The COVID-19 pandemic has both exposed and created deep rifts in society. It has thrust us into deep ethical thinking to help justify the difficult decisions many will be called upon to make and to protect from decisions that lack ethical underpinnings. This paper aims to highlight ethical issues in six different areas of life highlighting the enormity of the task we are faced with globally. In the context of COVID-19, we consider health inequity, dilemmas in triage and allocation of (...) scarce resources, ethical issues associated with research, ethical considerations relating to tracing apps, and exit strategies such as immunity passports and COVID-19 vaccines. Finally, we consider environmental issues in light of COVID-19. The paper also offers some ethical reflection on these areas as many parts of the world contemplate the recovery phase. (shrink)

The proposal to create a chamber selected by sortition would extend this democratic procedure into the legislative branch of government. However, there are good reasons to believe that, as currently conceived by John Gastil and Erik Olin Wright, the proposal will fail to realize sufficiently two fundamental democratic goods, namely, political equality and deliberative reasoning. It is argued through analysis of its historic and contemporary application that sortition must be combined with other institutional devices, in particular, rotation of membership and (...) limited mandate, in order to be democratically effective and to realize political equality and deliberative reasoning. An alternative proposal for a responsive sortition legislature is presented as more realistic and utopian: one that increases substantially the number of members, makes more extensive use of internal sortition and rotation, and recognizes the importance of establishing limited mandates. I review some recent work on applications of category theory to questions concerning theoretical structure and theoretical equivalence of classical field theories, including Newtonian gravitation, general relativity, and Yang-Mills theories.

Neural correlates of consciousness (NCC) are neural states or processes correlated with consciousness. The aim of this article is to present a coherent explanatory model of NCC that is informed by Thomas Aquinas’s human ontology and Aristotle’s metaphysics of causation. After explicating four starting principles regarding causation and mind-body dependence, I propose the Mind-Body Powers model of NCC.

With the waves of reform occurring in mental health legislation in England and other jurisdictions, mental capacity is set to become a key medico-legal concept. The concept is central to the law of informed consent and is closely aligned to the philosophical concept of autonomy. It is also closely related to mental disorder. This paper explores the interdisciplinary terrain where mental capacity is located. Our aim is to identify core dilemmas and to suggest pathways for future interdisciplinary research. The terrain (...) can be separated into three types of discussion: philosophical, legal and psychiatric. Each discussion approaches mental capacity and judgmental autonomy from a different perspective yet each discussion struggles over two key dilemmas: whether mental capacity and autonomy is/should be a moral or a psychological notion and whether rationality is the key constitutive factor. We suggest that further theoretical work will have to be interdisciplinary and that this work offers an opportunity for the law to enrich its interpretation of mental capacity, for psychiatry to clarify the normative elements latent in its concepts and for philosophy to advance understanding of autonomy through the study of decisional dysfunction. The new pressures on medical and legal practice to be more explicit about mental capacity make this work a priority. (shrink)

The following suggestions for the interpretation of Parmenides and Melissus can be grouped for convenience about one problem. This is the problem whether, as Aristotle thought and as most commentators still assume, Parmenides wrote his poem in the broad tradition of Ionian and Italian cosmology. The details of Aristotle's interpretation have been challenged over and again, but those who agree with his general assumptions take comfort from some or all of the following major arguments. First, the cosmogony which formed the (...) last part of Parmenides' poem is expressly claimed by the goddess who expounds it to have some measure of truth or reliability in its own right, and indeed the very greatest measure possible for such an attempt. Second, the earlier arguments of the goddess prepare the ground for such a cosmogony in two ways. For in the first place these arguments themselves start from assumptions derived from earlier cosmologists, and are concerned merely to work out the implications of this traditional material. And, in the second place, they end by establishing the existence of a spherical universe: the framework of the physical world can be secured by logic even if the subsequent introduction of sensible qualities or ‘powers’ into this world marks some decline in logical rigour. Why do people who disagree about one subject tend to disagree about other subjects as well? In this paper, we introduce a model to explore this phenomenon of ‘epistemic factionization’. Agents attempt to discover the truth about multiple propositions by testing the world and sharing evidence gathered. But agents tend to mistrust evidence shared by those who do not hold similar beliefs. This mistrust leads to the endogenous emergence of factions of agents with multiple, highly correlated, polarized beliefs.

