The principle of subsidiarity can be an effective tool for adjusting economic systems and establishing the social rule-of-law concept in public organisation. In considering the usability of the principle of subsidiarity, the following aspects thereof are discussed: the role in the development of the European social model; employment in determining limits for the powers of the public and private sectors; the application in the market and planned economy systems; and the social justice function in the development (...) of a social welfare state. The principle of subsidiarity as an instrument for individuals’ interests, balancing and adjusting in the regulation of economic systems, helps to establish the relative sizes of public policy and the market, as subsidiarity can help ensure a more equitable distribution of public goods while guaranteeing the maintenance of the creative potency of operators and minimal satisfaction of vital needs of individuals unable to contribute to the production of goods. It amounts to a constitutional measure determining the balance of productive and protective state, thus ensuring the stability of the state organisation. In the concept of a social rule-of-law state, subsidiarity draws clear limits to the state’s powers, institutionally bringing together efforts of all members of the community to achieve welfare in the state. The paper starts with a case study of a medium-sized company in which a strong and successful change in the organisational form and job design took place. A bureaucratic organisation with highly-specialised jobs was converted into a new organisation in which employees became much more autonomous in managing their own work. This not only entailed new techniques and managerial systems but also a new anthropological vision. Bureaucratic rules were reduced, but not eliminated completely, and management became less authoritarian. Employees could (...) therefore apply greater entrepreneurial spirit, developing their talents in pursuit of the company’s common goals. It is argued that this new organisational form is ethically superior to the old, and reflects the basic requirements of the principle of subsidiarity. The ethical principle of subsidiarity holds that a larger and higher-ranking body should not exercise functions which could be efficiently carried out by a smaller and lesser body; rather the former should support the latter by aiding it in the coordination of its activities with those of the greater community. While the principle has usually been applied in a political context, this paper explores the principle as a moral base for organisational forms within business organisations. Finally, the principle of subsidiarity is analysed in the context of business organisations and proposed as an ethical guideline for organisational forms. This would help to mitigate the effects of those bureaucracies in which individuals, with their dignity, freedom, diversity and capacity for undertaking business activities with entrepreneurial spirit, are often not fully appreciated. Prysukhin “The Principle of Subsidiarity: Lessons from the Social Teaching of the Catholic Church” analyzes the achievements of the Social Teaching of the Catholic Church, represented by the works of Leo XIII, Pius XI, Pius XII, John Paul II, revealing the meaningful characteristics of the concept of “the principle of subsidiarity”, its role and meaning in the system of Christian values. The principle of subsidiarity makes possible such relationships in social (...) life, when the community of higher order does not interfere in the internal life of the community of the lower order, taking over the proper functions of that function; for the common good it gives it when necessary support and assistance, thereby coordinating its interaction with other social structures. The principle of subsidiarity guides social practice to the promotion of the common good in the human community. The spread and application of the principle of subsidiarity opposes the danger of "nationalization" of society and the most terrible manifestations of collectivism, restricts the absoluteization of power, bureaucratization of state and socio-cultural structures, becoming one of the guarantors of respect for the rights and freedoms of citizens of their country. Drawing on the principle of subsidiarity, this article develops a framework for allocating medical decision-making authority in the absence of capacity to consent and argues that decisional authority in paediatric transgender healthcare should generally lie in the patient. Regardless of patients’ capacity, there is usually nobody better positioned to make medical decisions that go to the heart of a patient’s identity than the patients themselves. Under the principle of subsidiarity, decisional authority should only be held by (...) a higher level decision-maker, such as parents or judges, if lower level decision-makers are incapable of satisfactorily addressing the issue even with support and the higher level decision-maker is better positioned to satisfactorily address the issue than all lower level decision-makers. Because gender uniquely pertains to personal identity and self-realisation, parents and judges are rarely better positioned to make complex medical decisions. Instead of taking away trans youth’s authority over their healthcare decisions, we should focus on supporting their ability to take the best possible decision for themselves. (shrink)

