Since the mid-sixties an important change in the attitude of local authorities towards cultural infrastructure such as meeting halls, public libraries, sporting accommodation, etc. can be noticed. Induced by the government many state-subsidized initiatives have been taken in this field, implicating an active role of public authorities and contrasting with the former merely supporting policy. However cultural policy also supposes citizen's participation. This involvement has been legally guaranteed: every ideological tendency in the population bas the right to participate in the (...) management of public provisions in the cultural sector. Up to now the scale enlargement of the municipalities had no directimpact on the expansion of the cultural infrastructure. Many options were decided before the mergers and since 1977 the crisis in public finance lead to other priorities. The participatory structures have been reorganized on the level of the new municipalities, thus creating a social distance to the grass roots. (shrink)

The political agreements concluded in the summer of 1981 between the main majority and opposition parties constitute a turning point in the development of Spanish regionalism. Whereas previously autonomy statutes were awarded to historic regions with strong social and cultural identities, we have now a situation where a considerable degree of self-government is also made possible for all other regions. This decision shifted the focus more to socio-economic development, thereby stimulating expectations of improvement based on regional political efforts as well (...) as on national solidarity and state assistance. The recently adopted statute of Andalucia illustrates excellently this new orientation. In this contribution an analysis is made of the institutional instruments available for regional self-government. The conclusions are quite positive with regard to the devolution of powers provided in the constitution and the different statutes. Nevertheless Spain is not evolving into a federal state system. As a more appropriate description we prefer Perez Moreno's characterisation of the existing intergovernmental relations as «autonomias integradas». (shrink)

The concept of resistance has always been central to the reception of Hegel's philosophy. The prevalent image of Hegel's system, which continues to influence the scholarship to this day, is that of an absolutist, monist metaphysics which overcomes all resistance, sublating or assimilating all differences into a single organic 'Whole'. For that reason, the reception of Hegel has always been marked by the question of how to resist Hegel: how to think that which remains outside of or other to the (...) totalizing system of dialectics. In recent years the work of scholars such as Catherine Malabou, Slavoj Žižek, Rebecca Comay and Frank Ruda has brought considerable nuance to this debate. A new reading of Hegel has emerged which challenges the idea that there is no place for difference, otherness or resistance in Hegel, both by refusing to reduce Hegel's complex philosophy to a straightforward systematic narrative and by highlighting particular moments within Hegel's philosophy which seem to counteract the traditional understanding of dialectics. The restructuration of municipalities which has been decided by the Belgian government, is not only a purely technical operatzon but rather, and in the first place, a social problem. The shape and duty-profile of a local authority should not, indeed, be attuned only to fast changing expectations as far as services are concerned, but to consultation and participation as well.Public administration research cannot keep aloof from this debate, but is considerably hampered by the institutional confusion and the insufficient explicitation of (...) the aims of the present reform. A starting-pointcan, however, be found in the mergers of municipalities that were realized in 1964 and in 1970/1971. In 67 of these municipalities an inquiry was held concerning the consequences of the merger, and moreover, in twotest-cases this inquiry grew to a full-scale systematic policy analysis.This research shows that, as a rule, the former municipalities are reasonably represented in the new entity's council, but it also reveals that few efforts are made to give this representation a broader impact along formal or informal participation-channels. Integration of employees has not caused insurmountable problems. However, in large sized municipalities, resulting from mergers, one could notice a drastic increase in municipal personnel, not only with regard to new duties and objectives but to traditional administrative and police duties as well. Such a phenomenon points to the far-reaching changes which a substantial scale-increase provokes in a municipality's structure and policy profile. A large municipality resulting from mergers is no langer a simple sum of component parts, but a completely new entity, wishing to catch up as fast as possible with comparable municipalities that passed through a progressive growth process. Therefore, scale-increase is not only a means of economizing or an intra-administrative matter, but rather a way of creating chances for further development or wealth and well-being. (shrink)

