Human Rights in a Pluralistic World and Christianity and Human Rights, edited by John Witte and Frank Alexander, both contribute to the growing and sophisticated literature addressing the relationship between religious traditions and human rights. Kao’s book opens by asking whether “the very idea of human rights [must] be premised upon a religious or metaphysical idea in order to be conceptually intelligible, sufficiently protected, or practically stable over time” (4). Kao proposes that this question has generally been answered in one of two ways: a “maximalist” response that identifies religion as a necessary foundation for human rights, and a “minimalist” response that rejects this turn to religion. A significant portion of the book is devoted to assessing representatives of these two approaches. Chapter 2 includes a discussion of maximalist thinkers Michael Perry, Max Stackhouse, Hans Küng, and Nicholas Wolterstorff. Chapters 3 through 5 consider different forms of minimalism, including that found in the work of John Rawls and Martha Nussbaum.Kao’s organization of the debate into maximalism and minimalism imposes a useful typology over a diverse range of thought while also establishing interesting points of contact and contestation among various thinkers. At the same time, because the analysis occurs at a rather high level of abstraction, it will be most useful to those already familiar with the texts and thinkers discussed. This is not a text for those seeking a summary introduction. Those less familiar will still profit from the book, but perhaps more from the opening and closing chapters than those discussed here. [End Page 187]Following the discussion of maximalism and minimalism, the final chapter of Kao’s book presents a model for moving beyond the “extremes” of these two dominant approaches (8). At its most basic, human rights, Kao argues, must be grounded in a nonreligious moral realism. This “straddling” of the “minimalist-maximalist divide” is, in certain respects, a creative and bold proposal for reshaping debate about religion and human rights. It defends the universality of human rights as being necessarily grounded in objective values but does not narrowly locate these values in religious sources. Yet, while offering some intriguing insights, the themes of this final chapter never quite come together to form a comprehensive theory. Kao’s proposal is more a selective appropriation of insights from others than a totalizing alternative.Because Kao does not fully develop her model, it is difficult to assess the particular rights claims that follow from its premises. This is evident, for instance, in Kao’s discussion of the so-called marginal cases, where it remains unclear what specific principles and methods have been employed to develop normative positions (160–61). This disconnect between theory and application limits the book’s ability to have an impact on core disputes within human rights. The most significant fault lines within the contemporary human rights debate involve the content and expanse of human rights more than their theoretical grounding, and human rights language often serves as a way to legitimize preferred political goods. Kao not only needs to defend her approach to grounding human rights but also to establish how this particular grounding informs the norms of human rights.Witte and Alexander’s edited volume, Christianity and Human Rights, addresses the relationship between religion and human rights from a quite different perspective. Whereas Kao critically assesses religion’s role as a foundation for human rights, the essays in Witte and Alexander’s book largely explore the meaning of human rights from within a Christian framework. The book does not entirely bypass questions about the warranting role of religion as such, but its concern is not to justify the role of Christianity within human rights but to develop “the budding new human rights hermeneutic of... Review of Alexander X. Douglas, Spinoza and Dutch Cartesianism: Philosophy and Theology.

It is an old idea, lately out of fashion but now experiencing a revival, that quantum mechanics may best be understood, not as a physical theory with a problematic probabilistic interpretation, but as something closer to a probability calculus per se. However, from this angle, the rather special C *-algebraic apparatus of quantum probability theory stands in need of further motivation. One would like to find additional principles, having clear physical and/or probabilistic content, on the basis of which this apparatus (...) can be reconstructed. In this paper, I explore one route to such a derivation of finite-dimensional quantum mechanics, by means of a set of strong, but probabilistically intelligible, axioms. Stated very informally, these require that systems appear completely classical as restricted to a single measurement, that different measurements, and likewise different pure states, be equivalent (up to the action of a compact group of symmetries), and that every state be the marginal of a bipartite non-signaling state perfectly correlating two measurements. This much yields a mathematical representation of (basic, discrete) measurements as orthonormal subsets of, and states, by vectors in, an ordered real Hilbert space – in the quantum case, the space of Hermitian operators, with its usual tracial inner product. One final postulate (a simple minimization principle, still in need of a clear interpretation) forces the positive cone of this space to be homogeneous and self-dual and hence, to be the state space of a formally real Jordan algebra. From here, the route to the standard framework of finite-dimensional quantum mechanics is quite short. (shrink)

A traditional interpretation holds that Kant's political theory simply constitutes an account of the constraints which reason places on the state's authority to regulate external action. Alexander Kaufman argues that this traditional interpretation succeeds neither as a faithful reading of Kant's texts nor as a plausible, philosophically sound reconstruction of a `Kantian' political theory. Rather, he argues that Kant's political theory articulates a positive conception of the state's role.

How do words mean? What is the nature of meaning? How can we grasp a word's meaning? The frame-semantic approach developed in this book offers some well-founded answers to such long-standing, but still controversial issues. Following Charles Fillmore's definition of frames as both organizers of experience and tools for understanding, the monograph attempts to examine one of the most important concepts of Cognitive Linguistics in more detail. The point of departure is Fillmore's conception of "frames of understanding" - an approach (...) to (cognitive) semantics that Fillmore developed from 1975 to 1985. The envisaged Understanding Semantics ("U-Semantics") is a semantic theory sui generis whose significance for linguistic research cannot be overestimated. In addition to its crucial role in the development of the theoretical foundations of U-semantics, corpus-based frame semantics can be applied fruitfully in the investigation of knowledge-building processes in text and discourse. There is a common misconception that our genomes - all unique, except for those in identical twins - have the upper hand in controlling our destiny. The latest genetic discoveries, however, do not support that view. Although genetic variation does influence differences in various human behaviours to a greater or lesser degree, most of the time this does not undermine our genuine free will. Genetic determinism comes into play only in various medical conditions, notably some psychiatric syndromes. Denis Alexander (...) here demonstrates that we are not slaves to our genes. He shows how a predisposition to behave in certain ways is influenced at a molecular level by particular genes. Yet a far greater influence on our behaviours is our world-views that lie beyond science - and that have an impact on how we think the latest genetic discoveries should, or should not, be applied. Written in an engaging style, Alexander's book offers tools for understanding and assessing the latest genetic discoveries critically. (shrink)

