Artificial intelligence systems advising healthcare professionals will be widely introduced into healthcare settings within the next 5–10 years. This paper considers how this will sit with tort/negligence based legal approaches to compensation for medical error. It argues that the introduction of AI systems will provide an additional argument pointing towards no-fault compensation as the better legal solution to compensation for medical error in modern health care systems. The paper falls into four parts. The first part rehearses the main arguments for (...) and against no-fault compensation. The second explains why it is likely that AI systems will be widely introduced. The third part analyses why it is difficult to fit AI systems into fault-based compensation systems while the final part suggests how no-fault compensation could provide a possible solution to such challenges. Angels are the ultimate stranger. They come from another world and have a special place in the art of the Russian Jewish painter Marc Chagall (1887-1985). Drifting into sleep in the corner of a room (all he could afford) he suddenly saw the ceiling open and a winged being, surrounded by light and blue air, hovered above him before disappearing through the ceiling again.

The distinction between occurrent and non-occurrent mental states is frequently appealed to by contemporary philosophers, but it has never been explicated in any significant detail. In the literature, two accounts of the distinction are commonly presupposed. One is that occurrent states are conscious states. The other is that non-occurrent states are dispositional states, and thus that occurrent states are manifestations of dispositions. Theism and its cousins, atheism and agnosticism, are seldom taken to task for logical-epistemological incoherence. This paper provides a condensed proof that not only theism, but atheism and agnosticism as well, are all of them conceptually self-undermining, and for the same reason: All attempt to make use of the concept of “transcendent reality,” which here is shown not only to lack meaning, but to preclude the very possibility of meaning. In doing this, the incoherence of theism, atheism, and agnosticism is (...) secondary to the more general incoherence of any attempts to refer to so-called “transcendent realities.” A recognition of the conceptually fundamental incoherence of theism, atheism, and agnosticism compels our rational assent to a position the author names “paratheism.”. The paper begins by acknowledging that weakened systematic precision in phenomenology has made its application in philosophy of science obscure and ineffective. The defining aspirations of early transcendental phenomenology are, however, believed to be important ones. A path is therefore explored that attempts to show how certain recent developments in the logic of self-reference fulfill in a clear and more rigorous fashion in the context of philosophy of science certain of the early hopes of phenomenologists. Transnational higher education, where students study on a ‘foreign’ degree programme whilst remaining in their home country, has seen exponential development over the last decade. In addition to the increase in students engaged in TNHE across the globe, the involvement of university teachers in TNHE has also risen in response to the demand for this form of international education. Although research into transnational education has doubled since 2006, there is a paucity of research focusing on transnational teacher education, especially outside (...) of North America. The global nature and scope of the expansion of TNHE remains underexplored, and the ways in which different countries are realising TNHE provision is little understood. This book explores the experiences and perceptions of teachers in transnational higher education, interrogating the ways in which university teachers negotiate cultural, linguistic, and disciplinary contexts in order to provide transformative learning experiences for their students. The paper describes the author's enduring personal philosophical precept; it is also an implicit encomium to individuals whose psychology establishes a dependable bridge between their rational convictions and their conduct.

“Act so that the effects of your action are compatible with the permanence of genuine human life on Earth.” How can we understand Jonas’ “maxim”? Is it too anthropocentric to be of any interest for an environmental ethic? Is is too limited to survival to have a moral signification in a truly human ethic? One can argue first that it is not so much anti-Kantian than that it challenges the current prevailing “presentism” and obliges us to take into consideration not (...) only future generations, but also the context in which one anticipates these future generations to be living. Therefore, we can distinguish two different interpretations of Jonas’ maxim: in a first stage, that of sustainable development, it was understood as taking into consideration not only the needs but also the rights of future generations; in a second stage, that of an Anthropocene and ecological transition, it means that making sense of humanity implies connecting human beings to the Earth and other living beings far from opposing them. This article presents results from simulations studying the hypothesis that mechanisms for landmark-based navigation could have served as preadaptations for compositional language. It is argued that sharing directions would significantly have helped bridge the gap between general and language-specific cognitive faculties. A number of different levels of navigational and communicative abilities are considered, resulting in a range of possible evolutionary paths. The selective pressures for, resp. against, increased complexity in either faculty are then evaluated for a range of environments. The (...) study aims specifically to identify whether there is a viable evolutionary path leading to compositional language, and if so, under what circumstances. The results show that environmental conditions can render a step towards more complex communication either desirable or harmul, and suggest that very specific initial conditions and changes in the environment, resp. the ecological niche occupied, would have been needed to select for compositional language. Subject to these conditions, a (proto)language using order, but no hierarchical structure could evolve. This represents a middle ground, which brings closer hypotheses about syntax that have so far appeared difficult to reconcile. (shrink)