This book provides a theory of the juridification of business ethics. Ethical codes pop up everywhere in the business world and increasingly resemble the code of law. A focus on compliance rather than reflection becomes the norm. Legal perspectives replace ethical perspectives, turning ethicists into lawyers without a law degree. This juridification of business ethics conceals a diminishing trust in ethics, as legal reasoning substitutes philosophical thinking. By appealing to the critical study of law, Bart Jansen advocates for a (...) renewed focus on the ethical side of business. This is an attempt at reviving Kneale's version of the description theory of names, which says that a proper name is synonymous with a definite description of the form ‘the individual named so-and-so’. To begin with, I adduce a wide range of observations to show that names and overt definites are alike in all relevant respects. I then turn to Kripke's main objection against Kneale's proposal, and endeavour to refute it. The legal basis for processing personal data and some other types of Big Data is often the informed consent of the data subject involved. Many data controllers, such as social network sites, offer terms and conditions, privacy policies or similar documents to which a user can consent when registering as a user. There are many issues with such informed consent: people get too many consent requests to read everything, policy documents are often very long and difficult to understand and users (...) feel they do not have a real choice anyway. Furthermore, in the context of Big Data refusing consent may not prevent predicting missing data. Finally, consent is usually asked for when registering, but rarely is consent renewed. As a result, consenting once often implies consent forever. At the same time, given the rapid changes in Big Data and data analysis, consent may easily get outdated. This paper suggests expiry dates for consent, not to settle questions, but to put them on the table as a start for further discussion on this topic. Although such expiry dates may not solve all the issues of informed consent, they may be a useful tool in some situations. (shrink)

According to the error theory, normative judgements are beliefs that ascribe normative properties, even though such properties do not exist. In this paper, I argue that we cannot believe the error theory, and that this means that there is no reason for us to believe this theory. It may be thought that this is a problem for the error theory, but I argue that it is not. In this volume, Geurts takes discourse representation theory (DRT), and turns it into a unified account of anaphora and presupposition, which he applies not only to the standard problem cases but also to the interpretation of modal expressions, attitude reports, and proper names. The resulting theory, for all its simplicity, is without doubt the most comprehensive of its kind to date. The central idea underlying Geurts' 'binding theory' of presupposition is that anaphora is just a special case of presupposition projection. (...) But this is only one of the ways in which the concept of presupposition is taken beyond its traditional limits. Geurts shows, furthermore, that presupposition projection is crucially involved in several phenomena that are not usually viewed in presuppositional terms, such as modal subordination, de re readings of attitude reports, and rigid designation. While making his case for DRT and the binding theory, Geurts also presents an incisive analysis of what is probably still the most influential account of presupposition, viz. the satisfaction theory, demonstrating that there are fundamental problems not only with this theory but with the very framework in which it is couched. The reform movement in science is seemingly constructing a new moral economy of science around process and bureaucracy, in which a new scientific etiquette is emerging that prescribes the performance of reformed science as civilised, efficient and objective. Bureaucratic innovations were borne out of the reform movement that seek to prescribe specific research processes, including but not limited to preregistration and registered reports. This moral economy emerges in the form of a bureaucracy and its epistemic uniformity actively suppresses scientific plurality. (...) This paper argues that Eliasian drivers such as distinction, shame and disgust, act to pressure scientists into adopting this new etiquette. Even though the etiquette's appearance is quite new, it can be traced back to existing moral economies of science and their pursuit of efficiency and objectivity. (shrink)

