Background: Organ donation and transplantation have made it possible to both save life and to improve the quality of life for a large number of patients. In the last years there has been an increasing gap between the number of patients who need organs and organs available for transplantation, and the focus worldwide has been on how to meet the organ shortage. This also rises some ethical challenges. Objective: The objective of this study was to explore healthcare professionals' experience of (...) ethics related to care and interaction with critically ill patients with severe brain injuries and their families. Research design: A hermeneutic phenomenological approach was used to explore the participants' experiences. Methods for collecting data were a combination of participant observations and in-depth interviews. Participants and research context: Two ICUs in a Norwegian university hospital were recruited for data collection. A total of 12 cases were observed, and 32 of the healthcare professionals involved were interviewed. Ethical considerations: The study was approved by the Regional Committee for Research Ethics. Permission to the study in the ICUs was obtained from the Chief Physician in the two ICUs respectively. The right of the participants was ensured by written, voluntary, and informed consent. Findings: From the thematic analysis, a structure of the participants' experiences emerged as a process. While the patients' condition was clarified through phases of prognostic ambiguity, gradual clarification and prognostic certainty, interaction with the families was characterized by ambiguity that involved withholding. The prognostic process had a great impact on how the healthcare professionals interacted with the family. The interaction challenged the participants' caring values in various ways and captured an important structure in their experiences of the ethical interaction with the patients' families. These challenges distinguish caring for families in donation situations from caring for relatives of critically ill patients in general. Discussion: In the discussion we have illuminated how professional ethics may be threatened by more pragmatic and utilitarian arguments contained in regulations and transplant act. Conclusion: Ethical questions should be discussed more both in educations of healthcare professionals and in clinical practice. (shrink)

The effect of uniform lighting on face identity processing is little understood, despite its potential influence on our ability to recognize faces. Here, we investigated how changes in uniform lighting level affected face identification performance during face memory tests. Observers were tasked with learning a series of faces, followed by a memory test where observers judged whether the faces presented were studied before or novel. Face stimuli were presented under uniform bright or dim illuminations, and lighting across the face learning (...) and the memory test sessions could be the same or different. This led to four experimental conditions: Bright/Dim ; Bright/Bright; Dim/Bright; and Dim/Dim. Our results revealed that incongruent lighting levels across sessions significantly reduced sensitivity to faces and introduced conservative biases compared to congruent lighting levels. No significant differences in performance were detected between the congruent lighting conditions and between the incongruent lighting conditions. Thus, incongruent lighting deteriorated performance in face identification. These findings implied that the level of uniform lighting should be considered in an illumination-specific face representation and potential applications such as eyewitness testimony. (shrink)

The article questions the assumption that conjoined twins are necessarily two people or persons by employing arguments based on different points of view: non-personal vitalism, the person as a sentient being, the person as an agent, the person as a locus of narrative and valuation, and the person as an embodied mind. Analogies employed from the cases of amputation, multiple personality disorder, abortion, split-brain patients and cloning. The article further questions the assumption that a conjoined twin's natural interest and wish (...) is separation. I first contend that separation is such a radical procedure as to render the post-separation person different from the pre-separation one. Therefore, it is not possible to benefit the pre-separation twin by the act of separation. The article concludes with a critical evaluation of the tendency in bioethics to regard ethical challenges as rivalry between individuals competing for scarce resources. (shrink)

This study explores the perceptions of Norwegian nurses who have received assisted dying requests from terminally ill patients. Assisted dying is illegal in Norway, while in some countries, it is an option. Nurses caring for terminally ill patients may experience ethical challenges by receiving requests for euthanasia and assisted suicide. We applied a qualitative research design with a phenomenological hermeneutic approach using open individual interviews. A total of 15 registered nurses employed in pulmonary and oncology wards of three university hospitals (...) and home care in one municipality were recruited. Four themes emerged from the analysis: (1) unprepared for the request; (2) meeting direct, indirect, and nonverbal requests; (3) working in a gray zone, and (4) feeling alone and powerless. The study found that nurses were unsure how to handle such requests due to professional uncertainty about assisted dying. Working in an environment where the topic is taboo made nurses morally uncertain, and some perceived this as moral distress. The hospital chaplain played a significant role in providing support to these nurses. (shrink)

