This paper shows how the critical questions matching an argumentation scheme can be mod-eled in the Carneades argumentation system as three kinds of premises. Ordinary premises hold only if they are supported by sufficient arguments. Assumptions hold, by default, until they have been questioned. With exceptions the negation holds, by default, until the exception has been supported by sufficient arguments. By “sufficient arguments”, we mean arguments sufficient to satisfy the applicable proof standard.

According to the argument scheme approach, to evaluate a given scheme-saturating instance completely does entail asking all critical questions relevant to it. Although this is a central task for argumentation theorists, the field currently lacks a method for providing a complete argument evaluation. Approaching this task at the meta-level, we combine a logical with a substantive approach to the argument schemes by starting from Toulmin’s schema: ‘data, warrant, so claim’. For the yet more general schema: ‘premise; if premise, (...) then conclusion; so conclusion’, we forward a meta-level CQ-list that is arguably both complete and applicable. This list should inform ongoing theoretical efforts at generating appropriate object-level CQs for specific argument schemes. (shrink)

This paper offers insights into the nature and design of critical questions as they are found in argumentation schemes. In the first part of the paper, I address some general concerns regarding their purpose and formulation. These include a discussion of their evaluative function, their relationship with the patterns of reasoning they accompany, as well as the differing formulations of critical questions currently on offer. I argue that the purpose of critical questions for humans (...) ought to be to provide the means for a scalar evaluation of the reasoning at hand. To do so, critical questions should be closely paired with individual premises in the accompanying pattern of reasoning and be open-ended. Doing so allows the roles of raising considerations relevant for the reasoning and scrutinizing those considerations to be clearly distinguished. In the second part of the paper, I offer a positive methodological proposal for the construction of questions and premises that aims at overcoming a number of the individual and systematic shortcomings of extant question styles. The paper concludes by arguing that the newly proposed approach is both normatively strong and practically useful for argumentation in context. (shrink)

Critical questions have been understood in the framework of argument schemes from their conception. This understanding has influenced the process of evaluating arguments and the development of classifications. This paper argues that relating these two notions is detrimental to research on argument schemes and critical questions, and that it is possible to have critical questions without relying on argument schemes. Two objections are raised against the classical understanding of critical questions based on (...) theoretical and analytical grounds. The theoretical objection presents the assumptions that are embedded in the idea of argument schemes delivering questions to evaluate arguments. The analytical objection, on the other hand, exposes the shortcomings of the theory when critical questions are used to evaluate real-life argumentation. After presenting these criticisms, a new theory of critical questions is sketched. This theory takes into account the dynamics of dialectical discussions to describe the function of critical questions and their implications for evaluating arguments. (shrink)

The dynamic nature of design studio pedagogy has witnessed numerous paradigm shifts as tools and technologies associated with its professional practice have evolved. Generative artificial intelligence (particularly text-to-image) appears to be one such emerging tool with the potential to impact architecture pedagogy. Grounded in two semesters of jury observations and discussions across five design studios, this paper presents a debate addressing the advantages and disadvantages of employing emerging technology in the workflow of the architectural design studio. The debate is based (...) on the self-declared usage of generative AI across 41 instances among 221 public juries. The debate table was developed in the first semester and completed and refined in the second semester. The outcome presents an argument for the necessity of developing a framework for the utilization of generative AI in the design studio pedagogy. While AI image generation offers benefits such as design versatility and enhanced creative exploration, this research critically analyses its drawbacks, including potential bias, loss of attention to essential architectural qualities such as human scale, abstraction, and a tendency to produce designs that defy the reality of architectonics. The debate argues for a balanced approach, advocating for the harmonious coexistence of AI with traditional design methods. As generative AI becomes increasingly prevalent in architectural practice, its inclusion in the curriculum is essential. We propose that AI can empower students to confidently express their design ideas, but emphasize the need for a human-centric design approach. Ultimately, this debate extends its relevance beyond architecture to encompass various creative disciplines, highlighting the importance of navigating the transformative impact of AI on design education. Affect control theory (ACT) is a sociological theory developed for modeling and predicting emotions and social behaviors in social interaction. In this commentary, I identify a few potential problems in the theory, as presented in the target article (Rogers, Schröder, & von Scheve, 2014) and elsewhere, and in its suggested compatibility with other major emotion theories. The first problem concerns ACT’s capacity to model emotion generation insofar as emotions have nonconceptual content. The second problem focuses on the limits of modeling (...) interaction on the basis of fixed affective meanings of identities. Finally, ACT has problems with explaining the dynamic change of affective meanings, given its tenets that people seek to maintain the established affective meanings of social roles and situations and deflections are not expressed in behavior but compensated by identity-confirming behavior. Instances of the ad baculum argument (also known as the threat appeal argument or the argument from threat) are common in both private and public sphere discourse. Although contemporary argumentation scholarship recognizes these instances as contingently fallacious, the literature lacks not only a well-motivated ad baculum argument scheme but also a complete list of critical questions (CQs). In combining argument scheme and speech act theoretic elements, we formulate the felicity conditions of the speech act of threatening from the (...) viewpoint of a rational third party and use the recognition conditions of this speech act to construct the ad baculum argument scheme and its correctness conditions to construct the CQs. Results include revised felicity conditions of the speech act of threatening, a new ad baculum argument scheme, and a set of arguably complete, functionally distinct CQs. (shrink)

