Canadian ethicists Jocelyn Downie and Udo Schuklenk seek to assess the effect of Canada’s decriminalisation of ‘medical assistance in dying’ ‘to inform Canada’s ongoing discussions and because other countries will confront the same questions if they contemplate changing their assisted dying law.’1 Their assessment focuses on two arguments earlier levied against expansion of these procedures. The first is that of a ‘slippery slope’ and the second is what they disingenuously call, ‘social determinants of health’. Recently, interest has surged in similarity-based epistemologies of possibility. However, it has been pointed out that the notion of ‘relevant similarity’ is not properly developed in this literature. In this paper, I look at the research done in the field of analogical reasoning, where we find that one of the most promising ways of capturing relevance in similarity reasoning is by relying on the predictive analogy similarity relation. This takes relevant similarity to be based on shared properties that have structural (...) relations to the property of interest. I argue that if we base our epistemology of possibility on similarity reasoning on the predictive analogy similarity relation, we require prior knowledge of the specifics of these structural relations. I discuss a number of possible responses to this on behalf of the similarity theorists given their methodological approach to the epistemology of modality more generally. They could either opt for making explicit the metaphysics underlying these structural relations, in which case they need to spell out how we can come to know these relations. Or they could opt for developing a theory that explains why we do not need to have explicit knowledge of these structural relations; for example by suggesting that we make use of epistemic shortcuts. To develop a theoretical framework for drawing moral distinctions between instances of sexual misconduct, I defend the “Ameliorative View” of consent, according to which there are three possibilities for what effect, if any, consent has: “fully valid consent” eliminates a wronging, “fully invalid consent” has no normative effect, and “partially valid consent” has an ameliorative effect on a wronging in the respect that it makes the wronging less grave. I motivate the view by proposing a solution to the problem of (...) characterizing the moral effect of consent that is given in response to minor coercion. (shrink)

Medical practice has always involved at least three roles, three complimentary identities. Practitioners have been at once clinicians dedicated to a patient’s care, members of a professional organization promoting medicine, and informed citizens engaged in public debates on health issues. Beginning in the 1970s, a series of social and technological changes affected, and in many cases restricted, the practitioner’s ability to function equally in these three identities. While others have discussed the changing realities of medical practice in recent decades, none (...) have commented on their effect on their effect on rights of practitioners as citizens. Here several cases begin an analysis of the manner in which those changes have limited the physician’s right to act conscientiously and speak publicly in the face of organizational agendas and political priorities. In sensory neuroscience, the neural and perceptual levels of investigation are commonly related through a reductive research strategy based in psycho-neural isomorphisms. Davida Teller’s “linking propositions” are a particularly vivid illustration of this epistemology in the context of vision science. For Teller, linking propositions guide the core epistemological practices of vision science by expressing the criteria for acceptable explanations of perceptual phenomena by neural processes and by articulating heuristics for discovering neural properties on grounds of perceptual ones, and vice versa. Furthermore, linking propositions create a uniform discourse in which ontological identity statements can be formulated on the basis of structural terms applicable to both the neurophysiological and perceptual domains.I argue that the epistemic practices of current color vision science are better understood through Machamer-style mechanisms than isomorphism-based linking propositions. For Machamer, activity types of mechanisms are central for both explanation and the discovery of entities and their properties. The activity type of color cancellation is fundamental to the opponent process paradigm of color vision precisely in this manner. The descriptive inadequacy of linking propositions for clarifying vision scientific research is particularly damaging because activity types have a unifying role for the structural facts of color perception. As a form of local reductionism, Teller’s proffered epistemology aims to create a uniform domain for neuroscience and perceptual psychology but on the basis of a non-unified, disparate set of structural identity statements. By bringing attention to the unifying role of activity types, Machamer mechanisms allow also for critical epistemological explorations of ontological reductions on grounds of the fit between activity types of higher-level and lower-level sciences. Background Research on the impact of ethics reflection groups (ERG) (also called moral case deliberations (MCD)) is complex and scarce. Within a larger study, two years of ERG sessions have been used as an intervention to stimulate ethical reflection about the use of coercive measures. We studied changes in: employees’ attitudes regarding the use of coercion, team competence, user involvement, team cooperation and the handling of disagreement in teams. Methods We used panel data in a longitudinal design study to measure (...) variation in survey scores from multidisciplinary employees from seven departments within three Norwegian mental health care institutions at three time points (T0–T1–T2). Mixed models were used to account for dependence of data in persons who participated more than once. Results In total, 1068 surveys (from 817 employees who did and did not participate in ERG) were included in the analyses. Of these, 7.6% (N = 62) responded at three points in time, 15.5% (N = 127) at two points, and 76.8% (N = 628) once. On average, over time, respondents who participated in ERG viewed coercion more strongly as offending (p < 0.05). Those who presented a case in the ERG sessions showed lower scores on User Involvement (p < 0.001), Team Cooperation (p < 0.01) and Constructive Disagreement (p < 0.01). We observed significant differences in outcomes between individuals from different departments, as well as between different professions. Initial significant changes due to frequency of participation in ERG and case presentation in ERG did not remain statistically significant after adjustment for Departments and Professions. Differences were generally small in absolute terms, possibly due to the low amount of longitudinal data. Conclusions This study measured specific intervention-related outcome parameters for describing the impact of clinical ethics support (CES). Structural implementation of ERGs or MCDs seems to contribute to employees reporting a more critical attitude towards coercion. Ethics support is a complex intervention and studying changes over time is complex in itself. Several recommendations for strengthening the outcomes of future CES evaluation studies are discussed. CES evaluation studies are important, since—despite the intrinsic value of participating in ERG or MCD—CES inherently aims, and should aim, at improving clinical practices. (shrink)

