Remedial responsibility is the prospective responsibility to assist those in great need. With tens of millions of people worldwide suffering from severe poverty, questions about the attribution of remedial responsibility and the nature of the relevant duties of assistance are among the most pressing of our time. This article concerns the question of whether remedial responsibility for severe poverty is a matter of justice or of humanity. I discuss three kinds of situation in which an agent owes remedial responsibility to (...) another suffering from severe poverty. In the first, the remedially responsible agent foreseeably and avoidably caused the poverty. In the second, the poverty was caused by forces outside the control of any agent, such as natural disaster. And in the third situation, the agent who was originally attributed remedial responsibility fails to fulfil it, and so remedial responsibility for the poverty in question is acquired by a secondary bearer. According to David Miller, remedial responsibility is a matter of justice in the first two situations, but not in the third. I argue that his grounds for thinking that remedial responsibility in the second situation are in tension with his view that remedial responsibility is not a matter of justice in the third situation. This has important implications in our world in which remedial responsibilities too often go unfulfilled. (shrink)

Because secession centrally involves taking away a territory, a successful normative theory of secession must give a credible account of when a seceding group has a valid territorial claim. One of the most prominent types of normative theory of secession is remedial theories of secession. I argue that while remedial theories address the question of territorial justification, they fail to do so adequately, because their account is both arbitrary and internally inconsistent. I argue that addressing the question of territorial justification (...) non-arbitrarily and consistently requires adopting a broader and morally more plausible conception of justice than that on which remedial theories explicitly rely; and I show that this broader conception of justice is implicit in remedial theories’ account of territorial justification. Recognizing this, however, has significant implications for remedial theories, as it considerably broadens the scope of valid territorial claims, and hence of valid secessionist claims. (shrink)

This paper delves into crucial issues surrounding attempts to make flawless Qur’anic recitation, in Nigeria, a permanent tradition. The paper identifies major militating factors against an error-free recitation of the holy Qur’an in Nigeria as a basis for locating appropriate remedial programmes. The study discovered that factors such as acquisition of deficient typologies, language interference, complexity of the rules, lack of awareness dearth of specialists , dearth of relevant texts , underutilization of orthographic symbols and methodology used in imparting the (...) knowledge constitute major impediments towards achieving ideal recital of the Qur’an. In proffering relevant remedial measures like the teaching of the ideal typologies of Qur’anic recitation supported by a well planned curriculum, the paper concludes that the rectification of diagnosed deficiencies in reciting the Qur’an is feasible, in the long run, provided the intervention strategies proposed are effectively implemented. In this paper we examine the relation between technologies that aim to remediate pollution and moral responsibility. Contrary to the common view that successful remediation technologies will permit the wheels of industry to turn without interruption, we argue that such technologies do not exculpate polluters of responsibility. To make this case, we examine several environmental and non-environmental cases. We suggest that some strategies for understanding the moral problem of pollution, and particularly those that emphasise harms, exclude an important dimension (...) of morality. A common remedial response to a culture of racism, sexism, homophobia and other forms of oppression on college campuses has been to institute mandatory implicit bias training for faculty, staff and students. A critical component of such training is the identification of unconscious prejudices in the minds of individuals that impact behavior. In this paper, I critically examine the rush to rely on implicit bias training as a panacea for institutional culture change. Implicit bias training and the notion of implicit (...) bias it is grounded in is examined and the advantages and limitations of this approach is elaborated. An exclusive focus on implicit bias, it is argued, can protect ignorance rather than correct it. Similar to implicit bias, microaggressions is a concept that has played a role in campus diversity interventions. An examination of microaggression education demonstrates how it corrects for some of the pitfalls of relying on the concept of implicit bias to improve campus climate. The ambiguity that is characteristic of microaggressions, however, hints at the need to explore the type of “unknowing” that both implicit bias education and microaggression education attempt to remedy. Building on the recent scholarship around the idea of epistemic injustice, crucial insights can be gleaned about the significance of shifting the focus from lack of knowledge to a willful resistance to know. In the final section, some implications for improving campus climate are drawn out. (shrink)