The Nature and Status of Critical Questions in Argumentation Schemes.

Authority arguments generate support for claims by appealing to an agent’s authority status, rather than to reasons independent of it. With few exceptions, the current literature on argument schemes acknowledges two basic authority types. The _epistemic_ type grounds in knowledge, the_ deontic_ type grounds in power. We review how historically earlier scholarship acknowledged an_ attractiveness-based_ and a _majority-based_ authority type as equally basic type. Crossing these with basic speech act types thus yields authority argument sub-schemes. Focusing on the_ epistemic-assertive_ sub-scheme (...) (‘an epistemic authority _A_ _E_ asserts a proposition _P_’), we apply a meta-level approach to specifying critical questions. Results improve the evaluation of this sub-scheme and show how similar improvements are obtainable for other schemes. (shrink)

Whether abduction is treated as an argument or as an inference, the mainstream view presupposes a tight connection between abduction and inference to the best explanation. This paper critically evaluates this link and supports a narrower view on abduction. Our main thesis is that merely the hypothesis-generative aspect, but not the evaluative aspect, is properly abductive in the sense introduced by C. S. Peirce. We show why equating abduction with IBE unnecessarily complicates argument evaluation by levelling the status of abduction (...) as a third reasoning mode. We also propose a scheme for abductive argument along with critical questions, and suggest retaining abduction alongside IBE as related but distinct categories. (shrink)

While courts depend on expert opinions in reaching sound judgments, the role of the expert witness in legal proceedings is associated with a litany of problems. Perhaps most prevalent is the question of under what circumstances should testimony be admitted as expert opinion. We review the changing policies adopted by American courts in an attempt to ensure the reliability and usefulness of the scientific and technical information admitted as evidence. This paper begins a working through of Blair’s (2001) theoretical agenda concerning argumentation schemes and their attendant critical questions, in which we propose a number of solutions to some outstanding theoretical issues. We consider the classification of schemes, their ultimate nature, their role in argument reconstruction, their foundation as normative categories of argument, and the evaluative role of critical questions.We demonstrate the role of schemes in argument reconstruction, and defend a normative account of their nature against (...) specific criticisms due to Pinto (2001). Concerning critical questions, we propose an account on which they are founded in the R.S.A. cogency standard, and develop an account of the relationship between critical questions and burden of proof. Four perspectives on numerical origins are examined. The nativist model sees numbers as an aspect of numerosity, the biologically endowed ability to appreciate quantity that humans share with other species. The linguistic model sees numbers as a function of language. The embodied model sees numbers as conceptual metaphors informed by physical experience and expressed in language. Finally, the extended model sees numbers as conceptual outcomes of a cognitive system that includes material forms as constitutive components. It is always great good fortune for an author to have his writings meet with a receptive circle of readers who take them up in their own work and clarify them further. Indeed, it may even be the secret of all theoretical productivity that one reaches an opportune point in one's own creative process when others' queries, suggestions, and criticisms give one no peace, until one has been forced to come up with new answers and solutions. The four essays collected (...) here, in any event, jointly represent an ideal form of such a challenge: I am now compelled to make further theoretical developments and clarifications that lead me to a whole new stage of my own endeavours, well beyond what I initially had in mind in The Struggle for Recognition . For this reason, I will not concentrate here on interpretative issues regarding my earlier work but will instead take up the problems and challenges that have occasioned several revisions on my part. For this reason, it makes sense to begin (in section I) with the points that Carl-Göran Heidegren makes, in terms of a history of social theory, regarding my proposed theory of recognition. The issues that still motivate me today can best be expressed via an engagement with the conscientious interpretations he offers. The core of this rejoinder is based on Heikki Ikäheimo's and Arto Laitinen's suggestions and corrections, which they have used to develop my initial approach further, to the point where the theoretical outlines of a precise and general concept of recognition come into view. It is primarily these two contributions that helped me develop a productive elaboration of my originally vague intuitions (section II). By way of conclusion (in section III), I take up the penetrating questions raised by Antti Kauppinen regarding the use of the concept of recognition in the broader context of social criticism; he has compelled me to take on several extremely helpful clarifications, and they give me the opportunity, in conclusion, to summarize my overarching intentions. In this paper, we devise a network that consists of argumentation schemes and critical questions that participants in debates can use to easily construct arguments that attack or support former arguments. As a prototype, we build a potential network of argumentation schemes and critical questions with a practical reasoning scheme at its center. The usefulness of a NASCQ in constructing and reconstructing complex arguments and in formal argumentation is also explored along with argumentation more broadly.

