Modern jurisprudence has typically been presented as a debate between legal positivism and natural law. Though the demise of legal positivism has been touted despite its pre-eminence in past decades, it is clear that there remains a vigorous debate surrounding this theory. It is noteworthy that Hans J. Morgenthau’s legal thought and critique of legal positivism have remained unexplored in the context of this debate. Largely forgotten, his legal thought answers questions that lie at the heart of the natural law (...) and legal positivist debate. It showcases his deeply nuanced understanding of legal and political theory and contains a powerful and insightful commentary on the fundamental problems faced by international law. Building on existing literature, this paper unearths Morgenthau’s critique of legal positivism. It does this by re-examining his works, which address the question of whether moral considerations are relevant to determining the content of the law in force. It brings his legal thought to light, which highlights the artificiality of the division between law and morality and offers a nuanced analysis of problems inherent in international law. Ultimately, the paper challenges the claim that the law can be determined without resorting to moral judgement and shows how Morgenthau’s insights remain relevant to legal positivism and natural law debates today. The objective of this research is to examine how and when employees' attributions of corporate social responsibility (CSR) affect their extra-role service behaviors. The research analyses the mediating role of work meaningfulness in the employees' CSR attributions–extra-role behaviors relationships. The moderating role of employees' attitudes toward CSR in both the relationships between CSR attributions and work meaningfulness and in the mediated relationship is also studied. The hypotheses were tested on a sample of 204 frontline employees of four- and five-star hotels (...) in Spain using structural equations and the PROCESS macro. The results indicate that only substantive CSR attributions positively influenced employees' extra-role service behaviors and that the relationship occurs through the work meaningfulness experienced by employees. While substantive CSR attributions boosted work meaningfulness and subsequent extra-role service behavior regardless of personal attitudes toward CSR, the link between symbolic CSR attributions and work meaningfulness as well as the mediated relationship with extra-role service behaviors were found to be moderated by employees' personal attitudes toward CSR. When employees had lower personal attitudes toward CSR, symbolic CSR attributions positively affected work meaningfulness and extra-role service behavior; when attitudes toward CSR were higher, the relationships were not significant. Since time immemorial, the phenomenon of leadership and its understanding has attracted the attention of the business world because of its important role in human groups. Nevertheless, for years efforts to understand this concept have only been centred on people in leadership roles, thus overlooking an important aspect in its understanding: the necessary moral dimension which is implicit in the relationship between leader and follower. As an illustrative example of the importance of considering good morality in leadership, an empirical study (...) is conducted in which a good performance of the "leader-follower" relationship is reflected when individuals perceive ethical leadership in higher hierarchical managerial levels. To be precise, findings of this study demonstrate that follower job response is improved through an ethics trickle-down partial effect from the Top Manager to the immediate supervisor, and also reveal both key aspects and managerial level on which the practice of ethical leadership should rest upon to have a stronger effect on the follower positive job response. Practical implications of these findings and directions for future research are finally presented. (shrink)

Background: Advances in biomedical sciences, technologies and care practices have resulted in an increase in ethical problems and a resulting growth of difficulties encountered by health workers in their professional activity. Objective: The main objective of this study was to analyse knowledge in the ethical field and experience with and the propensity for using ethics consultations by nurses and physicians. Methods: Between March and June 2014, a cross-sectional observational study was conducted on a sample of 351 nurses and 128 physicians (...) in four central Italian hospitals. For data collection, a semi-structured questionnaire was used, consisting of 21 items divided into four sections exploring (1) demographic and occupational characteristics, (2) knowledge in the ethics field, (3) experience with ethical issues and (4) the propensity to use ethics consultation. Ethical considerations: Research ethics approval was obtained from the Italian Nurses Professional Board. Results: The results show that both nurses and physicians are faced with ethically sensitive situations. Nurses were found to have better judgement concerning their own knowledge than physicians, but more physicians were found to have a deeper level of specific training in ethics issues. The propensity to ask for ethics consultations to address ethical issues was found to be significantly associated with the degree to which ethical issues have deepened (and the level of experience acquired in this field). Conclusion: The presence of a consulting service that can lead to shared choices may represent, together with basic and continuing education, a valid support for professional growth in the ethical field for both physicians and nurses. The subject of “The Other”, the different one always generated conflicts more or less serious in the history of humanity, without proposals of any resolution. In the measure in that The Other questions, by similitude or by difference, the identity in which the subject is sustained, that questioning make unstable that precarious construction, and because of this, it converts itself in the opposer. In this study, we will find, in the text of Il Visconte Dimezzato by Italo Calvino, the subject (...) of the Otherness/Alterity, analyzing from the semiotic point of view the reactions and behaviors of each one of the two characters and of the members of the society in which they live. The starting point of the story by Italo Calvino is that in a war between Austria and the Turks, the Viscount Medardo di Terralba as a consequence of a canon shot remains divided vertically into two halves and both halves survive. One of the two halves is very bad and the other is very good. Each one of the two halves sees in the other one “The Other”, feeling itself “The One” but incomplete and desiring to turn to be “The Same” as it was before being divided by the canon shot. (shrink)