This paper examines the implications of digital remediation which translates and transforms an older text, endowing it with new life, in relation to the project #LauraSpeaks, a translation and remediation of Pellegra Bongiovanni’s Risposte di Madonna Laura alle rime di Messer Francesco Petrarca, in nome della medesima. Divided into three different sections, it describes the steps involved in this project, from the discovery of the original text and the analysis of Bongiovanni’s contribution within the realm of Petrarchism, moving (...) to a discussion of the translation of her work from Italian to English and the creation of the “Twitterature” version of the text, then finally to an analysis of the text’s transformation into the film medium. This paper also investigates the theoretical premises of digital remediation and the role that hypertext plays in multiplying opportunities for meaning-making and in enriching the act of reading and writing. This paper discusses the relation between deontic logic and the study of conversational interactions. Special attention is given to the notion of remedial interchange as analysed by sociologists and linguistic pragmaticians. This notion is close to the one of contrary-to-duty (reparational) obligation, which deontic logicians have been studying in its own right. The present article also investigates the question of whether some of the aspects of conversational interactions can fruitfully be described by using formal tools originally developed in the study (...) of iterated belief change. I here adapt the latter tools to deontic logic, and attempt an account of remedial interchange (and, more generally, contrary-to-duty reasoning) in terms of commutation. One of the most notable features in recent Confucian political theory is the advocacy of political meritocracy. Though Confucian meritocrats’ controversial institutional design has been subject to critical scrutiny, less attention has been paid to their underlying normative claims. This paper aims to investigate the two justificatory conditions of Confucian political meritocracy—the service condition and the reciprocity condition—in light of classical Confucianism and with special attention to moral disagreement. Finding the normative argument for Confucian political meritocracy both incomplete (in light (...) of classical Confucianism) and implausible (under the circumstances of moral disagreement), it proposes Confucian constitutional democracy as an alternative that can meet the three conditions of the good Confucian polity—service, reciprocity, and remedy—by reconceiving the people's well-being in terms of their basic rights, as well as by promoting constitutional dialogue among the three branches of the government. It is increasingly acknowledged that cognitive impairment can play an important role in depression vulnerability. Therefore, cognitive remediation strategies, and cognitive control training procedures have gained attention in recent years as possible interventions for depression. Recent studies suggest a small to medium effect on indicators of depression vulnerability. Despite initial evidence for the efficacy and effectiveness of CCT, several central questions remain. In this paper we consider the key challenges for the clinical implementation of CCT, including exploration of potential (...) working mechanisms and related to this, moderators of training effects, necessary conditions under which CCT could be optimally administered, such as dose requirements and training schedules, and how CCT could interact with or augment existing treatments of depression. Revisiting the CCT literature, we also reflect upon the possibilities to evolve toward a stratified medicine approach, in which individual differences could be taken into account and used to optimize prevention of depression. Scientists aim to remediate artifacts in their experimental datasets. However, the remediation of one artifact can result in another. Why might this happen, and what does this consequence tell us about how we should account for artifacts and their control? In this paper, I explore a case in functional neuroimaging where remediation appears to have caused this problem. I argue that remediation amounts to a change to an experimental arrangement. These changes need not be surgical, and the (...) arrangement need not satisfy the criterion of causal modularity. Thus, remediation can affect more than just the factor responsible for the artifact. However, if researchers can determine the consequences of their remediation, they can make adjustments that control for the present artifact as well as for previously controlled ones. Current philosophical accounts of artifacts and the factors responsible for them cannot adequately address this issue, as they do not account for what is needed for artifact remediation (and specifically correction). I support my argument by paralleling it with ongoing concerns regarding the transparency of complex computational systems, as near future remediation across the experimental life sciences will likely make greater use of AI tools to correct for artifacts. This paper explores the deep historical contexts for imagining natural disasters. By focusing on a foundational event in the Western disaster imaginary – the eruption of Vesuvius in AD 79 – and its remediation across centuries, the paper suggests that the real-time aesthetic of the mediation of extreme nature events that now abounds in contemporary culture is profoundly embedded in processes of historical intermediality. The term remediation is used to denote a genuinely historical mechanism by which past and (...) present (process and event) are simultaneously made visible. Empirically, the paper investigates the superimposition of temporal dimensions in recreations of the ancient disaster from the late 18th century to the present. Using the insights gained from this spectacular case study, the paper ends by arguing that a re-temporalization of historical analysis itself is needed for history to contribute to contemporary concerns with the present as a conjuncture of multiple and conflicting time scales. How should we determine which nations have a responsibility to remedy suffering elsewhere? The problem