This book presents a comprehensive overview of what the criminal law would look like if organised around the principle that those who deserve punishment should receive punishment commensurate with, but no greater than, that which they deserve. Larry Alexander and Kimberly Kessler Ferzan argue that desert is a function of the actor's culpability, and that culpability is a function of the risks of harm to protected interests that the actor believes he is imposing and his reasons for acting in (...) the face of those risks. The authors deny that resultant harms, as well as unperceived risks, affect the actor's desert. They thus reject punishment for inadvertent negligence as well as for intentions or preparatory acts that are not risky. Alexander and Ferzan discuss the reasons for imposing risks that negate or mitigate culpability, the individuation of crimes, and omissions. (shrink)

In a recent article in this journal, Parker Crutchfield argues that if moral bioenhancement ought to be compulsory, as some authors claim, then it ought to be covert, i.e., performed without the knowledge of the population that is being morally enhanced. Crutchfield argues that since the aim of compulsory moral bioenhancement is to prevent ultimate harm to the population, compulsory moral bioenhancement is best categorized as a public health issue, and should therefore be governed by the norms and values that (...) apply in public health settings. In this article, I argue for two related claims. First, I question the extent to which compulsory moral enhancement should be considered a public health issue that ought to be governed by the norms and values that apply in public health settings. Second, I argue that Crutchfield's argument that covert moral bioenhancement would better respect people's autonomy than an overt program overlooks two important autonomy‐based reasons that, in fact, favor an overt moral enhancement program over a covert one. Machine learning, and more broadly artificial intelligence (AI), is a fascinating technology and can be considered as the closest approximation to the Cartesian “thinking thing” that humans have ever created. Just as the industrial revolution required a new ethos, the age of intelligent machines will create its own, challenging the established moral, economic, and political presuppositions. This paper discusses the relationship between AI and society; it presents several thought experiments to explore the complexity of the relationship and highlights the insufficiency (...) of the current normative paradigm in addressing technological expansion. I argue that many of the externalities, such as security risks, loss of privacy, and economic instability will result from trying to fit the emerging technologies into the existing frame of efficiency and utility, by redefining the notions of human value, identity, autonomy, purity, and truth, among others. The age of the intelligent machine is elevating alienation to new levels, treating the individual as mere patterns in data—its primary commodity. I further argue that while the possibility of unintended consequences, due to the potential misuse of AI is ever present, the intelligent machine per se is unlikely to engage in a zero-sum game for power on its own initiative. I question whether singularity is at all attainable and argue that technology will forever remain a proxy for human interests. I conclude by posing questions for charting the path forward. Through this analysis, I aim to provide a more nuanced understanding of the complex relationship between the AI and humans. (shrink)

An ongoing trend in technology policy has been to advocate participation. However, the author claims that lay citizens’ participation typically materializes in the form of a laboratory experiment at present. That is, lay participation as currently organized by professional participation experts under controlled conditions rarely is linked to public controversies, to the pursuit of political participation or to individual concerns. Derived from qualitative research on two citizen conferences, the author shows empirically that in practice, this laboratory participation leads to paradoxical (...) effects: successfully carrying out the experiment results in a systematic disappointment of the hope for gains in rationality typically attached to lay participation. Finally, the author relates this result to sociological debates about new modes of knowledge production. Under such a perspective, the author sees a paradoxical development: while society at large is becoming a laboratory in which knowledge is produced, participation practice is retreating from society into the lab. The mentioning of error-possibilities makes us less likely to ascribe knowledge. This paper offers a novel psychological account of this data. The account appeals to “subadditivity,” a well-known psychological tendency to judge possibilities as more likely when they are disjunctively described.

