Cette contribution analyse le Grand débat national (2019) et la Convention citoyenne pour le climat (2019-2020) à la lumière de l’opposition élaborée par la théorie politique entre démocratie participative et démocratie délibérative. Chacun d’entre eux démontre la difficulté à articuler participation et délibération. Au-delà de cette opposition, ces deux processus partagent la caractéristique fondamentale de n’être que purement consultatifs. In this paper, we argue that promoting patient values is a legitimate goal of medicine. Our view offers a justification for certain current practices, including birth control and living organ donation, that are widely accepted but do not fit neatly within the most common extant accounts of the goals of medicine. Moreover, we argue that recognising value promotion as a goal of medicine will expand the scope of medical practice by including some procedures that are sometimes rejected as being outside (...) the scope of acceptable medical practice, such as certain forms of physician-assisted death. We then rebut some common and possible objections to this view. Our aim is not to argue that other accounts are mistaken—except when they argue for a single goal that does not include patient values—but rather to show that value promotion should play a more central role in discussions about the goals of medicine. Carroll Izard completed his dissertation in 1952, beginning a career spanning more than six decades that coincided with clinical psychology maturing as a profession, and the birth of clinical science and cognitive neuroscience. Izard’s focus on discrete emotions as evolved systems that organize information, prepare responses, and shape the development of personality and relationships persisted through his career, despite “emotions” often being overshadowed by psychodynamic, behavioral, or cognitive perspectives. His theoretical work anticipated and now integrates contemporary neuroscience and relational perspectives. (...) Exploration of discrete emotions has kept lines of inquiry open that enrich our understanding of psychopathology. Izard also embraced clinical science, combining basic research with effectiveness studies addressing the unmet need for mental health services via emotion-focused interventions. (shrink)

Children and individuals with developmental disabilities compared to typical participants are disadvantaged not only by virtue of being vulnerable to risks inherent in research participation but also by the higher likelihood of exclusion from research altogether. Current regulatory and ethical guidelines although necessary for their protection do not sufficiently ensure fair distributive justice. Yet, in view of disproportionately higher burdens of co-occurring physical and mental disorders in individuals with DD, they are better positioned to benefit from research by equitable participation. (...) Greater elucidation of this ethical dilemma is called for by researchers, institutional review boards, and funding agencies to urgently redress the imbalance. This article discusses many of the regulatory principles to ensure better research participation of children and individuals with DD: human rights, validity, distributive justice, beneficence/nonmaleficence, and autonomy. The Moral Foundations of Trust seeks to explain why people place their faith in strangers, and why doing so matters. Trust is a moral value that does not depend upon personal experience or on interacting with people in civic groups or informal socializing. Instead, we learn to trust from our parents, and trust is stable over long periods of time. Trust depends on an optimistic world view: the world is a good place and we can make it better. Trusting people (...) are more likely to give through charity and volunteering. Trusting societies are more likely to redistribute resources from the rich to the poor. Trust has been in decline in the United States for over 30 years. The roots of this decline are traceable to declining optimism and increasing economic inequality, which Uslaner supports by aggregate time series in the United States and cross-sectional data across market economies. Joseph Keim Campbell has attempted to say “farewell” to a particular version of source incompatibilism, viz. direct source incompatibilism, arguing that direct source incompatibilism is committed to two theses that are in tension, thereby threatening the coherence of the position. He states that direct source incompatibilism is committed to the following claims: SI-F: there are genuine Frankfurt-style counterexamples. SI-D: there is a sound version of the Direct Argument. Campbell argues that both of these theses cannot be simultaneously held since a (...) sound version of the Direct Argument would undermine Frankfurt-style counterexamples, and vice versa. After laying out Campbell’s argument, I will first make some preliminary comments regarding actual direct source incompatibilists and their commitment to SI-F and SI-D. I then object to Campbell’s argument, arguing that one can accept both SI-F and SI-D, thereby vindicating direct source incompatibilism from the charge of incoherence. (shrink)