is pressing because, following David Miller, ‘[it] is morally intolerable if (remediable) suffering and deprivation are allowed to continue . . . where they exist we are morally bound to hold somebody (some person or collective agent) responsible for relieving them’. Miller offers a connection theory of remedial responsibilities in response to this problem, a theory he has been developing over the last decade. This theory (...) is meant to serve as a guide on how we can best determine which nations are remedially responsible for alleviating suffering and deprivation elsewhere. Miller’s theory entails our following a procedure in order to determine remedial responsibility for nations. The problem is that there is an important flaw in this procedure, a flaw that previous critiques have overlooked. This essay will explain this flaw and how Miller’s theory might be reformulated into a two-tiered procedure that would take better account of this problem. Recent developments in empirical fields such as developmental psychology and neuroscience have led to a re-evaluation of empathy as a natural human faculty and the fundament of altruism and morality. This essay examines the inherent relations between empathy and human rights conceived of as moral norms. Taking into account the importance of empathy gives us a better understanding and thus reconstruction of the (evolution of) human rights protection, particularly their motivational basis. This may remedy some descriptive shortcomings of traditional human (...) rights theories regarding the relevance of emotion, altruism and human nature. However, human rights are highly complex phenomena with an important normative dimension and as such they neither can nor should be reduced to mere feelings like compassion or empathy. (shrink)

With the example of treatment of menopause-related vegetative and emotional disturbances, the author verifies the effectiveness of the use of Ignatia amara containing complex homeopathic remedies (IACCHR) as an alternative to placebo. Substantial improvement in psychological and psychosomatic symptoms was observed. Climacteric complaints diminished or disappeared completely in the majority of women (95.7% by patient evaluation and 96.2% by physician evaluation). Compared to standard pharmaceuticals, IACCHR treatment was tolerated better and lower risk of side effects was observed. The results obtained (...) in this work indicate the significant therapeutic potential of this group of treatments, which is in line with the therapeutic effect of the placebo. Nevertheless, the showing of specific effects in pharmacological tests disqualifies the investigated treatments from use in a clinical trial in place of a placebo. (shrink)

David Miller's theory of nationalism and national responsibility offers the leading alternative ‘anticosmopolitan’ theory of global justice. His theory claims that ‘nations’ may be held responsible for the benefits and harms resulting from their collective decisions. Nations may be held remedially responsible to help nations in need even where the former lack causal or moral responsibility, for example. This article critically examines Miller's position that remedial responsibilities – the responsibilities of nations to remedy others in need – can and should (...) only be satisfied by nations. I argue that the characteristics that define and justify a particular understanding of nationalism extend to further constructions of identity, such as religious affiliation and other connections. The problem with Miller's position is that it is overly narrow by focusing solely on our national identities as the characteristic most relevant for determining remedial responsibilities. In the absence of effective judicial remediation mechanisms after business-related human rights violations, companies themselves are expected to establish remediation procedures for affected victims and communities. This is a challenge for both companies and victims since comprehensive company-based grievance mechanisms are currently missing. In this paper, we explore how companies can provide effective remediation after human rights violations. Accordingly, we critically assess two different approaches to conflict resolution, alternative dispute resolution and restorative justice, for their potential to (...) provide dialogue-based, non-judicial remediation. We argue that remedy through agreement-driven ADR mechanisms risks marginalizing the interests and concerns of victims and affected community members, particularly in weak institutional contexts. Hence, we develop a dialogue-driven framework for corporate remediation of human rights violations grounded on RJ principles. This restorative framework provides a comprehensive CGM that focuses on the harms and needs of victims and aims at restoring justice through restorative dialogue. Based on a prompt discovery and a thorough investigation of the grievance, companies should design and prepare the remediation process together with victims, offenders and affected community members. Through restorative dialogue with the affected parties about the circumstances and impacts of the wrongdoing, companies can repair the harm, regain legitimacy amongst stakeholders as well as transform their business practices to avoid future human rights violations. New Jersey residents who tested their homes for radon and found more than four picocuries per liter were surveyed about their knowledge, emotions, attitudes, and intentions to take remedial action Respondents proved well informed, but radon levels were not highly correlated with any of the response variables. Overoptimism was more common than overreaction. The results suggest that active guidance is needed to ensure appropriate responses to environmental hazards, like radon, that require individual remediation. Simple information dissemination alone seems inadequate.