In this paper I present experimental data showing that the interpretation of donkey sentences is influenced by certain aspects of world knowledge that seem to elude introspective observation, which I try to explain by reference to a scale ranging from prototypical individuals (like children) to quite marginal ones (such as railway lines). This ontological cline interacts with the semantics of donkey sentences: as suggested already by the anecdotal data on which much of the literature is based, the effect of world (...) knowledge is by and large restricted to donkey sentences with non-intersective determiners. I outline a psychological model which incorporates both ontological and logical factors, and suggest that there may be something wrong with the standard assumption that a statement's receiving a truth value requires that it have a definite reading. The term ‘inertia’ is often used to describe a kind of irrational resistance to change in individuals or institutions. Institutions, ideas and power structures appear to become entrenched over time, and may become ineffective or obsolete, even if they once played a legitimate or useful role. In this paper I argue that there is a common set of problems underlying the occurrence of resistance to change in individuals, social structures and the development of knowledge. Resistance to change is not always (...) irrational or problematic; it is also necessary to allow stable personal identities and social structures to survive in a constantly changing world. I offer a historical and theoretical framework for the question of inertia. Finally, I argue that philosophy has often seen its task to be the critique of ossified, inert or obsolete ideas and social structures, but that it has neglected the positive dimension of resistance to change. Unbelievable Errors defends an error theory about all normative judgements: not just moral judgements, but also judgements about reasons for action, judgements about reasons for belief, and instrumental normative judgements. This theory states that normative judgements are beliefs that ascribe normative properties, but that normative properties do not exist. It therefore entails that all normative judgements are false. -/- Bart Streumer also argues, however, that we cannot believe this error theory. This may seem to be a problem for the (...) theory. But he argues that it makes this error theory more likely to be true, since it undermines objections to the theory and it makes it harder to reject the arguments for the theory. -/- He then sketches how certain other philosophical theories can be defended in a similar way. The epistemologists Biro and Siegel have raised two objections against the pragma-dialectical approach to argumentation. According to the first objection the pragma-dialectical theory is not genuinely normative. According to the second objection the rejection of justificationism by pragma-dialecticians is unwarranted: they reject justificationism prematurely and they are not consistent in accepting some arguments (‘justifications’) as sound. The first objection is based on what we regard as the misconception that the goal of resolving differences of opinion cannot provide a normative approach. (...) Recent research by the author has established that boards have an important and significant role to play when it comes to their organisations' strategy and strategic planning process. But is there room for improvement? According to the directors that have participated in an ongoing research project, the answer is most definitely 'yes'. The current paper identifies and discusses the top 13 areas of improvement, which directors feel need to be addressed if their responsibility for strategy is to be exercised properly. (...) Two computer simulations are investigated that model interaction of cultural evolution of language and biological evolution of adaptations to language. Both are agent-based models in which a population of agents imitates each other using realistic vowels. The agents evolve under selective pressure for good imitation. In one model, the evolution of the vocal tract is modeled; in the other, a cognitive mechanism for perceiving speech accurately is modeled. In both cases, biological adaptations to using and learning speech evolve, even though (...) the system of speech sounds itself changes at a more rapid time scale than biological evolution. However, the fact that the available acoustic space is used maximally is constant, and therefore biological evolution does have a stable target. This work shows that when cultural and biological traits are continuous, their co-evolution may lead to cognitive adaptations that are strong enough to detect empirically. (shrink)

Research increasingly demonstrates that associations between autonomy-relevant parenting and adolescent adjustment generalize across cultures. Yet, there is still an ongoing debate about the role of culture in these effects of autonomy-relevant parenting. The current study aimed to contribute to a more nuanced perspective on this debate by addressing cultural variability in micro-processes involved in autonomy-relevant parenting and, more specifically, in adolescents’ appraisals of and responses to parental behavior. In this vignette-based experimental study, involving 137 South-Korean adolescents (54% female, mean age (...) = 16 years), we examined whether individual differences in vertical collectivism affect the association between descriptions of potentially autonomy-supportive and controlling parenting practices and (a) appraisals of these practices (in terms of perceived autonomy support and control and experiences of autonomy need satisfaction and frustration), and (b) anticipated responses to these practices (i.e., negotiation, submissive compliance, and oppositional defiance). Participants in the autonomy-supportive condition reported more perceived autonomy support and autonomy satisfaction and lower perceived control and autonomy need frustration than participants in the controlling condition. Collectivism moderated between-vignette effects on perceived control and autonomy need frustration such that the differences between the autonomy-supportive and controlling vignettes were less pronounced (yet still significant) among adolescents scoring higher on collectivism. Collectivism did not moderate effects of the vignettes on the responses to parenting, but yielded a main effect, with collectivism relating to more submissive compliance and less oppositional defiance. Overall, the results suggest that both universal and culture-specific processes are involved in autonomy-relevant socialization. (shrink)