In this paper I focus on a major aspect of the later Wittgenstein’s investigation of thinking – his discussion of the idea of thinking as a process or an activity. I shall show that Wittgenstein’s remarks, apart from some concerning the methodology and conception of philosophy, are grammatical remarks, meaning that they describe the use of the word “thinking” and can be agreed to by every competent speaker. I thus show that Wittgenstein’s investigation of thinking is a grammatical one, and (...) hence that there is no inconsistency between his conception of philosophy and his philosophical practice. In the process of doing so, I shall also review previous studies on this topic and point out their deficiencies. (shrink)

En este trabajo analizamos una de las propuestas recientes que defienden modificaciones metodológicas en la evaluación de riesgos respecto a los estándares de prueba: el enfoque basado en el peso de las pruebas (weight of evidence). Este enfoque puede interpretarse como un caso de ciencia precautoria en la investigación sobre riesgos. Esto es, se trata de una metodología que pretende proporcionar resultados más protectores de la salud pública y del entorno que las metodologías usuales en la evaluación de riesgos. Sin (...) embargo, existe la posibilidad de que quienes se muestran en contra de la regulación de ciertas aplicaciones tecnológicas introduzcan artificialmente incertidumbre en el cuerpo de la evidencia. En consecuencia, la metodologia del peso de las pruebas no conduce de manera automática a una mayor protección de la salud pública y del ambiente. Por ello es necesario analizar cada innovación valorando los posibles riesgos y los posibles beneficios sociales, y decidir en cada caso cuál de las dos posibilidades, la subregulación o la sobrerregulación, es más aceptable. El conocimiento científico es un elemento necesario para llevar a cabo esta valoración, pero no la determina.This paper analyzes one recent proposal for modifying the metodologies used in risk assessment: the Weight-Of-Evidence (WOE) approach. This approach is an example of precautionary science in risk research, i.e. a methodology which aims at a better protection of human health and the environment. However, some groups opposed to the regulation of certain technologies have started artificially introducing uncertainties into the body of evidence. This means that the WOE approach does not automatically lead to a higher level of health or environmental protection. It is therefore necessary to analyze each innovation on a case-by-case basis in order to evaluateits risks and benefits, and decide if to accept lower or, on the contrary, higher standards for its regulation. Scientific knowledge is a necessary element in this assessment, but not the decisive one. (shrink)

Like many of his contemporaries, Hegel considered Spinoza a modern reviver of ancient Eleatic monism, in whose system “all determinate content is swallowed up as radically null and void”. This characterization of Spinoza as denying the reality of the world of finite things had a lasting influence on the perception of Spinoza in the two centuries that followed. In this article, I take these claims of Hegel to task and evaluate their validity. Although Hegel’s official argument for the unreality of (...) modes in Spinoza’s system will turn out to be unsound, I do believe there is one crucial line in Spinoza’s system – Spinoza’s rather weak and functional conception of individuality – which provides some support for Hegel’s reading of Spinoza. We claim that, as it stands, the Deutsch–Wallace–Everett approach to quantum theory is conceptually incoherent. This charge is based upon the approach’s reliance upon decoherence arguments that conflict with its own fundamental precepts regarding probabilistic reasoning in two respects. This conceptual conflict obtains even if the decoherence arguments deployed are aimed merely towards the establishment of certain ‘emergent’ or ‘robust’ structures within the wave function: To be relevant to physical science notions such as robustness must be empirically grounded, and, on (...) our analysis, this grounding can only plausibly be done in precisely the probabilistic terms that lead to conceptual conflict. Thus, the incoherence problems presented necessitate either the provision of a new, non-probabilistic empirical grounding for the notions of robustness and emergence in the context of decoherence, or the abandonment of the Deutsch–Wallace–Everett programme for quantum theory. Judges and juries often make factual decisions even if the facts are disputed and there is no clear-cut evidence available. Despite this common state of uncertainty, verdicts are thought of as having clear winners and losers––either the plaintiff wins and receives a full remedy, or the defendant wins and the plaintiff gets nothing. In private disputes, factfinders base their binary factual determinations on the preponderance of the evidence. There are, however, several doctrines that allow for partial remedy, discounted by the (...) probability that the facts support the plaintiff’s case, given the available evidence (proportional liability). This Article offers a general theory for proportional liability in private law. It identifies three types of factual uncertainty—mutual uncertainty, unilateral uncertainty, and institutional uncertainty—and shows that legal economists should support proportional liability when the state of uncertainty is shared by the parties and the court (mutual uncertainty), and they should adopt an all-or-nothing rule whenever the information is observable but unverifiable (institutional uncertainty). In cases where one party holds private information (unilateral uncertainty), proportional liability is sometimes, but not always, superior to an all-or-nothing rule. (shrink)

