That holobionts are units of selection squares poorly with the observation that microbes are often recruited from the environment, not passed down vertically from parent to offspring, as required for collective reproduction. The taxonomic makeup of a holobiont’s microbial community may vary over its lifetime and differ from that of conspecifics. In contrast, biochemical functions of the microbiota and contributions to host biology are more conserved, with taxonomically variable but functionally similar microbes recurring across generations and hosts. To save what (...) is of interest in holobiont thinking, we propose casting metabolic and developmental interaction patterns, rather than the taxa responsible for them, as units of selection. Such units need not directly reproduce or form parent-offspring lineages: their prior existence has created the conditions under which taxa with the genes necessary to carry out their steps have evolved in large numbers. These taxa or genes will reconstruct the original interaction patterns when favorable conditions occur. Interaction patterns will vary in ways that affect the likelihood of and circumstances under which such reconstruction occurs. Thus, they vary in fitness, and evolution by natural selection will occur at this level. It is on the persistence, reconstruction, and spread of such interaction patterns that students of holobiosis should concentrate, we suggest. This model also addresses other multi-species collectively beneficial interactions, such as biofilms or biogeochemical cycles maintaining all life. (shrink)

In this study, W. J. Waluchow argues that debates between defenders and critics of constitutional bills of rights presuppose that constitutions are more or less rigid entities. Within such a conception, constitutions aspire to establish stable, fixed points of agreement and pre-commitment, which defenders consider to be possible and desirable, while critics deem impossible and undesirable. Drawing on reflections about the nature of law, constitutions, the common law, and what it is to be a democratic representative, Waluchow urges a different (...) theory of bills of rights that is flexible and adaptable. Adopting such a theory enables one not only to answer to critics' most serious challenges, but also to appreciate the role that a bill of rights, interpreted and enforced by unelected judges, can sensibly play in a constitutional democracy. They were written by experts for the general reader and combined a comprehensive approach to knowledge with an emphasis on accessibility. The Moral Life by W. R. Sorley was first published in 1911 and reissued as this third edition in 1920. Even lawyers who obey the law often seem to act unethically--interfering with the discovery of truth, subverting justice, and inflicting harm on innocent people. Standard arguments within legal ethics attempt to show why it is permissible to do something as a lawyer that it would be wrong to do as an ordinary person. But in the view of most critics these arguments fail to turn wrongs into rights. Even many lawyers think legal ethics is flawed because it does not accurately (...) describe the considerable moral value of their work. In Lawyers and Fidelity to Law, Bradley Wendel introduces a new conception of legal ethics that addresses the concerns of lawyers and their critics alike.Wendel proposes an ethics grounded on the political value of law as a collective achievement that settles intractable conflicts, allowing people who disagree profoundly to live together in a peaceful, stable society. Lawyers must be loyal and competent client representatives, Wendel argues, but these obligations must always be exercised within the law that constitutes their own roles and confers rights and duties upon their clients. Lawyers act unethically when they treat the law as an inconvenient obstacle to be worked around and when they twist and distort it to help their clients do what they are not legally entitled to do. In this article I have tried to rebut certain types of arguments which purport to show not merely that God does not exist but that the notion of necessary existence is itself either self-contradictory or senseless. In showing that it is not self-contradictory I have allowed myself the luxury of a negative and a positive approach. Negatively, I have had to show that when the accusation of self-contradiction is made, it is often accompanied, not by an argument but by a (...) sheer assertion. On the rare occasions when an argument is forthcoming, the arguments, I have tried to show, have been invalid, not even, inconclusive. And to the extent that Kant may be said to have argued not simply the impossibility of a genuine proof of the existence of God, but indeed the impossibility of the concept of necessary existence, I have argued out the weakness of Kant's arguments, the most notable of which I have discussed in some detail. Finally, to establish the genuineness of the concept of necessary existence, positively, I have paradoxically made use of a notion from Russell's logic. (shrink)

Is original sin compatible with evolution? Many today believe the answer is 'No'. Engaging Aquinas's revolutionary account of the doctrine, Daniel W. Houck argues that there is not necessarily a conflict between this Christian teaching and mainstream biology. He draws on neglected texts outside the Summa Theologiae to show that Aquinas focused on humanity's loss of friendship with God - not the corruption of nature. Aquinas's account is theologically attractive in its own right. Houck proposes, moreover, a new Thomist view (...) of original sin that is consonant with evolution. This account is developed in dialogue with biblical scholarship on Jewish hamartiology and salient modern thinkers, and it is systematically connected to debates over nature, grace, the desire for God, and justification. In addition, the book canvasses a number of neglected premodern approaches to original sin, including those of Anselm, Abelard, and Lombard. (shrink)

Buddhist meditation practices presuppose that the abstract doctrines of Buddhist teachings can be transformed into individual experiences. In contrast to the assumption of a merely solipsistic phenomenology which focuses on first-person perspectives alone, we would like to propose a sociological extension of this perspective to a relational perspective that includes specific world- and selfreferences. With the empirical case of a long-time practitioner of Theravada Buddhism, we show how the primary focus on individual experiences may be misleading in terms of Buddhist (...) training and how shifts in the first-person perspective only occur through social friction. In this way, we are able to present empirical insights into how individual qualities of meaning become linked to social qualities of meaning, which then can be understood as a process of co-production of individual and social meaning. Latin constructions of the type magna cum laude "with great praise" have traditionally been equated structurally and historically with univerbated phrases of the type mecum "with me" and further with postpositional constructions in Sabellic like Umbrian nertru-co persi "at the left foot." Moreover, all three have been adduced as archaic survivals of postpositional syntax in Italic. A detailed investigation of both the synchrony and diachrony of these constructions, however, reveals that these conclusions are for the most part incorrect and that (...) our historical account of the evolution of adpositional syntax in both branches of Italic must be revised.