In this work, we present some traits of the socio-political and economic thought of Giuseppe Toniolo, who lived in Italy at the turn of the XIX and XX century, with special reference to the contribution that the Italian economist and sociologist gave to the definition and implementation of the principle of subsidiarity and to the ethical foundation of economic science. After outlining the definition of the subsidiarity principle in the first paragraph, we sketch the historical background (...) in which Toniolo lived and operated. We then focus on the ethical factor and on the concept of subsidiary State emerging from Toniolo’s writings. Globalisation, repeated economic (financial) crisis and other contemporary social processes are changing the capability of the state to provide individual social security and guarantee human rights. There is therefore a need to review social policy guidelines and their implementation measures. The problem is how to develop the social security system of state, so that human rights are not violated. For the reformation of the social security system to be consistent, it is also necessary to determine the principles on which the (...) social security system should be based. This article examines the concept of the principle of subsidiarity and its impact on the implementation of socio-economic human rights. The goal of this research is to explore theoretical aspects of application of principle of subsidiarity for ensuring the protection of socio-economic human rights and development of the policy of social security in Lithuania. In order to achieve this goal, the research starts from the analysis of the concept and origin of the principle of subsidiarity and its impact on the implementation of human rights. Further the constitutional basis and levels of application of this principle for implementation of socio-economic human rights are studied. Lastly, according to the principle of subsidiarity, some relevant issues of Lithuanian social security system are evaluated. (shrink)

The right to ‘domestic remedies’, which ideally connects ‘subsidiarity’ and ‘embeddedness’ of the ECHR in the legal systems of member States, is deemed to play a crucial role for the Strasbourg machinery survival as well as for an effective protection of human rights, especially in the field of the ‘reasonable-time’ requirement. In this respect the Italian case seems an excellent test. Once a compensatory remedy was introduced in the Italian legal system by Law No. 80 of 2001 (the ‘Pinto (...) Act’), it soon appeared that such a remedy could be considered ‘effective’ in so far as it was implemented in accordance with the ECtHR’s jurisprudence. Therefore a legal tool for the interaction between ECtHR and Italian courts had to be found. Nevertheless, the results of this interaction might suggest that the domestic remedy has neither increased the protection of the reasonable-time requirement in Italy nor is it the final solution to the ECtHR’s overload. The social principle of subsidiarity, both regarding the federalism debate in North America and the principle’s role in the formation of the European Union, has garnished increased attention in recent years. In this paper I will argue that if one looks for the historical seed of the principle of subsidiarity in Aristotle—as many authors do—then attention should fall more properly on his analysis of practical reasoning in Book VI of the Nicomachean Ethics than on Book (...) I of the Politics. The treatment of practical reasoning more aptly explains the need for the principle of subsidiarity and, indeed, averring that it is based on an Aristotelian sense of autonomy is misplaced at best and dangerous at worst. Subsidiarity is often implicitly conceived as an organizational model or a Weberian ideal type. The purpose of this paper is to show that, in contrast, subsidiarity is a principle in the sense of the tradition originating from Thomas Aquinas. Considered as an ideal type, subsidiarity may be perceived as impossible to apply because of its ideal status, abstracted from the circumstances. Here, we will demonstrate the consequences of the fact that subsidiarity is one of the (...) common principles of practical moral reasoning of particular prudence. Because it is a principle, subsidiarity does not have a visualizable substance or prescribe an organizational model, unlike the ideal type. It thus avoids the indiscriminate application of organizational models to contexts that are not appropriate, and in the context of tension between external consultants and managers, it rehabilitates the prudence of leaders who know the circumstances of their organization. This commentary defines what shared yet differentiated ethical responsibilities to tackle antimicrobial resistance (AMR) mean, by introducing a threefold principled account of AMR global governance. It argues that the principles of solidarity, subsidiarity, and stewardship can be especially helpful for further justifying some of the universal, differentiated, and individual responsibilities that Van Katwyk et al propose. The upshot of my threefold principled account of AMR global governance is a less ambitious AMR treaty, one that can only justify (i) universal (...) duties of global coordination (as per the principle