A leading contemporary theory of consciousness in theoretical neuroscience apparently shares significant common ground with a philosophical system of thought from Antiquity. Although chronologically disparate, the integrated information theory of consciousness and Aristotelian metaphysics seem to be akin with regards to fundamental ontology, epistemic priority, and causal powers. In this article, I explore these areas of common ground. Additionally, I consider an apparent dissimilarity regarding panpsychism and suggest that an Aristotelian understanding of powers provides a natural way for IIT to (...) reasonably regulate its ascription of consciousness. Kant's remark may sound harsh to our modern sensibility but it raises an issue that is central to an understanding of Nietzsche's critique of "the democratic movement of our times" (BGE 203) and, thus, to an understanding of Nietzsche's salience for contemporary democratic theory. This issue is self-respect—and, more generally, the topic of duties to oneself. The relationship between this issue and democratic theory may not appear a wholly obvious one but, on Nietzsche's account, it is crucial to the kind (...) of equality that is expressed by democratic practices. Nietzsche's concern, I'll argue, is that "the democratic movement of our times" expresses a levelling mode of equality that undermines the conditions of self-respect in the relevant sense. Consequently, the aim of this article will be to elucidate Nietzsche's understanding of self-respect, to clarify the grounds on which he attacks "the democratic movement of our times" and to consider the relationship between these arguments and his advocacy of the agon as a model of cultural and political relations. It concludes by drawing out the implications of this interpretation of Nietzsche for democratic theory. (shrink)

It is now nearly axiomatic among Platonic scholars that the Timaeus and its unfinished sequel the Critias belong to the last stage of Plato's writings. The Laws is generally held to be wholly or partly a later production. So, by many, is the Philebus, but that is all. Perhaps the privileged status of the Timaeus in the Middle Ages helped to fix the conviction that it embodies Plato's maturest theories.

The causal pairing problem allegedly renders nonphysical minds causally impotent. This article demonstrates how a dualist view I call neo-Thomistic hylomorphism can circumnavigate the causal pairing problem. After explicating the problem and hylomorphism, I provide an account of causal pairing that appeals to a foundational tenet of hylomorphism. Subsequently, I suggest that a prominent view of consciousness in theoretical neuroscience—the integrated information theory—can learn from hylomorphism and likewise account for causal pairing.

In their response to ‘Public interest in health data research: laying out the conceptual groundwork’, Grewal and Newson critique us for inattention to the law and putting forward an impracticably broad conceptual understanding of public interest. While we agree more work is needed to generate a workable framework for Institutional Review Boards/Research Ethics Committees, we would contend that this should be grounded on a broad conception of public interest. This broadness facilitates regulatory agility, and is already reflected by some current (...) frameworks such as that found in the guidelines approved under Australia’s Privacy Act. It remains unclear which elements of our broad account Grewal and Newson would reject, or indeed where the substantive disagreement with our position lies. (shrink)