The complexity and emotional/psychological responses to the environmental challenges of the 21st century has led to the coining and development of new words and concepts that, for some people, better describe how they are personally grappling with anthropogenic ecosystem damage and climate breakdown. This paper identifies some of the more commonly used environmental neologisms within scholarly literature and evaluates their usefulness and contradictions for those influenced by the virtue ethics promoted by the ancient Stoics and the Catholic Church. We find (...) that environmental neologisms, when framed by these philosophical and/or theological ideas, offer an alternative and, ultimately, helpful means to contemplate the nature of what might be considered an environmental crisis and how best we might address, or at least, mitigate it, as conscientious spiritual human beings. The aim of this article is to analyse Spanish conversational structure, more concretely, to investigate in depth the role of the third move, or follow-up, outside classroom discourse. Since first introduced by Sinclair and Coulthard, the follow-up move has attracted a great deal of attention, as proved by numerous studies. However, these studies have mostly focused on English while Spanish has been neglected. The present study intends to fill in this gap by analysing a corpus of 50 conversational exchanges in (...) Peninsular Spanish. The analysis is qualitative and based on Tsui’s conversational framework, which has proved methodologically useful. As results will show, the presence or absence of the third move in Spanish conversations seems to rely heavily on a gender-based distinction. (shrink)

The role played by witnesses of bullying in nursing settings remains little studied, despite their potential relevance in explaining the onset and development of bullying. The objective of this study was to develop a model to account for witnesses’ intention to help and helping behaviour in response to bullying in a nursing setting. Three hundred and thirty‐seven witnesses completed self‐report measures of variables predicting intention to help and helping behaviour. A full structural model was constructed using structural equation modelling. The (...) intention to help victims was elicited by tension, group identity, support to peers’ initiative to intervene and absence of fear of retaliation. However, engagement in helping behaviour was only predicted by the absence of fear of retaliation. This study shows that witnesses of bullying in nursing settings do not remain impassive, but their experienced discomfort and intention to help victims is not sufficient to predict helping behaviour. Fear of possible retaliation if intervening in favour of victims constitutes a crucial factor explaining witnesses’ hesitation to help victims. Several implications for the implementation of policies directed at eradicating bullying in nursing settings are discussed. (shrink)

Objetivo. Verificar si el procesamiento semántico de estímulos visuales complejos, como la repetición, la identidad, el orden y la doble incongruencia, es recursivo o computable. Sujetos y métodos. Veintisiete universitarios respondieron a un paradigma adaptado N400 con cinco condiciones, cada una con 80 tareas, mientras se registraba su actividad cerebral con un gorro de 64 electrodos. Resultados. Dos ventanas temporales de 400 a 550 ms y de 550 a 800 ms se analizaron mediante un contraste ANOVA del factor condición por (...) regiones de interés. Además, se calculó la solución inversa de las ventanas mediante tomografía electromagnética de baja resolución para identificar las fuentes corticales subyacentes a los potenciales eléctricos. Se corroboran diferencias significativas (p< 0, 05) en los potenciales N400 y P600 en áreas frontales y centroparietales asociadas a los operadores lógicos estudiados. Conclusión. Se confirma que el procesamiento cerebral de imágenes complejas (congruentes/incongruentes) es modulado por la repetición, la identidad y el orden, pero no por la negación. Por consiguiente, se puede decir que el procesamiento semántico de imágenes complejas es semicomputable. (shrink)

As concerns heighten over links between biomass production and land grabs in the global south, attention is turning to understanding the role of governance of biofuels systems, whereby decision-making and conduct are not solely determined through government regulations but increasingly shaped by non-state actors, including multi-stakeholder initiatives. Launched in 2005, Bonsucro is the principal MSI that focuses on sustainability standards for sugar and sugarcane ethanol production. Bonsucro claims that because it is free from government interference and draws on scientific metrics, (...) their standards transcend localized, political–economic contexts. In this paper, we illustrate how the local context shapes the prospects for Bonsucro sustainably certified biofuel production in relation to land and water grabs. To accomplish this, our case focuses on Colombia, which has used a range of national policy mandates to establish itself as one of the larger producers of agrofuels in Latin America. We draw on interviews with stakeholders in the sugar and ethanol industries, paired with an examination of Bonsucro principles on land rights and water use, to illustrate how the sugar industry is framing their participation in Bonsucro, and the effects of the increasing intensification of sugarcane for ethanol production on land and water access for communities. We find that within the context of Colombia, efforts such as Bonsucro provide a veil of legitimacy and authority to a system that is premised on deeply entrenched historical patterns of inequitable land ownership patterns and access to natural resources. Este trabajo intenta analizar la concepción, naturaleza jurídica y garantía de los derechos económicos, sociales y culturales, en América Latina, así como las condiciones y medidas que pueden contribuir a su efectividad. Presenta tambien una propuesta de indicadores que pueden utilizarse en la supervision de la efectividad de esos derechos y de la proteccion que ellos han alcanzado, proporcionando información sobre la situactón latinoamericana y caribeña actual.