For some users the current Internet epoch can be considered the Internet of Hate which poses serious human rights concerns. Reflecting the scale and seriousness of the problem, innovations in governance tools for online hate have been initiated by national governments, intergovernmental organisations and Internet intermediaries across Europe in past years. -/- This study maps, explains and critically evaluates these emerging innovations covering three levels: moderation, oversight, and regulatory level. It reviews whether and how these innovations deliver a victim sensitive (...) approach; uphold human rights including freedom of expression and prohibition of discrimination; and fulfil goals, aims, values and expectations of governmental agencies, Internet platforms, civil society organisations and the general public when it comes to the governance of online hate speech. -/- The study identifies 30 indicators that could assess the success or progress of different governance tools for online hate speech and makes many practical recommendations covering ten key areas. Logical empiricism and the Austrian School of economics are two of the internationally most influential intellectual movements with Viennese roots. By and large independently of each other, both have been subject to detailed historical and philosophical investigations for the last two dec-ades. However, in spite of numerous connections and interactions be-tween the two groups, their relationship has captured surprisingly sparse attention. My dissertation focuses on the many-faceted juxtaposition of two supposedly antagonistic championsof Viennese Late Enlightenment: logical empiricist Otto Neurath and (...) Austrian economist Ludwig Mises. I rationally reconstruct and critically compare their epistemological, meth-odological, and economic positions and demonstrate that a closer look reveals more compatibilities and similarities than acknowledged by the received view and by the protagonists themselves. Over and above the historiographic task of challenging and amending this received view, the analytic components of my thesis inform contemporary debates in phi-losophy, politics, economics, and other sciences. In this paper I explore a new approach to the ethics of animal experimentation by conceiving of it as a form of rescue. The notion of rescue, I suggest, involves some moral agent performing an action or series of actions, whose end is to prevent or alleviate serious harm to another party, harm that otherwise would have occurred or would have continued to occur, had that moral agent not intervened. Animal experiments that are utilized as a means to alleviate human (...) illnesses mirror the structure of rescue cases and this means that we can and should apply principles of rescue to illuminate the moral status of animal experimentation. To do this I consider various principles of rescue that might justify animal experimentation. I’ll argue that all of these rescue principles are either not independently plausible, or else they fail to imply that animal experimentation is morally justified. This suggests that it is quite difficult to morally justify animal experimentation when conceived as a form of rescue. (shrink)

Must we obtain a patient’s consent before posthumously removing her organs? According to the consent requirement, in order to permissibly remove organs from a deceased person, it is necessary that her prior consent be obtained. If the consent requirement is true, then this seems to rule out policies that do not seek and obtain a patient’s prior consent to organ donation, while at the same time vindicating policies that do seek and obtain patient consent. In this paper, however, I argue (...) that once we recognize the difference between consent, on the one hand, and wishing or desiring, on the other, we will see that obtaining consent before organ removal is neither necessary nor sufficient to respect patient autonomy in organ procurement. Summary The article examines unofficial imperial nicknames, sobriquets and appellatives, from Octavian Augustus to Julian the Apostate, in the light of traditions of Roman political humour, and argues that in the political field during the Principate there were two co-existing competing modes of emperors’ naming: along with an official one, politically loyal, formalised and institutionally legitimised, there existed another – unofficial, sometimes oppositional and even hostile towards individual emperors, frequently licentious, humorously coloured and, in this regard, deeply rooted in Roman (...) Republican traditions of political humour. Many of the known imperial nicknames and appellatives belong to a specific kind of folklore and express popular public opinion. They survived for us because of ancient authors’ interest in using such material for their literary and ideological intentions, particularly to express better the individual characteristics of the historical personages. But, for the very same purposes, Greek and Roman writers could invent some names and sobriquets, following special rhetorical and moralising principles, or mere love of ridicule. All in all, most imperial nicknames, both authentic and made-up, reveal a rather good quality of humour and mockery constructed by expressive linguistic devices and various rhetorical tropes. An apt derisive nickname marked anti-values, mocked the ruler’s badness and could vilify his reputation to the extreme, stigmatise his personality, or else become a widely-used quasi-cognomen. Many nicknames and appellatives were of ephemeral, ad hoc nature, their sense and effect largely dependent on the particular context; but, taken as a whole, they demonstrate the possible scope of and common trends in naming practice. The political system of the Principate and its very atmosphere of hypocrisy did promote double meaning and double thinking reflected in the double system of the rulers’ nomenclature. Imperial nicknames were a counter-hegemonic transcript and a weapon in the struggle for symbolic capital. All the efforts which many emperors took to control their nomina were ultimately powerless against the strength of the inevitable humorous counter-naming by the ruled. (shrink)

