomatic whole under the hegemonic power of reason. This ambitious book presents a new interpretation of Chinese thought guided both by a philosopher's sense of mystery and by a sound philosophical theory of meaning. That dual goal, Hansen argues, requires a unified translation theory. It must provide a single coherent account of the issues that motivated both the recently untangled Chinese linguistic analysis and the familiar moral-political disputes. Hansen's unified approach uncovers a philosophical sophistication in Daoism that traditional accounts have overlooked. _Heidegger’s Shadow_ is an important contribution to the understanding of Heidegger’s ambivalent relation to transcendental philosophy. Its contention is that Heidegger recognizes the importance of transcendental philosophy as the necessary point of entry to his thought, but he nonetheless comes to regard it as something that he must strive to overcome even though he knows such an attempt can never succeed. Engelland thoroughly engages with major texts such as _Kant and the Problem of Metaphysics_, _Being and Time_, and _Contributions _and (...) traces the progression of Heidegger’s readings of Kant and Husserl to show that Heidegger cannot abandon his own earlier breakthrough work in transcendental philosophy. In _ Psychiatry in the Scientific Image, _Dominic Murphy looks at psychiatry from the viewpoint of analytic philosophy of science, considering three issues: how we should conceive of, classify, and explain mental illness. If someone is said to have a mental illness, what about it is mental? What makes it an illness? How might we explain and classify it? A system of psychiatric classification settles these questions by distinguishing the mental illnesses and showing how they stand in relation to (...) one another. This book explores the philosophical issues raised by the project of explaining and classifying mental illness. Murphy argues that the current literature on mental illness -- exemplified by the Diagnostic and Statistical Manual of Mental Disorders -- is an impediment to research; it lacks a coherent concept of the mental and a satisfactory account of disorder, and yields too much authority to commonsense thought about the mind. He argues that the explanation of mental illness should meet the standards of good explanatory practice in the cognitive neurosciences, and that the classification of mental disorders should group symptoms into conditions based on the causal structure of the normal mind. The use of medical stimulants to sustain attention, augment memory and enhance intellectual capacity is increasing in society. The use of Methylphenidate for cognitive enhancement is a subject that has received much attention in the literature and academic circles in recent times globally. Medical doctors and medical students appear to be equally involved in the off-label use of Methylphenidate. This presents a potential harm to society and the individual as the long-term side effect profile of this medication is unknown.

Are humans composed of a body and a nonmaterial mind or soul, or are we purely physical beings? Opinion is sharply divided over this issue. There is no shortage of scientists who are skeptical of the power of philosophy. Philosophers themselves have had similar reservations about philosophy, at least as it is typically studied and taught in universities. It can be easy enough to feel the force of these complaints, as it is not uncommon for academic philosophers to lose the forest for the trees. It doesn’t have to be this way. Philosophers can be better at explaining how their abstract theorizing bears on concrete problems, (...) and they can spend more time directly addressing these concrete problems. There are plenty of philosophers who acknowledge this, and many of them engage in research programs that do what we call engaged philosophy. The work of the Toolbox Dialogue Initiative (TDI) is part of this landscape.
