In 2009 the Roundtable on Sustainable Palm Oil established a conflict resolution mechanism to help rural communities address their grievances against palm oil companies that are RSPO members. This article presents the broadest ever comprehensive assessment of the use and effectiveness of the RSPO conflict resolution mechanism, providing both overviews and in-depth analysis. Our central question is: to what extent does the RSPO conflict resolution mechanism offer an accessible, fair and effective tool for communities in Indonesia to resolve conflicts with (...) companies? Our aim is not only to provide a ‘reality check’ of this mechanism but also to contribute to the wider debate on how communities can seek access to justice when engaged in intractable conflicts with palm oil companies. For data collection, we took three steps. First, we used our own database of 150 conflicts between communities and companies in Indonesia. We identified 64 conflicts that involved RSPO member companies, of which 17 prompted communities to convey their grievances to the RSPO’s conflict resolution mechanism. Second, we used the database of the RSPO, which handled 85 complaints against companies in Indonesia in the period 2009–2020. Third, we conducted fieldwork, in total, about 6 months of fieldwork and extensive interviews on three conflicts involving RSPO companies to identify mechanisms leading to both failed and successful instances of conflict resolution. For our assessment, we used three criteria to assess the conflict resolution mechanism of the RSPO: accessibility, procedural justice, and the outcomes of the process. We conclude that—on all counts—the conflict resolution mechanism is biased in favor of companies. The result of these biases is that the actual capacity of the RSPO’s mechanism to provide a meaningful remedy for rural communities’ grievances remains very limited. This article theorizes a research process in a highly politicized environment in which we, as feminist researchers, found ourselves standing outside the feminist standpoint which dominated Irish public discourse, viz advocacy of a Swedish-style, neo-abolitionist, prostitution policy. We suggest that our increasing personal and intellectual discomfort as that policy position gained support contained valuable epistemic insight. We theorize this principally by drawing on Pillow’s concept of ‘reflexivities of discomfort’. This article offers an account of the messy dynamics of a research (...) process in which we, in time, recognized our own psychosocial worlds as sites of social critique. We contribute to debates about reflexivity by exploring the insights which this approach brought when applied to the dynamics of power politics between us as researchers and the wider policy field within which we were immersed. This essay describes a new ethical theory that has begun to coalesce from the works of several scholars in the international computer ethics community. I call the new theory ‚Flourishing Ethics’ because of its Aristotelian roots, though it also includes ideas suggestive of Taoism and Buddhism. In spite of its roots in ancient ethical theories, Flourishing Ethics is informed and grounded by recent scientific insights into the nature of living things, human nature and the fundamental nature of the universe – (...) ideas from today’s information theory, astrophysics and genetics. Flourishing Ethics can be divided conveniently into two parts. The first part, which I call ‚Human-Centered FE,’ is focused exclusively upon human beings – their actions, values and characters. The second part, which I call ‚General FE,’ applies to every physical entity in the universe, including humans. Kant’s Transcendental Ideal (TI) is presented in a notoriously obscure section of the Critique of Pure Reason. Many readers know that Kant’s principal purpose in the TI is to show how reason fallaciously derives its concept of God from its idea of the world. But this argument is clothed in a language that is unfamiliar even to skilled commentators on Kant’s work. In this essay, I present the historical context of the proof, conduct a detailed exegesis of the proof, and (...) argue that Kant formulated the Transcendental Ideal in such a way as to avoid Spinozism—a point Kant later seems to have doubted could be avoided. On the standard reading of Hume, the belief that the necessity associated with the causal relation is “an entirely mind-independent phenomenon” in the world isunjustified. For example, Jonathan Bennett writes that necessary connections of the sort that Hume allows are not “relations which hold objectively between the ‘objects’ or events which we take to be causally related.” Similarly, Barry Stroud writes that, according to Hume, we believe falsely “that necessity is something that ‘resides’ in the relation between objects or events (...) in the objective world.” In this paper I argue that this reading of Hume is mistaken and that there is a sense of justification (viz., justification qua “proof”) according to which human beings are justified in holding the belief that the necessity associated with the causal relation is “an entirely mind-independent phenomenon” in the world. This paper describes an argumentative fallacy we call ‘Retroductive Analogy.’ It occurs when the ability of a favored hypothesis to explain some phenomena, together with the fact that hypotheses of a similar sort are well supported, is taken to be sufficient evidence to accept the hypothesis. This fallacy derives from the retroductive or abductive form of reasoning described by Charles Sanders Peirce. According to Peirce’s account, retroduction can provide good reasons to pursue a hypothesis but does not, by itself, provide (...) good reasons to believe the hypothesis. In successful applications of retroduction, pursuit leads to the accumulation of evidence. In retroductive analogy, comparison with other successful hypotheses is substituted for the genuine pursuit of evidence. We describe a case from ecological genetics in which retroduction plays a legitimate role as the initial phase of an ongoing research program that serves to accumulate genuine evidence for a hypothesis. We also examine two contexts in which the fallacy of retroductive analogy occurs: in defenses of Intelligent Design Theory and in defense of some hypotheses in Evolutionary Psychology. (shrink)

