Most contemporary interpreters of Aquinas have assumed that Thomas subscribed to a “non-repeatability principle” such that created entities, once destroyed entirely, cannot be “brought back" into existence, even by God's power. Souls persisting in the interim between death and resurrection thus play an essential identity-preserving role between our death and rising again. No separated souls, no resurrection. Two of Aquinas’s best medieval interpreters, however, reject this interpretation. Leaning largely on one of Aquinas’s late quodlibetal questions, they deny that Thomas held (...) any non-repeatability principle strong enough to bar God’s resurrecting us even from complete destruction, souls and all. Here the chapter argues that careful analysis of the quodlibet and other texts largely vindicates the contemporary interpretation. It does so in a surprising way, however, since it turns out Aquinas’s non-repeatability principle applies only to corruptible, material entities like us, and not to incorruptible entities like angels. The reason Aquinas held this view, the chapter argues, is rooted in his theory of individuation. (shrink)

In this article I argue that the proper subjects of intangible property claims include medical records, genetic profiles, and gene enhancement techniques. Coupled with a right to privacy these intangible property rights allow individuals a zone of control that will, in most cases, justifiably exclude governmental or societal invasions into private domains. I argue that the threshold for overriding privacy rights and intangible property rights is higher, in relation to genetic enhancement techniques and sensitive personal information, than is commonly suggested. (...) Once the bar is raised, so‐to‐speak, the burden of overriding it is formidable. Thus many policy decisions that have been recently proposed or enacted – citywide audio and video surveillance, law enforcement DNA sweeps, genetic profiling, national bans on genetic testing and enhancement of humans, to name a few – will have to be backed by very strong arguments. The law inevitably draws lines. These lines distinguish, for example, whether certain conduct reflects ordinary recklessness constituting manslaughter or more extreme recklessness constituting murder. There is no way to meaningfully draw such lines, however, absent shared ways of representing amounts of recklessness or at least knowledge of the consequences of drawing lines in particular places. Yet legal actors frequently draw lines in the dark, establishing cutoffs along a spectrum with little or none of the information required to do so in (...) a way that suits the law’s goals. For example, jurors must decide whether some conduct constitutes extreme recklessness without knowing prior precedent nor the sentencing consequences of drawing cutoffs in particular places. Judges and lawyers cite line drawing precedents from other jurisdictions without considering whether the lines drawn in prior cases had the same consequences as those in the case at bar. And scholars argue about how to classify conduct without making clear what consequences they believe ought to attach once the classification is made, leaving it hard to tell when scholars have substantive or simply superficial disagreements. In this Article, I discuss some line drawing problems and briefly suggest ways we can add meaning to cutoffs. More generally, I argue, we can “smooth” certain features of the law to both reduce our vulnerability to line drawing in the dark and improve the fit between the law and what our best theories of law recommend. Even when we cannot easily smooth the law, thinking about the law in a smoother fashion can help reduce the jurisprudential pathologies I describe. (shrink)

This paper focuses on the self-knowledge of emotions. I first argue that several of the leading theories of self-knowledge, including the transparency method (see, e.g., Byrne 2018) and neo-expressivism (see, e.g., Bar-On 2004), have difficulties explaining how we authoritatively know our own emotions (even though they may plausibly account for sensation, belief, intention, and desire). I next consider Barrett’s (2017a) empirically informed theory of constructed emotion. While I agree with her that we ‘give meaning to [our] present sensations’ (2017a, p.26), (...) I disagree with her that we construct our emotions, as this has some unwelcome implications. I then draw upon recent data from the science of emotions literature to advance a view I call partial first-person authority. According to this view, first-person authority with respect to our emotions is only partial: we can introspect and authoritatively know our own sensations, and beliefs, in ways others cannot; but we still need to interpret those sensations and beliefs, to know our emotions. Finally, I consider self-interpretational accounts of self-knowledge by Carruthers (2011) and Cassam (2014). I argue that while these accounts are implausible when applied to beliefs, desires, and intentions, they are more plausible when applied to our emotions. (shrink)