of solidarity); (ii) differentiated duties to local communities, which bear the primary AMR responsibilities (as per the principle of subsidiarity); and (iii) individualized duties for ensuring truthful, evidence-based, consistent, and timely shared accountable communication (as per the principle of stewardship). This article describes and proposes the “environmental subsidiarity principle” as a guiding ethical value in forestry governance. Different trends in environmental management such as local participation, decentralization or global governance have emerged in the last two decades at the global, national and local level. This article suggests that the conscious or unconscious application of subsidiarity has been the ruling principle that has allocated the level at which tasks have been assigned to different agents. Based on this (...) hypothesis this paper describes the principle of subsidiarity and its application to environmental policies within forest governance and proposes the “environmental subsidiarity” principle as a critical conceptual tool for sustainable resource management. The paper explains as an example how “environmental subsidiarity” is the key principle that can link payment for ecosystem services (PES) with environmental public policies and applies this principle with all its political consequences to reducing emissions from deforestation and forest degradation, and enhancing forest carbon stocks in developing countries (REDD+) architecture. It concludes by showing how the adoption of “environmental subsidiarity” as a ethical principle could help to maximize benefits to all stakeholders involved in PES schemes such as REDD+. (shrink)

Referring to the phenomenon of structural injustice resulting from unintended consequences of the combination of the actions of many people, Iris Marion Young claims for a new understanding of responsibility. She proposes what she calls a social connection model of responsibility which assigns responsibility to individuals also for participating in ongoing structural and social processes. To remedy structural injustice Young claims for collective action of various actors in society and assigns different degrees of responsibility depending on the agent’s position within (...) the structural process. However, although Young mentions power, privilege, interest, and collective ability as parameters influencing the degree of an actor’s responsibility to contribute to structural change she does not elaborate which responsibilities concern which groups in society. As we will outline in our contribution, we hold the tenet of subsidiarity to be a useful supplement to the conception of Iris Marion Young which would allow for assigning such responsibilities to different layers in society. However, since the tenet of subsidiarity is only a supple principle which does not distinguish between different kinds of duties, we propose to enrich the tenet of subsidiarity by the Kantian conception of perfect and imperfect duties. In the science of administrative and constitutional law, administration science and many other sciences, including political science, it is widely accepted that the basic, inherent feature of a municipality, deciding the essence of the territorial self-government unit as an entity of public administration, is the self-reliance it is entitled to. The self-reliance of territorial self-government units is even defined as a constitutional norm.In principle, self-reliance is perceived as a fundamental attribute of a decentralised public authority and constitutes one of (...) the fundamental systemic principles of the Republic of Poland. It was formulated expressis verbis in art. 165 par. 2 of the Constitution of the Republic of Poland, which states that the self-reliance of territorial self-government units is subject to judicial protection, meaning that TSGUs can defend themselves against illegal attempts, not grounded in the law to interfere in their self-reliance. This protection seems to encompass both the private-law and public-law spheres of territorial self-government activity.The essence and guarantees of territorial self-government units’ self-reliance also arise from other constitutional principles, including the aforementioned decentralisation principle, subsidiarity principle, separation of powers, supremacy of the nation and democratic state under rule of law.The goal of this article is to interpret the principle of municipal self-reliance in the context of constitutional principles of law, in the light of the Polish Constitution. A European Account of Justice: Under Pressure of Subsidiarity? This paper provides a dialectical-historical description of the EU's constitutional discourse. It is argued that the early Community's member state blind principle of justice implied the notion of a European political community and led to the establishment of fair procedures for decision making. This coming of age of an encompassing European constitutional narrative of justice and fairness prompted the question of the demarcation between the political role of the European (...) political community and that of member states' political communities. The answer proved to be subsidiarity. However, subsidiarity has introduced national conceptions of justice in the Union's constitutional discourse, at the risk of making European justice dependent on