Waged in 2016, Philippine President Rodrigo Duterte’s war on drugs has claimed over 20,000 lives according to human rights groups. The Duterte administration’s own count is significantly lower: around 6,000. The huge discrepancy between the government’s official count and that of arguably more impartial organizations about something as concretely material as body count is symptomatic of how disinformation is central to the Duterte administration and how it can sustain the approval of the majority of the Philippine electorate. We suggest that (...) Duterte’s populist politics generates what Boler and Davis call “affective feedback loops,” which create emotional and informational ecosystems that facilitate smooth algorithmic governance. We turn to Patron Saints of Nothing, a recently published novel by Randy Ribay about a Filipino-American who goes back to the Philippines to uncover the truth behind the death of his cousin. Jay’s journey into the “heart of darkness” as a “hyphenated” individual allows him access to locally networked subjectivities but not its affective entanglements. Throughout the novel, he encounters numerous versions of the circumstances of Jun’s demise and the truth remains elusive at the end of the novel. We argue that despite the constant distortion of fact and fiction in the novel, what remains relatively stable or “sticky” throughout the novel are the letters from Jun Reguero that Jay carries with him back to the Philippines. We suggest that these letters can potentially serve as a form of “dissensus” that challenges the constant redistribution of the sensible in the novel. (shrink)

This article analyses the concept of punishment. This concept can be analysed as a normative, retributive concept ; however, a justificatory neutral and formal analysis is also available . Analysing punishment is important, particularly because legislators around the world have shown a tendency to circumvent the criminal law regime simply by claiming that a certain imposition of harm does not constitute punishment. The imposition is said to be a measure or an order and as such there is no need for (...) it to be governed by the principles of the criminal law. This implies that the notions of 'punishment', 'measure', 'order' and so on are more than just labels in our debates on the criminal law. All too often they serve the function of argument. In response, I believe that one of the ways to judge whether a conception of punishment is fruitful is to determine how well it is equipped to expose any conceptual tricks. I argue in this article that the neutral conception is more fruitful in this respect than the normative conception. (shrink)

This paper discusses the role of self-determined commitment in the methodological dynamics of the Environmental Integration Tool Producer and its potential impact on the adoption of pro-environmental behaviors by local economy actors in the Global South. This tool is part of the EIT Approach developed by Louvain Coopération, the NGO associated with Université Catholique de Louvain, which aims to support social actors in productivity and consumption activities in Africa, Andean America, and Asia. The aim is to highlight the conceptual and (...) methodological elements of the OIE Producer, in order to understand the role of self-determined commitment in the expected ends and in the impact of the tool. The integration between economic development and the environment is a central issue in the challenges of contemporary global society. This article intends to contribute with answers to such challenges, especially with regard to the development of methodologies that are effective in governmental and non-governmental cooperation programs engaged for sustainable development. The so-called daxue zhi dao 大學之道, though a Confucian way of self-cultivation, can inspire contemporary universities through a process of creative interpretation. Having examined the ethos of modern university in its four historical stages, I come up with its last stage of reaching out in the era of globalization and dialogue among civilizations, in which we have to rethink the idea of university from the fuller development of human reason. This can be achieved only through increasingly reaching out toward many (...) others by means of mutual waitui 外推 and self-reflection, which presuppose and announce an ethics of generosity in priority over and implementable by reciprocity. Universities today should learn from classical Confucianism, and we should keep in mind their initial generous spirit as exemplified by Confucius himself. Strangification and self-reflection, being moved by original generosity and implemented by reciprocity, will eventually bring us the hope of reason. (shrink)

Positive Polarity indefinites, such as some in English, are licensed in simplex negative sentences as long as they take wide scope over negation. When it surfaces under a clausemate negation, some can in principle take wide scope either by movement or by some semantic mechanism; e.g., it can take pseudoscope if it is interpreted as a choice function variable. Therefore, there is some uncertainty regarding the way in which PPI indefinites get licensed: can pseudoscope suffice? In this article we show, (...) using novel data from Hindi-Urdu and English, that pseudoscope is not sufficient, and that it is the syntactic position of PPI indefinites at LF, rather than their actual scope, which is relevant for licensing. These facts support a unified view of PPI indefinites as generalized quantifiers, and disfavor analyses where they are, or can be, interpreted as choice function variables. (shrink)