Hundreds of evaluative studies of psychotherapy still leave the issue of its effectiveness unsettled. The author argues that such studies have ignored the major determinant of therapeutic effectiveness, the role of a patient’s belief in the successful outcome in therapy. Psychiatrist Thomas Szasz, one of the foremost critics of psychiatry, wrote of this paper: "It is one of the best, if not the best, that I have read on this subject.” It makes little sense to claim that a certain therapy (...) is effective or ineffective in itself; rather, there is a relation of mutual interaction among three terms: a patient’s ability to learn in a psychological context, a therapist’s ability to teach, and the capacity of an approach to therapy to engender in the patient the necessary belief in its effectiveness. -/- The paper is followed by a 4-page 2014 Afterword. The author considers the model-theoretic character of proofs and disproofs by means of attempted counterexample constructions, distinguishes this proof format from formal derivations, then contrasts two approaches to semantic tableaux proposed by Beth and Lambert-van Fraassen. It is noted that Beth's original approach has not as yet been provided with a precisely formulated rule of closure for detecting tableau sequences terminating in contradiction. To remedy this deficiency, a technique is proposed to clarify tableau operations.

At first sight it may seem as if Imagination can easily be characterized as a continuous process of having images; but this is very soon found to be inadequate and misleading. On the one hand we have a great number of good witnesses who insist that in their best imaginative work they have made use of no images, or of very few; and on the other, everybody makes distinction between flights of fancy, for example, which certainly involve successions of images, (...) and true imagination. Perhaps a better method of approach is found when we examine how the material dealt with in the imaginative process is built together. In the flight of fancy image follows image, and the transition from one to the next seems to be determined by something in the nature of each individual step of the whole chain, or by each individual act of imaging. Vol. II in English is available separately from this website. -/- The principal objective of the work is to construct an analytically precise methodology which can serve to identify, eliminate, and avoid a certain widespread conceptual fault or misconstruction, called a "projective misconstruction" or "projection" by the author. -/- It is argued that this variety of error in our thinking (i) infects a great number of our everyday, scientific, and philosophical concepts, claims, and theories, (...) (ii) has largely been undetected, and (iii), when remedied, leads to a less controversial and more rigorous elucidation of the transcendental preconditions of human knowledge than has traditionally been possible. -/- The dissertation identifies, perhaps for the first time, a projective variety of self-referential inconsistency, and proposes an innovative, self-reflexive approach to transcendental argument in a logical and phenomenological context. The strength of the approach lies, it is claimed, in the fact that a rejection of the approach is possible only on pain of self-referential inconsistency. The argument is developed in the following stages: -/- A general introduction identifies the central theme of the work, defines the scope of applicability of the results reached, and sketches the direction of the studies that follow. The preliminary discussion culminates in a recognition of the need for a critique of impure reason. -/- The body of the work is divided into two parts: Section I seeks to develop a methodology, on a purely formal basis, which is, on the one hand, capable of being used to study the transcendental foundations of the special sciences, including its own proper transcendental foundation. On the other hand, the methodology proposed is intended as a diagnostic and therapeutic tool for dealing with projective uses of concepts. -/- The approach initiates an analysis of concepts from a perspective which views knowledge as coordination. Section I describes formal structures that possess the status of preconditions in such a coordinative account of knowledge. Special attention is given to the preconditions of identifying reference to logical particulars. The first section attempts, then, to provide a self-referential, transcendental methodology which is essentially revisionary in that it is motivated by a concern for conceptual error-elimination. -/- Phenomenology, considered in its unique capacity as a self-referential, transcendental discipline, is of special relevance to the study. Section II accordingly examines a group of concepts which come into question in connection with the central theme of phenomenological constitution. The "de-projective methodology" developed in Section I is applied to these concepts that have a foundational importance in transcendental phenomenology. A translation is, in effect, proposed from the language of consciousness to a language in which preconditions of referring are investigated.