Civility is formed by social norms that guide our behavior and allow us to interact appropriately with others. These norms affect everyone and are learned through the socialization process. However, in the same process, people also learn gender norms that dictate how men and women should behave, leading to gender stereotypes and differentiated behavioral characteristics. The purpose of this research is to examine the relationship between gender and civility, and how we react to those who behave uncivilly given their gender. (...) The results of Study 1 showed that even in a fictional and gender-neutral society, uncivil behaviors were associated with stereotypically masculine characteristics, and those who behaved uncivilly were dehumanized. In Study 2, gender differences were observed in incivility. Women were harsher when facing uncivil transgressors than men, especially if the transgressor was another woman. Our findings support the notion that gender norms are applied to civility, leading those supposedly equal social norms to unequal perceptions and evaluations. (shrink)

The extremely rapid evolution of portable technologies and children's receptiveness to constantly accessing the latest information creates the conditions for a number of new developments in most areas of activity. Moreover, their attraction to real-time visualisation of various events and competitions projects a certain level of perception and imitation of certain behaviours. Therefore, special attention should be paid to them from the earliest stages, i.e., from the time they are selected to play various sports. Also, the complementarity of some sports (...) must be taken into account when it is desired to obtain positive results. Age group adaptation and the investigation of some of the parameters relevant to different age groups have generated values that can support positive outcomes in the long term and thus increase motivation to participate in sport at a competitive level. Todavía hoy en la historia de la antropología cuba­na se presta poca atención a la escritora y antropóloga Lydia Cabrera, quien solo muy recientemente ha empezado a formar parte de la nómina intelectual de la cultura cubana oficial. Sin embargo, en función de su obra y trayectoria vital puede consi­derarse a Cabrera como la fundadora moderna de los estudios sobre las religiones afrocubanas. El objeto central de este texto es analizar el trabajo etnográfico de Lydia Cabrera a partir de la (...) idea de que existe un contrapunteo, un diálogo, un juego metafórico, entre la identidad liminar de la propia autora -manifiesta en un sentido racial, cultural, de género, social y político- y su interés y dedicación a la aportación de los esclavos y la población de origen africano a la historia, a la cultura y, en última instancia, a la identidad misma de su patria cubana. Electrical brain activity modulation in terms of changes in its intensity and spatial distribution is a function of age and task demand. However, the dynamics of brain modulation is unknown when it depends on external factors such as training. The aim of this research is to verify the effect of deductive reasoning training on the modulation in the brain activity of healthy younger and older adults ( (mean age of 21 ± 3.39) and (mean age of 68.92 ± 5.72)). The (...) analysis reveals the benefits of training, showing that it lowers cerebral activation while increasing the number of correct responses in the trained reasoning task (). The brain source generators were identified by time-averaging low-resolution brain electromagnetic tomography (sLORETA) current density images. In both groups, a bilateral overactivation associated with the task and not with age was identified. However, while the profile of bilateral activation in younger adults was symmetrical in anterior areas, in the older ones, the profile was located asymmetrically in anterior and posterior areas. Consequently, bilaterality may be a marker of how the brain adapts to maintain cognitive function in demanding tasks in both age groups. However, the differential bilateral locations across age groups indicate that the tendency to brain modulation is determined by age. (shrink)

En este artículo procederemos, en primer lugar, a clarificar las características de la razón poética de M. Zambrano en relación con la vida, la historia y, por ende, con la razón vital-histórica de Ortega y Gasset. A continuación, mostraremos de qué modo la primera incluye la poiésis de la pintura. Veremos entonces la relación que la “razón poética-pictórica” guarda con la memoria, así como el tipo de memoria que la filósofa reivindica en comparación con uno de los filósofos a los (...) que leyó desde su juventud: Henri Bergson. Al hilo de esta exposición analizaremos el sentido que la pensadora le otorga al “lugar”, con el objeto de descifrar el título de su obra “Algunos lugares de la pintura”. Solo así lograremos entender la preocupación zambraniana por abrir lugares espaciotemporales habitables en los que detenerse a contemplar. Nos preguntaremos en nuestra conclusión si esto es todavía posible en la era de la información. (shrink)