This primarily diagnostic paper offers, from the perspective of relational egalitarianism, a normative analysis of three major injustices in the context of adaptation finance. Adaptation finance includes payments provided by the affluent countries of the Global North to low-income countries in the Global South, countries particularly exposed to the harms of climate change. Relational egalitarianism is the normative view that interactions between people and between institutions have to respect the equal moral status of every human being. The first injustice, from (...) this perspective, consists in the sheer fact that adaptation measures are required at all to deflect harm from people who did not significantly contribute to the causes of climate change. The second injustice consists in the persisting, even increasing adaptation finance gap, as countries of the Global North do neither provide adequate financial means to reduce climate risks, nor even fulfil their commitments to adaptation finance pledged in the Copenhagen Accord in 2009. The third injustice emerges from current procedures to determine criteria for distributing scarce financial resources that consolidate structural injustice. The paper concludes by providing the contours of a practical response to these injustices that respects the demands of relational egalitarianism. (shrink)

Diese neueste Buchveröffentlichung von Professor Vincenzo RUGGIERI SJ, der am Pontificio Istituto Orientale in Rom byzantinische Archäologie und byzantinische Geschichte lehrt, stellt einige archäologische byzantinische Stätten aus seinem traditionellen Forschungsgebiet in der historischen Kirchenprovinz Karien vor, die im westlichen Kleinasien gelegen war. Hier wartet R. nun zum größten Teil mit von ihm selbst aufgefundenen und erforschten Monumenten auf und das vorgelegte Werk kann als die geographisch nördliche Fortsetzung der im selben Verlag bereits im Jahre 2003 erschienenen stattlichen und sehr umfangreichen (...) Monographie über die frühchristlichen und byzantinischen Denkmäler am Golf von Keramos (V. RUGGIERI, Il golfo di Keramos. Dal tardo-antico al medioevo bizantino. Soveria Mannelli 2003. 441 S.; vgl. dazu nun auch die Rezension von: M. DENNERT, Oriens Christianus 89 (2005), 295–297.) begriffen werden – dieser Meeresarm gehört übrigens auch zu Karien. Zugrunde liegen beiden Buchpublikationen Ergebnisse etlicher in den 1990er Jahren durchgeführter systematischer Geländebegehungen (‚Surveys‘) des Forschungsteams um R., von denen an einigen auch der Verfasser dieser Zeilen mitgewirkt hat; vgl. A. Zäh, OCP 63 (1997) 147 ff. Die hier vorgestellten bisher zum größten Teil neu aufgefundenen und hiermit bekannt gemachten byzantinischen Denkmäler sind auf der Halbinsel von Halikarnassos (heute: Bodrum) und im westlichen Karien (Myndos, Bargylia) gelegen – des Weiteren werden hier einige Binnen-Orte in Zentralkarien (Euromos, Mylasa, Labraunda, Stratonikeia und Lagina) und viele weitere kleinere Fundorte vorgestellt. Die großen historischen Stätten des nördlichen Karien, wie Milet, Aphrodisias (Stauroúpolis) oder Antiocheia ad Meandrum, werden nicht behandelt. Die hier vorgeführten Orte und Regionen verfügen über eine stattliche Anzahl von Denkmälern, die nun nicht minder bedeutender sind als der Denkmälerbestand am Golf von Keramos, und das mag damit die hier vorgelegte zusammenfassende weitere monographische Abhandlung rechtfertigen. Denn das Werk fasst die wesentlichen Ergebnisse der Ruggieri-Forschungen der 1990er Jahre zusammen, die bisher über diverse JÖB- und OCP-Artikel verstreut erschienen sind (im Literaturverzeichnis Bibliografia S. 32 f. teilweise aufgeführt) und aus, einschränkend erst im Untertitel genannten, diversen Poleïs und deren Umland in Karien stammen. Das Buch bringt aber im Gegensatz zu diesen Artikeln auch gute farbige Abb. der hier entdeckten byzantinischen Wandmalereien und führt ebenso diverse Fußbodenmosaike und Bauskulpturfragmente erneut – zum Teil allerdings bisher auch völlig unbekanntes Material – in übersichtlicher Art und Weise vor. Das Werk ist als eine Gesamtschau der Ruggieri-Entdeckungen in diesem Gebiet anzusprechen. R. ist dem Kleinasien-Kenner seit langem als ein detailverliebter Beobachter und Auffinder sowie hartnäckiger Initiator und fortwährend laufender verlässlicher Motor einer planmäßigen christlichen kunstgeographischen Erschließung nicht nur dieser Region bekannt – wie es auch diese Publikation eindringlich veranschaulicht. This paper examines the existence of strategic solutions to finite normal form games under the assumption that strategy choices can be described as choices among lotteries where players have security- and potential level preferences over lotteries (e.g., Cohen, Theory and Decision, 33, 101–104, 1992, Gilboa, Journal of Mathematical Psychology, 32, 405–420, 1988, Jaffray, Theory and Decision, 24, 169–200, 1988). Since security- and potential level preferences require discontinuous utility representations, standard existence results for Nash equilibria in mixed strategies (Nash, Proceedings of (...) the National Academy of Sciences, 36, 48–49, 1950a, Non-Cooperative Games, Ph.D. Dissertation, Princeton University Press, 1950b) or for equilibria in beliefs (Crawford, Journal of Economic Theory, 50, 127–154, 1990) do not apply. As a key insight this paper proves that non-existence of equilibria in beliefs, and therefore non-existence of Nash equilibria in mixed strategies, is possible in finite games with security- and potential level players. But, as this paper also shows, rationalizable strategies (Bernheim, Econometrica, 52, 1007–1028, 1984, Moulin, Mathematical Social Sciences, 7, 83–102, 1984, Pearce, Econometrica, 52, 1029–1050, 1984) exist for such games. Rationalizability rather than equilibrium in beliefs therefore appears to be a more favorable solution concept for games with security- and potential level players. (shrink)

