This chapter argues that ethics plays an extremely important role in decision making and lawmaking in bioethics issues. These decisions are not simple case-by-case judgments; rather, they rest upon deeply considered ethical opinions. It also discusses the implications of this epistemic grounding for bioethics and its use of case law materials as an ethical resource. Finally, since many people base their moral judgments on religious beliefs, the religious implications of this legal-moral relationship are considered.

This paper explores some of the ethical implications of artificial insemination and in vitro fertilization. In both cases the emphasis is on the interests of the potential child. It concludes that in neither case is great optimism or great pessimism appropriate. About AID, much of the legal and ethical concern has been other than child-centered, and has focused mainly on the interests of parents and donors. Three aspects expecially remain troubling: donor selection, record-keeping and disclosure and the testing of frozen (...) semen. This article seeks to shed light on the beliefs that influence nurses’ intention of respecting or not respecting an advance directive document, namely a living will or a durable power of attorney. Nurses’ beliefs were measured using a 44-statement questionnaire. The sample was made up of 306 nurses working either in a long-term care centre or in a hospital centre offering general and specialized care in the province of Québec. The results indicate that nurses have a strong intention of complying (...) with advance directives written by patients. The analysis also shows that four variables determine the strength of this intention: respect for autonomy; the location of the workplace; justice; and the dimension of relationships and emotions. Although these documents favour the expression of patients’ wishes, nurses should be aware that they do not systematically guarantee respect of a patient’s autonomy, nor do they replace a relationship based on trust between patients and health care professionals. This expository essay relies on the views of scholars writing about Atlas Shrugged to make a case that it is a highly integrated work of imaginative literature. The article focuses on the ways in which integration is manifested in Atlas Shrugged. Part 1 examines the philosophical structure of the novel. Part 2 addresses literary structure. This is followed by a discussion of Rand's techniques of characterization. An analysis of the speeches and the theme of mind-body integration concludes the discussion.

The ethical theories employed in health care today assume, in the main, a modern Western philosophical framework. Yet the diversity of cultural and religious assumptions regarding human nature, health and illness, life and death, and the status of the individual suggest that a cross-cultural study of health care ethics is needed. FurtonIn his article titled “Moral Complicity in Induced Pluripotent Stem Cell Research,” Mark T. Brown (2009) unfortunately mischaracterizes my ethical analysis of the use of induced pluripotent stem (iPS) cells for replacement therapies, or treatments (Byrnes 2008). In my paper, which Brown cites, I argue that, just as it is ethically acceptable (...) for parents to allow their children and themselves to be immunized using vaccines produced by cell lines derived from human fetuses aborted in the past, it is also acceptable for persons in the future to benefit from treatments that use iPS cells validated using human embryonic stem (ES) cell lines [End Page 202] derived in the past. The assumption I make is that iPS cells would have to be shown to be functionally equivalent to human ES cells—i.e., validated—before they could be used for cell replacement treatments. (If it turns out that this assumption is incorrect, and primate or even mouse ES cells can be used for the validation, then all residual ethical problems will disappear and there will be no ethical problems whatsoever associated with iPS cells.) I wrote:... [I]n both cases, the origin of the treatment is in a one-time event: either the one-time use of aborted fetuses to obtain cell lines (e.g., MRC-5 and WI- 38) to grow weakened virus strains for vaccine production, or the one-time destruction of human embryos to validate iPS cells, which then effectively replace embryonic stem cells. In this case, embryo destruction could be considered a past event, just as the abortion of a human fetus from which vaccine-producing cell lines were derived is a past, albeit tragic, event.In the process of building his argument that proponents of iPS cell research are morally complicit in embryo destruction, Brown (2009, p. 15) casts me as being in favor of the “derivation of new embryonic stem [cell lines].” This is the exact opposite of my position. In fact, I am opposed to further destruction of human embryos. I believe that the hundreds of ES cell lines already in existence are more than sufficient to validate iPS cells and so no additional lines need to be derived. This means that no additional human embryos will need to be destroyed.Apparently based on the misperception that I support future destruction of human embryos, Brown concludes that “Byrnes’s endorsement of ongoing iPSC validation studies would seem to implicate him and those who follow his lead in formal and material complicity in what they perceive as moral evil” (p. 16). Stability definitions for describing human behavior under