A critique of LaPorte's views on chemical kinds, like jade and ruby, is presented. More positively, a new slant is provided on the question of whether elements are natural kinds. This is carried out by appeal to the dual nature of elements, a topic that has been debated in the philosophy of chemistry but not in the natural kinds literature. It is claimed that the abstract notion of elements, as opposed to their being simple substances, is relevant to the Kripke–Putnam (...) approach to natural kinds and to some criticisms that have been raised against it, although I do not support the K–P account. The proposed view avoids the traditional microstructuralist approach to natural kinds. The article also addresses the question of whether natural kinds concern metaphysical or epistemological considerations. Recent attempts by chemists to modify the periodic table are brought to bear on the question of classification and consequently on whether the identification of elements is interest dependent. This paper summarizes paired courses, a technique that is being used to incorporate the benefits of liberal arts into the business curriculum. This technique pairs a required business course with a liberal arts course that students take concurrently during a semester. The courses have overlapping themes and activities to build specific competencies that are desired by organizations, such as communication, critical thinking and problem solving, emotional intelligence, and organizational professionalism. These competencies are identified by exploring national surveys and conducting a (...) local survey of business professionals. The paired courses utilize a variety of exercises with the ultimate goals of building desired workplace-related skills in students and improving their practical reasoning ability. The exercises do this by strengthening students’ analytical thinking, understanding of multiple framing, and reflective exploration of meaning through various techniques. Many of the activities are explained in detail with some additional resources provided. Teachers can utilize the same activities or adapt them to their classroom. (shrink)

This paper examines a recent attempt at updating Anselm’s ontological argument by employing the notion of mediated and unmediated causal powers. After presenting the updated argument and the underlying metaphysical framework of causal powers that is utilized in the argument, I show that some of the key assumptions can be rejected. Once we closely examine some of the assumptions, it will also be evident that the updated version in some ways collapses back to Anselm’s original version and so is subject (...) to some of the same worries. Several philosophers have argued that property dualism and substance materialism are incompatible positions. Recently, Susan Schneider has provided a novel version of such an argument, claiming that the incompatibility will be evident once we examine some underlying metaphysical issues. She purports to show that on any account of substance and property-possession, substance materialism and property dualism turn out incompatible. In this paper, I argue that Schneider’s case for incompatibility between these two positions fails. After briefly laying out her case for (...) incompatibility, I present an account of substance—one that relies on a relational ontology—that makes the combination of substance materialism and property dualism unproblematic. Then I show that even under the theories of substance that Schneider considers—those that rely on a constituent ontology—there still is no incompatibility problem. (shrink)

It seems that we can know moral truths. We are also rather reluctant to defer to moral testimony. But it’s not obvious how moral cognitivism is compatible with pessimism about moral testimony. If moral truths are knowable, shouldn’t it be possible for others to know moral truths you don’t know, so that it is wise for you to defer to what they say? Or, alternatively, if it’s always reasonable to refuse to defer to the wisest among us, doesn’t this show (...) that morality is not genuinely cognitive? There is a tension in our commonsense moral epistemology. In this chapter I (a) explicate this tension, (b) criticize how others have attempted to resolve it, and finally (c) explain how Rossian deontology helps us see that the tension is only apparent: morality is indeed knowable, despite the fact that it is usually wise to refuse to defer to moral testimony. Armed reprisals are the limited use of military force in response to unlawful actions perpetrated against states. Historically, reprisals provided a military remedy for states that had been wronged by another state without having to resort to all-out war in order to counter or deter such wrongful actions. While reprisals are broadly believed to have been outlawed by the UN Charter, states continue to routinely undertake such self-help measures. As part of the roundtable, “The Ethics of Limited Strikes,” this essay (...) examines the doctrine of armed reprisals in light of recent instances of states using force “short of war” in this manner. We argue that the ban on reprisals has been largely ignored by states, and that recent attempts to apply the laws of armed conflict to the cyber domain are further weakening this prohibition. We conclude that this is a potentially dangerous development that lowers the bar for resorting to military force, risking escalation and thereby further destabilizing the international system. No citizen should be denied the right to vote due solely to her age. We can see this by showing that all objections to it fail. It might be objected that it is not unjust to so deprive children because children as a group are unintelligent or irrational, have their interests already represented by the parents, or are justly deprived of many other rights, among other reasons. But all these objections fail because there is no evidence to support it, even (...) if true, this would not justify disenfranchisement, or, most prominently argued here, they deprive individuals of political rights based upon their membership in a group. Relationships between children and parents pervade the Star Wars saga, especially if people include surrogate parents. Anakin's relationship with his mother, Shmi, in the prequels impacts his trajectory toward the dark side. In The Mandalorian, Mando's role as a surrogate father to Grogu transforms them into a “Clan of Two”. But the most significant parent‐child relationship in the saga may be the one between Luke Skywalker and Darth Vader. Confucius's teachings highlight the importance of benevolence, social order, and ritual propriety (...) among other virtues and values. This chapter shows that understanding Luke's surrender to Vader in terms of Confucian filial piety makes sense of how Luke is able to overcome the allure of the dark side and become a Jedi. Confucius's Analects has a moral framework called “exemplarism”. This is the idea that moral knowledge and practice do not start with principles, rules, duties, consequences, or character traits. How does a country repair its harm to a vulnerable minority targeted during times of national fear because of race? How did the United States redress its then popular yet unconstitutional WWII incarceration of 120,000 innocent Japanese Americans in desolate barbed wire prisons without charges, hearings, or bona fide evidence of military necessity? In response to a Congressional inquiry, political lobbying, and lawsuits, the Civil Liberties Act of 1988 directed the President to apologize and authorized over one billion dollars in (...) reparations. Congress also created a fund to educate the public about the government’s false assertion of “national security” to restrict civil liberties. Some considered redress a tremendous victory — rewriting history and personal healing. Others questioned reparations for one U.S. group but not others. Japanese American Redress served as a catalyst for reparations movements worldwide. This paper examines its genesis, legal implementation, and apparent effects. It also explores wide-ranging political mobilization and social meanings of redress and “unfinished business”. Reparations cannot be measured by laws alone. Diverse communities must engage contested questions of history, justice, and belonging. Reparations claims face often unforeseen benefits and limitations. The paper concludes with these “lessons learned” to date. (shrink)