Contemporary architecture is increasingly grounded in science and mathematics. Architectural discourse has shifted radically from the sometimes disorienting Derridean deconstruction, to engaging scientific terms such as fractals, chaos, complexity, nonlinearity, and evolving systems. That's where the architectural action is -- at least for cutting-edge architects and thinkers -- and every practicing architect and student needs to become conversant with these terms and know what they mean. Unfortunately, the vast majority of architecture faculty are unprepared to explain them to students, not (...) having had a scientific education themselves. Here is an architecture book by an architect/scientist, just in time to help architects in the new millennium. Alexander discusses many of the scientific terms arising in cutting-edge architecture, and explains them to those who don't have scientific training or advanced mathematical knowledge. We find discussions of the evolution of forms; the importance of process in design; iteration; genetic algorithms; sequences of transformations; different levels of scale (i.e. fractals); etc. They are explained here by an architect who is also a scientist, because he wants to change the way architects think and build. Alexander is not merely popularizing other scientists' results and making them accessible to architects: he is in fact presenting new and original scientific work that ties many of these concepts together in a way that will be useful to architects. Damn Great Empires! offers a new perspective on the works of William James by placing his encounter with American imperialism at the center of his philosophical vision. This book reconstructs James's overlooked political thought by treating his anti-imperialist Nachlass -- his speeches, essays, notes, and correspondence on the United States' annexation of the Philippines -- as the key to unlocking the political significance of his celebrated writings on psychology, religion, and philosophy. It shows how James located a craving for authority (...) at the heart of empire as a way of life, a craving he diagnosed and unsettled through his insistence on a modern world without ultimate foundations. Livingston explores the persistence of political questions in James's major works, from his writings on the self in The Principles of Psychology to the method of Pragmatism, the study of faith and conversion in The Varieties of Religious Experience, and the metaphysical inquiries in A Pluralistic Universe. Against the conventional view of James as a thinker who remained silent on questions of politics, this book places him in dialogue with a transatlantic critique of modernity, as well as with champions and critics of American imperialism, from Theodore Roosevelt to W. E. B. Du Bois, in order to excavate James's anarchistic political vision. Bringing the history of political thought into conversation with contemporary debates in political theory, Damn Great Empires! offers a fresh and original reexamination of the political consequences of pragmatism as a public philosophy. Vorliegende Studie behandelt die philosophiehistorische Bedeutung und den systematischen Gehalt, den zur Zeit seiner Konstruktion, d. h. in der Epoche des Hellenismus, jener Fall zweier Schiffbrüchiger besitzt, denen zur Rettung nur eine Planke, die nur einen von beiden tragen kann, zur Verfügung steht, welcher als "Brett des Karneades" in die abendländische Geschichte des Rechts wie der Rechtsphilosophie eingegangen ist und als Paradigma der europäischen Notrechtslehre ausgezeichnet werden kann. Im ersten Teil der Untersuchung wird anhand einer philosophiegeschichtlichen Auswertung der Quellen des (...) Falles, Ciceros De officiis und Laktanz' Institutiones Divinae, und ihrer historischen Kontexte die Plausibilität der Zuschreibung der Autorschaft an dem Fall an den akademischen Skeptiker Karneades erwiesen. Im zweiten Teil werden die verschiedenen Varianten des Falles und ihre Lösungen, die sich in den Quellen finden, ausführlich auf ihre philosophischen Prämissen hin analysiert, woraus ihre letztliche Fundierung in dem auf einer empiristischen Erkenntnistheorie gegründeten Begriff des Naturrechts der Alten und Mittleren Stoa hervorgeht. Der abschließende dritte Teil erörtert das kritische Potential des Beispieles, indem er seine zersetzende Wirkung auf alle zu seiner Lösung in Anschlag gebrachten Lehrstücke des stoischen Philosophie aufzeigt und so vor Augen führt, daß mit dem Brett des Karneades wenigstens eine empirische Begründung einer möglichen Naturrechtslehre schon aus epistemologischen Gründen zum Scheitern verurteilt ist. The "Plank of Carneades" is the name that has gone down in the Occidental history of law and legal philosophy to characterize the case of two shipwrecked persons who have one plank that can rescue only one of them. The case can be characterized as the paradigm of the European theory of necessity. This study considers the philosophically historical meaning and systemic content this case had at the time of its construction, namely during the Hellenistic epoch. The first part of the study is based on a philosophically historical evaluation of the sources of this case, Cicero's De officiis and Laktanz' Institutiones Divinae, and their historical context. It shows the plausibility of imputing authorship of this case to the academic skeptic Carneades. The second part exhaustively analyzes the various case constellations and the solutions these sources proffer to them. It considers the philosophical premises underlying these solutions and indicates that their ultimate foundation lies in the concept of natural law as based on the empirical epistemology of the ancient and middle-aged Stoics. The third and final part considers the case's critical potential by demonstrating its undermining effect on all of the teachings of Stoic philosophy proffered to solve it. The study thus shows that for the Plank of Carneades any empirical foundation of a possible theory of natural law is condemned to failure for epistemological reasons. (shrink)