Are democratic ideals better served by elections or sortition? Is the ideal national legislature one that is elected, chosen by lot, or some combination thereof? To answer these questions properly, it is necessary to perform a careful, balanced, and systematic comparison of the strengths and weaknesses of each. To do so, this article uses foundational democratic values—political equality, popular control, deliberative nature, and competency—as measuring sticks. On the basis of these values a purely elected legislature is compared with a purely (...) sortition one, on the assumption that each has the full decision-making powers normally possessed by national legislatures. This big picture will provide a clearer view of the strengths and weaknesses of the respective systems and their trade-offs, as well as the open questions that remain. (shrink)

Pretense imagination is imagination understood as the ability to recreate rational belief revision. This kind of imagination is used in pretend-play, risk-assessment, etc. Some even claim that this kind of hypothetical belief revision can be grounds to justify new beliefs in conditionals, in particular conditionals that play a foundational role in the epistemology of modality. In this paper, I will argue that it cannot. I will first provide a very general theory of pretense imagination, which I formalise using tools from (...) dynamic epistemic logic. As a result, we can clearly see that pretense imagination episodes are build up out of two kinds of imaginative stages, so I will present an argument by cases. This argument shows that pretense imagination might indeed provide us with justification for believing certain conditionals. Despite this, I will argue that these arenotthe kind of conditionals that allow pretense imagination to play a foundational role in the epistemology of modality. (shrink)

