This is a review essay of Lagasnerie, Judge and Punish and Fassin, The Will to Punish. It explores the way that these two books challenge conventional thinking about the relationship between crime and punishment.

Medicine and its allied health sciences have for too long been peripherally involved in work on human rights. Fifty years ago, the door to greater involvement was opened by Article 25 of the Universal Declaration of Human Rights, which underlined social and economic rights: “Everyone has the right to a standard of living adequate for the health and well-being of himself and his family, including food, clothing, housing, and medical care and necessary social services, and the right to security in (...) the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.”. The fifth book in the series offers an historical and conceptual account of the criminal law, as it has developed in England and spread to common law jurisdictions around the world. It traces how and why criminal law has come to be accorded with a central role in securing civil order in modernity, and justifies who and what should be treated as criminal under the law. Farmer argues that the emergence of the modern state in which criminal law is recognized (...) as an instrument of government is a result of the distinct body of rules which have emerged from the modern criminal law. This book examines the relationship between legal tradition and national identity to offer a critical and historical perspective on the study of criminal law. It develops a radically different approach to questions of responsibility and subjectivity, and was among the first studies to combine appreciation of the institutional and historical context in which criminal law is practised with a critical understanding of the law itself. Applying contemporary social theory to the particular case of nineteenth-century Scottish law, Lindsay Farmer is able (...) to develop a critique of modern criminal law theory in general. He traces the development of the modern characteristics of criminal law and legal order, tracing the relationship between legal practice and national culture, and showing how contemporary criminal law theory fundamentally misrepresents the character of modern criminal justice. Journal of Mathematical Logic, Ahead of Print. According to a theorem due to Kenneth Kunen, under ZFC, there is no ordinal [math] and nontrivial elementary embedding [math]. His proof relied on the Axiom of Choice (AC), and no proof from ZF alone is has been discovered. [math] is the assertion, introduced by Hugh Woodin, that [math] is an ordinal and there is an elementary embedding [math] with critical point [math]. And [math] asserts that [math] holds for some [math]. The axiom (...) [math] is one of the strongest large cardinals not known to be inconsistent with AC. It is usually studied assuming ZFC in the full universe [math] (in which case [math] must be a limit ordinal), but we assume only ZF. We prove, assuming ZF [math] [math] [math] “[math] is an even ordinal”, that there is a proper class transitive inner model [math] containing [math] and satisfying ZF [math] [math] [math] “there is an elementary embedding [math]”; in fact we will have [math] ⊆[math], where [math] witnesses [math] in [math]. This result was first proved by the author under the added assumption that [math] exists; Gabe Goldberg noticed that this extra assumption was unnecessary. If also [math] is a limit ordinal and [math]-DC holds in [math], then the model [math] will also satisfy [math]-DC. From the perspective of at least some of our valuing practices, the advance of the sciences can seem to constitute a threat. The question I take up in this dissertation is whether or not naturalism--understood as the picture of the world and of ourselves bequeathed to us by the sciences--should be understood as a threat to our moral practices, to moral living. On the account I defend, the knowledge we gain from empirical inquiry need not undermine moral living in toto, (...) although a naturalistic mindset does raise some possibly dangerous questions for particular inherited moral norms and ideals. In defense of my claim that the examined life need not destroy the moral life, I develop a social view of morality. On this view, both moral authority and moral justification are viewed as fundamentally social phenomena, and morality itself as a tool for social living. With a case study on the development of the ethics of care, I illustrate ways in which a concern for empirically truthful representations of humanity can also dovetail with liberatory political concerns. That is, I defend not only the claim that moral living can survive critical scrutiny, but also the claim that it can be enriched by this scrutiny--that the truth can be transformative. Expansive moral ideals, such as those humanist views that see progress in the expansion of our moral vocabularies and institutions, are compatible with a naturalistic outlook, I argue. However, a strong defense of humanist views, according to which such ideals flow unproblematically from the nature of reason or from the history of ethical practice, does not seem possible. A weak defense of humanism, which connects the ideals of humanists to more widely held values, seems more promising. In working socially and politically for their cause, I contend that humanists in some sense have the truth on their side: sexist, racist, classist, or otherwise inegalitarian views regularly trade in falsehoods and obfuscation. Empirically truthful accounts of particular inherited norms and ideals thus continue to be dangerous, at least for those invested in the continued existence of the corresponding institutions. We prove that certain partial choice principles in are the consequence of κ being inaccessible/weakly compact, and some other related facts.