Maintaining plural values is important when there is no conclusive principle by which the relative priority of normative positions can be determined. Value-articulating institutions predicated upon such principles have a low pluralistic potential. In response to the failures of stated-preference approaches to economic valuation, new perspectives have been developed to capture plural values. Three broad approaches are identified. The first, functional diversifi-cation, seeks to encompass the multiple qualities of the object of valuation, whereas positional modification enforces a particular mode of (...) thinking on the subject. Both entail a prior judgement of values and benefit from a reduction in the range of values. Eventually, therefore, both approaches collapse pluralism to a problem that can be tackled. The third approach, structural reconstruction, has greater pluralistic potential, recognising that the more diverse and uncertain the object of valuation, the more compelling it is. (shrink)

Uterus transplantation (UTx) is an experimental surgery likely to face the issue of organ shortage. In my article, I explore how this issue might be addressed by changing the prevailing practices around live uterus donor recruitment. Currently, women with children – often the mothers of recipients – tend to be overrepresented as donors. Yet, other potentially eligible groups who may have an interest in providing their uterus – such as transgender men, or cisgender women who do not wish to gestate (...) or to have children – tend to be excluded as potential donors. Moving forward, I recommend that donor inclusion criteria for UTx be broadened to be more inclusive of these latter groups. (shrink)

_Purpose_ of the article is to find out the main content and ways of embodying freedom as a value of the volunteer movement in the context of analyzing the social motivation of human behavior in general. _Theoretical basis._ The theoretical basis of the research is the philosophical and anthropological understanding of freedom as a person’s creative overcoming of obstacles to establish his or her eccentric essence. Such a vision is embedded, in particular, in Karl Jaspers’ philosophy of existence, Helmuth Plessner’s (...) philosophy of positioning in the world, and Paul Ricœur’s philosophy of rational choice of life path. _Originality__._ The importance of freedom as a value, as well as other social values, is revealed and specified through the analysis of the values of the volunteer movement. In the desire of people engaged in volunteer work to achieve freedom through other values, the content of freedom as a basis for self-reproduction of the individual, community and society is revealed. _Conclusions._ Representatives of various humanities and social sciences have distinct research interests in analyzing the values inherent in volunteers. As members of a certain society and certain communities in this society, volunteers do not act outside the economy, politics and other spheres of public life, but reveal their freedom through creative and non-standard solutions to economic, political, and other problems. At the same time, research psychologists focus attention on the personal self-realization of a person, theorists and practitioners of social work study volunteers’ desire to gain recognition from peers and other small social groups, and representatives of sociology, political science and other social sciences focus their attention on such socially significant values of volunteering as patriotism, solidarity, etc. The task of social philosophy is to justify the desire to contribute to the public good, which is common to all volunteers. Representatives of philosophical anthropology look for the best social intentions inherent in a person as a member of society in volunteering. Analysis of the values of volunteering as a motivator of human behavior provides knowledge of socially significant values inherent in every member of society to a greater or lesser extent. (shrink)

Friends of Wright-entitlement cannot appeal to direct epistemic consequentialism (believe or accept what maximizes expected epistemic value) in order to account for the epistemic rationality of accepting Wright-entitled propositions. The tenability of direct consequentialism is undermined by the “Truth Fairy”: a powerful being who offers you great epistemic reward (in terms of true beliefs) if you accept a proposition p for which you have evidence neither for nor against. However, this chapter argues that a form of indirect epistemic consequentialism seems (...) promising as a way to deal with the Truth Fairy problem. The relevant form of indirect consequentialism accommodates evidentialism but allows for exceptions in the case of anti-sceptical hypotheses. Since these are the kind of propositions to which Wright-entitlement is supposed to apply—i.e. cornerstone propositions—indirect consequentialism is entitlement-friendly. (shrink)

