The present volume, a tribute to Harry Dondorp, contains contributions to the symposium held on the occasion of his farewell at the Vrije Universiteit Amsterdam. Written by four eminent scholars in the field of legal history, the contributions are related to his areas of interest: delictual liability, Romano-canonical procedure and comparative law texts. The contributors are Wolfgang Ernst, David Ibbetson, Yves Mausen and Andreas Thier. The introductory words are by Eltjo Schrage, Jan Hallebeek and Hylkje de Jong.

A proof is presented showing that there is no paraconsistent logics with a standard implication which have a three-valued characteristic matrix, and in which the replacement principle holds.

Pathologizing ugliness refers to the framing of unattractive features as a type of disease or deformity. By framing ugliness as pathology, cosmetic procedures are reframed as therapy rather than enhancement, thereby potentially avoiding ethical critiques regularly levelled against cosmetic surgery. As such, the practice of pathologizing ugliness and the ensuing therapeuticalization of cosmetic procedures require an ethical analysis that goes beyond that offered by current enhancement critiques. In this article, I propose using a thick description of the goals of medicine (...) as an ethical framework for evaluating problematic medical practices. I first describe the goals of medicine based on Daniel Callahan's account. I then propose that the goals work best in conjunction with ancillary ethical concepts, namely medical knowledge and skills, standards of practice and medical duties and virtues. Next, I apply the thick description of the goals of medicine in critiquing the practice of framing ugliness as disease. Here, I demonstrate ethical conflicts between aesthetic judgments that underpin the practice of pathologizing ugliness and medical judgments that inform ethical medical practices. In particular, the thick description of the goals of medicine helps reveal ethical conflicts in at least three key domains common to clinical practices, which include (a) disease determination, (b) diagnostic evaluation and (c) establishing clinical indications. My analysis offers a novel way of critiquing the practice of pathologizing ugliness in cosmetic surgery, which tends to be neglected by enhancement critiques. (shrink)

A contribution to the Common Knowledge symposium “Antipolitics,” this article examines the diverse types of imaginary that support sortition, which is currently at the heart of important debates on the reform of existing democratic institutions. Different and often diametrically opposed actors now advocate sortition as a tool for addressing crises of political representation. How are we to understand this convergence? Over the past two decades, the field of experience and the horizon of expectation of citizens in the global North have (...) profoundly changed, and this article seeks to assess those changes in the context of three ideal types that advocate the use of randomly selected minipublics. This article analyzes, each in turn, the attraction of sortition for supporters and theorists of deliberative democracy, antipolitical democracy, and radical democracy, outlining the elements that unite and divide these imaginaries to help explain the astonishing convergence of voices in defense of sortition in politics. Si la doctrine arithmologique des nombres « parfaits », « abondants » et « déficients » est bien connue et souvent exposée depuis Nicomaque de Gérasa (iie siècle apr. J.-C.), elle reçoit une illustration nouvelle, dans laquelle la mythologie cède le pas à l’éthique et à la théologie, dans une glose médiévale du texte de Martianus Capella (livre VII des Noces de Philologie et de Mercure), où le nombre parfait est mis en correspondance avec la justice éternelle.

Comment la pensée médiévale continue-t-elle à agir dans la philosophie juridico-politique moderne, c'est-à-dire dans un horizon intellectuel et historique qui n'est plus le sien? Telle est la question qui anime les contributions au présent ouvrage. Cette action persistante de la pensée médiévale, qui est en même temps transformation de ce qui agit, est étudiée dans le cadre de trois grandes problématiques. 1. Le transfert de la notion de plenitudo potestatis de l'ordre ecclésiastique à l'ordre politique. 2. Le déplacement d'un univers (...) qui trouvait son fondement en Dieu vers un univers qui comporte, non un, mais deux fondements possibles entre lesquels se développe une tension (laquelle deviendra plus tard une concurrence) : Dieu et l'homme. C'est dans le cadre de cette tension entre les deux fondements théologique et éthique que se forment les doctrines du sujet psychologique et affectif, d'une part, et du sujet de droit, d'autre part. 3. Enfin, la constitution d'une théorie du pouvoir politique sur les hommes qui n'est plus pensée dans les catégories de la propriété des choses alors que celles-ci fournissaient, au Moyen Age, le principe d'intelligibilité de celle-là. The theory of action is a centerpiece of the philosophical thought of Ralph Cudworth. It is indeed in this theory that the fundamental, twofold operation of his thinking is played out: an overturning of necessitarian materialism and, correlatively, a reestablishment of the genuine idea of an intelligible system of the universe. The problem of action in Cudworth’s thought concerns his physical doctrine as much as his moral doctrine. It thus involves the theory of being and of value.

