A large number of Swedish public authorities produce ‘platform of values’ texts that present core values. This article presents a study of how such texts and practices, including the core values they revolve around, are legitimized. Using Van Leeuwen’s legitimation framework, three different data sets are analysed: 47 ‘platform of values’ texts, a focus group discussion with seven senior HR officers, and a quantitative questionnaire study answered by civil servants at three public authorities. The analysis shows how the existence of (...) ‘platform of values’ texts and practices is legitimized through rationalizations, above all by describing the texts as concrete means for reaching specific ends and, with regard to the choice of core values, through a custom-conformity type of authority. Thus, this article addresses discursive transformations of contemporary organizations with a particular focus on available discursive space for critical thinking in the wake of New Public Management and related developments. Background Older patients in emergency care often have complex needs and may have limited ability to make their voices heard. Hence, there are ethical challenges for healthcare professionals in establishing a trustful relationship to determine the patient’s preferences and then decide and act based on these preferences. With this comes further challenges regarding how the patient’s autonomy can be protected and promoted. Aim To describe nurses’ experiences of dealing with older patients’ autonomy when cared for in emergency departments (EDs). Research (...) design This study adopted reflective lifeworld theory and a phenomenological design. Participants and research context A total of 13 open-ended interviews were performed with nurses working at two EDs in Sweden. Ethical considerations The study was reviewed by the Ethical Advisory Board in South East Sweden and conducted according to the Declaration of Helsinki. All participants gave consent. Findings Nurses’ experiences of dealing with older patients’ autonomy in EDs are characterized by moving in a conflicting uphill struggle, indicating obscure thoughts on how patient autonomy can be protected in an ethically challenging context. The phenomenon is further described with its meaning constituents: ‘Being hampered by prioritization under stress’, ‘Balancing paternalism and patient autonomy’, ‘Making decisions without consent in the patient’s best interests’ and ‘Being trapped by notions of legitimate care needs’. Conclusion Stressful work conditions and lacking organizational strategies in EDs contribute to nurses maintaining unjustified paternalistic care, regardless of the patient’s ability and medical condition, and questioning who has legitimacy for participating in decisions about care. The nurses’ protection and promotion of older patients’ autonomy is dependent on the opportunity, ability and willingness to create a patient relationship where the patient’s voice and preferences are valued as important. Consequently, strategies are needed to improve patient autonomy in EDs based on the idea of ‘relational autonomy’. (shrink)