national conceptions of justice. This article analyzes six ethical principles at work in the Pastoral Letter of the Roman Catholic Bishops on the United States economy. The first three principles derive from the Thomistic tradition with its attempt to avoid the extremes of collectivism and individualism. Human beings are by nature social and called to live in political society. The principle of subsidiarity guides the role of the state. Distributive and social justice furnish the criteria for a just distribution of human goods. (...) The fourth ethical principle which is a later development in the Catholic tradition recognizes human rights including economic rights. In keeping with recent emphases in Catholic teaching the fifth principle insists that the goods of creation exist to serve all and stresses the social aspect of property. The philosophical origins of the principle of subsidiarity must be understood historically. This chapter argues that the critical point for the emergence of the principle lay in Thomas Aquinas’s theological interpretation of Aristotle’s political philosophy and his application of it to the institutional pluralism of medieval Europe. From Aristotle, Aquinas developed the idea that human societies naturally progress from families, through villages to entire city-states, but he recognised that what Aristotle said of city-states could be applied not (...) only to cities but even more emphatically to political communities on the scale of provinces, kingdoms and empires. Moreover, for Aquinas, the civil order was not the only ‘perfect community’ in Aristotle’s sense: there was also the church in all of its many grades and jurisdictions, alongside the many different religious orders and fraternities of medieval Europe, some of them also organised into their own graded hierarchies. Reflecting on the complexity of the society surrounding him, Aquinas acknowledged the many and various purposes for which various associations and forms of human community exist and are formed, giving rise to a whole host of familial, geographical, professional, mercantile, scholarly and other specialised societies. All of these groups and groupings, from the smallest to the largest, have their place and their proper function, according to Aquinas, and each should to be allowed to make its unique and special contribution as a means to integral human fulfillment, without undue interference from any others, including the state. Every country must allocate final decision-making authority over different issues/subjects within its boundaries. Historically, many scholars working on this topic implicitly assumed that identifying the features providing entities with justified claims for authority and the entities possessing those features would also identify which groups should have which powers (or vice versa). However, many candidate allocative principles select multiple entities as candidates for some sub-state authority and yet fail to explain which powers each should possess. Further work must explain which groups (...) should possess which powers when and what to do when two groups can make equally-valid authority claims using the same principle. Subsidiarity, the principle under which authority should presumptively belong to the entity representing those ‘most affected’ by its exercise and capable of addressing underlying problems, is one of the few principles focused on identifying which groups should have which powers. Unfortunately, subsidiarity alone does not provide guidance on many issues/subjects. Useful subsidiarity-related guidance relies on balancing underlying justificatory interests, which do the real allocative work. Another allocative principle remains necessary. A deflationary account of subsidiarity’s allocative potential nonetheless provides insights into how to articulate a new principle and accounts of subsidiarity that can fulfill other moral roles. Are businesses stronger with DEI practices and ideas or weaker? We believe that the DEI movement is asking the right questions: How do we create more just and equitable institutions? The challenge, however, is whether this movement is giving the right answers to such (...) questions. The main premise of our paper is that without deeper principles than DEI itself, these qualities of corporate life will be misunderstood, misused, and disordered in our increasingly fragmented and politicized culture. We propose in this essay that “subsidiarity” serves as one of those deeper principles that can order and enrich our understanding of DEI. It serves as a gift principle that begins to reveal the deepest nature of our work, namely, that our work allows us to exercise our gifts in serving others. (shrink)