Pourquoi la démocratie qui, en son principe, est un régime de liberté peut-elle dériver vers la servitude? Cette question n'est pas nouvelle, elle figurait déjà en bonne place dans la pensée politique de Platon et d'Aristote, pour lesquels cette dérive était inscrite dans la nature du régime, lequel n'était donc pas viable. Elle se retrouve également chez les premiers penseurs de la démocratie réelle moderne, en particulier Alexis de Tocqueville, pour lequel la démocratie est perpétuellement confrontée à une redoutable alternative (...) : promouvoir le goût de la liberté ou, à l'inverse, se dégrader en servitude de mœurs et d'opinion. Or, que cette servitude démocratique, qui est une tendance interne par laquelle la démocratie se détruit elle-même, ne résulte pas d'un pouvoir de contrainte externe mais trouve ses ressorts dans la volonté des individus, nous savons le penser depuis longtemps avec le concept de servitude volontaire d'Etienne de La Boétie. Pourquoi donc parler de nouvelles servitudes? Parce qu'il n'y a pas lieu d'écrire aujourd'hui un " Contr'un ". La figure du maître a changé, ce n'est plus un maître personnel, un tyran, qui tiendrait sous son pouvoir une multitude effrayée, mais un maître anonyme, sans visage et sans nom propre qui, par de nouvelles voies, instaure une domination d'un nouveau genre et de nouvelles servitudes. Celles-ci sont analysées ici sur les plans de l'anthropologie, de l'éthique, de l'économie, ainsi que de l'analyse sociale et de la philosophie politique en vue de repenser une liberté civile à la mesure des problèmes de notre temps. Ce livre est une défense de la liberté issue de la convergence des vues, non d'un collectif, mais d'un certain nombre d'individus singuliers, auteurs libres et indépendants, disons intempestifs, qui entendent s'élever contre les formes larvées de servitudes qui se mettent en place dans les sociétés démocratiques. Il s'agit donc de retrouver l'esprit de liberté sans lequel la démocratie se dégrade et se meurt. (shrink)

An argument can be taken as an operation of justification or as the product of this operation. But what about a counter-argument? This article is based on the hypothesis that there exists an operation of argumentative negation, which is both the argumentative and the negative equivalent of the operation of justification. Justification and argumentative negation necessarily act on assertions, for they are active at the level of the epistemic modalities of statements. As an operation, a counter-argument can thus be described, (...) as the application of an argumentative negation; as a product, it can be described as an argument the conclusion of which shows traces of negative modality. Two uses of argumentative negation are distinguished here: counter-argumentation and calling into question. The former can lead only to assertive conclusive statements, but the latter can also lead to directives or commissives. This leads the authors to introduce the notion of pseudo-argument, besides those of argument and counter-argument. It is shown in particular that when a pseudo-argument is rejected, argumentative negation has the effect of making evident an underlying argument. With respect to the latterit functions as a counter-argumentation, whereas with respect to the illocutionary act accomplished by the conclusive statement, it functions as a calling into question of a condition of satisfaction for this act. This article also defines certain characteristics of argument, proposes criteria for identifying argumentative negation in polemical conversations, and distinguishes four modes of counter-argumentation. This article defends four claims. The first is that in the last few decades, two waves of democratic innovation based on random selection must be differentiated by their partly different concrete devices, embodying different social dynamics and pointing toward different kinds of democracy. The second claim is that the rationale of the first wave, based on randomly selected minipublics, largely differs from the dynamic of political sortition in Athens, as it points toward deliberative democracy rather than radical democracy. Conversely, empowered (...) sortition processes that have emerged during the second wave capture better the spirit of radical Athenian democratic traditions. The third claim is normative: these empowered sortition processes are more promising for a real democratization of democracy. The last claim is that any proposal of a legislature by lot must rely on this lesson when trying to defend a normatively convincing and politically realistic perspective. (shrink)

The history of the philosophical exchanges between China and the West is the history of the translations between the two traditions. On the western side, after the Jesuits, the range of translators became gradually broader. On the Chinese side, many intellectuals introduced Western classics in their language in the twentieth century. This led several historians to argue that Chinese philosophy took off with the translation-comparison of both traditions. However, not all comparisons are of equal value. Thus, translation in philosophy implies (...) comparing concepts or arguments and considering all the cultural references involved. This means taking a risk and accepting a limit. A risk is to be taken because translating interprets a “foreign thought” according to one’s context. This implies disclosing one’s presuppositions. There is a limit because transitioning from one set of references to another implies welcoming a part of “untranslatable” that always remains. According to Ricoeur’s words, “linguistic hospitality” is required here. This article first presents two interpretations of the translation-comparison processes. In the last part, it describes the necessity of linguistic hospitality in the context of Comparative Philosophy. (shrink)

Simon explores moral virtue in this piece through identifying three moral positions common in modernity that attempt to substitute the traditional concept of virtue, as well as discussing the distinction between nature and use of sources of good or evil. He also discusses the distinctions between habits and opinions, as well as the virtue and science. He gives clear examples that make this book enjoyable for readers of all levels to understand moral virtue.

