This chapter examines the relationship between political re-burials and emergent nationalism in contemporary Israel. The re-burials include the bodily remains of important Zionist leaders and others who died in the Jewish Diaspora, and who were re-buried at the state's major ceremonial site, Mount Herzl in Jerusalem, as well as the bones of famed Jewish saints who were buried in Morocco and whose remains were later brought to Israel. Attention is also given to the conflicts between Israeli archaeologists and the ultra-orthodox (...) leadership regarding bones that are uncovered in archaeological research. The chapter concludes that the Israeli obsession with bones' is an expression of the current political-cultural struggles between different Israeli élite. (shrink)

The 'content view', in slogan form, is 'Perceptual experiences have representational content'. I explain why the content view should be reformulated to remove any reference to 'experiences'. I then argue, against Bill Brewer, Charles Travis and others, that the content view is true. One corollary of the discussion is that the content of perception is relatively thin (confined, in the visual case, to roughly the output of 'mid-level' vision). Finally, I argue (briefly) that the opponents of the content view are (...) partially vindicated, because perceptual error is due to false belief. (shrink)

This article argues that lingering uncertainty about the normative foundations of research ethics is perpetuated by two unfounded dogmas of research ethics. The first dogma is that clinical research, as a social activity, is an inherently utilitarian endeavor. The second dogma is that an acceptable framework for research ethics must impose constraints on this endeavor whose moral force is grounded in role-related obligations of either physicians or researchers. This article argues that these dogmas are common to traditional articulations of the (...) equipoise requirement and to recently articulated alternatives, such as the non-exploitation approach. Moreover, important shortcomings of these approaches can be traced to their acceptance of these dogmas. After highlighting these shortcomings, this article illustrates the benefits of rejecting these dogmas by sketching the broad outlines of an alternative called the "integrative approach" to clinical research. The prevailing discourse around AI ethics lacks the language and formalism necessary to capture the diverse ethical concerns that emerge when AI systems interact with individuals. Drawing on Sen and Nussbaum’s capability approach, we present a framework formalizing a network of ethical concepts and entitlements necessary for AI systems to confer meaningful benefit or assistance to stakeholders. Such systems enhance stakeholders’ ability to advance their life plans and well-being while upholding their fundamental rights. We characterize two necessary conditions for morally (...) permissible interactions between AI systems and those impacted by their functioning, and two sufficient conditions for realizing the ideal of meaningful benefit. We then contrast this ideal with several salient failure modes, namely, forms of social interactions that constitute unjustified paternalism, coercion, deception, exploitation and domination. The proliferation of incidents involving AI in high-stakes domains underscores the gravity of these issues and the imperative to take an ethics-led approach to AI systems from their inception. Theories and Narratives will interest all readers for whom the role of history in the understanding of contemporary civilizations is an essential issue.

After criticizing three common conceptions of therelationship between practical ethics and ethical theory, analternative modeled on Aristotle's conception of the relationshipbetween rhetoric and philosophical ethics is explored. Thisaccount is unique in that it neither denigrates the project ofsearching for an adequate comprehensive ethical theory norsubordinates practical ethics to that project. Because the purpose of practical ethics, on this view, is tosecure the cooperation of other persons in a way that respectstheir status as free and equal, it seeks to influence thejudgments (...) of others by providing them with reasons that areaccessible to their own understanding. On this account, theindependence of practical ethics is rooted in an appreciation ofthe constraints that non-ideal circumstances place on the rolethat the philosophically refined premises of moral theory canplay in such public deliberations. Practical and philosophicalethics are united, not by shared theoretical frameworks orprinciples, but by the need to exercise intelligently the sameintellectual and affective capacities. They are separated, notby the particularity or generality of their starting points, butby their responsiveness to the practical problem of facilitatingsound normative deliberations among persons as we find them,under non-ideal circumstances. There is near universal agreement within the scientific and ethics communities that a necessary condition for the moral permissibility of cross-national, collaborative research is that it be responsive to the health needs of the host community. It has proven difficult, however, to leverage or capitalize on this consensus in order to resolve lingering disputes about the ethics of international medical research. This is largely because different sides in these debates have sometimes provided different interpretations of what this requirement amounts to (...) in actual practice. The goal of the discussion that follows is to clarify the nature of this important moral requirement. The first section explains the requirement for responsiveness to host community health needs in the context of international medical research. The second section examines various formulations of this requirement as they are enunciated in some of the core consensus documents in research ethics. The third section then defends a particular interpretation of this requirement, and the final sections examine more liberal alternatives with the aim of highlighting points of agreement and assessing the significance of areas of disagreement. There is only one physically possible process that builds and operates purposive systems in nature: natural selection. What it does is build and operate systems that look to us purposive, goal directed, teleological. There really are not any purposes in nature and no purposive processes ether. It is just one vast network of linked causal chains. Darwinian natural selection is the only process that could produce the appearance of purpose. That is why natural selection must have built and must continually (...) shape the intentional causes of purposive behavior. Fodor’s argument against Darwinian theory involves a biologist’s modus tollens which is a cognitive scientist’s modus ponens. Assuming his argument is valid, the right conclusion is not that Darwin’s theory is mistaken but that Fodor’s and any other non-Darwinian approaches to the mind are wrong. It shows how getting things wrong in the philosophy of biology leads to mistaken conclusions with the potential to damage the acceptance of a theory with harmful consequences for human well-being. Fodor has shown that the real consequence of rejecting a Darwinian approach to the mind is to reject a Darwinian theory of phylogenetic evolution. This forces us to take seriously a notion that otherwise would not have much of a chance: that when it comes to the nature of mental states, indeterminacy rules. This is an insight that should have the most beneficial impact on freeing cognitive neuroscience from demands on the adequacy of its theories that it could never meet. (shrink)

Nine issues of fundamental importance for business ethics are examined with a view to encouraging researchers in the field to direct their attention to them in the 1990s and beyond. The issues are related to organized labour, social dumping, international finance and Third World debt, tobacco promotion, arms trade, wealth concentration and taxation, pollution and resource depletion, international trading blocks, and the Canadian Business Council on National Issues and other business organizations.