In this article, we discuss the ethical dimensions for the prescribing behaviours of opioids for a chronic pain patient, a scenario commonly witnessed by many physicians. The opioid epidemic in the USA and Canada is well known, existing since the late 1990s, and individuals are suffering and dying as a result of the easy availability of prescription opioids. More recently, this problem has been seen outside of North America affecting individuals at similar rates in Australia and Europe. We argue that (...) physicians are also confronted with an ethical crisis where a capitalist-consumerist society is contributing to this opioid crisis in which societal, legal and business interests push physicians to overprescribe opioids. Individual physicians often find themselves unequipped and unsupported in attempts to curb the prescribing of opioid medications and balance competing goals of alleviating pain against the judicious use of pain medications. Physicians, individually and as a community, must reclaim the ethical mantle of our profession, through a more nuanced understanding of autonomy and beneficence. Furthermore, physicians and the medical community at large have a fiduciary duty to patients and society to play a more active role in curbing the widespread distribution of opioids in our communities. In one of their arguments against the radical neuron doctrine, Gold & Stoljar (G&S) use the idea that, in certain situations, equivalent terms may not be substitutable into statements that regard properties of the objects to which the terms refer. This device allows G&S to refute the necessity of the conclusion that “the science of the mind equals the science of the brain” even though they take as a premise that the mind equals the brain. This paper explores the connective ‘because’, based on the idea that ‘_C_ because _A_’ implies the acceptance/truth of the antecedent _A_ as well as of the consequent _C_, and additionally that the antecedent makes a difference for the consequent. To capture this idea of difference-making a ‘relevantized’ version of the Ramsey Test for conditionals is employed that takes the antecedent to be relevant to the consequent in the following sense: a conditional is true/accepted in a state \(\sigma \) just in (...) case (i) the consequent is true/accepted when \(\sigma \) is revised by the antecedent _and_ (ii) the consequent fails to be true/accepted when \(\sigma \) is revised by the antecedent’s negation. To extend this to a semantics for ‘because’, we add that (iii) the antecedent and (iv) the consequent are accepted/true in the state \(\sigma \). We get metaphysical or doxastic interpretations of these clauses, depending on what we mean by a model and a state. We introduce several semantics known from suppositional conditionals, which we reinterpret for difference-making conditionals and ‘because’. We present a minimal logic for ‘because’ sentences and show how it can be extended in ways that parallel the hierarchy of extensions of the logic of suppositional conditionals. We establish correspondence results between axioms for ‘because’ and properties of states, and prove that the specified logics are sound with respect to the semantics. (shrink)

We review and present a new meta‐analysis of research suggesting that ethicists in the United States appear to behave no morally better overall than do non‐ethicist professors. Measures include: returning library books, peer evaluation of overall moral behavior, voting participation, courteous and discourteous behavior at conferences, replying to student emails, paying conference registration fees and disciplinary society dues, staying in touch with one's mother, charitable giving, organ and blood donation, vegetarianism, and honesty in responding to survey questions. One multi‐measure study (...) found ethicists tending to embrace more stringent moral views, especially about meat eating and charitable donation. The same multi‐measure study found ethicists and other professors to show similarly small‐to‐medium correlations between their expressed normative attitudes and their self‐reported or directly measured behavior. This chapter has two goals. The first is to explain concepts associated with information and computation in physical terms. The other goal of this chapter is to analyze concepts in physics like space, time, and causality in information-theoretic and computational terms.