Despite clear legislative and judicial support, a well established ethical consensus, and increased efforts at information dissemination and education, proxy decision making for incapacitated patients continues to produce moral muddle and poor resolutions in end-of-life care.In her analysis of the proxy-doctor relationship, Nancy Dubler spells out the institutionalized patterns that keep the promise of proxy directives so often unrealized. Facing medically complex care of an incapacitated patient, health care teams are apt to view the proxy as a potentially indecisive or (...) unrealistically demanding decision-maker, less a stand-in for the patient than an interloper whose improper, misguided, or self-interested decisions will work against the patient's best interests. So perceived, proxies are routinely relegated to the edges of care planning discussions, left relatively uninformed and unconsulted, and then suddenly thrust center stage to face decisions they find overwhelming. Confronting such decisions, proxies need support and compassion. What they often find is isolation and distrust, a web of professional and institutional practices that trammel their efforts to understand and execute their role. (shrink)

People talk not only to others but also to themselves. The self talk we engage in may be overt or covert, and is associated with a variety of higher mental functions, including reasoning, problem solving, planning and plan execution, attention, and motivation. When talking to herself, a speaker takes devices from her mother tongue, originally designed for interpersonal communication, and employs them to communicate with herself. But what could it even mean to communicate with oneself? To answer that question, we (...) need a theory of communication that explains how the same linguistic devices may be used to communicate with others and oneself. On the received view, which defines communication as information exchange, self talk appears to be an anomaly, for it is hard to see the point of exchanging information with oneself. However, if communication is analysed as a way of negotiating commitments between speaker and hearer, then communication may be useful even when speaker and hearer coincide. Thus a commitment-based approach allows us to make sense of self talk as well as social talk. (shrink)

This article presents the findings from an exploratory empirical research investigation that assessed the content of selected Board Charters for 118 publicly traded companies listed on the TSX/S&P Composite Index. The Board Charter is considered to be the starting point in a Board's quest for creating a state of good governance within its organisation. However, the specific content of what a Board Charter actually contains has largely remained a mystery. The current study, therefore, was designed to identify what a typical (...) Board Charter looks like as well as determine the frequency with which various Board Charter elements are contained in them. Interestingly, this is the first study of its kind to shed light on the nature and content of this often confidential document which has only recently come into greater use. (shrink)

'Broadening Horizons: multidisciplinary approaches to landscape study' presents nine papers on physical landscape research in the Mediterranean and the Near East. Giving prime place to young researchers working in this field, it brings together highly diverse applications ranging from ground survey to semi-automated remote sensing, from cuneiform studies to palynology and from human geography to paradigm re-evaluation. Aimed at a public of both students and scholars with a shared interest in the study of past landscapes, its aims are dual. In (...) presenting ongoing research which applies various techniques available to the student of landscape, it aims to add to the practice of these sub-fields. As such it may also provide a first insight into the particular methodologies addressed. In addition, by extending its gaze beyond geographical, temporal or disciplinary constraints, 'Broadening Horizons' addresses the need for a continued awareness of the many different methods and conceptualisations existing in this field. It hopes to illustrate some of the highly diverse ways in which to approach physical landscapes of the past and, by doing so, stress once again the value of continued cooperation between the many specialisations that make up this ever-expanding area of research. This is a very positive endeavour to improve cross-discipline awareness and collaboration. It is organised as a multi-facetted reader highlighting some of the wide ranging ways in which the past landscapes of the Mediterranean and Near East can be approached. It provides a significant contribution to the field of landscape research, and should prove of value to specialists and beginning researchers alike, both for its specific topics and its multidisciplinary approach. The competency profile underlying higher nursing education in the Netherlands states that bachelor-prepared nurses are expected to be able to participate in ethics committees. What knowledge, skills and attitudes are involved in this participation is unclear. In five consecutive years, groups of two to three fourth-year (bachelor) nursing students conducted 8 to 11 semi-structured interviews each with nurses in ethics committees. The question was what competencies these nurses themselves say they need to participate in such committees. This article reports the (...) aggregate of the 52 interviews in these five studies. Regarding knowledge, the article reports on health law, ethics and professional knowledge. Regarding skills, communication is mentioned, as are professional skills and skills for ‘doing ethics’. An open and respectful attitude towards patients and fellow committee members is required, as well as commitment to patient care, committee work and professional ethics. The right attitude for a nurse in an ethics committee is said to include a reflective and perceptive attitude, along with an awareness of one’s own limitations and convictions. A detailed competency profile for nurses’ participation in ethics committees as outlined in the recommendations may serve nursing education, institutional committees and nurses themselves to meet the demands of nurses’ preparation for clinical ethics consultations. Abstract: The Gricean theory of conversational implicature has always been plagued by data suggesting that what would seem to be conversational inferences may occur within the scope of operators like believe , for example; which for bona fide implicatures should be an impossibility. Concentrating my attention on scalar implicatures, I argue that, for the most part, such observations can be accounted for within a Gricean framework, and without resorting to local pragmatic inferences of any kin d. However, there remains a (...) small class of marked cases that cannot be treated as conversational implicatures, and they do require a local mode of pragmatic interpretation. (shrink)