IntroductionHigh healthcare costs make illness precarious for both patients and their families’ economic situation. Despite the recent focus on the interconnection between health and financial risk at the systemic level, the ethical conflict between concerns for potential health benefits and financial risk protection at the household level in a low-income setting is less understood.MethodsUsing a seven-step ethical analysis, we examine a real-life dilemma faced by families and health workers at the micro level in Ethiopia and analyse the acceptability of limiting (...) treatment for an ill newborn to protect against financial risk. We assess available evidence and ethical issues at stake and discuss the dilemma with respect to three priority setting criteria: health maximisation, priority to the worse-off and financial risk protection.ResultsGiving priority to health maximisation and extra priority to the worse-off suggests, in this particular case, that limiting treatment is not acceptable even if the total well-being gain from reduced financial risk is taken into account. Our conclusion depends on the facts of the case and the relative weight assigned to these criteria. However, there are problematic aspects with the premise of this dilemma. The most affected parties—the newborn, family members and health worker—cannot make free choices about whether to limit treatment or not, and we thereby accept deprivations of people’s substantive freedoms.ConclusionIn settings where healthcare is financed largely out-of-pocket, families and health workers face tragic trade-offs. As countries move towards universal health coverage, financial risk protection for high-priority services is necessary to promote fairness, improve health and reduce poverty. (shrink)