It then employs this theory to answer a variety of questions about legal obligation, political authority, community, and international justice. It argues that we ought to obey a particular community’s laws and government commands, so long as our government restricts itself to protecting classical liberty and individual property rights under the rule of law. It further argues that people today should ideally live in confederated, legally sovereign (...) nation-states or nation-unions. Finally, it suggests that we have greater obligations to our compatriots than we do to foreign citizens, although we will often have pressing moral reasons to obey foreign laws while abroad, grant citizenship to outsiders who wish to join us, and help relieve foreign people’s misery. Das provokative und vielgelobte Buch Rorty's, des inzwischen international bekannten Ordinarius aus Princeton, stellt das gesamte Unternehmen der abendländischen Philosophie in Frage. Zentrales Thema von Philosophy and the Mirror of Nature sind Krise und Niedergang der analytischen Philosophy, wie wir sie seit Descartes, Locke und Kant kennen. Während Descartes und Locke die Seele als Auge modellierten, das die äußere Welt als inneres Bild wahrnimmt und vermittelt, verfeinerte Kant diese okulare Metapher durch Einführung des transzendentalen Subjekts. Gleichzeitig gab Kant der professionalen (...) Philosophie die Aufgabe, über die Legitimität intellektueller Anstrengungen zu richten. Legitimität aber kann nur gegründet sein in objektiven Kriterien und Regeln darüber, welche Repräsentationen der Welt als die wahren anzuerkennen sind. Nach Rorty führt dieser Ansatz die Philosophie unabdingbar auf den verhängnisvollen Weg der Reduktion auf Epistemologie. Die damit auftretenden erkenntnistheoretischen Probleme gilt es jedoch nicht zu lösen, sondern aufzulösen, zum Verschwinden zu bringen. Eine Besserung für die Sache der Philosophie sei zu erhoffen nur von einer historischen Kehrtwende zur Geschichte als Therapie. An dieser Stelle werden Wittgenstein, Heidegger und Dewey als Neuerer einer hermeneutisch orientierten philosophischen Pragmatik vorgestellt. Das Buch endet mit einer Skizze, wie das Unternehmen Philosophie in Zukunft menschlicher, dilettantischer, sozialer und damit insgesamt relevanter gestaltet werden kann. - Nicht so sehr Rorty's Verdikt über die Fruchtlosigkeit der analytischen Tradition - daß weite Teile der analytischen Philosophy in Sophisterei und Langeweile ausgeartet sind, ist bekannt - als vielmehr Rorty's Methode soll hier untersucht werden, sein Stil, seine professionellen Argumente als Beispiel einer ebenso zeitlosen wie vielgesichtigen Vorgehensweise in der abendländischen Philosophie, die Rorty neu orientieren will: Philosophie, der der Atem ausgeht über der Arbeit am Begriff, hat die Tendenz, eine Atempause in der Historie zu suchen oder das Philosophieren durch metaphilosophische Prolegomena zu einer zukünftigen neuen Metaphysik zu ersetzen. Rorty liefert beides: Kritik der Tradition und Versprechen einer besseren Zukunft. This paper discusses the ethical implications of perverse incentives with regard to autonomous driving. We define perverse incentives as a feature of an action, technology, or social policy that invites behavior which negates the primary goal of the actors initiating the action, introducing a certain technology, or implementing a social policy. As a special form of means-end-irrationality, perverse incentives are to be avoided from a prudential standpoint, as they prove to be directly self-defeating: They are not just a form of (...) unintended side effect that must be balanced against the main goal or value to be realized by an action, technology, or policy. Instead, they directly cause the primary goals of the actors—i.e., the goals that they ultimately pursue with the action, technology, or policy—to be “worse achieved”. In this paper, we elaborate on this definition and distinguish three ideal-typical phases of adverse incentives, where only in the last one the threshold for a perverse incentive is crossed. In addition, we discuss different possible relevant actors and their goals in implementing autonomous vehicles. We conclude that even if some actors do not pursue traffic safety as their primary goal, as part of a responsibility network they incur the responsibility to act on the common primary goal of the network, which we argue to be traffic safety. The ArgumentPain has important biomedical socioanthropological, semiotic, and other facets. In this contribution pain and the experssion of pain are looked at from the perspective of evolutionary biology, utilizing, among others, cross-cultural data from field work in Melanesia.No other being cares for sick and suffering conspecifics in the way humans do. Notwithstanding aggression and neglect, common in all cultures, human societies can be characterized as empathic, comforting, and promoting the health and well-being of their members. One important stimulus triggering this (...) caring response in others is the expression of pain. The nonverbal channel of communication, particularly certain universal — i.e., culture-independent facial expressions, gestures, and body postures, convey much of the message from the painstricken person to the group.These behaviors signal the person's physical and psychical pain, sadness, grief, and despair in ways very similar to the signs given by infants and small children: the body loses tonus and sinks or drops to the ground, the gestures are those of helplessness. Pain and grief may be so strong that control is lost not only over the body's posture but also over the mind's awareness. In such cases the afflicted person may carry out actions endangering himself or others. In general, these behavior patterns resemble those of infants in situations of distress and danger, and it is not surprising that the response of the members of the group is basically parental: taking care, assisting and consoling.Perceptive and behavioral patterns which developed in the course of avian and mammalian phylogeny to serve the well-being of the young have proven, as was shown by Eibl-Eibesfeldt, to be powerful building blocks for actions in other spheres of human interaction. If an agent is unsure about which moral theory or principle should guide her action in a decision situation, she faces moral uncertainty. In recent years, various strategies have been explored to deal with this type of uncertainty. In this paper, we briefly mention two strategies from the literature that make use of credence distributions over moral theories, namely “my favourite theory” and “maximizing expected choice-worthiness”. As an alternative, we propose a two-step procedure which uses the concept of aggregation over (...) structural properties. It is standard in the theory of collective choice and has recently been applied to the Kuhnian problem of theory choice as well. The idea is to explore how a morally-motivated rational agent may assess different moral theories on the basis of fundamental properties. These properties are ranked on a common scale of qualitative verdicts. This method enables an outside observer to make comparisons across competing moral theories and then conclude to what degree these theories fulfil a set of postulated properties. By doing so, we try to render the reasons more transparent that lie behind different types of credence ascriptions. (shrink)