Background: Nurses require specific knowledge, skills and attitudes to participate competently in various forms of ethics meetings. The literature does not state the contents of the knowledge, skills and attitudes nurses need for ethics meetings. Without such a competency profile, it cannot be assessed in how far nurses actually possess these qualities for ethics meetings. Objective: Corroborating an existing profile of the requisite knowledge, skills and attitudes in the form of a questionnaire contributes to the development of a tool to (...) determine the competence nurses need for ethics meetings. Question: In how far can this profile be confirmed by a quantitative follow-up in a random sample? Design: A questionnaire was developed to determine in how far nurses with prior involvement in ethics meetings recognise the earlier competency profile as important and comprehensive. Participants: It was made available to subscribers of the digital newsletter of three widely read nursing journals in the Netherlands. Data collection and analysis took place in the spring of 2013. Ethical considerations: Care was taken to state explicitly in the questionnaire that participation in the survey was completely voluntary and anonymous. Findings: To a high degree, nurses with involvement in ethics meetings recognise the knowledge, skills and attitudes from the earlier interviews when presented as a survey. Discussion: Although the sample was small, the respondents and the results reflect known characteristics of nurses serving on ethics meeting. Conclusion: This may be helpful to recruit and prepare nurses for professional ethics in nursing care, and to develop a tool to assess to what extent nurses actually possess competence for ethics meetings. The secret ballot is considered a central feature of free and fair elections all over the world. While the reasons to uphold it seem to be overwhelming, we argue that the secret ballot is only second-best at best and that a modified version of open voting might prove to be more democratic. Instead of denying the various problems and difficulties that an open system might encounter, we want to offer a genuine proposal that can avoid these numerous pitfalls. After rehearsing (...) the various arguments pro and contra open voting, we draw attention to the role of shame, which has been neglected by both sides in the debate. While shame plays a pivotal role in the democratic argument pro open voting, it also brings out new problems that tell against opening up the vote. This means that, if we want to draw on the democratic potential of open voting, we will have to find a system that minimizes the undesirable effects of shame. In the third and final section, we will formulate a concrete proposal of open voting that we believe is more democratic than the current secret ballot and is able to avoid potential worries. Even if this proves to be highly speculative, it serves as an invitation for further empirical research. (shrink)

The aim of this paper is to describe the way in which argumentative patterns come into being in plenary debate over legislative issues in the European Parliament. What kind of argumentative patterns are to be expected within this macro context? It is shown that the argumentative patterns that come into being in legislative debate in the European Parliament depend for the most part on the problem-solving argumentation that is put forward in the opening speech by the rapporteur of the parliamentary (...) committee report. This argumentation can be pragmatic problem-solving argumentation or complex problem-solving argumentation. The most important prototypical argumentative patterns are investigated in the argumentation put forward by the Members of parliament. This investigation is based on an inventory of the arguments that can in principle be used to support or attack the initial problem-solving argumentation put forward by the rapporteur. (shrink)