Philosophical compatibilism reconciles moral responsibility with determinism, and some neurolaw scholars think that it can also reconcile legal views about responsibility with scientific findings about the neurophysiological basis of human action. Although I too am a compatibilist, this paper argues that philosophical compatibilism cannot be transplanted “as-is” from philosophy into law. Rather, before compatibilism can be re-deployed, it must first be modified to take account of differences between legal and moral responsibility, and between a scientific and a deterministic world view, (...) and to address a range of conceptual, normative, empirical and doctrinal problems that orbit its capacitarian core. We introduce the notion of positive local combinatorial dividing-lines in model theory. We show these are equivalently characterized by indecomposable algebraically trivial Fraïssé classes and by complete prime filter classes. We exhibit the relationship between this and collapse-of-indiscernibles dividing-lines. We examine several test cases, including those arising from various classes of hypergraphs.

In this paper, we show that VC-minimal ordered fields are real closed. We introduce a notion, strictly between convexly orderable and dp-minimal, that we call dp-small, and show that this is enough to characterize many algebraic theories. For example, dp-small ordered groups are abelian divisible and dp-small ordered fields are real closed.

In this paper, we study Vapnik‐Chervonenkis density (VC‐density) over indiscernible sequences (denoted VCind‐density). We answer an open question in [1], showing that VCind‐density is always integer valued. We also show that VCind‐density and dp‐rank coincide in the natural way.

This paper centres on the question as to whether human rights can be reconciled with patriotism. It lays out the more conventional arguments which perceive them as incommensurable concepts. A central aspect of this incommensurability relates to the close historical tie between patriotism and the state. One further dimension of this argument is then articulated, namely, the contention that patriotism is an explicitly political concept. The implicit antagonism between, on the one hand, the state, politics and patriotism, and, on the (...) other hand, human rights, is illustrated via the work of Carl Schmitt. However, in the last few decades there has been a resurgence of interest in patriotism and an attempt to formulate a more moderate form, which tries to reconcile itself with universal ethical themes. Some of these arguments are briefly summarised; the discussion then focuses on Jürgen Habermas’s understanding of constitutional patriotism. This is seen to provide an effective response to Schmitt’s arguments. There are weaknesses in the constitutional patriotic argument which relate to its limited understanding of both the state and politics. This leads me to formulate my own argument for “unpatriotic patriotism.” The discussion then examines and responds to certain potential criticisms of this argument. (shrink)

This book throws new light on their consensus theory of virtue. Hope works some of their ideas into a merit theory of rights applicable to conventional rights, defends ethical cognitivism, and analyzes pleasure.

It is generally assumed that sustainable development and economic growth are compatible objectives. Because this assumption has been left unspecified, the debate on sustainability and growth has remained vague and confusing. Attempts at specification not only involve clarification of the interrelation of the two concepts, but also, we argue, require a philosophical approach in which the concepts of sustainability and economic growth are analyzed in the context of our frame of reference. We suggest that if the notion of sustainability is (...) to be taken seriously, the conflicting conceptual and normative orientations between the two concepts require the reconsideration of our frame of reference. ABSTRACT This article explores relations, ruptures, and rituals in light of repetition. In turn, it considers repetition in light of Freud, Kierkegaard, and Dewey. The author’s engagement with Freud is however partly mediated by attention to how Jonathan Lear, especially in a recent book, Imagining the End: Mourning and Ethical Life (2022), criticizes the Freudian conception of repetition. While Freud valorizes remembrance over repetition, Kierkegaard does just the opposite: he elevates repetition above recollection, at least in the modern age (that (...) is, in his own age as envisioned by Kierkegaard). The insights to be derived from Lear’s critique of Freud’s one-sided understanding of repetition (especially Freud’s failure to appreciate how “repetition” might be healthy) and from Kierkegaard’s treatment of this topic need to be extricated from the context in which they are articulated. Dewey’s formulation of a nuanced, variable, and multifaceted understanding of habit provides us with a framework in which these—and indeed other—insights might be more tightly integrated and sharply focused on some of the salient features of everyday experience. One of these features concerns the repeated forms of activity through which the fleeting moments of our quotidian lives are given meaning shape and worthwhile foci (that is, rituals). (shrink)