The use of algorithms and automated systems, especially those leveraging artificial intelligence (AI), has been exploding in the public sector, but their use has been controversial. Ethicists, public advocates, and legal scholars have debated whether biases in AI systems should bar their use or if the potential net benefits, especially toward traditionally disadvantaged groups, justify even greater expansion. While this debate has become voluminous, no scholars of which we are aware have conducted experiments with the groups affected by these policies (...) about how they view the trade-offs. We conduct a set of two conjoint experiments with a high-quality sample of 973 Americans who identify as Black or African American in which we randomize the levels of inter-group disparity in outcomes and the net effect on such adverse outcomes in two highly controversial contexts: pre-trial detention and traffic camera ticketing. The results suggest that respondents are willing to tolerate some level of disparity in outcomes in exchange for certain net improvements for their community. These results turn this debate from an abstract ethical argument into an evaluation of political feasibility and policy design based on empirics. (shrink)

Henry Home (1696-1782) has been called "perhaps the most complete 'Enlightenment man' among the eighteenth-century Scottish thinkers." Kinsman and friend of David Hume, mentor and patron of Adam Smith, John Millar, and Thomas Reid, he was a key figure in that circle of luminaries. He read law, was called to the bar in 1723, was raised to the Bench of the Court of Session in 1752, with the title Lord Kames (the name of his family estate), and joined the (...) High Court of the Justiciary in 1763. Publishing broadly in law, history, philosophy, and criticism, Kames made significant contributions to the Enlightenment's science of human nature. The Essays is commonly considered Kames's most important philosophical work. In the first part, he sets forth the principles and foundations of morality and justice, attacking Hume's moral skepticism and addressing the controversial issue of the freedom of human will. In the second part, Kames focuses on questions of metaphysics and epistemology to offer a natural theology in which the authority of the external senses is an important basis for belief in the Deity. The text of this volume is based on the third edition of 1779, while the appendix presents substantial variant readings in the first and second editions. (shrink)

How can the situation of anatomical form be analysed without the illusion of instrumentalized reflection? Perhaps by amalgamating the categories and their issues. The issuance (...) of taxonomy is the actual fine muck of excrement, which every brick of ordered life leaks as exudence and decay. Deep thoughts leave a mucal snail trail of what was tabular-seeming about our bodily situation, our environs, our friends, our experiments and our nourishment. Especially in this current age of 露 露 and 娜娜 (Lulu and Nana), our first officially public transgenic kindred, the question becomes, ‘who are these free-living divergences and what does it mean to be the uber-ding beyond geoengineering’s capabilities?’. A fascinating exploration of the nature of consciousness This engaging and readable book provides an introduction to consciousness that does justice both to the science and to the philosophy of consciousness, that is, the mechanics of the mind and the experience of awareness. The book opens with a general discussion of the brain and of consciousness itself. Then, exploring the areas of brain science most likely to illuminate the basis of awareness, Zeman focuses on the science of sleep and waking (...) and on the science of vision. He describes healthy states and disorders--epilepsy, narcolepsy, blindsight and hallucinations after stroke--that provide insights into the capacity for consciousness and into its contents. And he tracks the evolution of the brain, the human species, and human culture and surveys the main current scientific theories of awareness, pioneering attempts to explain how the brain gives rise to experience. Zeman concludes by examining philosophical arguments about the nature of consciousness. A practicing neurologist, he animates his text with examples from the behavioral and neurological disorders of his patients and from the expanding mental worlds of young children, including his own. His book is an accessible and enlightening explanation of why we are conscious. (shrink)

