This article aims to deconstruct the concept of dignity in a way that is meaningful, in particular to nurses and other health workers who seek to promote the dignity of children in their care. Despite the emphasis in a variety of codes and policies to promote dignity, there is a lack of a clear definition of dignity in the literature. In particular there is little reference to dignity, theoretically or empirically, as it relates to children. Without clarity it is not (...) possible to act in an ethical way on behalf of children whose dignity could otherwise be compromised. The theoretical position taken has evolved from the medico-nursing and philosophical discourse concerning the nature of human dignity and more recent sociological texts that discuss the social construction of the child and childhood. The article is further influenced by additional insights derived from an ethnographic pilot study at a large district general hospital. This study was undertaken in an attempt to appreciate the subjective experience of dignity by children, and to begin to address the empirical gap in the literature and promote discussion. The concept of a macro and a micro dignity is discussed, together with the role of the nurse in articulating the relationship between the two. The importance of control and witnesses in the experience of dignity is discussed and, finally, also the ethical implications when seeking to promote the dignity of children. (shrink)

Charles Demuth is widely recognized as one of the most significant American modernists. His precisionist cityscapes, exquisite flowers, and free-wheeling watercolors of vaudeville performers, homosexual bathhouses, and cabaret scenes hang in many of the country's most prestigious collections, including the Metropolitan Museum of Art, the Philadelphia Museum of Art, the Columbus Museum of Art, the Amon Carter Museum in Fort Worth, the Art Institute of Chicago, and in Demuth's Lancaster, Pennsylvania, family residence, now home of the Demuth Foundation. At a (...) time when many American artists remained tied to Europe, Demuth "Americanized" European modernism. This collection of 155 of his letters offers valuable views of the arts and letters colonies in Provincetown, New York, and Paris. Besides offering information on Demuth's own works, the letters also shed light on the output of his contemporaries, as well as references to their trips, liaisons, and idiosyncrasies. Demuth numbered among his correspondents some of the most famous artists and writers of his time, inluding Georgia O'Keeffe, Eugene O'Neill, John Reed, Gertrude Stein, Alfred Stieglitz, Carl Van Vechten, and William Carlos Williams. In his travels in the United States and abroad, he encountered many other talented contemporaries: Peggy Bacon, Muriel Draper, Marcel Duchamp, the Stettheimer sisters, artists and writers, patrons, and gallery owners. Whether he is offering to pick up a copy of Joyce'sUlyssesfor Eugene O'Neill or trying to convince Georgia O'Keeffe to decorate his music room, Demuth is always in the thick of art and literary life. Flamboyant in attire but descreet in his homosexuality, Demuth also reveals in his letters the life of a talented homosexual in the teens and twenties. With his best friends Robert Locher and Marsden Hartley, he circulated through the art colonies of Greenwich Village, Provincetown, and Paris, meeting everyone. The book also contains reprints of some short appraisals of Demuth and his work that were published during his lifetime, long out of print, including pieces by A. E. Gallatin, Angela E. Feminist scholars have been critical of the expectations placed upon mothers to accomplish a perfect version of motherhood, but have often failed to interrogate the values about normalcy and disability imbedded in modern mothering ideologies. Mothers with disabilities are well positioned to expose the underlying beliefs about normalcy with which all mothers must contend. Drawing from interviews and focus groups conducted with mothers who have physical and sensory disabilities, I explore Deaf/disabled women’s experiences negotiating the scientific motherhood regime. Illuminating a (...) paradox, I argue these women are labeled “risky mothers” under scientific motherhood, which prizes the management of risk and the prevention of disability. Yet, these mothers are simultaneously rendered invisible by inaccessible and inflexible medical practices, and by a consumer market of expert advice which prescribes that mothers inhabit a typical body. These women’s experiences illuminate the normalcy project as a central tenet of scientific motherhood. (shrink)

Drawing on Hegel, Judith Butler argues that the subject is the product of its desire for subject-ion. The subject, its gender, and even the sexed body itself come into being through reiterating or parodying preexisting norms and discourses of power. Butler rejects the realities of substance and a fixed human nature that would limit the possibilities of performativity. I summarize and assess Butler’s proposals, highlighting both the value and the drawbacks of her theory. I then show how John Paul II’s (...) understanding of meaning and of the body as tasks takes up what is positive in Butler. He escapes the pitfalls of her thought, however, by retaining both metaphysics and revelation. He argues that the subject exists as substance or suppositum, which defends it against the encroachment of power. He also insists on the importance of human nature, which makes the human person to be the kind of substance who can form herself through the God-given task of creative action directed toward meaningful self-gift. Lastly, John Paul II emphasizes that the divine power of God enables the person to transcend the power dynamics of the culture of death. (shrink)