This article addresses the question of whether the relation of moral preference is transitive. I argue, following Larry Temkin and Stuart Rachels, that any ethical theory complex enough to be even minimally plausible allows us to generate intransitive sets of preferences. Even act utilitarianism cannot avoid this predicament unless we accept its least plausible version. We must reevaluate the assumption that an ethical theory must be transitive in order to be rational. This problem amounts to a foundational crisis in ethics. (...) However, it has not been taken seriously for two reasons—the belief that the problem has limited scope; and the claim that arguments against transitivity are 'merely' Sorites arguments. This article responds to both of these objections. I also point out some connections between intransitivity and the debate surrounding skepticism about the moral significance of numbers. (shrink)

Stakeholders in global health, including governments, international and nongovernmental organizations, and corporations, face complex decisions about how to help improve the lives of those most burdened by sickness and disease while upholding their rights and facilitating the transition to a more just social and political order. In “The Case for Resource-Sensitivity: Why It Is Ethical to Provide Cheaper, Less Effective Treatments in Global Health,” Govind Persad and Ezekiel Emanuel argue that “[t]he provision of health care in developing countries should reflect (...) what best balances utility, equality, and priority to the least advantaged in those countries.” This positive proposal faces several difficulties. For one thing, it is not clear that these are the only relevant values, and moreover, even if we assume that they are, we do not know what global health policies these values rule out because conflict between the values is pervasive. A short obituary of the philosopher Philippa Foot.

This paper argues that bioethics requires analysis, which is not explicitly ethical in character. The first part of the paper argues the general point, that ethical problems can arise not only on occasions when moral values make conflicting recommendations, but also in understanding the facts. I suggest that this is particularly so where the facts are provided by the biomedical sciences, since it is often not clear how to relate their conceptual framework to that in which we frame our value (...) judgements. In the second part, I illustrate the argument by criticizing the moral conclusions drawn by the authors of a recent widely publicized study of paediatric obesity. There is a failure to translate properly these results into the language we use for moral evaluation. The case therefore illustrates exactly the analytic gap which I suggest bioethics might do more to fill. (shrink)

With each superintuitionistic propositional logic L with a disjunction property we associate a set of modal logics the assertoric fragment of which is L . Each formula of these modal logics is interdeducible with a formula representing a set of rules admissible in L . The smallest of these logics contains only formulas representing derivable in L rules while the greatest one contains formulas corresponding to all admissible in L rules. The algebraic semantic for these logics is described.

This book examines the development and fundamental nature of legal pluralism. Legal pluralism evokes two distinctions: 'state' vs 'non-state' law; and 'law' vs 'non-law'. As such, although this book focuses upon circumstances where two or more legal orders compete to govern the same social space, it also addresses the nature of law in general. Drawing on material conflicts arising within jurisdictions such as Australia, Burundi, Cameroon, Gambia, the United States, and Zambia, this book explores the conceptual, moral, and political challenges (...) that legal pluralism creates. Emphasising that non-state law carries no less dignity than that often ascribed to the legal orders of contemporary states, it advances a theoretically sophisticated argument in favour of recognising and respecting genuine cases of legal pluralism, wherever they arise. Accessible and thought provoking, this book will appeal to legal scholars, anthropologists, sociologists, and political and social philosophers as well as practising lawyers, judges, and policy makers who deal with issues of legal pluralism. Suddendorf & Corballis (S&C) claim that mental time travel has significantly affected human cultural change. This echoes a common criticism of theories of Darwinian cultural evolution: that, whereas evolution is blind, culture is directed by people who can foresee and plan for future events. Here I argue that such a claim is premature, and more rigorous tests of S&C's claim are needed.

In celebration of Einstein's remarkable achievements in 1905, this essay examines some of his views on the role of “intellectuals” in developing and advocating socio-economic and political positions and policies, the historical roots of his ethical views and certain aspects of his philosophy of science. As an outstanding academic and public citizen, his life and ideas continue to provide good examples of a life well-used and worth remembering.

This paper is a set of comments on papers from the Third Shanghai International Conference on Business Ethics, October 29–30, 2010, Shanghai, China. I would like to thank the organizers of this conference for the opportunity to share some of my observations on some of the papers presented. As a result of some serious health problems, I could not make the conference and engage in the discussions. However, I am glad to be able to make some comments on a subset (...) of the papers that the adjudication committee thought should go into this collection. Some excellent papers were not included in the collection because they did not fit the scope of the Asian Journal of Business Ethics . So nothing in my comments should be regarded as any kind of comment on papers not mentioned here. I hope I can add some value to the good work already displayed in these papers.