Religious Conversion, Serf- Deception, and Pascal's Wager WARD E.JONES BLAISE PASCAL'S Pens~es is a sustained attempt to convert, to lead its reader to form the belief in the articles of faith. Pascal does not hope to convert by a direct presentation of evidence or argument, but rather attempts to induce in the reader a desire for belief in the articles of faith. He hopes that this desire will lead the reader to put herself in a situation in which she (...) will form the belief. Pascal, in other words, wants the reader to take control over her belief, to form it because she wants to do so. We commonly put ourselves in a situation for the purpose of forming beliefs. This is what happens when we choose to go, say, to university; choos- ing to learn is choosing to form beliefs in a given field. Pascal urges something more paradoxical. ~ He wants to induce us to form a particular belief . His dual aim is to induce the unbeliever to want a belief, and then to induce her to do what she can to gain that belief. Now if I want a particular belief, I might place myself in a situation in which nonrational or pragmatic determinants would bring about the belief. I might, that is, visit a hypnotist or a brainwasher, choosing some process which will either directly bring about the desired belief without involving my epistemic capabilities, or one which will diminish my epistemic capabilities. Digital personal data is increasingly framed as the basis of contemporary economies, representing an important new asset class. Control over these data assets seems to explain the emergence and dominance of so-called “Big Tech” firms, consisting of Apple, Microsoft, Amazon, Google/alphabet, and Facebook. These US-based firms are some of the largest in the world by market capitalization, a position that they retain despite growing policy and public condemnation—or “techlash”—of their market power based on their monopolistic control of personal data. We (...) analyse the transformation of personal data into an asset in order to explore how personal data is accounted for, governed, and valued by Big Tech firms and other political-economic actors. However, our findings show that Big Tech firms turn “users” and “user engagement” into assets through the performative measurement, governance, and valuation of user metrics, rather than extending ownership and control rights over personal data per se. We conceptualize this strategy as a form of “techcraft” to center attention on the means and mechanisms that Big Tech firms deploy to make users and user data measurable and legible as future revenue streams. Nietzsche and Freud saw Christianity as metaphysical escapism, with Nietzsche calling the religion a "Platonism for the masses" and faulting Paul the apostle for negating more immanent, material modes of thought and political solidarity. Integrating this debate with the philosophies of difference espoused by Gilles Deleuze, Michel Foucault, Jacques Derrida, Jacques Lacan, and Pier Paolo Pasolini, Ward Blanton argues that genealogical interventions into the political economies of Western cultural memory do not go far enough in relation to the imagined (...) founder of Christianity. Blanton challenges the idea of Paulinism as a pop Platonic worldview or form of social control. Discussions of sexual ethics often focus on the wrong of treating another as a mere object instead of as a person worthy of respect. On this view, the task of sexual ethics becomes putting the other’s subjectivity above their status as erotic object so as to avoid the harms of objectification. Ward and Anderson argue that such a view disregards the crucial, moral role that erotic objecthood plays in sexual encounters. Important moral features of intimacy are disclosed through the (...) experience of being an erotic object for another, as well as in perceiving another as an erotic object. Drawing on phenomenology, especially the insights of Simone de Beauvoir, Ward and Anderson argue that erotic encounters are shaped by the human condition of ambiguity, where being an object for others is intertwined with bodily agency. Because sexual agency is complex in this way, theories of sexual ethics and responsibility must widen their focus beyond transparent communication and authoritative expressions of will. (shrink)

This study examines how news factors in press releases influence journalists’ decisions and the journalistic treatment of press release information after its initial selection for the news agenda: These journalists can transform press releases into a news story, which involves little journalistic capital investment, or use these releases for a unique news production, which requires significant journalistic capital investment. The data elicited from the content analysis show that the more profound the presence of certain news factors in press releases, the (...) higher the chance that journalists will choose to invest their journalistic capital in these press releases. The Higgs mechanism gives mass to Yang-Mills gauge bosons. According to the conventional wisdom, this happens through the spontaneous breaking of gauge symmetry. Yet, gauge symmetries merely reflect a redundancy in the state description and therefore the spontaneous breaking can not be an essential ingredient. Indeed, as already shown by Higgs and Kibble, the mechanism can be explained in terms of gauge invariant variables, without invoking spontaneous symmetry breaking. In this paper, we present a general discussion of such gauge invariant (...) treatments for the case of the Abelian Higgs model, in the context of classical field theory. We thereby distinguish between two different notions of gauge: one that takes all local transformations to be gauge and one that relates gauge to a failure of determinism. (shrink)