Of the Presocratic thinkers traditionally credited with the foundation of Greek philosophy, Xenophanes, Parmenides and Empedocles are exceptional for writing in verse. This is the first book-length, literary-critical study of their work. It locates the surviving fragments in their performative and wider cultural contexts, applying intertextual and intratextual analyses in order to reconstruct the significance and impact they conveyed for ancient audiences and readers. Building on insights from literary theory and the philosophy of literature, the book sheds new light on (...) these authors' philosophical projects and enriches our appreciation of their works as literary artefacts. Mclntyre's original paper "Is Hume's Self Consistent?" was presented at the MoGiIl Hume Conference; it will be published in the forthcoming volume devoted to those preceedings. Tom Beauchamp" s paper is presented here as delivered. John Biro's paper has been revised since its original presentation. 37. SELF INCONSISTENCY OR MERE SELF PERPLEXITY? Professor Mclntyre's imaginative and constructive paper has three primary (...) parts (despite its division into six sections). First, she offers an interpretation of Hume's view of the self in Book I of the Treatise. Second, she explains why his own reservations in the Appendix create problems not only for this theory of self identity but for other parts of his philosophy as well. Finally, she tries to ease him out of these difficulties with her overlap interpretation of the bundle theory. My comments follow exactly this outline, though my conclusions, for the most part, do not coincide with hers. My reservations do not derive from her attempt to render Hume consistent. Rather, I question the foundations of the entire enterprise in which she, Robison, Nathanson, et. al. are engaged. That is, I remain unconvinced that the alleged problem, as presently framed, is more than a pseudo-problem. I. Hume's Theory in Book I In Book I Hume offers a variety of arguments about the nature of the self, most of which rely on other theories, such as those of causation, the association of ideas, and substance. Whatever the exact arguments and positions he may be advancing, at least the following six propositions are integral to his theory of personal identity: 1)The self is entirely reducible to a collection of perceptions. 2)The self is not characterized by strict identity. 3)There is nothing simple in which the collection of perceptions inheres. 4)Both identity and simplicity are attributed to the self because of relations between perceptions--the relations of causation and resemblance. 5)The relations of resemblance and causation unite these perceptions. 38. 6) There are no real (non-associational) connections or relations among these perceptions which unite them. Half of these six claims are critical denials of other philosophical claims; the other half are constructive philosophical theories. Hume's entire philosophical program in Book I is tied up with these claims. The criticisms are directed at numerous metaphysical theories of mind, substance and causation; and the constructive account of personai identity requires his theories of perception and association of ideas. I mention these obvious points only because it is so important to note that if_ the interpretation is correct which Professor Mclntyre and others give to (roughly) five sentences in the Appendix, where Hume mentions a possible inconsistency, then Hume is not only questioning his theory of personal identity in Book I, he is calling Book I itself into question. To be convinced that this strikingly implausible turnabout occurs in five sentences of the Appendix, we must be given a most compelling argument—one which I doubt is forthcoming. II. Hume's Alleged Inconsistency The alleged problem of inconsistency arises because Hume says in the Appendix that he does not know how to render his own former opinions consistent (T633, 636). However, when he comes to a formal statement of the inconsistency, as everyone is agreed, the propositions said to be inconsistent are not inconsistent. In the attempt to grasp Hume's meaning, a general consensus has emerged in recent Hume scholarship, including Professor Mclntyre in its company, that we ought both to move backward and forward a sentence or two in Hume's text. Hume says in those passages that his hopes for his theory are diminished because he is unable to explain the principles, that unite our successive perceptions in our thought or consciousness (T636) ; and he then indicates that i_f perceptions could be shown to inhere in something simple or to be really connected, these prob- 39. lems would vanish. It is this textual setting which Robison, Nathanson, and Professor Mclntyre turn into the claim that "the concept of a self which is affected by experience, and therefore must persist through experience— is precisely the concept of the self that... This essay conceives ecological life as radically dependent, vulnerable, and horrific. Epistemologically speaking, we are quite ignorant of the web of dependency that sustains our lives. Our ecological condition often prevents us from locating and identifying our dependencies and the many ways our actions impact the environment. This is the terror and danger that plagues the Anthropocene. Our ignorance bears an ontological weight that can be drawn out with the concept of trust. Trust, I argue, is not a choice. Trust (...) is a necessity to which we are riveted, and one that is always conditioned by our vulnerability and ignorance. The picture of ecological trust that I paint is not a hopeful one: it is dark, pessimistic, and urgent. It opposes visions of our future that are superstitious and optimistic about our ability to respond effectively to climate change. (shrink)

This editor's preface introduces a special issue of Critical Horizons on the theme of “contestatory cosmopolitanism.” After identifying the broad failings of the standard cosmopolitan appeal to global community, it presents the defining features of the “contestatory” alternative and introduces the papers in light of them.

The World Bank is no stranger to criticism of its projects, especially in respect of its privatization and private sector development projects. Critics point to the environmental, social and cultural damage that certain projects have caused, which for some appears not just to be a product of the individual projects themselves, but symptomatic of a broader policy failure within the Bank to engage with the social consequences of its actions. In fact, and somewhat surprisingly, both the Bank's critics and its (...) defenders seldom employ human rights language in their reasoning and rhetoric, and where they do, it is only fleetingly and often lacking in any real substance. This is surprising because of so much of what the Bank does can be, and is, supportive of the objects of international human rights standards, especially in respect of economic, social and cultural rights. It is a central theme of this Discussion Paper that for the Bank to embrace this fact alone would be a very significant step towards it being better able not only to respond to its critics, but also, crucially, to deliver upon its own objectives as most recently expressed in the Millennium Development Goals. This Discussion Paper was commissioned by the World Bank. The brief was to provide an account of the major criticisms directed at the World Bank's private sector-oriented projects, and to determine what, if any, consequences for the protection of human rights are revealed by those criticisms. The approach adopted in this paper is first to identify key criticisms through empirical research and then to subject them to human rights analysis. This provides the basis for a clear account of the legal and programmatic implications for the Bank, today and in the future, of those human rights obligations and duties raised, directly or indirectly, by the critics of the Bank. Jackson’s formulation of the knowledge argument has had an inestimable influence on the discussion of consciousness and the apparent problem it presents for physicalism. A common objection to KA is the ‘ignorance objection’. According to this objection, our intuitions about Mary merely reflect our ignorance of physical facts that are integral to the explanation of phenomenal consciousness. Armed with the insights of a future science, Mary would actually be able to deduce what it’s like to see red. We only have (...) the intuition that Mary would learn something new because we don’t know what she knows. Those sympathetic to KA have brushed away the ignorance objection on the grounds that evstructuren though we don’t know what the future science of consciousness will reveal, we do know what kind of facts it will contain and know that these are the wrong kind of facts from which to deduce facts about phenomenal consciousness. In other words, they suggest that the insight that underwrites KA is ‘future-proof’: it is not the kind of insight that could be displaced by new scientific knowledge. I argue that this strategy for defending KA is dialectically problematic and reveals a fundamental limitation of the Mary thought experiment. (shrink)