The ipsilesional arm of stroke patients often has functionally limiting deficits in motor control and dexterity that depend on the side of the brain that is lesioned and that increase with the severity of paretic arm impairment. However, remediation of the ipsilesional arm has yet to be integrated into the usual standard of care for upper limb rehabilitation in stroke, largely due to a lack of translational research examining the effects of ipsilesional-arm intervention. We now ask whether ipsilesional-arm training, (...) tailored to the hemisphere-specific nature of ipsilesional-arm motor deficits in participants with moderate to severe contralesional paresis, improves ipsilesional arm performance and generalizes to improve functional independence. We assessed the effects of this intervention on ipsilesional arm unilateral performance [Jebsen–Taylor Hand Function Test ], ipsilesional grip strength, contralesional arm impairment level [Fugl–Meyer Assessment ], and functional independence [Functional independence measure ]. Intervention occurred over a 3 week period for 1.5 h/session, three times each week. All sessions included virtual reality tasks that targeted the specific motor control deficits associated with either left or right hemisphere damage, followed by graded dexterity training in real-world tasks. We also exposed participants to 3 weeks of sham training to control for the non-specific effects of therapy visits and interactions. We conducted five test-sessions: two pre-tests and three post-tests. Our results indicate substantial improvements in the less-impaired arm performance, without detriment to the paretic arm that transferred to improved functional independence in all three posttests, indicating durability of training effects for at least 3 weeks. We provide evidence for establishing the basis of a rehabilitation approach that includes evaluation and remediation of the ipsilesional arm in moderately to severely impaired stroke survivors. This study was originally a crossover design; however, we were unable to complete the second arm of the study due to the COVID-19 pandemic. This article recounts the development of the Professional/problem-based Ethics Program, the original physicians’ professional ethics remediation course. Since 1992, more than 1,200 healthcare professionals of many disciplines have been mandated to attend ProBE by licensing boards and other oversight entities. Using a small-group, interprofessional setting, the ProBE Program assists participants to discover and articulate ethical underpinnings violated by their misconduct; appreciate professional responsibilities that are societal, regulatory, and ethical; and recommit to professional ideals. What do we mean by globalization? The president of Nabisco once defined it as "a world of homogeneous consumption." 2 It is a world in which everyone, no matter what latitude or longitude, eats the same food, wears the same clothing, and derives pleasure from the same entertainment. It is the world of McDonald's, Holiday Inn, James Bond movies, Nike shoes, and Coca-Cola. Noam Chomsky, in a lecture at Boston College, described globalization as the "new face of capitalism." 3 It is a network of power centered in corporate interests and financial institutions that controls the flow of capital in order to promote the financial interests of those in power to the detriment of all others. The strategies of globalization have to do with centralizing all power in financial interest, reducing all value to money, and subsuming governments to the interests of the corporations. According to Chomsky, the strategies employed by the transnational network are designed to consolidate this control:Buy the executive branch of the states involved;Own the legislative branch through lobbyists, campaign contributions, and term extensions, or whatever else may work; [End Page 31]Set the conditions in which policy is determined, asserting the power of global capital;Control the doctrine and information systems, especially to invent new needs in order to bolster a culture of fashionable consumption. 4The players in this transnational network reside in the wealthy countries of the world, especially the governments of the G8, and most especially the United States. The global dominance of the International Monetary Fund and the World Trade Organization is funded by U.S. dollars funneled to them by the network. Yet this capital is not really exchange of cash; instead, it is speculation. Chomsky commented: In the last twenty-five years, there has been a huge explosion of financial institutions and financial capital, most of it speculative, with little actual capital in the economy. The flow of capital is $1.5 trillion per day, very little of it productive. Ninety-five percent of it is destructive and speculative. The return time on investments is very rapid; eighty percent has a return time of a week, and often it is less than a day. This daily flow of capital in international markets is twice the total foreign exchange of all states together. It has been argued that the social circumstances of many children of prisoners goes against established principles of social justice. In this paper the proper allocation of responsibility for remedying this social injustice is discussed. Through a discussion of four principles for allocating remedial responsibility, it is argued that the responsibility for children of incarcerated parents is shared among several actors, including the incarcerated parent, remaining caregivers, prison officials, social work professionals, and, to some extent, members of the wider community. While incarcerated parents are partially responsible for remedying the harm caused to their children, prison officials have the responsibility to uphold the types of prison conditions under which incarcerated parents are able to fulfill their responsibilities to their children and socially contribute to their well-being. Similarly, whereas the main responsibility to care for the children of incarcerated parents falls on the caregivers (such as the remaining parent or other family relatives), states are at the same time responsible for implementing