In this paper, we look at reasoning with evidence and facts in criminal cases. We show how this reasoning may be analysed in a dialectical way by means of critical questions that point to typical sources of doubt. We discuss critical questions about the evidential arguments adduced, about the narrative accounts of the facts considered, and about the way in which the arguments and narratives are connected in an analysis. This article is a response to Robert Bernasconi’s critical philosophy of race. I start by speaking of the specific style in which life and philosophy are related in his work. I argue that he devises a political phenomenology which considers the lived experiences of racialization and inquires into their historical conditions, which have become “practico-inert” in facticity. Bernasconi’s thesis that the history of race is not determined by racial essentialism and his account of race as a border concept call (...) for an expansion of the notion of race that will better serve the cause of the global fight against racism. Paul Ricœur has been one of the most influential and intellectually challenging philosophers of the last century, and his work has contributed to a vast array of fields: studies of language, of history, of ethics and politics. However, he has up until recently only had a minor impact on the philosophy of technology. Interpreting Technology aims to put Ricœur’s work at the centre of contemporary philosophical thinking concerning technology. It investigates his project of critical hermeneutics for rethinking established theories (...) of technology, the growing ethical and political impacts of technologies on the modern lifeworld, and ways of analysing global sociotechnical systems such as the Internet. Teachers can’t add more minutes to a school day, but with mindfulness they can add depth to the moments they do have with students in their classroom. What is the meaning of critique for critical phenomenology? Building on Gayle Salamon’s engagement with this question in the inaugural issue of Puncta: A Journal for Critical Phenomenology (2018), I will propose a six-fold account of critique as: 1) the art of asking questions, moved by crisis; 2) a transcendental inquiry into the conditions of possibility for meaningful experience; 3) a quasi-transcendental, historically-grounded study of particular lifeworlds; 4) a (situated and interested) analysis of power; 5) the problematization (...) of basic concepts and methods; and 6) a praxis of freedom that seeks not only to interpret the meaning of lived experience, but also to change the conditions under which horizons of possibility for meaning, action, and relationship are wrongfully limited or foreclosed. While the first two dimensions of critique are alive and well in classical phenomenology, the others help to articulate what is distinctive about critical phenomenology. (shrink)

Recent turmoil in the Middle East and North Africa has prompted renewed concerns about women’s rights in Muslim societies. It has also raised questions about women’s agency and activism in religious contexts. This article draws on ethnographic research with women activists in Indonesia, the country with the world’s largest Muslim population, to address such concerns. My fieldwork shows that some Muslim women activists in democratizing Indonesia manifest pious critical agency. Pious critical agency is the capacity to engage (...) critically and publicly with religious texts. While some scholars have argued that pious and feminist subjectivity are inherently at odds, the emergence of pious critical agency in Indonesia demonstrates that piety and feminism can intersect in surprising and unexpected ways. Moreover, it shows that women’s agency can draw on both secular and religious resources and that religion can be used to promote critical discourses on gender. (shrink)