conflict when coalitions may form are generalized within the Graph Model for Conflict Resolution and algebraic formulations of these definitions are provided to allow computer implementation. The more general definitions of coalitional stabilities relax the assumption of transitive graphs capturing movements under the control of decision makers, either independently or cooperatively, and allow the convenient expansion to the case of coalitions of the four basic individual stabilities consisting of Nash stability, general metarationality, symmetric (...) metarationality, and sequential stability. To permit the various coalitional stabilities to be efficiently calculated and conveniently encoded within a decision support system, algebraic expressions for the coalitional stabilities are provided in this research. Furthermore, a range of the theorems establish the mathematical credibility of employing the innovative algebraic approach to conflict resolution when coalitions are present. Finally, a conflict over the proposed exportation of bulk water from Lake Gisborne within the Canadian Province of Newfoundland and Labrador is modelled and analyzed to illustrate the practical application of the different coalitional stabilities and the strategic insights they provide. This paper will begin with a brief account of the mandate and description of the Law Reform Commission of Canada and its Protection of Life Project, secondly, point to a limitation imposed upon it by the nature of health law in Canada and, thirdly propose some basic questions which such commissions have both the luxury and the duty to wrestle with and resolve. Managing ethical behavior is a one of the most pervasive and complex problems facing business organizations today. Employees' decisions to behave ethically or unethically are influenced by a myriad of individual and situational factors. Background, personality, decision history, managerial philosophy, and reinforcement are but a few of the factors which have been identified by researchers as determinants of employees' behavior when faced with ethical dilemmas. The literature related to ethical behavior is reviewed in this article, and a model for understanding (...) ethical behavior in business organizations is proposed. It is concluded that managing ethics in business organizations requires that managers engage in a concentrated effort which involves espousing ethics, behaving ethically, developing screening mechanisms, providing ethical training, creating ethics units and reinforcing ethical behavior. Buxrr HAS ADDUCED,Isaac Barrow (1630-1677) in his philosophy of space, time, and mathematical method strongly influenced the thinking of Newton: The recent publication of an early paper written by Newton (his De gravitatione et aequipondio fluidorum)2 affords evidence not known to Burtt of Newton's indebtedness in philosophy to Barrow, his teacher. Prior to its publication in 1962, this paper was (...) utilized by Alexandre Koyrd in his essay, "Newton and Descartes," 3 a study based on the third Horblit Lecture in the History of Science which he gave at Harvard University, March 8, 1961. Koyr8 maintains that there is a radical opposition in Newton's Principia not only to Descartes' purely scientific theories but also to the Cartesian philosophy. Yet, as he remarks, "we do not find in the Principia an open criticism of the philosophy of Descartes.... " He attributes this fact principally "to the very structure of the Principia: it is essentially a book on rational mechanics, which provides principles for physics and astronomy. In such a book there is a normal place for the discussion of Cartesian optics, but not of the conception of the relations of mind and body, and other such things." Koyrd asserts, nonetheless, that the criticism is not absent. It lurks in Newton's carefully worded definitions of fundamental concepts--those of space, time, motion, and matter--and becomes more apparent in the Optice of 1706 and in the second odition of the Principia. In support of this argument, he makes much of young Newton's unfini.~hed paper. Although American scholars sometimes consider European legal scholarship as old-fashioned and inward-looking and Europeans often perceive American legal scholarship as amateur social science, both traditions share a joint challenge. If legal scholarship becomes too much separated from practice, legal scholars will ultimately make themselves superfluous. If legal scholars, on the other hand, cannot explain to other disciplines what is academic about their research, which methodologies are typical, and what separates proper research from mediocre or poor research, they will probably end (...) up in a similar situation. Therefore we need a debate on what unites legal academics on both sides of the Atlantic. Smith's basic behavioral concepts of sympathy and self-interest are significant contributions to economic thought as are his philosophy of human nature being based on liberty and freedom and not simply the creation of wealth. The vectors of influence that converged on Adam Smith were of varied and even contradictory natures. For a serious book of philosophy, where better to begin to canvass various philosophical concepts and arguments than in relation to what is so familiar to every one of us –– the fact that we all have many and varied beliefs. The book is an introduction of philosophy, indeed intended as an introductory textbook. The author, as he wrote it, had both the teacher and the student in mind. He hopes it will prove a worthy contribution in the college, seminary (...) and university classroom, both interesting and serious. As well as thirteen clearly written chapters introducing the various topics, it is also provided with helpful summaries, tutorials, and work sheets. In considering belief we raise raises many of the central problems philosophers have discussed: knowledge, truth, justification, rationality, meaning, explanation, self deception, interpretation, reality, cause and effect, personal identity, theories, laws, hypotheses, the self, survival, God. Since belief is a universal phenomenon, it has unfortunately become common to understand the unqualified term ‘believer’ of the religious person. It seems strange to ask the question, ‘Are you a believer?’ outside the religious context. But we do when we are thinking of a particular theory or ideology or political attitude. We sometimes want to know whether she is ‘one of us!’ The author sometimes finds it convenient to illustrate his exposition by referring to religious beliefs. One does not have to be a religious believer to see that it is relevant and indeed interesting to do so. The history of philosophy provides many classical examples of such discussion. The book is of wide general interest. As well as doing service in the classroom, it will also prove its worth within other contexts. It will serve the aims of serious discussion groups, as well as providing a basis for regular and earnest individual study. It is proposed that a human conscious experience of the sort we report to each other reflects a direct causal interaction between a pattern of information about the world, encoded in a field of postsynaptic potentials, and a quantized mode of excitation occupying dendritic cytoskeleton. The requirement for a quantized account is seen simply as the need for an event of experience to be a single indivisible, but richly patterned, causal relation between information and an 'informee'. It is argued that (...) the informee is likely to be a higher-order quantized collective mode (much as proposed by Craddock and colleagues, 2017) with the biologically relevant dynamics likely also to be describable in classical terms. No specific interpretation of quantum theory is needed. In this scenario, anaesthetics would abrogate reportable experience by detuning parameters underpinning cytoskeletal informee modes, perhaps critically increasing associated impedence. It is also proposed that tuning and detuning of informee modes in individual dendritic trees by binding of accessory proteins to cytoskeleton plays a physiological role in short-term memory and truth evaluation through ascertainment of sequential signal pattern consonance. Components of this model may be involved in cellular adaptive responses in many types of organism. (shrink)

This paper introduces a new typology and associated measure of social and environmental mission integration by conceptually framing a feature of hybrid organizations—the degree of integration of their revenue model and social–environmental mission. The SEMI measure is illustrated using a hand-collected sample of 256 North American Certified B Corporations. We explore the heterogeneity of SEMI scores by identifying external-facing correlates and demonstrate non-congruence with Certified B Corporation’s audit results. Principal concerns: "to consider the philosophical truth of Vico's ideas themselves, rather than to examine their historical character" (p. 19); to consider "the importance of Vico's conception (...) of barbarism for understanding present society" (p. 28). 2. Two-fold approach: "to interpret the central theses of Vico's thought" from the inside in the spirit of the whole and, at the same time, "to develop the problems of Vico's philosophy themselves" (pp. 19--21 ). 3. Predominant contention: "that Vico's ideas constitute a philosophy of recollective universals which generates philosophical understanding fronl the image, not the rational category. This approach regards imagination as a method of pfiilosophical thought" (p. 19) and the imaginative universal as "a key to his conception of knowledge" (p. 67). Vico's philosophy is depicted and characterized by Verene as fi)llows. Beginning with the imagination (fantasia) as an original and independent power of mind, Vico builds his philosophy on the image, the imaginative universal, thereby creating a position outside Western philosophy as traditionally understood. His New Science is a process of recollective fantasia, a kind of memory, and the system built constitutes a system of memory for all of human reality. By means of his concept of memory, Vico works his way back to the world of original thought, the mythicopoeticfantasia of the first men. His discovery of the imaginative universal as their way of thinking and their kind of knowledge establishes a new genetic origin for philosophical thought. Recollective fantasia constitutes the subject-matter and form of Vico's science itself', i.e., the term designates a type of nlemory through which the New Science is acconlplished as well as the type of thought from which it must be understood. "The New Science is a metaphysical fable, h creates a vera narratio of the recollectire imagination. The storia ideale eterna is an ideal trnth, but not an a priori or fictional one. As the master image of the recollective mind, it precisely contains all of the human event.