Arrow’s impossibility result not only had a profound influence on welfare economics, but was, as this paper shows, also widely discussed in philosophy of science and in the engineering design literature.

In an article from 1973, Rittel and Webber distinguished between “tame” or “benign” problems on the one hand and “wicked” problems on the other. The authors argued that wicked problems occur in nearly all public policy issues. Since different groups adhere to different value-sets, solutions can only be expressed as better or worse. By no means can they be viewed as definitive or objective. In this paper we shall consider, from this very angle, the theory of social choice which is (...) about the aggregation of individual preferences with the aim to derive a consistent social preference. We shall show that collective choice offers wicked problems of various types which differ in their degree of severity. We shall hereby concentrate on welfare functions and voting schemes of different kinds and shall discuss these in the light of various criteria such as Arrow’s independence condition, Condorcet consistency, monotonicity, manipulability, and other properties. This article argues that the influence of heteronormativity on the conceptualization of women and technology in feminist constructivist technology studies creates serious problems for the analysis. This research aims to understand the coproduction of gender and technology in society, but does not approach the two elements in a symmetrical fashion. Hence, ethnographic studies can only exemplify how the gender of technology producers is reflected in the technology created. Masculine gender identity is stabilized as a cause for the masculinity of a (...) technology that is shaped by social relationships. The criticism is fleshed out in a close examination of case study accounts of ethnographies among producers and users of technology. It is argued that a habitual reproduction of heteronormativity, present in the surrounding culture and in the technological communities studied, has prevented the adoption of approaches to the subject conducive to the objective of this feminist research. Acknowledging that destabilizing gender can undermine the critical thrust of feminist critique, the paper turns towards queer theory for ideas about how to produce criticism that does not rely on the stability of identity. The article closes with suggesting how a queer feminist approach could contribute to different readings of life with technology. (shrink)

ArgumentThis paper challenges three assumptions common in the literature on expertise: that expertise is linearly derived from scientific knowledge; that experts always align with the established institutional order; and that expertise is a property acquired by individuals. We criticize these ideas by juxtaposing three distinct expert practices involved with flood risk management in England. Virtual engineering is associated with commercial consultancy and relies on standardized software packages to assess local flood inundation. Mathematical experimentation refers to academic scientists creating new digital (...) renderings of the physical dynamics of flooding. Participatory modeling denotes research projects that aim to transform the relationships between experts and local communities. Focusing on different modes of modeling we contribute an analysis of how particular models articulate with specific politics of knowledge as experts form relationships with flood risk management actors. Our empirical study also shows how models can contribute to re-distribution of expertise in local flood risk management. (shrink)