This article isolates ten prepositions, which constitute the undercurrent paradigm of contemporary discourse of health disease and medicine. Discussion of the interrelationship between those prepositions leads to a systematic refutation of this paradigm. An alternative set is being forwarded. The key notions of the existing paradigm are that health is the natural condition of humankind and that disease is a deviance from that nature. Natural things are harmonious and healthy while human made artifacts are coercive interference with natural balance. It (...) is suggested that the current paradigm is influenced by the world of finances and by instrumental reason. The alternative model suggests that human nature cannot be delineated. Humans fashion their own selves and nature by artificial means, medicine among them. The article discusses the implications of the paradigm adapted in various scholarly and popular debates such as the use of sex hormones for contraception, the care of the elderly, holistic medicine and distributive justice in health care. Medicine is not an isolated or a privileged realm. There is no unique entitlement to health care. It is always part of a broader agenda of social values and institutions. A open view of human societies, values and practices as they are situated within concrete material conditions is the platform required for an integrative and creative discourse of health care. In _Animacies_, Mel Y. Chen draws on recent debates about sexuality, race, and affect to examine how matter that is considered insensate, immobile, or deathly animates cultural lives. Toward that end, Chen investigates the blurry division between the living and the dead, or that which is beyond the human or animal. Within the field of linguistics, animacy has been described variously as a quality of agency, awareness, mobility, sentience, or liveness. Chen turns to cognitive linguistics to stress how language habitually (...) differentiates the animate and the inanimate. Expanding this construct, Chen argues that animacy undergirds much that is pressing and indeed volatile in contemporary culture, from animal rights debates to biosecurity concerns. Chen's book is the first to bring the concept of animacy together with queer of color scholarship, critical animal studies, and disability theory. Through analyses of dehumanizing insults, the meanings of queerness, animal protagonists in recent Asian/American art and film, the lead in toys panic in 2007, and the social lives of environmental illness, _Animacies_ illuminates a hierarchical politics infused by race, sexuality, and ability. Professional philosophy in the US remains relatively homogenous. I use four anecdotes to amplify some of the practices that may contribute to the dearth of underrepresented philosophers. Each anecdote highlights a different problem—lack of proper mentoring, stereotype threat, difficulties navigating sexism, and a sense of exclusion. Although I discuss each of these issues separately, it is certainly the case that these can and often do occur concurrently. This dissertation is an ontological investigation of value. The thesis is this: Value is a moment founded on a real entity and, in this sense, value is real. I argue that this thesis is true for all objects in the domain of value by looking at three distinct categories of value: economic value, aesthetic value, and moral value. And I demonstrate by means of advancing definitions, and the necessary and sufficient conditions for each of these three categories of value, that (...) this thesis is the essential glue that holds all values in the realm of social reality as part of the genus value. There are two restrictions to this thesis. One restriction is that the real existence of value is possible only if there is a relation of correspondence between a value judgment and its referent. A false value judgment, then, fails to correspond to its intentional target so there is no possible value. The other restriction is that the value entities are either concrete objects that have at least temporally come into being, or actual states of affairs with a spatial and temporal location. Both of these restrictions combined imply that no future states of affairs, or objects which either have not or cannot come into being, can be objects of value. _Purpose._ The article is dedicated to the research of Lesia Ukrainka’s correspondence, journalistic and literary-critical articles concerning the problem of national identity as a factor in overcoming the "Russian Ukrainians" dichotomy. Achieving this purpose involves solving the following tasks: 1) to reveal the poetess’s views on the essence and social manifestations of worldview fluctuations in the life activities of the Ukrainian elite at the end of the 19th and 20th centuries; 2) outline her strategy for overcoming cultural "inter-words" in the (...) individual and society. _Theoretical basis._ The author applies the existential discourse of Foreignness by G. Marcel, criticism of Christianity by F. Nietzche, the theory of the nation by F. Meineke, typology of patriotism by A. Valitsky, the phenomenology of the relationship between the Self and the Other by J. Kristeva, the typology of the Stranger by B. Waldenfels, the ideas of D. Dontsov, O. Zabuzhko, S. Varetska, S. Matsenka, D. Melnyk, Y. Tarasiuk. _Originality._ The author proves that Lesia Ukrainka is one of the first among Ukrainian thinkers who critically considers the issue of dichotomy in the worldview and life world of "Russian Ukrainians" of the early twentieth century – One’s own and Others’, stopping in the uncertainty of one’s belonging to Russian or Ukrainian culture, rejection of national self-identification. _Conclusions._ The ways to overcome this dichotomy, alienation from the values of Ukrainian culture, betrayal, and collaborationism, Lesia Ukrainka sees, firstly, awareness of the cultural difference of Ukrainians, that is, the spiritual and psychological incompatibility of the Ukrainian national identity with the Russian one. Secondly, the need for an effective volitional separation from others and the political struggle for unification into the Ukrainian nation as a social and culturally self-sufficient collective self, worthy of a free dignified existence and recognition by other nations of the world. Travelling internationally to acquire medical treatments otherwise unavailable or inaccessible in one’s home country is not a novel concept. Conventionally, such medical travel largely entailed patients from developed countries or wealthy patients from the developing world seeking care in Western facilities like the Mayo Clinic in the U.S. and myriad private clinics along Harley Street in London, England. What is different about the topical phenomenon known as “medical tourism” is the growing trend of health services export in the opposite direction. (...) The number of patients travelling from the developed world to low- and middle-income countries for treatments has ballooned in recent years, primarily driven by difficulties with accessing affordable care at home. An interpretation is offered of Thrasymachus' account of the nature of justice and just action in book I of the 'Republic' which is internally consistent throughout on all important points. Just action is not defined in terms of its practical consequences, as many commentators assume, but rather in terms of its logical consequences 'vis-a-vis' just agents. When one man acts justly towards another, the performance of the just act renders the just agent vulnerable to unfair or unjust exploitation by those (...) with whom he deals. The "strong man", in Thrasymachus' sense, would thus never be a just man. It is argued that Socrates addresses himself to this position, but that, while the textual Thrasymachus is silenced, Socrates' best arguments are, in fact, inadequate to refute Thrasymachus. How do we ready ourselves to intervene responsively in the contingent situations that arise in co-designing to make change? How do we attune to group dynamics and respond ethically to unpredictable developments when working with 'community'? Participatory Design can contribute to social transitions, yet its focus is often tightly tuned to technique for designing ICT at the cost of participatory practice. We challenge PD conventions by addressing what happens as we step into a situation to alter it with others, an (...) aspect of practice that cannot be replicated or interchanged. We do so to argue that practices of readiness are constituted by personal histories, experiences, philosophies and culture. We demonstrate this political argument by giving reflexive accounts of our dimensions of preparation. The narratives here are distinct, yet reveal complementary theories and worldviews that shape PD ontologies. We have organized these around the qualities of punctuation and poise as a way to draw out some less easily articulated aspects of PD practice. (shrink)

