It is generally held that doctors and researchers have an obligation to obtain informed consent. Over time there has been a move in relation to this obligation from a requirement to disclose information to a requirement to ensure that that information is understood. Whilst this change has been resisted, in this article I argue that both sides on this matter are mistaken. When investigating what information is needed for consent to be informed we might be trying to determine what information (...) a person would need in order to consent at all, or we might be trying to determine what information a person needs in order to make an informed choice about whether or not to consent. I argue that the obligation to ensure understanding only applies to information generated by the first type of enquiry; but that much of the information generally thought necessary in order for consent to be informed is only required if our concern is with the second type of enquiry. For this reason it is neither the case that doctors and researchers should ensure all the information they provide is understood, nor is it the case that their only obligation is to disclose it. Literature on the mental capacities and cognitive mechanisms of the great apes has been silent about whether they can act autonomously. This paper provides a philosophical theory of autonomy supported by psychological studies of the cognitive mechanisms that underlie chimpanzee behavior to argue that chimpanzees can act autonomously even though their psychological mechanisms differ from those of humans. Chimpanzees satisfy the two basic conditions of autonomy: (1) liberty (the absence of controlling influences) and (2) agency (self-initiated intentional action), each of (...) which is specified here in terms of conditions of understanding, intention, and self-control. In this account, chimpanzees make knowledge-based choices reflecting a richly information-based and socially sophisticated understanding of the world. Finally, two major theories of autonomy (Kantian theory and two-level theory) are rejected as too narrow to adequately address these issues, necessitating the modifications made in the present approach. Principles that provide general normative frameworks in bioethics have been criticized since the late 1980s, when several different methods and types of moral philosophy began to be proposed as alternatives or substitutes. Several accounts have emerged in recent years, including: (1) Impartial Rule Theory (supported in this issue by K. Danner Clouser), (2) Casuistry (supported in this issue by Albert Jonsen), and (3) Virtue Ethics (supported in this issue by Edmund D. Pellegrino). John Rawls's influential theory of justice and public reason has often been thought to exclude religion from politics, out of fear of its illiberal and destabilizing potentials. It has therefore been criticized by defenders of religion for marginalizing and alienating the wealth of religious sensibilities, voices, and demands now present in contemporary liberal societies. In this anthology, established scholars of Rawls and the philosophy of religion reexamine and rearticulate the central tenets of Rawls's theory to show they in fact offer (...) sophisticated resources for accommodating and responding to religions in liberal political life. The chapters reassert the subtlety, openness, and flexibility of his sense of liberal "respect" and "consensus," revealing their inclusive implications for religious citizens. They also explore the means he proposes for accommodating nonliberal religions in liberal politics, developing his conception of "public reason" into a novel account of the possibilities for rational engagement between liberal and religious ideas. And they reevaluate Rawls's liberalism from the "transcendent" perspectives of religions themselves, critically considering its normative and political value, as well as its own "religious" character. _Rawls and Religion_ makes a unique and important contribution to contemporary debates over liberalism and its response to the proliferation of religions in contemporary political life. Recent years have witnessed an enormous increase in behavioral and neuroimaging studies of numerical cognition. Particular interest has been devoted toward unraveling properties of the representational medium on which numbers are thought to be represented. We have argued that a correct inference concerning these properties requires distinguishing between different input modalities and different decision/output structures. To back up this claim, we have trained computational models with either symbolic or nonsymbolic input and with different task requirements, and showed that this allowed (...) for an integration of the existing data in a consistent manner. In later studies, predictions from the models were derived and tested with behavioral and neuroimaging methods. Here we present an integrative review of this work. (shrink)

What grounds and justifies conclusions in medical ethics? Is the source external or internal to medicine? Thee influential types of answer have appeared in recent literature: an internal account, an external account, and a mixed internal / external account. The first defends an ethic derived from either the ends of medicine or professional practice standards. The second maintains that precepts in medical ethics rely upon and require justification by external standards such as those of public opinion, law, religious ethics, or (...) philosophical ethics. The third claims that distinct medical ethics have emerged from distinct cultural frameworks, each with norms that govern physicians. There is merit in each perspective, but each overreaches its supporting arguments and fails to appreciate what is legitimate in the theses of its competitors. I propose a fourth account that offers a way to escape limitations of the other three, while retaining their most attractive features. (shrink)

“Applied ethics” has been the major growth area in North American philosophy in the last decade, yet a robust confidence and enthusiasm over its promise is far from universal in academic philosophy. It is considered nonphilosophical in West Germany, and has largely failed to penetrate British departments of philosophy. Whether it has any intellectually or pedagogically redeeming value is still widely debated in North America, where many who have tried to teach some area of applied ethics for the first time (...) have seen their courses grind to a halt in unresolvable quandaries, practical exigencies, or unavailable technical information. Consequently, some departments are at war over whether to hire or confer tenure on those who teach these subjects. Many also remain unconvinced that philosophical generalizations or theories can play any significant role in applied contexts. They may even doubt both that applied ethics is really ethics and that philosophy should accomodate this creature in its curriculum. (shrink)

Robert Baker and Laurence McCullough argue that the "applied ethics model" is deficient and in need of a replacement model. However, they supply no clear meaning to "applied ethics" and miss most of what is important in the literature on methodology that treats this question. The Baker-McCullough account of medical and applied ethics is a straw man that has had no influence in these fields or in philosophical ethics. The authors are also on shaky historical grounds in dealing with two (...) problems: (1) the historical source of the notion of "practical ethics" and (2) the historical source of and the assimilation of the term "autonomy" into applied philosophy and professional ethics. They mistakenly hold (1) that the expression "practical ethics" was first used in a publication by Thomas Percival and (2) that Kant is the primary historical source of the notion of autonomy as that notion is used in contemporary applied ethics. On December 15, 2011, a final report was issued by the Committee on the Use of Chimpanzees in Biomedical and Behavioral Research, which had been convened by the U. S. Institute of Medicine (IOM) in collaboration with National Research Council (NRC) of the National Academies. Within a month of its release, this report was designated by Wired Science one of the “top scientific discoveries of 2011” (Wired Science Staff 2011). Essays raise and discuss moral questions concerning euthanasia, suicide, war, capital punishment, abortion, famine relief, and the environment.