The popularity of surgical modifications of race-typical features among Asian women has generated debates on the ethical implications of the practice. Focusing on blepharoplasty as a representative racial surgery, this article frames the ethical discussion by viewing Asian cosmetic surgery as an example of medicalization, which can be interpreted in two forms: treatment versus enhancement. In the treatment form, medicalization occurs by considering cosmetic surgery as remedy for pathologized Asian features; the pathologization usually occurs in reference to western features as (...) the norm. In the enhancement form, medicalization occurs by using medical means to improve physical features to achieve a certain type of beauty or physical appearance. Each type of medicalization raises slightly different ethical concerns. The problem with treatment medicalization lies in the pathologization of Asian features, which is oppressive as it continues to reinforce racial norms of appearance and negative stereotypes. Enhancement medicalization is ethically problematic because cosmetic surgery tends to conflate beauty and health as medical goals of surgery, overemphasizing the value of appearance that can further displace women’s control over their own bodies. I conclude that in both forms of medicalization, cosmetic surgery seems to narrowly frame a complex psychosocial issue involving physical appearance as a matter that can be simply solved through surgical means. A collection of essays in French or English on the reception of Cartesian philosphy.

The success of the stakeholder theory in management literature as well as in current business practices is largely due to the inherent simplicity of the stakeholder model-and to the clarity of Freeman's powerful synthesised visual conceptualisation. However, over the years, critics have attacked the vagueness and ambiguity of stakeholder theory. In this article, rather than building on the discussion from a theoretical point of view, a radically different and innovative approach is chosen: the graphical framework is used as the central (...) perspective. The major shortcomings of the popular stakeholder framework are systematically confronted with the graphical scheme to illustrate their visual impact. The graphical illustrations of the imperfections help explain the sometimes-oversimplified generalisation inherent to every graphical model. They also make some interrelationships easier to understand. The analysis demonstrates that, with the tacit but implicit acceptance of simplification of the discussed explanatory elements, Freeman's framework remains a rather good approximation of reality. Only a few minor changes to the stakeholder model are consequently proposed. (shrink)

Pathologizing ugliness refers to the use of disease language and medical processes to foster and support the claim that undesirable features are pathological conditions requiring medical or surgical intervention. Primarily situated in cosmetic surgery, the practice appeals to the concept of “aesthetic pathology”, which is a medical designation for features that deviate from some designated aesthetic norms. This article offers a two-pronged conceptual analysis of aesthetic pathology. First, I argue that three sets of claims, derived from normativist and naturalistic accounts (...) of disease, inform the framing of ugliness as a disease. These claims concern: (1) aesthetic harms, (2) aesthetic dysfunction, and (3) aesthetic deviation. Second, I introduce the notion of a hybridization loop in medicine, which merges the naturalist and normative understanding of the disease that potentially enables pathologizing practices. In the context of cosmetic surgery, the loop simultaneously promotes the framing of beauty ideals as normal biological attributes and the framing of normal appearance as an aesthetic ideal to legitimize the need for cosmetic interventions. The article thus offers an original discussion of the conceptual problems arising from a specific practice in cosmetic surgery that depicts ugliness as the disease. (shrink)

In The Equilibrium Manifold, noted economic scholar and major contributor to the theory of general equilibrium Yves Balasko argues that, contrary to what many textbooks want readers to believe, the study of the general equilibrium model did not end with the existence and welfare theorems of the 1950s. These developments, which characterize the modern phase of the theory of general equilibrium, led to what Balasko calls the postmodern phase, marked by the reintroduction of differentiability assumptions and the application of (...) the methods of differential topology to the study of the equilibrium equation. Balasko's rigorous study demonstrates the central role played by the equilibrium manifold in understanding the properties of the Arrow-Debreu model and its extensions. Balasko argues that the tools of differential topology articulated around the concept of equilibrium manifold offer powerful methods for studying economically important issues, from existence and uniqueness to business cycles and economic fluctuations. After an examination of the theory of general equilibrium's evolution in the hundred years between Walras and Arrow-Debreu, Balasko discusses the properties of the equilibrium manifold and the natural projection. He highlights the important role of the set of no-trade equilibria, the structure of which is applied to the global structure of the equilibrium manifold. He also develops a geometric approach to the study of the equilibrium manifold. Applications include stability issues of adjustment dynamics for out-of-equilibrium prices, the introduction of price-dependent preferences, and aspects of time and uncertainty in extensions of the general equilibrium model that account for various forms of market frictions and imperfections. Special effort has been made at reducing the mathematical technicalities without compromising rigor. The Equilibrium Manifold makes clear the ways in which the postmodern" developments of the Arrow-Debreu model improve our understanding of modern market economies. (shrink)