In this paper, we argue that lack of access to the fruits of modern medicine and the science that informs it is an important and neglected topic within bioethics and medical ethics. This is especially clear to those working in what are now termed 'resource-poor settings'- to those working, in plain language, among populations living in dire poverty. We draw on our experience with infectious diseases in some of the poorest communities in the world to interrogate the central imperatives of (...) bioethics and medical ethics. AIDS, tuberculosis, and malaria are the three leading infectious killers of adults in the world today. Because each disease is treatable with already available therapies, the lack of access to medical care is widely perceived in heavily disease-burdened areas as constituting an ethical and moral dilemma. In settings in which research on these diseases are conducted but there is little in the way of therapy, there is much talk of first world diagnostics and third world therapeutics. Here we call for the 'resocialising' of ethics. To resocialise medical ethics will involve using the socialising disciplines to contextualise fully ethical dilemmas in settings of poverty and, a related gambit, the systematic participation of the destitute sick. Clinical research across steep gradients also needs to be linked with the interventions that are demanded by the poor and otherwise marginalised. We conclude that medical ethics must grapple more persistently with the growing problem posed by the yawning 'outcome gap' between rich and poor. (shrink)

Partial functions are ubiquitous in both mathematics and computer science. Therefore, it is imperative that the underlying logical formalism for a general-purpose mechanized mathematics system provide strong support for reasoning about partial functions. Unfortunately, the common logical formalisms — first-order logic, type theory, and set theory — are usually only adequate for reasoning about partial functionsin theory. However, the approach to partial functions traditionally employed by mathematicians is quite adequatein practice. This paper shows how the traditional approach to partial functions (...) can be formalized in a range of formalisms that includes first-order logic, simple type theory, and Von-Neumann—Bernays—Gödel set theory. It argues that these new formalisms allow one to directly reason about partial functions; are based on natural, well-understood, familiar principles; and can be effectively implemented in mechanized mathematics systems. Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

In contemporary philosophy of religion, the doctrine of omniscience is typically rendered propositionally, as the claim that God knows all true propositions (and believes none that are false). But feminist work makes clear what even the analytic tradition sometimes confesses, namely, that propositional knowledge is quite limited in scope. The adequacy of propositional conceptions of omniscience is therefore in question. This paper draws on the work of feminist epistemologists to articulate alternative renderings of omniscience which remedy the deficiencies of the (...) traditional formulation. (shrink)

Church's simple theory of types is a system of higher-order logic in which functions are assumed to be total. We present in this paper a version of Church's system called PF in which functions may be partial. The semantics of PF, which is based on Henkin's general-models semantics, allows terms to be nondenoting but requires formulas to always denote a standard truth value. We prove that PF is complete with respect to its semantics. The reasoning mechanism in PF for partial (...) functions corresponds closely to mathematical practice, and the formulation of PF adheres tightly to the framework of Church's system. (shrink)

Calling in sick to get out of work is a time-honored practice, and something of an art form in and of itself. Early and medieval Chinese texts are full of instances of individuals claiming illness to either excuse themselves from current positions, or to avoid appointments to office, a practice firmly situated in the rhetoric of reclusion. This paper focuses on several cases contained in Chang Qu’s 常璩 Huayang guo zhi 華陽國志 of men who made medical excuses to reject appointments (...) offered by Gongsun Shu 公孫述, the self-proclaimed emperor of the Shu region. I will examine these anecdotes with an eye toward understanding primarily their historiographical significance. Moreover, this paper is not an effort to compile a comprehensive history of illness and public service, nor a detailed examination of the medical science behind the illnesses used to avoid work; its focus is narrow and specific. How did the persons narrated by Chang Qu use illness to avoid service under a particular ruler, and what underlying messages might we glean from Chang’s own telling of these stories? (shrink)