Many legal jurisdictions permit victims of targeted hate speech to sue for damages in civil courts. In the US plaintiffs may sue for damages using the tort of intentional infliction of emotional distress. Indeed, back in 1982 Richard Delgado proposed the introduction of a new tort of racial insult to handle such cases. In South Africa plaintiffs can use the delict of injuria. Although there have been some successful lawsuits, the tort of intentional infliction of emotional distress has been an (...) unreliable means of recovering damages for psychological harms caused by targeted hate speech. One major obstacle to recovery in the US has been the tendency of courts to view the use of racial insults, for instance, as too ordinary or commonplace to count as ‘extreme and outrageous conduct’. Even Delgado’s tort of racial insult would not recognise as a cause of action the mere use of a racial insult; the insult must demean. But once again this opens up significant leeway for courts to treat many commonplace racial insults as non-demeaning. In South Africa the courts have interpreted the delict of injuria using the abstract test of whether the speech ‘impaired the plaintiff’s dignity’. The open-textured nature of this test has led courts to diverge in their understanding of the dignitary threat posed by almost identical forms of hate speech. In this article I argue that these two torts and one delict should be comprehensively rethought. At the level of theory, we should think of them as protecting people’s fundamental rights to human dignity and the expression of human dignity as well as people’s fundamental rights to civic dignity and confidence in their civic dignity. And, at the level of practice, courts should adopt what I am proposing as two new legal tests for degradation and humiliation as a way of interpreting and operationalising these two torts and one delict in cases of targeted hate speech. Despite advances in treatments over the last decades, a uniformly reliable and free of side effects therapy of human cancers remains to be achieved. During chromosome replication, a premature halt of two converging DNA replication forks would cause incomplete replication and a cytotoxic chromosome nondisjunction during mitosis. In contrast to normal cells, most cancer cells bear numerous DNA deletions. A homozygous deletion permanently marks a cell and its descendants. Here, we propose an approach to cancer therapy in which a pair (...) of sequence‐specific roadblocks is placed solely at two cancer‐confined deletion sites that are located ahead of two converging replication forks. We describe this method, termed “replication blocks specific for deletions” (RBSD), and another deletions‐based approach as well. RBSD can be expanded by placing pairs of replication roadblocks on several different chromosomes. The resulting simultaneous nondisjunctions of these chromosomes in cancer cells would further increase the cancer‐specific toxicity of RBSD. (shrink)