Background To produce and understand words, humans access the mental lexicon. From a functional perspective, the long-term memory component of the mental lexicon is comprised of three levels: the concept level, the lemma level, and the phonological level. At each level, different kinds of word information are stored. Semantic as well as phonological cues can help to facilitate word access during a naming task, especially when neural dysfunctions are present. The processing corresponding to word access occurs in specific parts of (...) working memory. Neural models for simulating speech processing help to uncover the complex relationships that exist between neural dysfunctions and corresponding behavioral patterns. Methods The Neural Engineering Framework (NEF) and the Semantic Pointer Architecture (SPA) are used to develop a quantitative neural model of the mental lexicon and its access during speech processing. By simulating a picture-naming task (WWT 6-10), the influence of cues is investigated by introducing neural dysfunctions within the neural model at different levels of the mental lexicon. Results First, the neural model is able to simulate the test behavior for normal children that exhibit no lexical dysfunction. Second, the model shows worse results in test performance as larger degrees of dysfunction are introduced. Third, if the severity of dysfunction is not too high, phonological and semantic cues are observed to lead to an increase in the number of correctly named words. Phonological cues are observed to be more effective than semantic cues. Conclusion Our simulation results are in line with human experimental data. Specifically, phonological cues seem not only to activate phonologically similar items within the phonological level. Moreover, phonological cues support higher-level processing during access of the mental lexicon. Thus, the neural model introduced in this paper offers a promising approach to modeling the mental lexicon, and to incorporating the mental lexicon into a complex model of language processing. Neuroscientific research in relation to antisocial behavior has strongly grown in the last decades. This has resulted in a better understanding of biological factors associated with antisocial behavior. Furthermore several neuroscientific instruments and interventions have been developed that have a relatively low threshold for use in the criminal justice system to contribute to prevention or reduction of antisocial and criminal behavior. When considering implementation in the criminal justice system, ethical aspects of the use of neuroscientific instruments and interventions need to (...) be taken into account. With respect to ethics in relation to neurocriminology much of the literature focuses on identifying and debating risks and value conflicts. This is important and necessary, but the positive contribution of neuroscientific applications may therefore get less attention in the ethical literature. Yet, ethicists can help criminal justice researchers and practitioners to identify ways in which neuroscience could add positively to important values in (young) offender rehabilitation. It is argued that this role of ethicists in interdisciplinary teams deserves more emphasis. As an illustration, this contribution focuses on how neuroscientific knowledge, instruments and interventions may contribute to autonomy of (young) offenders. (shrink)

Wulf Gaertner provides a comprehensive account of an important and complex issue within social choice theory: how to establish a social welfare function while restricting the spectrum of individual preferences in a sensible way. Gaertner's starting point is K. J. Arrow's famous 'Impossibility Theorem', which showed that no welfare function could exist if an unrestricted domain of preferences is to be satisfied together with some other appealing conditions. A number of leading economists have tried to provide avenues out of (...) this 'impossibility' by restricting the variety of preferences: here, Gaertner provides a clear and detailed account, using standardized mathematical notation, of well over forty theorems associated with domain conditions. This paper distinguishes between two main questions regarding the notion of privacy: “What is privacy?” and “Why do/should we value privacy?”. In developing a social-ontological recognitional model of privacy, it gives an answer to the first question. According to the SORM, Privacy is a second order quality of roles within social practices. It is a function of who is or should be recognized as a “standard authority”. Enjoying standard authority means to have the right to interpret and contest role behavior (...) and role obligations within a specific practice, as well as evaluate the normative structure, the fundamental practice norms as well as the roles and their status. The SORM utilizes the concept of standard authority to explicate privacy with regard to two categories that capture the relevant phenomena of privacy: decisional and informational privacy. Within a practice, an actor is said to have decisional privacy if she as a BCR does not recognize bearers of accidental roles as standard authorities. Vice versa, an actor is said to enjoy informational privacy if all other BCRs recognize her as a standard authority. Additionally, the requirement of mutual recognition by the practice participants as standard authorities introduces a “weak normativity” into the theory, which can be used to identify deficient privacy arrangements within practices. Young children learn to make sense of the world through mimetic processes. These processes are focused to begin with on their parents, brothers and sisters and people they know well. Young children want to become like these persons. They are driven by the desire to become like them, which will mean that they belong and are part of them and their world. Young children, and indeed humans in general are social beings. They, more than all non-human primates, are social beings (...) who cannot survive without the Other. In mimetic processes the outside world becomes the inner world and the inner world becomes the outside world. The imaginary is developed and the imaginary develops ways of relating to the outside world. In a mimetic loop, this in turn affects the inner world of the imaginary. These processes are sensory and governed by desire. All the senses are involved which means that the imaginary has multiple layers. Since there is an intermingling of images, emotions and language, these processes are rooted in the body and at the same time transcend the body as they become part of the imaginary. Human beings create images of themselves in all cultures and historical periods. They need these images to understand themselves and their relationship to other human beings and to develop social relations and communities. Images of the human being are designs and projections of the human being and his or her relationship to other people and to the world. They are formed to visualize representations of individuals or aspects of them. They arise when we communicate about ourselves. They support us to live with diversities and to develop similarities and feelings of belonging with other people. They are the result of complex anthropological processes, in which social and cultural power structures play an important role. (shrink)