social welfare policies of the sort that can help caregivers fulfill their responsibilities for the well-being of these children. And if so, is it possible for the good to vanquish the evil, eradicating it from the face of the Earth by declaring war on evildoers and bringing them to justice? Can we overcome evil by the power of memory? In _Memory as a Remedy for Evil_, Tzvetan Todorov answers these questions in the negative, arguing that despite all our efforts to the contrary, we cannot be delivered from evil. In this work (...) on evil, memory and justice, Todorov examines the uses of memory and the spate of memorial laws in France in order to show how memory has failed as a remedy against evil and how efforts to come to grips with past evil through trials and punitive justice have failed as well. Todorov locates the fatal flaw of all these approaches in our erroneous relationship with evil as alterity, the distinction that we draw between ourselves and others that allows us to imagine ourselves in the appealing role of hero and victim and confine others to the role of villain and criminal. Similarly, in his analysis of the South African Truth and Reconciliation Commission and Cambodia’s Khmer Rouge Tribunal, Todorov argues in favor of restorative justice, which “seeks not to punish but to restore relations that should never have been interrupted” between former perpetrators and former victims. _Memory as a Remedy for Evil_ is a powerful and timely work that asks that we recognize the good and evil within each of us—and reminds us that it is only by coming to terms with evil and trying to understand it that we can hope to tame it. Whereas much of the literature in the social epistemology of scientific knowledge has focused either on scientific communities or research groups, we examine the epistemic significance of scientific/intellectual movements (SIMs). We argue that certain types of SIMs can play an important epistemic role in science: they can remedy epistemic injus- tices in scientific practices. SIMs can counteract epistemic injustices effectively because many forms of epistemic injustice require structural and not merely individual remedies. Current orthodoxy in research ethics assumes that subjects of clinical trials reserve rights to withdraw at any time and without giving any reason. This view sees the right to withdraw as a simple extension of the right to refuse to participate all together. In this paper, however, I suggest that subjects should assume some responsibilities for the internal validity of the trial at consent and that these responsibilities should be captured by contract. This would allow the researcher to impose a (...) penalty on the subject if he were to withdraw without good reason and on a whim. This proposal still leaves open the possibility of withdrawing without penalty when it is in the subject's best interests to do so. Giving researchers recourse to legal remedy may now be necessary to protect the science, as existing methods used to increase retention are inadequate for one reason or another. (shrink)

I. Introduction Two kinds of remedies have traditionally been employed for breach of contract: legal relief and equitable relief. Legal relief normally takes the form of money damages. Equitable relief normally consists either of specific performance or an injunction – that is, the party in breach may be ordered to perform an act or to refrain from performing an act. In this article I will use a “consent theory of contract” to assess the choice between money damages and specific performance. (...) According to such a theory, contractual obligation is dependent on more fundamental entitlements of the parties and arises as a result of the parties' consent to transfer alienable rights. My thesis will be that the normal rule favoring money damages should be replaced with one that presumptively favors specific performance unless the parties have consented to money damages instead. The principal obstacle to such an approach is the reluctance of courts to specifically enforce contracts for personal services. The philosophical distinction between alienable and inalienable rights bolsters this historical reticence, since a right to personal services may be seen as inalienable. I will then explain why, if the subject matter of a contract for personal services is properly confined to an alienable right to money damages for failure to perform, specific enforcement of such contracts is no longer problematic. Finally, I shall consider whether the subject matter of contracts for corporate services is properly confined to money damages like contracts for personal services, or whether performance of corporate services can be made the subject of a valid rights transfer and judicially compelled in the same manner as contracts for external resources. South Africa is a complex society filled with diversity of many kinds. Because of the enormous and profound changes of the last 20 years of democracy, this can be perceived as a society in social identity crisis which is increasingly spilling over into many areas of life. Churches have also gone through a process of reformulating their identity and have restructured theological education for all its members resulting in growing multicultural student bodies. These new student constituencies reflect a wide spectrum (...) of cultural backgrounds, personal histories and theological commitments, and represent diversity in race, ethnicity, culture, class, gender, age, language and sexual orientation. These issues of diversity are theologically complicated and contested as they are attached to religious dogma. Diversity exists as a threat and promise, problem and possibility. Using current conceptualisations of diversity in South African Higher Education this article will seek to understand the notion of diversity and difference and the possibility of developing transformative remedies within the theological education curriculum. At a White House ceremony in October 1995, the Advisory Committee on Human Radiation Experiments presented its Final Report to President Bill Clinton. The 925-page report and the over 2,000 pages of supplemental