The domain of a quantifier is determined by a variety of factors, which broadly speaking fall into two types. On the one hand, the context of utterance plays a role: if the focus of attention is on a particular collection of kangaroos, for example, then “Q kangaroos” is likely to range over the individuals in that set. On the other hand, the utterance itself will help to establish the quantificational domain, inter alia through presuppositions triggered within the sentence. In this (...) paper, we concentrate our attention on constructions like the following, in which “the square to which... ” is the critical presupposition trigger: Q circles... Q of these circles... Q of these five circles...... have the same colour as the square to which they are connected. Many theories predict that all instances of these schemata will give rise to the presupposition that every circle is connected to a square. We present an analysis which predicts that these sentences should generally be accepted in a context in which not all the circles are connected to a square, with one exception only: if a quantified sentence is of type and Q is non-intersective, then the sentence should be more likely to be rejected. Furthermore, we predict that manipulating the context so as to make the connected circles more or less salient should have an effect on statements with non-intersective quantifiers only. These predictions were tested in a series of experiments. (shrink)

There is a complicated relation between social and political inertia – the failure of institutions to respond adequately to social, technological and environmental change – and social acceleration – the tendency of social change to go faster and faster. Social stasis and acceleration are not simply opposed but also causally related. This article contrasts two theories of political and social inertia. Francis Fukuyama argues that political inertia is a result of a cognitive and institutional rigidity which is ultimately grounded in (...) human nature, and that therefore inertia is a feature inherent in political systems. Hartmut Rosa, by contrast, sees inertia as a specifically modern phenomenon, which is the result of the inability of political institutions to cope with the accelerating rate of change in other social systems. It will be argued that a broad approach combining historical, institutional and normative perspectives is needed to explain political inertia. (shrink)

Toulmin’s scheme for the layout of arguments (1958, The Uses of Argument, Cambridge University Press, Cambridge) represents an influential tool for the analysis of arguments. The scheme enriches the traditional premises-conclusion model of arguments by distinguishing additional elements, like warrant, backing and rebuttal. The present paper contains a formal elaboration of Toulmin’s scheme, and extends it with a treatment of the formal evaluation of Toulmin-style arguments, which Toulmin did not discuss at all. Arguments are evaluated in terms of a so-called (...) dialectical interpretation of their assumptions. In such an interpretation, an argument’s assumptions can be evaluated as defeated, e.g., when there is a defeating reason against the assumption. The present work builds on recent research on defeasible argumentation (cf. e.g. the work of Pollock, Reiter, Loui, Vreeswijk, Prakken, Hage and Dung). More specifically, the author’s work on the dialectical logic DEFLOG and the argumentation tool ARGUMED serve as starting points. (shrink)

Presuppositions are items of information triggered by certain words and constructions that exhibit ‘projection behaviour’, which is to say that, except in special cases, they will escape from any level of embedding. Presupposed information is given, or at least presented as such, and there are two main theories of what it means for presuppositions to be given. On one account, a presupposition must be entailed in the local context in which it is triggered; on the other, presuppositions require that certain (...) discourse entities be available in the context. On the latter account, but not on the former, anaphora is a special case of presupposition. It might be that both accounts are correct, though for different types of presupposition. (shrink)

This paper consists of two main parts and a coda. In the first part I present the ''binding theory'' of presupposition projection, which is the framework that I adopt in this paper (Section 1.1). I outline the main problems that arise in the interplay between presuppositions and anaphors on the one hand and attitude reports on the other (Section 1.2), and discuss Heim''s theory of presuppositions in attitude contexts (Section 1.3).In the second part of the paper I present my own (...) proposal. To begin with, I define an extension of DRT in which attitude reports can be represented (Sections 2.1–2.2). I then argue that the verb believe triggers a certain presupposition and that, given the binding theory, this presupposition determines the projection behaviour of the verb (Section 2.3). This analysis yields predictions which are incomplete in the sense that they do not fully account for speakers'' intuitions about presuppositions and anaphors in belief contexts. In Section 2.4 I suggest that this is as it should be because we may assume on independent grounds that there is a class of plausibility inferences which complement the predictions of the presupposition theory. Finally, the analysis is extended to the verb want (Section 2.5). (shrink)
