Neonatal extracorporeal membrane oxygenation (ECMO), a technology for the treatment of respiratory failure in newborns, is used as a case study to examine statistical and ethical aspects of clinical trials and to illustrate a proposed 'ethics of evidence', an approach to medical uncertainty within the context of contemporary biomedical ethics. Discussion includes the twofold aim of the ethics of evidence: to clarify the role of uncertainty and scientific evidence in medical decision-making, and to call attention to the need to confront (...) the irreducible nature of uncertainty. Již letmý pohled na filosofii 20. století, která se snaží promýšlet podstatu lidského jednání, budí dojem, že patří k její metodě vrátit se k antickým teoriím a představit je jako historické východisko, jehož nové uchopení povede k lepšímu porozumění aktuálního problému. Tyto návraty, jak je lze sledovat u Heideggera, Gadamera, Ricoeura nebo Arendtové, směřují – nakolik se jedná o teorii jednání – především k Aristotelovi a jeho základnímu rozlišení mezi poiésis a praxis. Cílem následující stati je představit základ teorie jednání, (...) jež byla dílem prvních stoiků ve 3. stol. př. Kr. V naznačeném kontextu si však taková interpretace může činit větší ambice, než jak by se mohlo na první pohled zdát. Zůstává-li totiž Aristotelés pro novodobou filosofii jednání myslitelem, k němuž je třeba se vrátit a s nímž je třeba se vyrovnat, pak je dobré si uvědomit, že právě ve stoicismu lze vidět první a bezprostřední kritickou reakci na Aristotelovu filosofii. Navíc byl stoicismus naukou, v níž se jednání stalo gravitačním bodem všech ostatních úvah a která proto musela svoje vyrovnání s Aristotelem soustředit do pojmů souvisejících úzce právě s jednáním. Lze ovšem snadno vytušit, jaký byl hlavní důvod, proč zůstal stoicismus stranou pozornosti současných filosofů . Přesný vztah stoické nauky k aristotelismu má totiž stále tendenci se skrývat. Navzdory malé četnosti explicitních konfrontací s Aristotelovými argumenty je aristotelismus ve stoicismu přítomen všude – je v něm přítomen natolik, že snaze odlišit oba systémy občas hrozí sklouznutí do povrchních kategorizací, z nichž lze podezírat doxografickou tradici hellénistické a římské doby, která se snaží o uchopení téhož rozdílu. Přesto stoicismus není peripatetická filosofie a lze oprávněně předpokládat, že nahlédnutí odlišnosti mezi obojím vrhne nové světlo na moderní přístup k Aristotelovi. (shrink)

The article deals, on the one hand, with a legal conflict between a musical performer/arranger, Mike Batt, and the estate of a composer of avant-garde music, John Cage, over copyright. It is also concerned with the field of intertextuality – how meaning is created in a text or in a work of art, whether it is visual, musical or verbal, through allusions and quotations to previous texts or works of art. The controversy, which did not reach the courts because of (...) a pre-trial settlement, was over an author’s rights to silence, or, as in this case, a silent piece of music. The central issue discussed is the way in which silence may be considered – if at all, to be protectable. (shrink)

In this paper we set out to explore the enactments of risk by clinicians involved in the development of stem cell therapy for liver disease. In the process, we contribute to a performative re-thinking of how ‘risk’ can be analytically treated in relation to health. The bulk of the paper, drawing on interview data, is concerned with how clinicians’ accounts about the risks entailed in their research-oriented work performatively ‘make’ clinicians themselves, but also various other ‘constituencies’ – notably, publics and (...) regulatory actors, and also such diverse ‘entities’ as scientific rigour and ethics. We trace the ways in which they enact the complexities of taking risks in the context of public demands, regulatory constraints, and resource limitation and explore how clinicians tend to represent themselves as caught between the ‘rock of courage’ and the ‘hard place of caution’. The paper presents a general critique of the use of conceptual frameworks in design, illustrated by the well known synchronous/asynchronous, co-located/non-co-located framework. It argues that while frameworks are a necessary and inevitable starting point for design, the business of tailoring and adapting them to specific situations need not be ad hoc.Triggering artefacts are a way of systematically challenging both designers' preunderstandings and the conservatism of work practice.