It is relatively uncontroversial that some public health policies are paternalistic. Furthermore, that they are paternalistic is often taken to show that they are morally wrong. In this article I challenge this position. The article starts by arguing that given standard definitions of paternalism it is unclear why such policies count as paternalistic. Whilst it might appear that they impose restrictions on what individuals can, or cannot, do for their own good, this is not the case. The reason for this (...) is that whilst public health policies focus on achieving benefits at a population or group level, the imposition is made at the level of the individual. If we are to retain the idea that such policies are paternalistic we must characterize them in such a way that both the benefit and imposition are at the same level: either that of the individual or that of the group. I argue that in many cases moving to the group level is the only plausible option. However, if we move to the group level, the features that make a policy paternalistic will not, unlike in those cases where paternalism is targeted at an individual, make the policy morally wrong. Contemporary global politics poses urgent challenges – from humanitarian, migratory and environmental problems to economic, religious and military conflicts – that strain not only existing political systems and resources, but also the frameworks and concepts of political thinking. The standard cosmopolitan response is to invoke a sense of global community, governed by such principles as human rights or humanitarianism, free or fair trade, global equality, multiculturalism, or extra-national democracy. Yet, the contours, grounds and implications of such a global community remain (...) notoriously controversial, and it risks abstracting precisely from the particular and conflictual character of the challenges which global politics poses. The contributions to this collection undertake to develop a more fruitful cosmopolitan response to global political challenges, one that roots cosmopolitanism in the particularity and conflict of global politics itself. They argue that this ‘contestatory’ cosmopolitanism must be dialectical, agonistic and democratic: that is, its concepts and principles must be developed immanently and critically out of prevailing normative resources; they must reflect and acknowledge their antagonistic roots; and they must be the result of participatory and self-determining publics. In elaborating this alternative, the contributions also return to neglected cosmopolitan theorists like Hegel, Adorno, Arendt, Camus, Derrida, and Mouffe, and reconsider mainstream figures such as Kant and Habermas. Second, it is suggested that the Report is confused about the concept of paternalism. Third, it is argued that the discussion of the concept of stewardship is lacking in detail and substance. I argue that the theory of happiness now dominant among philosophers embraces a flawed, technicizing model that represents happiness as a set of mental states produced by actions and events. This view contrasts with Aristotle’s conception, according to which happiness is not produced by (but is tantamount to) long-term activity and incorporates (but is not reducible to) a set of mental states. I then go on to criticize the skill model of happiness on three main grounds. First, unlike the Aristotelian (...) model, it necessarily instrumentalizes activity while setting no principled limit to the manipulation of human action and experience. Second, and again contra Aristotle, it privileges an efficient (rather than formal) conception of causation while obscuring the way in which happiness is inextricably grounded in its conditions, which in turn has various deleterious upshots. Third and finally, the skill model yields a highly questionable notion of happiness as measurable. (shrink)

This article examines Nietzsche’s engagements with Kantian idealism and Kantian ethics. From the mid-1860s to the mid-1870s, Nietzsche’s engagement with Kantian idealism combined an interest in its potential therapeutic and cultural benefits with an exploration of its theoretical difficulties. In later works, Nietzsche rejects Kantian idealism not only for the conceptual incoherence, epistemological insignificance, and suspicious psycho-physical and cultural functions of its notion of an inaccessible reality, but also for the unlicensed ontology and primitive psychology of its notions of judgement. Nietzsche also developed his own version of ‘Kantian’ ethics—that is, an ethics which, like Kant’s, affirms agency as the highest and unconditional value, while, unlike Kant’s, admitting different degrees of agency and therefore moral significance, across agents and over time. This research describes and empirically evaluates the application of a business ethics pedagogy informed by neuroscience and evolutionary biology that suggest ethical decisions are made unconsciously and emotionally. Moral Foundation Theory (MFT) provides a framework that considers a range of values individuals rely on for decision-making. This relates to Virtue ethics (VE) that develops intellectual and character virtues, requires emotional development and is thus suitable for guiding business ethics pedagogy. This study focuses on a business ethics course integrating intellectual virtue (...) and character virtue pedagogies, including contemplative and emotional intelligence skills practices. The aim of the course is to develop character, providing future managers the means to enact ethical decision-making through self-awareness of emotions, intrinsic values and translate these into ethical behavior. Pre-Post Emotional Intelligence (EI) and Moral Foundation Questionnaires (MFQ) are used to evaluate the development of students’ character virtues, i.e., increased emotional awareness, emotional regulation and intrinsic values. This paper mainly seeks to understand how to develop ethical behavior, beyond learning didactic definitions of what is ethically right and what is wrong, i.e. focusing on the learning process that can lead to personal ethical judgment and conduct. The related pedagogy integrates transdisciplinary theories and practices, and as such suggests a holistic approach to ethical behavior transformation. The results indicate limited, significant changes in all measures except emotional awareness. This developing field requires more research to identify the contributions of MFT and related pedagogy to students’ ethical development. (shrink)
