Neonatal extracorporeal membrane oxygenation (ECMO), a technology for the treatment of respiratory failure in newborns, is used as a case study to examine statistical and ethical aspects of clinical trials and to illustrate a proposed 'ethics of evidence', an approach to medical uncertainty within the context of contemporary biomedical ethics. Discussion includes the twofold aim of the ethics of evidence: to clarify the role of uncertainty and scientific evidence in medical decision-making, and to call attention to the need to confront (...) the irreducible nature of uncertainty. Již letmý pohled na filosofii 20. století, která se snaží promýšlet podstatu lidského jednání, budí dojem, že patří k její metodě vrátit se k antickým teoriím a představit je jako historické východisko, jehož nové uchopení povede k lepšímu porozumění aktuálního problému. Tyto návraty, jak je lze sledovat u Heideggera, Gadamera, Ricoeura nebo Arendtové, směřují – nakolik se jedná o teorii jednání – především k Aristotelovi a jeho základnímu rozlišení mezi poiésis a praxis. Cílem následující stati je představit základ teorie jednání, (...) jež byla dílem prvních stoiků ve 3. stol. př. Kr. V naznačeném kontextu si však taková interpretace může činit větší ambice, než jak by se mohlo na první pohled zdát. Zůstává-li totiž Aristotelés pro novodobou filosofii jednání myslitelem, k němuž je třeba se vrátit a s nímž je třeba se vyrovnat, pak je dobré si uvědomit, že právě ve stoicismu lze vidět první a bezprostřední kritickou reakci na Aristotelovu filosofii. Navíc byl stoicismus naukou, v níž se jednání stalo gravitačním bodem všech ostatních úvah a která proto musela svoje vyrovnání s Aristotelem soustředit do pojmů souvisejících úzce právě s jednáním. Lze ovšem snadno vytušit, jaký byl hlavní důvod, proč zůstal stoicismus stranou pozornosti současných filosofů . Přesný vztah stoické nauky k aristotelismu má totiž stále tendenci se skrývat. Navzdory malé četnosti explicitních konfrontací s Aristotelovými argumenty je aristotelismus ve stoicismu přítomen všude – je v něm přítomen natolik, že snaze odlišit oba systémy občas hrozí sklouznutí do povrchních kategorizací, z nichž lze podezírat doxografickou tradici hellénistické a římské doby, která se snaží o uchopení téhož rozdílu. Přesto stoicismus není peripatetická filosofie a lze oprávněně předpokládat, že nahlédnutí odlišnosti mezi obojím vrhne nové světlo na moderní přístup k Aristotelovi. (shrink)

The article deals, on the one hand, with a legal conflict between a musical performer/arranger, Mike Batt, and the estate of a composer of avant-garde music, John Cage, over copyright. It is also concerned with the field of intertextuality – how meaning is created in a text or in a work of art, whether it is visual, musical or verbal, through allusions and quotations to previous texts or works of art. The controversy, which did not reach the courts because of (...) a pre-trial settlement, was over an author’s rights to silence, or, as in this case, a silent piece of music. The central issue discussed is the way in which silence may be considered – if at all, to be protectable. (shrink)

As commonly understood, professional ethics consists of shared duties and episodic dilemmas--the responsibilities incumbent on all members of specific professions joined together with the dilemmas that arise when these responsibilities conflict. Martin challenges this "consensus paradigm" as he rethinks professional ethics to include personal commitments and ideals, of which many are not mandatory. The Concussion in Sport Group guidelines have successfully brought the attention of brain injuries to the global medical and sport research communities, and has significantly impacted brain injury-related practices and rules of international sport. Despite being the global repository of state-of-the-art science, diagnostic tools and guides to clinical practice, the ensuing consensus statements remain the object of ethical and sociocultural criticism. The purpose of this paper is to bring to bear a broad range of multidisciplinary challenges to the processes and (...) products of sport-related concussion movement. We identify lacunae in scientific research and clinical guidance in relation to age, disability, gender and race. We also identify, through multidisciplinary and interdisciplinary analysis, a range of ethical problems resulting from conflicts of interest, processes of attributing expertise in sport-related concussion, unjustifiably narrow methodological control and insufficient athlete engagement in research and policy development. We argue that the sport and exercise medicine community need to augment the existing research and practice foci to understand these problems more holistically and, in turn, provide guidance and recommendations that help sport clinicians better care for brain-injured athletes. The study of engineering ethics tends to emphasize professional codes of ethics and, to lesser degrees, business ethics and technology studies. These are all important vantage points, but they neglect personal moral commitments, as well as personal aesthetic, religious, and other values that are not mandatory for all members of engineering. This paper illustrates how personal moral commitments motivate, guide, and give meaning to the work of engineers, contributing to both self-fulfillment and public goods. We argue that Maclaurin and Dyke's recent critique of non-naturalistic metaphysics suffers from difficulties analogous to those that caused trouble for earlier positivist critiques of metaphysics. Maclaurin and Dyke say that a theory is naturalistic iff it has observable consequences. Depending on the details of this criterion, either no theory counts as naturalistic or every theory does.