How should a political society be structured so as to legitimately distribute political power? One principle advanced to answer this question is the principle of subsidiarity. According to this principle, the default locus of political power is with the lowest competent political unit. This article argues that subsidiarity is a structural principle of a conception of political legitimacy informed by epistemic considerations. Broadly, the argument is that political societies organised according to the principle (...) of subsidiarity can more effectively achieve political decisions that can justifiably appear to be correct from the point of view of those subject to them. The article presents two considerations in order to establish a pro tanto case for acting separately before presenting five additional epistemic considerations that establish a prima facie case for acting separately. The article then shows that political legitimacy and the epistemic aim of decision-making can sometimes be served more effectively and efficiently by allowing higher-level political units to assist lower-level political units. Subsidiarity, i.e., “the principle of subsidiarity,” i.e., “the principle of subsidiary function/responsibility,” i.e., the principle that it is unjust for a higher authority to usurp the self-governing authority that lower authorities, acting in the service of their own members, rightly have over those members, is a presumptive and defeasible, not an absolute, principle. But it excludes any general policy or aim of assuming the control or managerial direction of lower groups. Its deepest rationale is (...) the intrinsic desirability of self-direction, a good that is to be favored and respected even at the expense of some efficiency in the pursuit of other goods. Though arising out of Aristotelean moral and political theory, it denies or strongly disambiguates a cardinal principle of Aristotelean political theory. After coming into force of the Treaty of Lisbon it is acknowledged that better control and respect of the principle of subsidiarity is one of the most important and innovative goals of the Treaty. To achieve this goal, the Treaty introduces a mechanism which, apart from checking compliance of draft legislative acts with that principle, may eventually lead to a draft act to be deleted from the legislative agenda of the European Union on grounds of violation of (...) subsidiarity. Within this mechanism, crucial role is attributed to the national parliaments of the Member States. In this article, the reasons for overall inclusion of national parliaments in the European Union (hereinafter EU, the Union) activities are analysed. The role of national parliaments in the EU according to the specific provisions of the EU treaties is also discussed and the largest part of the work is devoted to the ex ante subsidiarity principle control mechanism (the Early Warning System), which gives the right for the national parliaments to influence the EU legislative process. Subsidiarity is a key term in the development of the European Union. The word itself was unknown in the English language until recently when it was first used and immediately became a key concept in the European political discussion. Since then, everyone is using it according to their own interpretation and purpose. From the extreme left to the extreme right, from the Euro-sceptics to the Euro-enthusiasts, the term is used to justify contradictory points of view.Is it because its meaning (...) is so vague that anyone can use it at will? Is it because this concept, which seems at first hand to be so clear, does not mean anything and is useless in rethinking the renewal of social organization? The European purpose in introducing the subsidiarity principle was to give a place to intermediary communities, but the whole ambiguity of the concept is related to the comprehension of what is called a community. This in its turn is related to the view one has of what a human being is, and of the importance of his relationship with others for the constitution of his identity.If a community is part of the human identity, this has a deep influence on the understanding of what a community is, and the consequences of the principle of subsidiarity point towards much more than a mere principle of political federalism. Jane Jacobs’s classic 1961 book, The Death and Life of Great American Cities, famously indicted a vision of urban development based on large scale projects, low population densities, and automobile-centered transportation infrastructure by showing that small plans, mixed uses, architectural preservation, and district autonomy contributed better to urban vitality and thus the appeal of cities. Implicit in her thinking is something that could be called “the urban good,” and recognizable within her vision of the good is the principle of (...) subsidiarity—the idea that governance is best when it is closest to the people it serves and the needs it addresses—a principle found in Catholic papal encyclicals and related documents. Jacobs’s work illustrates and illuminates the principle of subsidiarity, not merely through her writings on cities, but also through her activism in New York City, which was influential in altering the direction of that city’s subsequent planning and development. A common criticism of the Green New Deal proposal to address climate change is that it would centralize too much power at the level of the federal government. However, the Green New Deal can avoid this by centering local action and decision-making in keeping with the principle of subsidiarity from Catholic social ethics. This principle holds that higher levels of society should not override the initiative of lower levels of society but should instead coordinate and support their (...) work whenever possible. Contact between culturally distinct human groups in the contemporary ‘glocal’ -global and local- world is much greater than at any point in history. The challenge we face is the identification of the most convenient