In The Architectonic of Reason, Lea Ypi provides an illuminating and innovative interpretation of the Architectonic in the first Critique. Ypi argues that Kant’s project of uniting practical and theoretical uses of reason in a critical metaphysics ultimately fails because practical reason does not have its own domain in which to legislate. This article challenges Ypi’s objection to practical reason’s lack of a domain in the first Critique. Its main contention is that reason’s need for unity in legislation may be (...) satisfied by a belief in God as a necessary practical presupposition rather than a dogmatic metaphysical reality. A novel attempt to explain why teens and adults often struggle with scientific explanation even thought young children clearly possess impressive causal reasoning skills.

Constructive mathematics is based on the thesis that the meaning of a mathematical formula is given, not by its truth-conditions, but in terms of what constructions count as a proof of it. However, the meaning of the terms 'construction' and 'proof' has never been adequately explained (although Kreisel, Goodman and Martin-Löf have attempted axiomatisations). This monograph develops precise (though not wholly formal) definitions of construction and proof, and describes the algorithmic substructure underlying intuitionistic logic. Interpretations of Heyting arithmetic and (...) constructive analysis are given. The philosophical basis of constructivism is explored thoroughly in Part I. The author seeks to answer objections from platonists and to reconcile his position with the central insights of Hilbert's formalism and logic. Amongst intellectuals and activists, neoliberalism has become a potent signifier for the kind of free-market thinking that has dominated politics for the past three decades. Forever associated with the conviction politics of Ronald Reagan and Margaret Thatcher, the free-market project has since become synonymous with the 'Washington consensus' on international development policy and the phenomenon of corporate globalization, where it has come to mean privatization, deregulation, and the opening up of new markets. But beyond its utility as a protest slogan (...) or buzzword as shorthand for the political-economic Zeitgeist, what do we know about where neoliberalism came from and how it spread? Who are the neoliberals, and why do they studiously avoid the label? Constructions of Neoliberal Reason presents a radical critique of the free-market project, from its origins in the first half of the 20th Century through to the recent global economic crisis, from the utopian dreams of Friedrich von Hayek through the dogmatic theories of the Chicago School to the hope and hubris of Obamanomics. The book traces how neoliberalism went from crank science to common sense in the period between the Great Depression and the age of Obama. Constructions of Neoliberal Reason dramatizes the rise of neoliberalism and its uneven spread as an intellectual, political, and cultural project, combining genealogical analysis with situated case studies of formative moments throughout the world, like New York City's bankruptcy, Hurricane Katrina, and the Wall Street crisis of 2008. The book names and tracks some of neoliberalism's key protagonists, as well as some of the less visible bit-part players. The aim of this study was to analyse how the patient is constructed and socially positioned in Swedish patient information. Corpus‐assisted critical discourse analysis methodology was utilised on a sample of 56 online patient information texts about cancer containing a total of 126,711 words. The findings show an overarching discourse of informed consent guided by specific features to produce a patient norm that we name “the reasonable patient”, who is receptive to arguments, emotionally restrained and makes decisions based on information. Through the discourse of informed consent, the norm of the reasonable patient emerges, apparently to even out the imbalance of power between patient and professional, but in reality, more likely to construct a patient who is easily controlled and managed. When the self‐responsibility towards health is incorporated into the everyday domestic spaces via digital health technologies, the ideas and concepts of the patient role need to be reconsidered based on these new conditions. We conclude that it is important for nursing researchers to broaden the research on patients to include the relationship of power created through language. This study demonstrates both methodological and empirical possibilities to do so. (shrink)

Challenging the claim that Kant's attempt to provide a critique of reason fails because it collapses into a dogmatic argument from authority, O'Neill shows why Kant held that we must construct, rather than assume, the authority of reason, and how this can be done by ensuring that anything we offer as reasons can be followed by others, including others (...) with whom we disagree. Two centuries after they were published, Kant's ethical writings are as much admired and imitated as they have ever been, yet serious and long-standing accusations of internal incoherence remain unresolved. Onora O'Neill traces the alleged incoherences to attempt to assimilate Kant's ethical writings to modern conceptions of rationality, action and rights. When the temptation to assimilate is resisted, a strikingly different and more cohesive account of reason and morality emerges. Kant offers a `constructivist' vindication of reason and a moral vision (...) in which obligations are prior to rights and in which justice and virtue are linked. O'Neill begins by reconsidering Kant's conceptions of philosophical method, reason, freedom, automony and action. She then moves on to the more familiar terrain of interpretation of the Categorical Imperative, while in the last section she emphasises differences between Kant's ethics and recent 'Kantian' ethics, including the work of John Rawls and other contemporary liberal political philosophers. Some things are reasons for us to perform certain actions. That it will spare you great pain in the future, for example, is a reason for you to go to the dentist now, and that you are already late for work is a reason for you not to read the next article in the morning paper. Why are such considerations reasons for or against certain actions? Constructivism offers an intriguing answer to this question. Its basic idea is often encapsulated in (...) the slogan that reasons are not discovered but made by us. This book elaborates the constructivist idea into a fully fledged account of practical reasons, makes its theoretical commitments explicit, and defends it against some well-known objections. It begins with an examination of the distinctive role that reason judgements play in the process of practical reasoning. This provides the resources for an anti-representationalist conception of the nature of those judgements, according to which they are true, if they are true, not because they accurately represent certain normative facts, but because of their role in sound reasoning. On the resulting view, a consideration owes its status as a reason to the truth of the corresponding reason judgement and thus, ultimately, to the soundness of a certain episode of reasoning. Consequently, our practical reasons exhibit a kind of mind-dependence, but this does not force us to deny their objectivity. (shrink)