The General Data Protection Regulation (GDPR) of the EU confirms the protection of personal data as a fundamental human right and affords data subjects more control over the way their personal information is processed, shared, and analyzed. However, where data are processed by artificial intelligence (AI) algorithms, asserting control and providing adequate explanations is a challenge. Due to massive increases in computing power and big data processing, modern AI algorithms are too complex and opaque to be understood by most data (...) subjects. Articles 15 and 22 of the GDPR provide a modest regulatory framework for automated data processing by, among other things, mandating that data controllers inform data subjects about when it is being used, and its logic and ramifications. Nevertheless, due to the phrasing of the articles and the numerous exceptions they allow, doubts have arisen about their effectiveness. In this paper, we empirically evaluate the quality and effectiveness of AI disclosures as mandated by the GDPR. By means of an online survey (N = 835), we investigated how data subjects expect to be informed about the automated processing of their data. We then conducted a content analysis of the AI disclosures of N = 100 companies and organizations. The combined findings reveal that current GDPR-mandated disclosures do not meet the expectations and needs of data subjects. Explanations drawn up following the guidelines of the generic formulations of the GDPR differ widely and are often vague, incomplete and lack transparency. In our conclusions we identify a path towards standardizing and optimizing AI information notices. (shrink)

Kuhn claimed that several algorithms can be defended to select the best theory based on epistemic values such as simplicity, accuracy, and fruitfulness. In a recent paper, Okasha :83–115, 2011) argued that no theory choice algorithm exists which satisfies a set of intuitively compelling conditions that Arrow had proposed for a consistent aggregation of individual preference orderings. In this paper, we put forward a solution to avoid this impossibility result. Based on previous work by Gaertner and Xu, we suggest to (...) view the theory choice problem in a cardinal context and to use a general scoring function defined over a set of qualitative verdicts for every epistemic value. This aggregation method yields a complete and transitive ranking and the rule satisfies all Arrovian conditions appropriately reformulated within a cardinal setting. This article contributes to the literature on the evaluation of sets of opportunities. The starting point is Lancaster's characteristics approach. However, instead of assuming the existence of a canonical utility function, a reference point or reference level is postulated from which an agent evaluates set expansions in appropriate directions. One of the major tools for this exercise is the notion of directed cones. Desirability of characteristics is restricted to the interior of these cones. Satiation and non-monotonic evaluation is considered as (...) well. An axiomatic characterization for various cases is provided. (shrink)