ways to organise the coexistence of different human language groups in order that we might promote their solidarity as members of the same culturally developed biological species. Processes of economic and political integration currently in motion are seeing increasing numbers of people seeking to become polyglots. Thus, (...) English is establishing itself as the usual world supra-language, although it coexists with other lingua francas that are widely used in certain parts of the globe. All this communicative reorganization of the human species may very well pose new problems and aggravate existing tensions as regards language and identity. It would seem that these processes comprise at least four major conceptual dimensions which must be taken into account above all else, as they are both widespread and, left unaddressed, may lead to significant social instability. These dimensions concern linguistic recognition, communicability, sustainability and integration. While accepting the utility of having an inter-national language, the keystone of the system is clearly that it must ensure the linguistic sustainability of each group. The basic principle is likely to be functional subsidiarity, i.e., whatever can be done by the local language should not be done by another one which is more global. As in the quote from Paracelsus --“the dose alone makes the poison”-- contact between languages is not ‘poisonous’ per se, but when the correct dose is exceeded it can prove harmful to the language whose position is weaker. Catholic Social Teaching (CST), or Catholic social doctrine, has been reinforced on the magisterial level by the commemorations of the encyclical by Pius XI, Paul VI, and John Paul II. It should be noted, then, that the tradition of CST is comparatively recent. Indeed, it is nearly coextensive with the twentieth-century. Nevertheless, this short tradition already calls for a ressourcement. As Russell Hittinger has pointed out, reflections on CST often move swiftly to the particulars of social issues without an adequate grasp even of its basic concepts: subsidiarity, solidarity, the common good, and the dignity of the person. Further, historical [End Page 1101] developments have had dramatic impact upon the ways in which these principles have been received and developed in the course of this young tradition.In his book Social Justice and Subsidiarity: Luigi Taparelli and the Origins of Modern Catholic Social Thought, Thomas C. Behr provides a major contribution to just such a ressourcement. He does this by presenting an introduction to the thought of the Jesuit scholar whose revival of Thomistic thought in a modern register formed the basis for Leonine social teaching. As Behr explains, Taparelli has remained a somewhat hidden figure in accounts of the genesis and development of CST. He goes unmentioned in the major social encyclicals of Leo and Pius, despite the fact that Leo himself was Taparelli's student. Because of his rhetorically and philosophically potent critique of Enlightenment thought and its effect on mid-nineteenth-century Europe, available to a popular audience through his frequent contributions to the Jesuit periodical La Civiltà Cattolica, Taparelli's name carried baggage for a Church that sought to move beyond the posture of reaction to liberal political orders.However, as Behr shows in the introduction, Taparelli hardly rejected the methods and insights of modern political thought tout court. Behr describes Taparelli's system as a "realist social science." This terminology speaks to the promise which Taparelli found in the sociological analysis of Montesquieu in particular. Though Taparelli judged that Montesquieu held a questionable preference for a republican political form, he greatly admired Montesquieu's ability to, as Behr puts it, "bring political theory into relationship with social theory and historical contingency" (8). Though Taparelli was not familiar with the work of Alexis De Tocqueville, Behr also notes the resonances between Taparelli's work and Tocqueville's political sociology and defense of "intermediary institutions." Yet Taparelli makes up for what the sociological approaches of Montesquieu and Tocqueville lack in the way of natural, teleological principles of politics. Behr alerts the reader from the very beginning of his work that, in approaching Taparelli, he will not find a simple recapitulation of Thomas, but rather a creative approach to political thought which aims to set what is worthy in the modern empirical methodologies on firmer foundations through the recovery of Thomistic-Aristotelian principles.In chapter 1, "Taparelli and the Age of Ideology," Behr situates Taparelli within the political conflicts of the early nineteenth century. Behr sets the scene for Taparelli's renovated Scholasticism by explaining the opposition between Catholic traditionalism (represented especially by Joseph De Maistre and Donoso Cortés) and Catholic liberalism (represented especially by Henri Dominique Lacordaire and his more radical associate Felicité de Lammenais). Distributivism holds that private property should be widely distributed among as many as possible and that such a distribution best serves the common good. This paper applies a distributist approach rooted in subsidiarity to the contemporary issue of the unaffordability of single-family homes and the