Seeing that socio-legal theory has produced a number of compelling grand theories about law’s development as a body of knowledge, this contribution analyzes legal evolution on the micro-level of decision-making in concrete cases. To that end, law finding is reconstructed as a three stage process of reason-based rule-construction. Legal evolution is argued to stem from the argumentative jumps that are made in this process in order to use what is initially drawn from the body of legal knowledge in new cases. (...) This paper points out some problems with two recent logical systems – one due to Prakken and Sartor, the other due to Kowalski and Toni – designedfor the representation of defeasible arguments in general, but with a specialemphasis on legal reasoning.

Previous research on the use of diagrams for argumentation instruction has highlighted, but not conclusively demonstrated, their potential benefits. We examine the relative benefits of using diagrams and diagramming tools to teach causal reasoning about public policy. Sixty-three Carnegie Mellon University students were asked to analyze short policy texts using either: 1) text only, 2) text and a pre-made, correct diagram representing the causal claims in the text, or 3) text and a diagramming tool with which to construct their (...) own causal diagram. After a pretest and training, we tested student performance on a new policy text and found that students given a correct diagram significantly outperformed the other groups. Finally, we compared learning by testing students on a third policy problem in which we removed all diagram or tool aids and found that students who constructed their own diagrams learned the most. We describe these results and interpret them in a way that foreshadows work we now plan for a cognitive-tutor on causal diagram construction. (shrink)

In recent years several proposals to view reasoning with legal cases as theory construction have been advanced. The most detailed of these is that of Bench-Capon and Sartor, which uses facts, rules, values and preferences to build a theory designed to explain the decisions in a set of cases. In this paper we describe CATE (CAse Theory Editor), a tool intended to support the construction of theories as described by Bench-Capon and Sartor, and which produces executable code corresponding to (...) a theory. CATE has been used in a series of experiments intended to explore a number of issues relating to such theories, including how the theories should be constructed, how sets of values should be compared, and the representation of cases using structured values as opposed to factors. Inference is elementary and ubiquitous: Cognition always goes beyond the data. Thinking—including problem solving, decision making, judgement, planning, and argumentation—is here defined as the deliberate application and coordination of one's inferences to serve one's purposes. Reasoning, in turn, is epistemologically self-constrained thinking in which the application and coordination of inferences is guided by a metacognitive commitment to what are deemed to be justifiable inferential norms. The construction of rationality, in this view, involves increasing consciousness and control of logical and (...) other inferences. This metacognitive conception of rationality begins with logic rather than ending with it, and allows for developmental progress without positing a state of maturity. (shrink)

Onora O'Neill argues for an interpretation of the Critical philosophy as a whole which recognizes the categorical imperative as the first principle of theoretical as well as practical reason. She offers an interpretation of Kantian ethics which attempts to answer the central charges that have been brought against it since the critiques of Mill and Hegel: empty formalism and moral rigorism. She enters into dialogue with contemporary positions both hostile and sympathetic to Kant's practical philosophy. (...) The paper addresses O'Neill's view that her version of Kant's Categorical Imperative, namely, the requirement of followability (RF), marks the supreme principle of reason; it takes issue with her claim that RF commits us to Kantian constructivism in practical philosophy. The paper distinguishes between two readings of RF: on a weak reading, RF ranges over all (practical) reasoning but does not commit to constructivism, and on a strong version RF commits to constructivism but fails to meet its own test, (...) and so is self-defeating. The paper argues that RF, if understood strongly, depends for its reasonableness on reasons that cannot coherently be required to meet RF, so that RF cannot be the supreme principle of reason. The paper considers several responses to this problem in order to suggest that RF depends for its reasonableness on perfectionist considerations. (shrink)