Faute de savoir prédire quels humains nous serons suite au déferlement technologique et scientifique en cours, l'humanisme vise à réinscrire l'homme dans son histoire. Longue quête en faveur de la nécessaire rénovation de la pensée humaniste pour s'adapter au nouveau monde en train de se structurer sous nos yeux, tout en s'opposant à la « chosification » en cours de l'humain. Niccolò Machiavelli is the most prominent and notorious theorist of violence in the history of European political thought - prominent, because he is the first to candidly discuss the role of violence in politics; and notorious, because he treats violence as virtue rather than as vice. In this original interpretation, Yves Winter reconstructs Machiavelli's theory of violence and shows how it challenges moral and metaphysical ideas. Winter attributes two central theses to Machiavelli: first, violence is not a generic technology (...) of government but a strategy that tends to correlate with inequality and class conflict; and second, violence is best understood not in terms of conventional notions of law enforcement, coercion, or the proverbial 'last resort', but as performance. Most political violence is effective not because it physically compels another agent who is thus coerced; rather, it produces political effects by appealing to an audience. Yves R. Simon (1903-1961) was one of this century’s greatest students of the virtue of practical wisdom. Simon’s interest in this virtue ranged from ultimate theoretical and foundational concerns, such as the relationship between practical knowledge and science, to the most concrete and immediate questions regarding the role of practical wisdom in personal and social decision-making. These concerns occupied Simon from his earliest published writing to the final notes and correspondence he was working on at the moment of his (...) untimely death. Throughout his life, practical wisdom and its related philosophical ramifications emerge time and again at critical junctures, throwing into bold relief some of the deeper dimensions of questions as diverse as the nature of democracy, the concept of law, and the theory of work. Practical knowledge constitutes a unifying motif of Simon’s entire encyclopedic effort. This volume reconstructs what would have been Simon’s final sustained writing on practical knowledge. It includes reworking of some previously published material, especially the landmark 1961 essay, "Introduction to the Study of Practical Wisdom," possibly the best treatment of the concept of "command" in recent philosophical writing. But it also reproduces, in a form closely corresponding to Simon’s intention, material drawn from notes and schemata, concerning issues such as the relationship between moral science and wisdom, the nature of practical judgment, and the relationship between practical knowledge and Christian moral philosophy. Also included are previously unpublished letters to Jacques Maritain on the controversy surrounding the theoretical-practical and practico-practical syllogisms, as well as Maritain’s responses. The volume concludes with applications of Simon’s general theory to a critique of the concept of a social science and to the notion of Christian humanism. This volume will appeal to moral philosophers interested in a range of normative issues, as well as social scientists and readers concerned with the philosophical foundations of modern culture. Virtue moralist, in particular, will find in Simon one of the profoundest commentators on this tradition in normative ethics. (shrink)

Recent academic articles point to an increased vagueness and overlap in concepts related to business ethics and corporate responsibility. Further, the perception of these notions can differ in the smallbusiness world from the original academic definitions. This article focuses on the cognition of small-business owner-managers. Given the impact of small-business owner-managers on their ventures, corporate responsibility and ethical issues can take a different route in SMEs. The small-business owner-manager is able to shape the corporate culture and to enact values other (...) than profit. Adopting a cognitive perspective, we have identified how the small-business owner-manager makes sense of notions linked to corporate social responsibility (CSR) and business ethics. The concept of sensemaking has recently been applied to CSR (Basu and Pallazzo, 2008; Cramer et al., 2006). Applying a cognitive perspective to small-business owners may help in explaining specific phenomena found within smallbusiness ownership. For this research, the Repertory Grid Technique (RGT) is used, a method that has not previously been widely applied in the business and society field. Our findings to an extent invalidate the confusion in terminology found in the academic literature. Smallbusiness owner-managers, pragmatically and rather clearly, differentiate among the various concepts related to corporate responsibility and business ethics but, at the same time, they recognise the interrelationships and interdependencies of these concepts. These findings contribute to a better understanding of how small-business owners think and integrate corporate responsibility and ethical issues into their decisionmaking. (shrink)