The therapy/enhancement distinction is a controversial one in the philosophy of medicine, yet the idea of enhancement is rarely if ever questioned as a proper goal of sports medicine. This opens up latitude to those who may seek to use elite sport as a vehicle of legitimation for their nature-transcending ideology. Given recent claims by transhumanists to develop our human nature and powers with the aid of biotechnology, I sketch out two interpretations of the myth of Prometheus, in Hesiod and (...) Aeschylus, which can help frame the moral limits of sports medicine. By way of conclusion I assemble some banal reminders: We are mortal beings; our vulnerability to disease, injury and the waning of our powers, far from something we can overcome or eliminate, represent natural limits both for morality and medicine generally and sports medicine in particular. This paper has two broad objectives. First, the paper aims to treat roadkill as a topic of serious social scientific inquiry by addressing it as a cultural artifact through which various identities are played out. Thus, the paper shows how the idea of roadkill-as-food mediates contradictions and ironies in American identities concerned with hunting, technology, and relationships to nature. At a second, more abstract, level, the paper deploys the example of roadkill to suggest a par ticular approach to theorizing broader (...) relationships between humans, nonhuman animals, and technology. This paper draws on recent developments in science and technology studies, in particular, the work of Latour and Serres , to derive a number of prepositional metaphors. The paper puts these forward tentatively as useful tools for exploring and unpicking some of the complex connections and heterogeneous relationalities between humans, animals, and the technology from which roadkill emerges. This article considers how the figure of the ``user'' is deployed to imagine the assembling of location-based mobile phone technologies in the context of UK policy. Drawing on the sociology of expectations, we address the performativity of the ``user'' in the think tank Demos' publication Mobilisation. In the process, we analyze how discourses about users enact particular futures that feature arrangements of, for example, persons, mobile phone technologies, and political institutions. We present two narrative strategies operating in Mobilisation: first, the (...) purification of the social and technological in the portrayal of futures and their impediments; second, how existing, emergent, and future users serve as ``narrative joints'', reconnecting the social and technological in the enactment of preferred policy trajectories. In conclusion, we explore Mobilisation as a `catalogue of expectations' in which the representation of a multiplicity of users is itself performative, enacting a particular future policy terrain while bracketing off others. Engagement events—whether interviews, installations, or participatory encounters—can entail a range of happenings which, in one way or another, “overspill” the empirical, analytic, or political framing of those engagement events. This article looks at how we might attend to these overspills—for instance, forms of “misbehavior” on the part of lay participants—not only to provide accounts of them but also to explore ways of deploying them creatively. In particular, Stengers’ figure of the “idiot” is proposed as a device for deploying those overspills (...) to interrogate “what we are busy doing” as social science researchers in engagement events. This interrogation is furthered by considering the proactive idiocy of “Speculative Design’s” version of the public engagement with science which seems directly to engender “overspilling.” Providing examples of speculative design prototypes and practices, the article develops an ideal typical contrast between social scientific and designerly perspectives on public engagement. It is suggested that speculative design can serve as a resource for supplementing “science and technology studies” conceptualizations of, and practices toward, public, engagement, and science. This paper explores the role of citizen journalism in the improvement of slums through the Voice of Kibera (VoK) case study. To meet the research objectives, both qualitative and quantitative methods are applied. The study used content analysis, a survey and interview techniques. It concluded that citizen journalism in the VoK uses a participatory, bottom-up approach, with the residents taking a lead role in the production and consumption of news, and that it plays its part in improving the lives of (...) people in Kibera, contributing to governance and processes of democracy. The core development values of participation and empowerment are central to this study, which examines how these values are being impacted on by information technology interventions in the communications area. The research also concludes that citizen journalism may be sustainable if it is financed, promoted, resourced with professional journalists, equipped with new technologies and citizens continue to participate. Lack of cooperation from the audience, finance both for the running of the project, salary and technical problems were cited as the major challenges of citizen journalism. (shrink)

Yuval Noah Harari contends that human rights are an outdated myth. He calls for replacing them with a new global ethic to meet crises as varied as environmental destruction, disruptive technologies, and extreme gaps between rich and poor. Toward that end, he outlines an ethics that exalts compassion and elides justice, an ethics that animates his trilogy: Sapiens, Homo Deus, and 21 Lessons for the 21st Century. I draw together the key elements in his personal ethics, tracing them to a (...) combination of scientism, postmodernism, and Buddhism. It outlines key elements for a pedagogy of adventurous learning and provides guidelines grounded in accessible theory. In suggesting that “philanthropy is almost the only virtuewhich is sufficiently appreciated by mankind,” Thoreau did not wish to denigrate charity, but he took offense when even minor Christian leaders were ranked above Newton, Shakespeare, and other creative individuals “who by their lives and works are a blessing to mankind.”1 Such individuals might be motivated primarily by caring for nonmoral goods, such as scientific truth, aesthetic appreciation, or creative achievement. Yet, paradoxically, they often benefit humanity far more than they could (...) have through direct humanitarian service. This creativ- ity paradox has been given less attention than paradoxes of self-interest and altruism, but it contains an important insight about moral motivation.