Modern formal accounts of the constructive nature of elementary geometry do not aim to capture the intuitive or concrete character of geometrical construction. In line with the general abstract approach of modern axiomatics, nothing is presumed of the objects that a geometric construction produces. This study explores the possibility of a formal account of geometric construction where the basic geometric objects are understood from the outset to possess certain spatial properties. The discussion is centered around Eu , a recently (...) developed formal system of proof (presented in Mumma (Synthese 175:255–287, 2010 )) within which Euclid’s diagrammatic proofs can be represented. Following the Aristotelian constructivism proposed by Mark LeBar, the paper outlines a possible metaethical framework of values, necessary elements within legal reasoning. This framework proposes a consideration of values that need to be virtuously constructed, namely through the virtue of _phronesis_. In this way, legal reasoning can take into account more elements concerning the specific legal case, not only legal provisions, but also abstract objects, such as pain. The central feature of _phronesis_ will lead to support a virtue-ethical (...) approach to law. More specifically, the paper will be structured as follows. The first section will introduce the topic and the structure of the paper. The second section will analyze Vittorio Villa’s post-positivist costructivism, which makes it possible to understand the role of value judgments in legal reasoning. The third section will therefore examine Mark LeBar’s metaethical constructivism, investigating, in particular, two different elements: experience (paragraph 3.1 ) and _phronesis_ (paragraph 3.2 ). In the fourth section, considering what has emerged from the research, the conclusion will highlight a possible connection between this metaethical framework and a virtue-ethical approach to law. This article examines the role of the Cambridge Experimentation Review Board in the seven-month moratorium on recombinant DNA research in Cambridge, Massachusetts. The article focuses on CERB's 23 November 1976 debate, which was the turning point in the committee's proceedings. Although CERB members were implicitly charged with making rational decisions, they were inevitably influenced by biases and emotions. In the process of justifying their decisions, however, they were almost exclusively concerned with appeals to reason. This article argues that appeals to (...) emotion and authority are essential and inevitable components of reasonable decision making. It further argues that legitimizing these appeals in the process of justification will make such appeals more accessible to criticism during the process of construction and, thereby, will help us to define which appeals to emotion and authority are appropriate and which are inappropriate in any given context. We begin with the idea that lines of reasoning are continuous mental processes and develop a notion of continuity in proof. This requires abstracting the notion of a proof as a set of sentences ordered by provability. We can then distinguish between discrete steps of a proof and possibly continuous stages, defining indexing functions to pick these out. Proof stages can be associated with the application of continuously variable rules, connecting continuity in lines of reasoning with continuously variable (...) reasons. Some examples of continuous proofs are provided. We conclude by presenting some fundamental facts about continuous proofs, analogous to continuous structural rules and composition. We take this to be a development on its own, as well as lending support to non-finitistic constructionism. (shrink)

Theory Young children have an understanding of basic science concepts such as stability, yet their theoretical assumptions are often not concerned with stability. The literature on theory theory and theory-evidence coordination suggests that children construct intuitive theories about their environment which can be adjusted in the face of counterevidence that cannot be assimilated into the prior theory. With increasing age, children acquire a Center theory when balancing objects and try to balance every object at their middle, succeeding with symmetrical objects. (...) Later, they acquire the basic science concept of stability through learning that the weight distribution of an object is of importance. Thus, they acquire a Mass theory and succeed in balancing asymmetrical objects as well. Fluid and crystallized intelligence might contribute to children’s acquisition of Mass theory. Moreover, their Mass theory might be supported by implementing a playful intervention including (a) material scaffolds and (b) verbal scaffolds. Aims We investigated which theories children have about stability and whether these theories can be adjusted to Mass theory by implementing a playful intervention. Method A total of 183 5- to 6-year-old children took part in the study with a pre-post-follow-up intervention design. Children’s Mass theory was assessed with an interview in which children explained constructions’ stabilities. The children received a playful intervention with two differing degrees of scaffolding (material scaffolds or material + verbal scaffolds) or no scaffolding. Results At first few children used a Mass theory to explain their reasoning. However, after being confronted with counterevidence for the asymmetrical constructions, children changed their explanation and applied a Mass theory. More children in the play group with the highest degree of scaffolding, i.e., material + verbal scaffolds, acquired a Mass theory compared to the other groups. Fluid as well as crystallized intelligence contributed to children’s acquisition of a Mass theory. Discussion Counterevidence can support children in their acquisition of a Mass theory. A playful intervention with scaffolding supports children even more. (shrink)