In a survey on research misconduct, roughly 20% of the respondents admitted that they have submitted federal grant proposals that include scholars as research participants even though those scholars were not expected to contribute to the research effort. This manuscript argues that adding such false investigators is illegal, violating multiple federal statutes including the False Statements Act, the False Claims Act, and False, Fictitious, or Fraudulent Claims. Moreover, it is not only the offending academics and the false investigators that face (...) civil and criminal penalties because administrators may also be liable if they sign off on proposals and are in a position to know that false investigators might be included. Policy recommendations that should reduce the use of false investigators include changing institutional cultures, better training and oversight of the responsible conduct of research, and, most importantly, making all grant reviews double blind. Across the globe, education has recently been through a major semantic shift, where new notions such as ‘learning’, ‘competences’, ‘projects’ came to replace or complement an older, more established, educational vocabulary. The political approach to education has also evolved, as many authors have underlined, from established national forms of governing to global, transnational forms of governance. These evolutions, often abbreviated to shifts ‘from teaching to learning’ and ‘from governing to governance’ have resonated globally and attracted the attention of researchers. Most (...) sociological accounts of such evolutions attribute them to the development and primacy of a preponderant logic, generally politics/power, culture or the economy. Niklas Luhmann’s systems theory, on which we draw in this article, suggests to start from a different, opposite, premise: not the predominance but instead the lack of any predominant logic characterizes modernity. The functional differentiation of modern society into a multiplicity of—specific yet universal—systems should therefore be the pivotal point that helps make sense of these transformations. We argue that the very coexistence of such systems, their simultaneous and therefore uncoordinated existences, increases the complexity of the social world tremendously and leaves them with an uncertain future. The so-called turns to governance and to learning, we argue, should be understood, respectively, as political and educational attempts to deal with this loss of direction. (shrink)

Research on the perception of silence has led to insights regarding its positive effects on individuals. We conducted a series of studies during which individuals were exposed to several minutes of silence in different contexts. Participants were introduced to different social and environmental settings, either in a seminar room at a university or in a city garden, alone or in a group. Instructions across studies varied, as participants were exposed to real waiting situations, were asked to just think and to (...) explicitly experience the time interval without further instructions or following a session of Depth Relaxation Music Therapy (DRMT)/ Hypnomusictherapy (HMT). Silence was judged to significantly increase relaxation, improve mood states, and alter the perception of time and the orientation towards the present moment. We controlled for influences of trait variables, such as impulsivity, mindfulness, daydreaming, and time perspective. Findings empirically demonstrate that exposure to silence can be effective in therapeutic and educational contexts to promote relaxation and well-being. (shrink)

Jan Patočka holds that both the Husserlian and the Heideggerian descriptions of history remain abstract because they lack an authentic reflection on historical sense’s appearing, which presupposes a description of the transition from the nonhistorical and prehistorical states of humanity to its final historical state. Nevertheless, it seems that Patočka would confront an internal aporia here because, even if he sought to think the continuity of these three movements, he tends to affirm the rupture between them. To overcome that aporia, (...) it becomes necessary to formulate the hypothesis according to which the prehistorical is characterized by a repression of sense’s problematic character, whereas the historical as such is characterized by a conversion of consciousness toward this problematic character. Justifying this hypothesis requires exploring Patočka’s anthropology, confronting it with Arendt’s anthropology, and formulating metaphysical perspectives. (shrink)

It has often been said that metaphors are based on analogies, but the nature of this relation has never been made precise. This article rigorously and formally specifies two semantic relations that do obtain between some metaphors and analogies. We argue that analogies often provide conditions of meaningfulness and truth for metaphors. An analogy is treated as an isomorphism from a source to topic domain. Metaphors are thought of as surface structures. Formal analogical conditions of meaningfulness and truth are fully (...) and rigorously worked out for several grammatical classes of metaphors. By providing analogical meaningfulness and truth conditions for metaphors, this article shows that truth-conditional semantics can be extended to metaphors. (shrink)