impact of investors buying up more single-family homes, increasing their own wealth at the expense of typical home buyers. Here, we will first consider multiple factors in the housing “crisis,” then highlight the impact of (...) investors on the market. Second, we will consider a critique and analysis of the situation from a distributist perspective, rooted in principles of private property, solidarity, dignity, and subsidiarity (particularly turning to G.K. Chesterton's view on the importance of home). Due consideration is given to some objections to such a distributist critique, with response. Finally, several examples of proposals and implemented practices are provided to discourage this growing trend concerning the concentration of ownership of housing by investors and to better enable homeownership by families. The apportionment of responsibility for health policy within multi‐level states should be sensitive to a number of conflicting normative pressures, some of which militate for placing decision‐making authority at the higher reaches of policy‐making structures, while others would seem to require placing them lower down this structure. The principle of subsidiarity is a structural principle that addresses in a manner that is neutral with respect to these values a way of addressing the conflicting claims of these values. (...) Standard accounts of federalism fare poorly with respect to the criterion of subsidiarity. While central governments are at first glance better equipped to apply such a principle to the issue of the distribution of authority, there are strong empirical grounds for thinking that centralized governments will non‐neutrally privilege central authorities in applying the principle. Federal structures that admit of overlapping jurisdictions, and that therefore require that deliberation among federal parties occur as a condition of the problem of the distribution of powers over health care being solved, are most amenable to solving problems of distribution of authority. This essay will reflect on the importance of Catholic social teaching in public health ethics, especially in the context of the global COVID-19 pandemic. Catholic social teaching will be presented as being continuous with Catholic moral teaching—while the latter sets out norms and prohibitions often in relation to individual agents and their actions, the Church’s social doctrine invites us to think of the community and social dimension of the moral good. To illustrate this continuity of doctrine, I will argue that (...) the COVID-19 pandemic has shown a need for a serious evaluation of the relationship between public health and the common good, in light of the far-reaching and long-lasting public health measures that have been used around the world, such that the good of health has dominated considerations of almost all other aspects of life. The essay considers contemporary surveillance strategies from a Christian ethical perspective. It discusses first surveillance as a form of speech in the light of biblical themes of truthfulness, then draws on principles of subsidiarity and solidarity. Surveillance is dignified as human work whilst its dehumanizing outcomes are challenged. It is concluded that surveillance must contribute to human dignity and that accountability for data must follow a revised model of subsidiarity, appropriate to network rather than linear socio-political relationships. In response to challenges to moral philosophy presented by other disciplines and facing a diversity of approaches to the foundation and focus of morality, this paper argues for a pluralist meta-ethics that is methodologically hierarchical and guided by the principle of subsidiarity. Inspired by Deweyan pragmatism, this novel and original application of the subsidiarity principle and the related methodological proposal for a cascading meta-ethical architecture offer a “dirty” and instrumentalist understanding of meta-ethics that promises to work, (...) not only in moral philosophy but also in the (rest of the) real world, and that facilitates collaboration with other disciplines outside moral philosophy. This paper questions an exclusively state-centred framing of global health justice and proposes a multilateral alternative. Using the distribution of COVID-19 vaccines to illustrate, we bring to light a broad range of global actors up and down the chain of vaccine development who contribute to global vaccine inequities. Section 1 (Background) presents an overview of moments in which diverse global actors, each with their own priorities and aims, shaped subsequent vaccine distribution. Section 2 (Collective action failures) characterises collective action failures (...) at each phase of vaccine development that contributed to global vaccine disparities. It identifies as critical the task of establishing upstream strategies to coordinate collective action at multiple stages across a range of actors. Section 3 (A Multilateral model of global health governance) takes up this task, identifying a convergence of interests among a range of stakeholders and proposing ways to realise them. Appealing to a responsibility to protect (R2P), a doctrine developed in response to human rights atrocities during the 1990s, we show how to operationalise R2P through a principle of subsidiarity and present ethical arguments in support of this approach.