In Experience and the Absolute and other works, Jean-Yves Lacoste develops a phenomenology of a way of life he calls “liturgy,” in which one refuses one's being-in-the-world in favor of a more basic form of existence he calls “being-before-God.” In this essay I argue that if there is indeed such a thing as being-before-God, Lacoste has not sufficiently considered the possibility that it is characterized in part by a disturbance of one's being-in-the-world similar to, or perhaps even identical with, the (...) disruptive encounter with the human other that constitutes the self as responsible according to Levinas's unique notion of ethics. Lacoste's dismissal of Levinas, evidently based on a misunderstanding of what Levinas means by the word “ethics,” leads him to overlook the potential relevance of Levinas's ideas to his phenomenological project at a number of significant points in his work. The literary scene of Kant’s day goes unmentioned by philosophical commentators. Yet some of its salient features have a clear relation to his problems and positions, not demonstrably causal in every detail, but too close overall to be coincidence in the random sense. Kant’s critical view of society and his establishing of an independent aesthetic realm parallel the themes, and the arguments in self-defence, of contemporaneous radical writing; his discussion of how to exemplify ethical arguments bears on the general Enlightenment (...) problem of how to embody abstractions persuasively, while his theoretical and practical difficulties over written style have consequences for the reception of his own work, and were responsible for divisions among writers of the day who might otherwise have made common cause. All this adds a valuable dimension to our understanding of both Kant’s aesthetics and his time. (shrink)

This paper addresses some important questions related to ethical and human values that stem from the transition of Eastern European businesses to a market economy. While such a change has the potential for a tremendous redistribution of power and benefits in the societies involved, it also has its detrimental effects in terms of loss of wages, decline in security of life and a reduced standard of living for a significant number of people. The paper explores the problems and issues relating (...) to former state-owned firms and newly created companies under three broad headings: the manufacture and distribution of products; management and corporate governance; and rights, responsibilities and problems of workers. The author concludes by saying that while the transition to a market economy has broad support throughout Eastern Europe, it does not represent a painless solution. Moreover, it allows for the emergence of a range of moral problems. This complexity involved in addressing ethical issues lends itself to either of the two extreme tendencies-paralysis or creativity. The stance which Eastern Europeans take towards these problems will largely depend upon the 'moral resources' which they are able to muster up in addressing these issues. (shrink)

In this article, I review A Theory of Legal Personhood, explaining what I see as its key contributions to animal law scholarship, while situating it against wider jurisprudential contributions that may be of interest to philosophers and legal scholars grappling with the oft-thorny idea of legal personhood, not just for nonhuman animals but for corporations, artificially intelligent machines, and late-term fetuses. The article will explain Kurki's “bundle” theory of legal personhood as a “cluster” concept and analyze the extremely helpful parsing (...) his theory provides in terms of the active and passive “incidents” of legal personhood. I focus much of the piece on Kurki's view of legal “nonpersons” who nonetheless have some rights or incidents of personhood in order to help clarify the challenge Kurki's theory raises for Steven M. Wise and the Nonhuman Rights Project, as the issues surrounding those litigation efforts will likely be familiar to readers here, who will be wondering how this theory interacts with what Wise seeks to achieve. With the rise of globalization, the debate around free trade versus fair trade and liberalism versus protectionism has become increasingly complicated. At times, the regulations of the World Trade Organization seem to pit developed markets against emerging markets as governments attempt to expand international trade while at the same time protecting local industry. To this end, antidumping measures have been extensively developed as a way to block foreign low-cost goods from entering domestic markets. In response, some exporters have begun to (...) circumvent these antidumping measures using strategies such as transhipment, assembly operations, and slightly modified products. While previous studies have addressed the ethical aspects of antidumping measures, this study will focus on the ethics of circumvention strategies with a special focus on the theories on legal compliance and, specifically, civil disobedience and conscientious evasion. People are unable to report how they decide whether to move backwards or forwards to catch a ball. When asked to imagine how their angle of elevation of gaze would change when they caught a ball, most people are unable to describe what happens although their interception strategy is based on controlling changes in this angle. Just after catching a ball, many people are unable to recognise a description of how their angle of gaze changed during the catch. Some people (...) confidently choose incorrect descriptions that would guarantee failure of interception demonstrating unconscious knowledge co-existing with systematically different conscious beliefs. Where simple solutions to important evolutionary problems exist, unconscious perception needs to be impervious to conscious beliefs. (shrink)