Argumentation Frameworks provide a fruitful basis for exploring issues of defeasible reasoning. Their power largely derives from the abstract nature of the arguments within the framework, where arguments are atomic nodes in an undifferentiated relation of attack. This abstraction conceals different senses of argument, namely a single-step reason to a claim, a series of reasoning steps to a single claim, and reasoning steps for and against a claim. Concrete instantiations encounter difficulties and complexities as a result of conflating these senses. (...) To distinguish them, we provide an approach to instantiating AFs in which the nodes are restricted to literals and rules, encoding the underlying theory directly. Arguments in these senses emerge from this framework as distinctive structures of nodes and paths. As a consequence of the approach, we reduce the effort of computing argumentation extensions, which is in contrast to other approaches. Our framework retains the theoretical and computational bene.. Industrial drug design methodology has undergone remarkable changes in the recent history. Up to the 1970s, the screening of large numbers of randomly selected substances in biological test system was often a crucial step in the development of novel drugs. From the early 1980s, such ‘blind’ screening was increasingly rejected by many pharmaceutical researchers and gave way to ‘rational drug design’, a method that grounds the design of new drugs on a detailed mechanistic understanding of the drug action. Surprisingly, however, (...) the chance-based method of random screening returned to center stage of industrial drug development in the 1990s in the form of ‘high-throughput screening’ (HTS). I will argue in this paper that this to-and-fro in the prominence of random screening comes with fundamental changes in the epistemic significance of chance experiments in pharmaceutical development. While up to the 1970s, random screening used to be chosen as an empirical search strategy primarily because suffi- cient knowledge of the mechanistic basis of drug action was lacking, it has turned with high-throughput screening into an experimental method that employs chance variation and testing to illuminate this mechanistic basis. As a consequence, research into the underlying mechanisms of drug action and the development of new drugs have become closely integrated. The rise of HTS therefore not only shows how chance experiments have assumed a new epistemic role in drug development. It also allows for a detailed study of the much debated emergence of a new relationship between scientific understanding and the development of technological artifacts. (shrink)

The phenomenon of ‘canalization’ ‐ the genetic capacity to buffer developmental pathways against mutational or environmental perturbations ‐ was first characterized in the late 1930s and early 1940s. Despite enormous subsequent progress in understanding the nature of the genetic material and the molecular basis of gene expression, there have been few attempts to interpret the classical work on canalization in molecular genetic terms. Some recent findings, however, bear on one form of canalization, ‘genetic canalization’, the stabilization of development against mutational (...) effects. These data indicate that co‐expressed paralogous genes can function as mutual ‘back‐up’ elements in developmental processes. Paralogues, however, are far from the only basis of canalization: other genetic sources can be readily envisaged and some of these are described here. The evolutionary questions about genetic canalization and the mechanistic questions about developmental instability that still need to be addressed are also briefly discussed. (shrink)

Because families disrupt fair patterns of distribution and, in particular, equality of opportunity, egalitarians believe that the institution of the family needs to be defended at the bar of justice. In their recent book, Harry Brighouse and Adam Swift have argued that the moral gains of preserving the family outweigh its moral costs. Yet, I claim that the egalitarian case for abolishing the family has been over-stated due to a failure to consider how alternatives to the family would also (...) disturb fair distributions and, in particular, equality of opportunity. Absent the family, children would continue to be exposed to care-givers of different levels of ability, investment in childrearing and beneficial partiality. In addition, social mechanisms other than the family would lead to the accumulation of economic inequalities. Any kind of upbringing will fail to realise equality for reasons that go deeper than the family: our partiality and unequal abilities to nurture. (shrink)

Subjects were requested to choose between gambles, where the outcome of one gamble depended on a single elementary event, and the other depended on an event compounded of a series of such elementary events. The data supported the hypothesis that the subjective probability of a compound event is systematically biased in the direction of the probability of its components resulting in overestimation of conjunctive events and underestimation of disjunctive events. Studies pertaining to this topic are discussed.