In 1894, John McTaggart reviewed Francis Bradley’s major work, Appearance and Reality. I know of no other review by McTaggart of Bradley’s work; and I know of no review by Bradley of McTaggart’s work. McTaggart, then 28 years old, had been a Cambridge Fellow for only three years. Bradley, 48 years old and a leading figure at Oxford, was at the height of his powers. He has been seen as a culmination of the English Idealism, or Neo-Hegelianism, that both philosophers (...) shared. McTaggart has been seen as a postscript, yielding his life’s work only after his Cambridge colleagues like Russell had, in a sense, effected a sea change in the direction of British and Anglo-Saxon philosophical discourse. The first volume of McTaggart’s The Nature of Existence was to appear only in 1921. A better understanding of McTaggart’s work can be obtained by a double reading — a reading that considers McTaggart’s metaphysics in the light of Bradley’s work and that considers Bradley’s metaphysics in light of McTaggart’s work. To illustrate this, this paper will focus on a single item in their respective metaphysics, the unreality of time. (shrink)

This article focuses on the question of the function of imitation and whether current accounts of imitative function are consistent with our knowledge about imitation's origins. We first review theories of imitative origin concluding that empirical evidence suggests that imitation arises from domain‐general learning mechanisms. Next, we lay out a selective account of function that allows normative functions to be ascribed to learned behaviours. We then describe and review four accounts of the function of imitation before evaluating the relationship between (...) the claim that imitation arises out of domain‐general learning mechanisms and theories of the function of imitation. In July 1993, the Scottish Highlands Centre for Human Caring sponsored a conference with the title Exploring the Spirituality in Caring. The papers given at the conference and included in this volume are offered as a contribution to the debate that must take place in nursing and in the wider context of health care provision. Ann Bradshaw's paper puts the debate in context arguing that nursing is fundamentally a loving response to the human being created in the image of God.

A significant open problem in inner model theory is the analysis of HODL[x] as a strategy premouse, for a Turing cone of reals x. We describe here an obstacle to such an analysis. Assuming sufficient large cardinals, for a Turing cone of reals x there are proper class 1-small premice M,N, with Woodin cardinals δ,ε, respectively, such that M|δ and N|ε are in L[x], M and N are countable in L[x], and the pseudo-comparison of M with N succeeds, is in (...) L[x], and lasts exactly ω1L[x] stages. Moreover, we can take M=M1, the minimal iterable proper class inner model with a Woodin cardinal, and take N to be M1-like and short-tree-iterable. (shrink)

This paper studies homogeneously Suslin (hom) sets of reals in tame mice. The following results are established: In 0 ¶ the hom sets are precisely the [Symbol] sets. In M n every hom set is correctly [Symbol] and (δ + 1)-universally Baire where ä is the least Woodin. In M u every hom set is <λ-hom, where λ is the supremum of the Woodins.

Although several theories of online syntactic processing assume the parallel activation of multiple syntactic representations, evidence supporting simultaneous activation has been inconclusive. Here, the continuous and non‐ballistic properties of computer mouse movements are exploited, by recording their streaming x, y coordinates to procure evidence regarding parallel versus serial processing. Participants heard structurally ambiguous sentences while viewing scenes with properties either supporting or not supporting the difficult modifier interpretation. The curvatures of the elicited trajectories revealed both an effect of visual context (...) and graded competition between simultaneously active syntactic representations. The results are discussed in the context of 3 major groups of theories within the domain of sentence processing. (shrink)

Let M be a short extender mouse. We prove that if $E\in M$ and $M\models $ “E is a countably complete short extender whose support is a cardinal $\theta $ and $\mathcal {H}_\theta \subseteq \mathrm {Ult}(V,E)$ ”, then E is in the extender sequence $\mathbb {E}^M$ of M. We also prove other related facts, and use them to establish that if $\kappa $ is an uncountable cardinal of M and $\kappa ^{+M}$ exists in M then $(\mathcal {H}_{\kappa ^+})^M$ satisfies the (...) Axiom of Global Choice. We prove that if M satisfies the Power Set Axiom then $\mathbb {E}^M$ is definable over the universe of M from the parameter $X=\mathbb {E}^M\!\upharpoonright \!\aleph _1^M$, and M satisfies “Every set is $\mathrm {OD}_{\{X\}}$ ”. We also prove various local versions of this fact in which M has a largest cardinal, and a version for generic extensions of M. As a consequence, for example, the minimal proper class mouse with a Woodin limit of Woodin cardinals models “ $V=\mathrm {HOD}$ ”. This adapts to many other similar examples.