This paper discusses evaluations of distributive justice in two different situations. Focal point is the so-called equity axiom which lies at the heart of Rawls’ second principle of justice, the maximin rule. Our investigation which was run at a German university spans over a period of fifteen years. It seems to us that consideration for the worst-off (group) in society has become considerably weaker over the years. This and related observations are tested by using a probit model including several demographic (...) characteristics of the probands. The supposed time trend proves to be statistically robust. Several reasons for this observation are given. Obviously, depending on the underlying context, evaluations are to some degree influenced by current topics, including the ongoing discussion about the German educational system as well as about recent economic problems. We introduce a new theorem in social choice theory built on a path integral approach which will show that, under some reasonable conditions, there is a unique way to aggregate individual preferences based on fuzzy sets into a social preference based on probabilities, and that this way is invariant under any permutation of alternatives. We then apply this theorem to the case of democratic decision making with data of the behaviour and voting preferences of voting agents and show that there (...) is a tradeoff between fairness and efficiency and that no voting system can achieve both simultaneously. Background It is a common ethical challenge for ambulance clinicians to care for patients with impaired decision-making capacities while assessing and determining the degree of decision-making ability and considering ethical values. Ambulance clinicians’ ethical competence seems to be increasingly important in coping with such varied ethical dilemmas. Ethics rounds is a model designed to promote the development of ethical competence among clinicians. While standard in other contexts, to the best of our knowledge, it has not been applied within the ambulance (...) service context. Thus, the aim of this study was to describe ambulance clinicians’ experiences of participating in ethics rounds. Methods This was a qualitative descriptive study, evaluating an intervention. Data were collected through sixteen interviews with ambulance clinicians who had participated in an intervention involving ethics rounds. The analysis was performed by use of content analysis. Results Two themes describe the participants’ experiences: (1) Reflecting freely within a given framework, and (2) Being surprised by new insights. The following categories form the basis of the themes; 1a) Gentle guidance by the facilitator, 1b) A comprehensible structure, 2a) New awareness in the face of ethical problems, and 2b) Shared learning through dialogue. Conclusion Incorporating structured ethics rounds seems to create a continuous development in ethical competence that may improve the quality of care in the ambulance service. Structured guidance and facilitated group reflections offer ambulance clinicians opportunities for both personal and professional development. An important prerequisite for the development of ethical competence is a well-educated facilitator. Consequently, this type of ethics rounds may be considered a useful pedagogical model for the development of ethical competence in the ambulance service. (shrink)

The memory wave in the humanities has contributed to the impressive revival of cultural history, but the success of memory studies has not been accompanied by significant conceptual and methodological advances in the research of collective memory processes. Most studies on memory focus on the representation of specific events within particular chronological, geographical, and media settings without reflecting on the audiences of the representations in question. As a result, the wealth of new insights into past and present historical cultures cannot (...) be linked conclusively to specific social collectives and their historical consciousness. This methodological problem is even enhanced by the metaphorical use of psychological and neurological terminology, which misrepresents the social dynamics of collective memory as an effect and extension of individual, autobiographical memory. Some of these shortcomings can be addressed through the extensive contextualization of specific strategies of representation, which links facts of representation with facts of reception. As a result, the history of collective memory would be recast as a complex process of cultural production and consumption that acknowledges the persistence of cultural traditions as well as the ingenuity of memory makers and the subversive interests of memory consumers. The negotiations among these three different historical agents create the rules of engagement in the competitive arena of memory politics, and the reconstruction of these negotiations helps us distinguish among the abundance of failed collective memory initiatives on the one hand and the few cases of successful collective memory construction on the other. For this purpose, collective memory studies should adopt the methods of communication and media studies, especially with regard to media reception, and continue to use a wide range of interpretive tools from traditional historiography to poststructural approaches. From the perspective of collective memory studies, these two traditions are closely related and mutually beneficial, rather than mutually exclusive, ways of analyzing historical cultures. (shrink)

In this article Cristoph Wulf examines the basic concepts of pedagogy and educational science in the German-speaking world, looking at education and socialization from the perspective of educational anthropology. He makes evident that the complex German concept of Bildung, in particular, can only be fully understood by means of a historical and philosophical analysis.

Interpersonal respect can be differentiated into two kinds: horizontal respect, i.e. treating someone with dignity; and vertical respect, i.e. genuinely honoring someone’s merits. With the present research, we draw on motivation theory to explore their interplay in leadership relations. Specifically, we argue for a moderated mediation hypothesis in that leaders’ horizontal respect for their subordinates fundamentally speaks to subordinates’ self-determination and that the message of respectful leadership is enhanced by the vertical respect subordinates have for their leaders. As a result, (...) subordinates are more satisfied with their jobs, which should also show in a decreased willingness to leave. The proposed model was supported in two survey studies and an experimental scenario study —thus suggesting that perceived leader behavior needs to be complemented by leader standing. (shrink)