volumes summarized eighteen months of investigative research, debate, and deliberation on historical and contemporary issues in human subjects research. Can humanity be divided into good and evil? And if so, is it possible for the good to vanquish the evil, eradicating it from the face of the Earth by declaring war on evildoers and bringing them to justice? Can we overcome evil by the power of memory? In Memory as a Remedy for Evil, Tzvetan Todorov answers these questions in the negative, arguing that despite all our efforts to the contrary, we cannot be delivered from evil. In this work (...) on evil, memory and justice, Todorov examines the uses of memory and the spate of memorial laws in France in order to show how memory has failed as a remedy against evil and how efforts to come to grips with past evil through trials and punitive justice have failed as well. Todorov locates the fatal flaw of all these approaches in our erroneous relationship with evil as alterity, the distinction that we draw between ourselves and others that allows us to imagine ourselves in the appealing role of hero and victim and confine others to the role of villain and criminal. Similarly, in his analysis of the South African Truth and Reconciliation Commission and Cambodia's Khmer Rouge Tribunal, Todorov argues in favor of restorative justice, which "seeks not to punish but to restore relations that should never have been interrupted" between former perpetrators and former victims. Memory as a Remedy for Evil is a powerful and timely work that asks that we recognize the good and evil within each of us--and reminds us that it is only by coming to terms with evil and trying to understand it that we can hope to tame it. The authors relate the major groups involved in the desegregation of Boston's public schools to divergent understandings of rights in America's political and religious traditions. After an initial historical review, the authors suggest that the desegregation controversy may be understood as a conflict between a natural law theory of rights which requires remedial action to correct injustices and a traditionalist theory which sanctions prevailing liberties. In Boston, one natural law position is represented by black parents and the Federal court's desegregation (...) orders. Another position is represented by many white parents, who base their opposition to desegregation on a traditionalist notion of natural law. The authors suggest that any permanent resolution of the conflict must address these divergent understandings of natural law, as well as the political realities peculiar to Boston. (shrink)

In response to the big data era trend, statistics has become an indispensable part of mathematics education in junior high school. In this study, a pre-test and a post-test were developed for the six attributes of the data distribution characteristic. This research then used the cognitive diagnosis model to learn about the poorly mastered attributes and to verify whether cognitive diagnosis can be used for targeted intervention to improve students' abilities effectively. One hundred two eighth graders participated in the experiment (...) and were divided into two groups. Among them, the intervention materials read by the experimental group students only contained attributes that they could not grasp well. In contrast, the reading materials of the control group were non-targeted. The results of the study showed the following: The variance and the weighted average were poorly mastered by students in the pre-test; compared with the control group, the average test score of the experimental group was significantly improved; in terms of attributes, the experimental group students' mastery of variance and the weighted average was significantly improved than the pre-test, while the control group's mastery was not. This article examines the absence of biological relatedness in couples where the use of a third-party gamete donor casts doubt on the notion of conventional kinship. The authors observe that individuals who have used technology to create a family remediate relatedness through a dehistoricized idea of kinship in which the traditional concept is replaced with the concept of chance. The article also examines how inherited value is replaced by strategies that redefine the ways in which donor gamete parents can pass (...) their values on to their children. This examination is accomplished by looking at how couples who used donated gametes articulate the ways in which familial relatedness is left open to chance. (shrink)

This paper investigates necessary conditions for developing a participatory, rightsholder-driven approach to remedy for business-related human rights abuses by analyzing findings from a case study with the Fair Food Program. With the inclusion of human rights into discussions of business ethics and CSR, scholars and practitioners have made calls for participatory approaches to remedy to address cases of human rights abuses. However, a gap remains in our understanding of how to operationalize participatory approaches in a manner that empowers rightsholders, particularly (...) within contexts of severe power imbalances. The paper puts forth a rightsholder-driven theoretical framework for remedy, grounded on critical dialogic accountability principles and integrated with empirical analysis from the Fair Food Program case study. This framework defines remedy as a system comprising reinforcing aspects rather than standalone mechanisms. The critical dialogic accounting and accountability framework provides a theoretical framing of engagement that enables the inclusion of multiple, divergent voices and aims toward meaningful engagement with marginalized groups. The analysis of findings from the case study identifies enforcement and education as necessary conditions for effective and empowering rightsholder-driven approaches to remedy. The paper deconstructs these conditions to develop an understanding of the program’s unique approach to enforcement and education. The paper concludes by discussing the implications of rightsholder-driven remedy for Business and Human Rights and business accountability. (shrink)