Despite the growing attention to oppression and resistance in social and political philosophy as well as ethics, philosophers continue to struggle to describe and appropriately attribute agency under non-ideal circumstances of oppression and structural injustice. This chapter identifies some features of new accounts of non-ideal agency and then examines a particular problem for such theories, what Serene Khader has called the agency dilemma. Under the agency dilemma, attempts to articulate the agency of subjects living under oppression must on the one (...) hand avoid overemphasizing constraints on agency, and thereby producing paternalistic theories that “deny agency” for oppressed subjects, and on the other hand avoid failing to fully appreciate the effects of oppression on agency, thereby missing crucial features of how oppression unjustly shapes a person’s lived possibilities. This chapter traces this dilemma to a preoccupation with ascribing agency, which produces problematic descriptive and political effects for theorizing agency under oppression: what the author calls an asymmetry problem and a disenfranchisement problem. Finally, the chapter proposes that the agency dilemma might be ameliorated if theorists scrutinize more closely how moral, epistemic, and political agency interact and overlap in life under oppression. Ward I WOULD LIKE TO BEGIN this reply by thanking the commentators. The reports of their clinical experience contained some interesting evidence regarding evil behavior that, I think, supports my thesis and their full frontal criticism has given me a chance to reemphasize how complex the problem of evil behavior (...) is.On the question raised by Steven Sverdlik, as to whether Kant was in possession of the idea of the unconscious: it never occurred to me that Kant's notion of the subreption of the will—the idea that we could somehow be deceived with regard to our true motives (1956, 121)—could be regarded as a reason for assuming that Kant had a concept of the unconscious. Certainly talk of being unsure of one's motives has been common currency in every age that has had the idea of acting out of duty as opposed to desire. This uncertainty allows us to think about unconscious motives and thus of a set of hidden mechanisms that might motivate our actions without our being aware of them. However, I think we would both agree that Kant nowhere articulates this hypothesis. Freud did articulate it. So I agree that I should have said that Kant was not in possession of a concept of unconscious mechanisms that may generate behavior in such a way as to be opaque to the agent involved.Sverdlik has two worries with regard to my thesis. The first concerns my characterization of evil behavior as wrongdoing for wrongdoing's sake. He believes that rather than insisting that all principled behavior must fit this formula, "Ward is really interested in wrongdoing that is non-impulsive and actuated by some principle, but not necessarily the satanic one." This is, indeed, exactly what I was interested in. It is the unconscious adherence to some principle that causes all the trouble for evil people. Sverdlik thinks that my proposal was "to attribute acceptance [of such principles] to the unconscious" and to maintain that though the agent does "not consciously accept it, [it] does do so unconsciously" (my emphasis). What I actually said was: In my account, there is a near-perfect dovetailing of the two different psychological perspectives—that of Kant's moral psychology (which lacks the resources to accommodate the possibility of evil) and that of Peck's psychiatric diagnosis of evil—that explains (on my construal) how an unconscious adherence to unacknowledged principles could be the driving power behind evil behaviour. What is the difference between unconscious acceptance of a principle and unconscious adherence to it? This difference can be illustrated in connection with Sverdlik's continuation of his argument: Ward suggests that the agent does not consciously accept it, but does so unconsciously. But why does the unconscious not see that it is not universalizable? And if it does see this, why does it proceed to act on it? Ward's picture of the unconscious must allow it to be rational enough to understand the narcissistic principle, for example, [protect your self-image at all costs] and to act on it. But if it is that rational, then it is puzzling that it does not draw the same conclusion [End Page 23] that the agent's conscious deliberation can and will draw. Therefore, if consciously acting on a non-universalizable principle is inexplicable, then so is unconsciously acting on it. According to my picture of the unconscious, what the unconscious is rational about are hypothetical principles: it sees the connection between means and ends with perfect rationality. When, in my article, I distinguished between categorical and hypothetical imperatives I pointed out that... it is clear that hypothetical principles like always dress in woolens can only motivate us if we already have a desire to be warm. Strictly speaking, hypothetical principles do not motivate us by themselves.