Using fMRI, we investigated how right temporal lobe gliomas affecting the posterior superior temporal sulcus alter neural processing observed during speech perception and production tasks. Behavioural language testing showed that three pre-operative neurosurgical patients with grade 2, grade 3 or grade 4 tumours had the same pattern of mild language impairment in the domains of object naming and written word comprehension. When matching heard words for semantic relatedness (a speech perception task), these patients showed under-activation in the tumour infiltrated right (...) superior temporal lobe compared to 61 neurotypical participants and 16 patients with tumours that preserved the right postero-superior temporal lobe, with enhanced activation within the (tumour-free) contralateral left superior temporal lobe. In contrast, when correctly naming objects (a speech production task), the patients with right postero-superior temporal lobe tumours showed higher activation than both control groups in the same right postero-superior temporal lobe region that was under-activated during auditory semantic matching. The task dependent pattern of under-activation during the auditory speech task and over-activation during object naming was also observed in eight stroke patients with right hemisphere infarcts that affected the right postero-superior temporal lobe compared to eight stroke patients with right hemisphere infarcts that spared it. These task-specific and site-specific cross-pathology effects highlight the importance of the right temporal lobe for language processing and motivate further study of how right temporal lobe tumours affect language performance and neural reorganisation. These findings may have important implications for surgical management of these patients, as knowledge of the regions showing functional reorganisation may help to avoid their inadvertent damage during neurosurgery. In his commentary on Aristotle’s De generatione et corruptione Marsilius of Inghen defends the view—unusual in the Middle Ages—that there is no such thing as intermittent or “gappy” existence. Even God cannot restore things that have been corrupted. This paper examines Marsilius’s unusual position, connecting them to another view he defends, namely that a thing’s origins—and in particular the time at which it comes about—are essential to its numerical identity as the particular individual it is. I consider John Buridan and (...) Nicole Oresme’s influence upon Marsilius’s views, and ultimately evaluate their plausibility, drawing on some recent work of Gyula Klima’s on gappy existence in Thomas Aquinas. (shrink)

From philosophy to theology -- Structure -- Mystery -- Power.

A hypothesis on the evolutionary origin of the genetic pathway of sex determination in the nematode Caenorhabditis elegans is presented here. It is suggested that the pathway arose in steps, driven by frequency‐dependent selection for the minority sex at each step, and involving the sequential acquisition of dominant negative, neomorphic genetic switches, each one reversing the action of the previous one. A central implication is that the genetic pathway evolved in reverse order from the final step in the hierarchy up (...) to the first. The possible applicability of the model to the other well‐characterized sex determination pathway, that of Drosophila melanogaster, and to sex determination in mammals, is discussed, along with some potential implications for pathway evolution in general. Finally, the specific molecular and population genetic questions that the model raises are described and some tests are proposed. (shrink)

Frege’s views on identity continue to provoke scholars, and rightly so. In particular his view in Begriffsschrift of 1879, and its relation to his view in ‘Über Sinn und Bedeutung’ of 1892 deserve careful attention. The issues involved have a wider significance than Frege’s specific views on identity in different periods, though these are important enough. They concern also the move from what I call below ‘thin’ semantics, which is exhausted in signs being assigned content, to a ‘thick’ semantics, in (...) which ‘modes of determining their content’, or Sinne are also concerned. As I am sitting at my desk in front of my computer, a thought crosses my mind: There's water in the glass. The thought has a particular content: that there is water in the glass. And, if all is well, there is water in the glass, so my thought is true. According to external-world skepticism, I still do not know that there is water in the glass, because my way of telling what's in front of me does not allow me (...) to rule out the possibility that I’m only under some kind of illusion about what's in front of me. Analogously, according to content skepticism, I cannot know that I am thinking that there is water in my glass, even if in fact that is what I am thinking. This is because for all I know, my way of telling what I am thinking does not allow me to rule out the possibility that I am only under some kind of illusion about what I am thinking. (shrink)

Much of contemporary metaethics revolves around the issue of “naturalism.” However, there is little agreement on what “naturalism” is or why it should be of significance. In this paper, I aim to rectify this situation by providing a set of necessary conditions on what positions ought to count as “naturalistic.” A metaethical view should count as an instance of naturalism only if it claims that there can be evidence for normative claims that is both public and spatiotemporal. I argue that, (...) unlike other characterizations of “naturalism,” this view shows a clear difference between many metaethical positions and the sciences. The view thereby renders debates about naturalism philosophically significant: the division between naturalists and non‐naturalists is that between philosophers who hold that ethics is relevantly similar to the sciences and those who deny this.