The status of the geodesic principle in General Relativity has been a topic of some interest in the recent literature on the foundations of spacetime theories. Part of this discussion has focused on the role that a certain energy condition plays in the proof of a theorem due to Bob Geroch and Pong-Soo Jang [“Motion of a Body in General Relativity.” Journal of Mathematical Physics16(1) (1975)] that can be taken to make precise the claim that the geodesic principle is a (...) theorem, rather than a postulate, of General Relativity. In this brief note, I show, by explicit counterexample, that not only is a weaker energy condition than the one Geroch and Jang state insufficient to prove the theorem, but in fact a condition still stronger than the one that they assume is necessary. Chapter 51 focuses on the subjective side of alcoholism, specifically about what memoirs of alcoholism teach about alcoholism, and argue that a common theme in many memoirs is that drinking, sometimes heavy drinking, a prerequisite of addiction, was modelled, endorsed, and eventually achieved in a way that involves deep identification, and also argues that alcoholic memoirs, even assuming that they suffer from objectivity problems such as the latter, nonetheless serve an important function, and not just whatever cathartic function they serve (...) for the author. This paper examines Nuti’s accounts of structural injustice and historical injustice in the light of a political dilemma that confronted Young’s work on structure injustice. The dilemma emerges from a paradox that can be stated simply: justly addressing structural injustice would require that those subject to structural injustice enjoy the kind of privileged position of decision-making power that their being subject to structural injustice denies them. The dilemma thus concerns how to justly address structural injustice. I argue that Nuti’s account (...) is currently unable to provide an adequate theorization of how to address this dilemma because it lacks an account of political solidarity, but also that her account provides important resources for dissolving a dispute between two competing theories of solidarity in a way that facilitates the articulation of an account of political solidarity that is adequate to addressing the political dilemma. Until recently, philosophical scholarship has not been kind to Hume’s arguments in “Of scepticism with regard to reason” (A Treatise of Human Nature, 1.4.1). [1] Reid gives the negative arguments a pretty rough ride, though in the end he agrees with Hume’s conclusion that reason cannot be defended by reason.[2] Stove’s comment that the argument is “not merely defective, but one of the worst arguments ever to impose itself on a man of genius” (Stove 1973), while extreme, is not untypical. Many important books on Hume (e.g. Stroud 1977) simply ignore it, though this may be because it is difficult to find any trace of the arguments in the Enquiry Concerning the Human Understanding.[3] Furthermore, when attention was paid to the arguments, it was devoted mainly to the second of the two negative arguments Hume puts forward, and that argument was held to contain an elementary mistake concerning beliefs about beliefs (McNabb 1951). This paper suggests that genealogy is an exemplary form of critique. The stakes of this argument are established in the course of on intial response to critics of genealogy such as Habermas and Fraser throght the distinguishing of legislative and exemplary forms or critique. The essay then goes on to to show how Foucault's central concern, namely, the relation of humanism and bio-power, leads him to articulate an ethics of creativity which exhibits an ethods of ironic heroization and discloses a (...) conception of the political as agon. Reflecting on these features of genealogy's saying, it is argued that the form of genealogical reflection manifests these features. This emphasis on the showing of genealogy leads to the claim that Foucault's anti-humanism, mode of historical consciousness and perspectivism reproduce the substantive commitment of genealogy to the value of autonomy within the structure of genealogical reflection. Assessment of decision-making capacity (DMC) can be difficult in acquired brain injury (ABI) particularly with the syndrome of organic personality disorder (OPD) (the “frontal lobe syndrome”). Clinical neuroscience may help but there are challenges translating its constructs to the decision-making abilities considered relevant by law and ethics. An in-depth interview study of DMC in OPD was undertaken. Six patients were purposefully sampled and rich interview data were acquired for scrutiny using interpretative phenomenological analysis. Interview data revealed that awareness of deficit (...) and thinking about psychological states can be present. However, the awareness of deficit may not be “online” and effectively integrated into decision-making. Without this online awareness of deficit the ability to appreciate or use and weigh information in the process of deciding some matters appeared absent. We argue that the decision-making abilities discussed are: (1) necessary for DMC, (2) threatened by ABI, and (3) assessable at interview. Some advice for practically incorporating these abilities within assessments of DMC in patients with OPD is outlined. (shrink)

Global Justice and Avant-Garde Political Agency is, first and foremost, a manifesto for an approach to political philosophy*what Ypi calls ‘activist political theory’*and can, I think, be best understood as an attempt to disturb analytic political philosophy from its ‘dogmatic slumber’ and motivate its movement towards the tradition of critical theory. In the first section of this commentary, I will lay out the grounds for this view. Having thus sketched an account of the point and purpose of this text, I (...) will then focus on the relationship of both the methodological and the substantive arguments on global justice to the question of power. At a methodological level, I will argue that Ypi does not take the significance of power sufficiently seriously as an issue for political theory with emancipatory intent. With regard to her substantive arguments concerning global justice and state power, I will argue that she does not adequately address the character of power as a positional good because the analysis does not operate at the fundamentally appropriate institutional level of analysis. This article draws on ethnographic data from a field leading university licensing office to document and explain a key step in the process of institutionalization, the abstraction of standardized rules and procedures from idiosyncratic efforts to collectively resolve pressing problems. I present and analyze cases where solutions to complicated quandaries become abstract bits of professional knowledge and demonstrate that in some circumstances institutionalized practices can contribute to the flexibility of expert reasoning and decision-making. In this setting, expertise is rationalized in (...) response to institutional tensions between academic and business approaches to deal making and professional tensions between relational and legal approaches to negotiation. Abstraction and formalization contribute both to the convergence and stability of routines and to their improvisational use in professional work. Close attention to these processes in a strategic research setting sheds new light on an interesting tension in sociological theories of the professions while contributing to the development of a micro-level, social constructivist institutional theory. This article offers a reading of Machiavelli’s _il Principe_ and its relationship to his _Discorsi_ which defends, first, the coherence of Machiavelli’s appeal to the figure of the one-man _ordinatore_ and, second, a republican interpretation of _il Principe_. Its particular focus is on the pivotal role played in Machiavelli’s text-act by ‘love of worldly glory’. It is argued, first, that it is through love of glory that Machiavelli can coherently aim to produce an effective one-man _ordinatore_ and, second, that the (...) political education that _il Principe_ provides to this figure leads them ineluctably to the conclusion that lasting glory can only be achieved through the foundation of a republic.