The fundamental reason that the genetics of behavior has remained so controversial for so long is that the layer of theory between data and their interpretation is thicker and more opaque than in more established areas of science. The finding that variations in tiny snippets of DNA have small but detectable relations to variation in behavior surprises no one, at least no one who was paying attention to the twin studies. How such snippets of DNA are related to differences in (...) behavior—known as the gene‐to‐behavior pathway—is the great theoretical problem of modern behavioral genetics.Given that intentional human breeding is a horrific prospect, what kind of technology might we want (or fear) out of human behavioral genetics? One possibility is a technology that could predict important behavioral characteristics of humans based on their genomes alone. A moment's thought suggests significant benefits and risks that might be associated with such a possibility, but for the moment, just consider how convincing it would be if on the day of a baby's birth we could make meaningful predictions about whether he or she would become a concert pianist or an alcoholic. This article will consider where we are right now as regards that possibility, using human height and intelligence as the primary examples. (shrink)

During his career, Ronald Dworkin wrote extensively on an impressive range of issues in moral, political, and legal philosophy, but, like many of his contemporaries, international law remained a topic of relative neglect. His most sustained work on international law is a posthumously published article, “A New Philosophy for International Law” (2013), which displays some familiar aspects of his views in general jurisprudence, in addition to some novel (though perhaps surprising) arguments as well. This paper argues that the moralized account (...) of international law we might have expected is conspicuously missing from this posthumous article; with Dworkin advancing an argument based on a form of political realism instead. n recent years, there has been a resurgence of academic interest in Adam Smith. As a consequence, a large number of PhD dissertations on Smith have been written by international scholars - in different languages, and in many diverse disciplines, including economics, women’s studies, philosophy, science studies, political theory and english literature: diversity which has enriched the area of study. In response to this activity, and in order to making these contributions more easily accessible to other Smith scholars, Leonidas Montes (...) and Eric Schliesser have edited this important new book. Of interest to Smith scholars and those interested in the history of economic thought in general, the contributions to this book are self-consciously interdisciplinary and skilfully employ many different methodologies. Recent work within psychology demonstrates that unconscious cognition plays a central role in the judgments and actions of individuals. We distinguish between two basic types unconscious social cognition: unconsciousness of the influences on judgments and actions, and unconscious of the mental states that give rise to judgments and actions. Influence unconsciousness is corroborated by strong empirical evidence, but unconscious states are difficult to verify. We discuss procedures aimed at providing conclusive evidence of state unconsciousness, and apply them to recent empirical (...) findings. (shrink)

Written in 1839 and chosen as the winning entry in a competition held by the Royal Norwegian Society of Sciences, Schopenhauer's Prize Essay on the Freedom of the Will marked the beginning of its author's public recognition and is widely regarded as one of the most brilliant and elegant treatments of free will and determinism. Schopenhauer distinguishes the freedom of acting from the freedom of willing, affirming the former while denying the latter. He portrays human action as thoroughly determined but (...) also argues that the freedom which cannot be established in the sphere of human action is preserved at the level of our innermost being as individuated will, whose reality transcends all dependency on outside factors. This volume offers the text in a previously unpublished translation by Eric F. J. This article addresses the place of situationist ideas in the current drive to make meaningful social and political change to avoid the catastrophic consequences of climate change. After a brief review of some key situationist concepts, the article shows how situationist thinkers post-1968 saw the prospect of environmental degradation as one of the key consequences of the social apathy induced by the spectacle and the grim prospects for the prevailing liberal assemblage of power to address the problem. Considering the argument that words are signs of the speaker’s ideas, Locke seems to assign meaning to an individual origin. However, at the beginning of Book III of the Essay Concerning Human Understanding, he defines language as the common tie of society: far from constituting a simple introductory formula, this definition is illustrated and confirmed throughout the book. Language is a common link because it fixes not only ideas but also the relationships between ideas in a way which determines the (...) minds of men and organizes their representations. Rather than seeing Locke as a thinker of interiority, for whom language is only exteriorization by the sign of thoughts which without words would remain locked in the mind of Man, we must consider the role of practices and uses in the constitution of the relationship between ideas. Locke criticizes the imperfection of the words, but, following on from Arnauld and Nicole, he strives to think of the links between logic and civil life. (shrink)

The concept of a chemical element is foundational within the field of chemistry, but there is wide disagreement over its definition. Even the International Union for Pure and Applied Chemistry (IUPAC) claims two distinct definitions: a species of atoms versus one which identifies chemical elements with the simple substances bearing their names. The double definition of elements proposed by the International Union for Pure and Applied Chemistry contrasts an abstract meaning and an operational one. Nevertheless, the philosophical aspects of this (...) notion are not fully captured by the IUPAC definitions, despite the fact that they were crucial for the construction of the Periodic Table. Although rich scientific literature on the element and the periodic table exists as well as a recent growth in the philosophy of chemistry, scholars are still searching for a definitive answer to this important question: What is an element?