By analyzing a gedanken experiment designed to measure the distance l between two spatially separated points, we find that this distance cannot be measured with uncertainty less than (ll 2 P) 1/3 , considerably larger than the Planck scale lP (or the string scale in string theories), the conventional-wisdom uncertainty in distance measurements. This limitation to space-time measurements is interpreted as resulting from quantum fluctuations of space-time itself. Thus, at very short distance scales, space-time is “foamy.” This intrinsic foaminess of (...) space-time provides another source of noise in the interferometers. The LIGO/VIRGO and LISA generations of gravity-wave interferometers, through future refinements, are expected to reach displacement noise levels low enough to test our proposed degree of foaminess in the structure of space-time. Several defences, viewed in this study as specifications or 'offspring' of the 'parent' greater-good defence, have been formulated in response to the charge that Christianity is untenable because God's existence is incompatible with evil's existence. In this first book-length study of the parent defence, Stewart begins with careful definitions of the omni-attributes central to the dispute: omnipotence, omniscience, omnibenevolence. The parent defence is traced to tenets of theism and variant accounts of the defence considered. Plantinga's modal free-will defence and Hick's (...) and Yandell's soul-growth specifications are carefully analyzed and several difficulties resolved. An original formulation of a redemption specification and an original account of the origin of moral evil are offered. Stewart argues that the defences are rightly viewed as a family of defences falling under the greater-good heading, and that they comprise a complementary apologetic complex that refutes the claim of inconsistency. Following Henkin’s discovery of partially-ordered (branching) quantification (POQ) with standard quantifiers in 1959, philosophers of language have attempted to extend his definition to POQ with generalized quantifiers. In this paper I propose a general definition of POQ with 1-place generalized quantifiers of the simplest kind: namely, predicative, or “cardinality” quantifiers, e.g., “most”, “few”, “finitely many”, “exactly α ”, where α is any cardinal, etc. The definition is obtained in a series of generalizations, extending the original, Henkin definition first to a (...) general definition of monotone-increasing (M↑) POQ and then to a general definition of generalized POQ, regardless of monotonicity. The extension is based on (i) Barwise’s 1979 analysis of the basic case of M↑ POQ and (ii) my 1990 analysis of the basic case of generalized POQ. POQ is a non-compositional 1st-order structure, hence the problem of extending the definition of the basic case to a general definition is not trivial. The paper concludes with a sample of applications to natural and mathematical languages. (shrink)

This study concerns the ideas of one particular philosopher, Henri Bergson, whose views of time, intuition, and creativity have had a significant impact on art, literature, and the humanities, both in his time and in our own. Although it is generally recognized that Bergson's ideas have significantly impacted the arts and the humanities, it has not been recognized how they have also had a creative influence on the sciences as well. Nor has it been realized that this was one of (...) his most basic contentions. Bergson's conception of intuition--his fundamental insight into reality--was not limited to fugitive insights into human existence. By realizing previously unsuspected possibilities for research and discovery, his endeavors were also meant to make possible new advances in the sciences. If it enabled his cousin by marriage, Marcel Proust, to explore human memory in depth, it also inspired psychologists like Daniel Schachter to use Bergson's ideas to make real contributions to contemporary memory science. If his notion of creative evolution brought many thinkers to a belief in human creative freedom, it brought others (notably Alexis Carrel and Pierre Lecomte de Noüy) to a scientific study of biological time. Among his successful speculations was the theory of the Big Bang cosmology. 'Getting Bergson Straight' shows many points at which Bergson's ideas anticipated future developments in the sciences. This was seen clearly by the Nobel Prize-winning physicist Luis de Broglie who viewed Bergson's physics as presaging quantum physics. Thus, the text is well situated for arts, humanities, social science, and natural science classrooms studying creative thinking and/or intellectual history. (shrink)