A parieto-frontal integration theory (P-FIT) model of human intelligence has been proposed based on a review of neuroimaging literature and lesion studies. The P-FIT model provides an important basis for future research. Future studies involving connectivity analyses and an integrative approach of imaging modalities using the P-FIT model should provide vastly increased understanding of the biological bases of intelligence.

Contemporary scholars in Chinese philosophy, Thaddaeus particularly concerned about Chinese philosophy and methodological issues. Of this paper is designed to make way for the study of Chinese philosophy, the discussion to commemorate him, the first part will describe Thaddaeus study of Chinese philosophy, methods and contribution to the idea, the latter part of the study will be my personal view of Chinese philosophy, methods to further to call upon and complement. Thaddaeus based on the fundamental principles of truth and goodness, (...) the dominant theme proposed research method will be grouped into eight themes of Chinese philosophy, including political, moral, dominate the day, nature and personnel mutual induction, root cause of all things, all things and personnel often said, heaven and earth and man were one, nature, etc., as the dominant theme. In accordance with the above method, after reading the text can be more broad philosophical texts on the historical context, and even on different philosophical traditions to be compared. The most important thing is to play the role of analysis and critique of reason, to make their own original ideas. Among contemporary scholars of Chinese Philosophy, Thaddeus Hang is most famous for his concern with methodological problems in studying Chinese Philosophy. This paper contains two parts: first, an exposition of Thaddeus Hang's own method of studying Chinese Philosophy; second, a deeper reflections on methodology in studying Chinese philosophy. Thaddeus Hang proposes a method of studying Chinese Philosophy by dominant themes. For him there are eight major dominant themes in Chinese philosophy: Politics, Morality, Heaven as Ruler, Mutual affection / response between All things and Human Affairs, the Origin of all things, the Constant Way of all things and Human Affairs, Unity of Heaven, Earth and Man, and, he added later, the Nature. For him, we can take these eight dominant themes as criteria to judge the difference and development of different schools and philosophers in Chinese philosophy. These eight dominant themes should be applied on the following four methodological lines: first, one should trace the origin in the history of philosophy, including the investigation by evidences; second, one should look for the fusion of horizons as emphasized by contemporary hermeneutics and avoid subjective arrogance by emphasizing one's idiosyncrasies on irrelevant matters; third, one should use logical analysis and semantic analysis; fourth, one should do some comparison with Western philosophy. In the second part, I redefine Chinese philosophy and propose several levels of methodological principles in reading and philosophizing on Chinese philosophical texts: First, on the level of general hermeneutic, I propose the principle of intra-textuality; the principle of coherence, the principle of minimum emendation, and the principle of maximal reading. Second, we should pay attention to the hermeneutic characteristics of Chinese philosophy: targeting Idea-Image rather than Pure Ideas, Chinese philosophy prefers to show the movement of meaning by metaphors more than concepts, narrative of inner connected events more than logical argumentation. Third, one should pay attention to the hermeneutic principles or philosophy of language proposed by the author or the school of thoughts under investigation. The historical contextualization and comparative studies should base themselves on the previous work. Most importantly, an original way of philosophizing, based on analytic and critical skills, is invited in any philosophical study, no matter Chinese or Western. (shrink)

Envisaging these problematics, my paper will begin by defining the concept of "civil society", and then proceeds to discuss the ethical theories, utilitarianism, obligation ethics and virtue ethics. We will then try to make clear the relationship between a liberal society and civil virtue. Some important civil virtues, such as tolerance, social justice, freedom, equality and active participation, will then be discussed. We will conclude in a practical reflection by examining the function of today's civil education with Taiwan concerning the formation of civil virtues, with special regard to problems suc1i as teaching materials and credentializing teachers.