This article draws attention to struggles inherent in discourse about the meaning of participation in a Flemish participatory technology assessment (pTA) on nanotechnologies. It explores how, at the project’s outset, key actors (e.g., nanotechnologists and pTA researchers) frame elements of the process like ‘the public’ and draw on interpretive repertoires to fit their perspective. The examples call into question normative commitments to cooperation, consensus building, and common action that conventionally guide pTA approaches. It is argued that pTA itself must reflect (...) an awareness of competing interests and perspectives inherent in the discourse associated with the meaning of ‘participation’ if it is to incite action beyond vested interests and ensure genuine mutual learning. The postmodern debate has been heavily influenced by often contradictory conclusions about the foundations of knowledge: hermeneutics challenges epistemology, politics challenges science, identity theory challenges critical theory, pragmatism challenges formalism, and so on. Horace Fairlamb contends that philosophy's foundationist quest has usually been misconceived as a choice between a 'super-science' and theoretical anarchy. Through an examination of the history of foundationism, and detailed analysis of the work of leading theorists including Fish, Foucault, Derrida, Gadamer and Habermas, Dr Fairlamb argues (...) for a less reductive and less arbitrary conception of knowledge and meaning. Okolo maintains that the African is identified by his personality which is the attitudinal disposition he designates as ‘beingwith’. He adopts the term ‘being-with’ to represent the African ‘communality’ which is all there is to be truly African. Though maintaining a radical communalistic viewpoint suspending in socio-ontological considerations, Okolo posits that this attitude characteristically defines and symbolically stands for that by which ‘an African’ is identified. However, Okolo’s position inheres some problems that border on one, the question and place of (...) right and freedom of the individual as a community-member in the face of the community-consciousness, two, imposition of the title ‘African’ on even non-Africans as he opines that even an American, for instance, who imbibes by the principle of ‘being-with’ is ‘an African’, among other problems. Nonetheless, this paper defends that there are serious series of challenges/disruptions to this personality of ‘being-with’ which today hinder a satisfactory realization of its practicability/liveability even among Africans. The expectations from the paper include one, an analysis of Okolo’s thoughts, pointing out the loopholes for further academic exercise on African philosophical discourse, two, to reiterate the fact that what is African has substantial potency to sustain Africa, and address African problems hence ‘African solutions to African problems’, and third and finally, to propose an alternative view to ameliorating the radical communalistic positions in Okolo. The paper shall here also adopt philosophical conceptualization, content and contextual analysis and clarifications to critically review Okolo. (shrink)

By bringing feminist science studies scholar Donna J. Haraway’s A manifesto for cyborgs (1985) and Situated knowledges (1988) in line with contemporary critical new materialist thought (see Colman & Van der Tuin, 2024; Dolphijn & Van der Tuin, 2012; Geerts, 2022), this critical pedagogical and philosophical think piece tackles the problematic of Anthropocenic disruptions of the planetary biosphere for critical pedagogies and higher education (also see Carstens, 2016). It additionally encourages its readers to think through their own (...) pedagogical conceptions and praxes by means of irruptive (Geerts & Carstens, 2024; Koro-Ljungberg, 2015) selfreflection- stimulating questions. Our situated – and thus limited and open-ended – response to this all-encompassing Anthropocenic crisis is rooted in a rethinking of Harawayan cyborgian and situated knowledges and the critical pedagogical lessons drawn from the latter. Rereading Haraway’s work through contemporary critical new materialist and related scholarship reveals that it already contained an ecofeminist onto-epistemological shift toward more-than-human agency and relationality. This shift has major consequences for all things critical pedagogical and educational, as our pedagogical thinking-doings are deeply embedded in today’s crisis-ridden lifeworld. This rereading exercise furthermore underlines the necessity of an updated critical new materialist pedagogical praxis for learning and teaching, inspired by Harawayan ecofeminism, that takes the entanglements between human, dehumanised, and more-than-human actors seriously. Both questions as abstract objects and the speech acts, here called requests, by which we ask them play an enormous role in all argumentative practices. Nonetheless, there is hardly a proper systematic treatment of questions and requests in current argumentation theories. This paper is a first attempt at providing such a systematic treatment. This is achieved by following the ideal model of a critical discussion as elaborated over the years by the Amsterdam school of pragma-dialectics. After introducing (...) the distinction between questions and requests, the paper sets forth and illustrates the norms of questioning which implicitly underlie the four stages of a critical discussion in the standard order: confrontation, opening, argumentation, and conclusion. Among other things, it is shown that crucial insights of pragma-dialectics are illuminated by the questioning perspective, in particular the distinction between single and multiple differences of opinion, the duties of the antagonist and protagonist roles, the precise character of the argumentation stage, and the different ways in which a disagreement can be resolved. Marx discusses the initial money capital invested (M), the commodity inputs purchased with investment capital (C), the production process (P), the new commodities produced (C’), and the money appropriated from sales of those (...) commodities (M’). Custers insists that two other elements must be included: the non-commodity waste produced in the course of commodity production, and the social waste that results when commodities have “negative use-values” (this occurs when their use inflicts net harm on society). He takes the pollution generated in the course of producing nuclear energy as the main example of non-commodity waste, while nuclear weapons provide the paradigmatic illustration of social waste. Custers adds symbols for these two phenomena (-W and =W, respectively) to Marx’s M-C-P-C’-M formula. The discussion of the profound environmental costs of each and every stage in the production of nuclear energy warrants special mention due to its clarity and comprehensiveness.