This article provides a broad overview of the problem of irony to contemporary hermeneutics. It offers a thematic account of the effects of irony on interpretation, and argues that the problems of irony are embedded within the relation between the free play of irony and the regulative role of interpretative discourse. It argues, against hermeneutic theories such as that of Hans‐Georg Gadamer, that the “problems” which irony poses for interpretation can be seen as symptomatic of irony's identification: that irony is, (...) essentially, problematic. It argues that any account of irony needs to account for the value of irony as a problem, rather than subsuming such problems into larger models of understanding. The article explores this notion by looking at the interpretative “discourse of irony” and noting its thematic features. It is argued that the account of irony as a negation of meaning is intrinsically tied to the construction of a sovereign economy in response to the excesses of ironic possibility, but that such a construction is determined only by the stepping‐away from the initial ironic possibilities which enabled its construction. Using the work of Gadamer as an example, the article argues that this in itself does not close irony, but produces yet more irony which frustrates the interpretative act while lending itself to interpretative possibility. The main purpose of this study is to investigate the effect of after sales service, brand equity, environmental awareness, and product pricing towards consumer purchase intention of green home appliance. Data were collected from 150 Penang, Malaysia citizen who were age from 18 to 60 via convenient sampling method analysed using partial least square structure equation modelling. Results indicated that BE, EA, and PP has significant effect on CPI of green home appliance brand. However, ASS do not have significant effect (...) on CPI on green home appliance brand. This research helps home appliance manufacturer to better design marketing promotions, considering the consumers focus on BE, EA, and pricing. In addition, this study provides consumer insight for the government agency to construct better policy in order to increase the green home appliance penetration rate among citizens. (shrink)

In conjunction with its 1992 companion-piece, Imagining the Pacific, and supported by collations of art and cartography from Cook’s and other voyages, this work also established his reputation as a major presence in Pacific-centred research. Likewise, the ongoing influence of European Vision and the South Pacific has seen Smith claimed as a foundational figure in (...) post-colonial scholarship, as one who ‘anticipated’ aspects of Edward Said’s late-1970s analysis of orientalism. But while there are important parallels and overlaps in the thinking of this pair, their differences and divergences are at least as significant. Above all, Smith’s Pacific-centred writings need to be understood as the unique intellectual achievements they undeniably are. (shrink)

In this article I critically discuss Michael Steven Green's Nietzsche and the Transcendental Tradition and R. Kevin Hill's Nietzsche's Critiques: The Kantian Foundations of his Thought. Firstly, I raise textual doubts about Hill's interpretation of the early Nietsche as a Kantian critic of Schopenhaur. Secondly, I argue that Hill fails to establish that Nietzsche's later theoretical philosophy developed through a direct engagement with Kant's. Thirdly, I raise broader criticisms of Hill's 'Kantian' approach, and argue that Green's alternative account identifies an (...) underappreciated Kantian theme in Nietzsche's theoretical philosophy, although Green misrepresents Nietzsche's ultimate conclusions. Finally, I argue that while Hill rehearses prevailing misinterpretations of Kant's and Nietzsche's moral philosophies, Green's accoung also illuminates Nietzsche's developing criticism of Kantian notions of moral agency.In diesem Artikel werden die Bücher Michael Steven Greens Nietzsche and the Transcendental Tradition un R. Kevin Hill's Nietzsche's Critiques: The Kantian Foundations of his Thought kritisch diskutiert. Erstens bezwifle ich aus textualen Gründen, dass Hills Interpretation richtig ist, der frühe Nietzsche habe mit Kant Schopenhaur kritisiert. Zweitens, so mein Argumentation gelingt es Hill nicht nachzuweisen, dass Nietzsches spätere theoretische Philosophie direkt aus seiner Auseinandersetzung mit Kant hervorgeht. Drittens kritisiere ich den Kantischen Ansatz Hills umfassender und ziehe die alternative Deutung Greens heran, die ein wenig beachteres Kantisches Thema in Nietzsches theoretischer Philosophie ausmacht, wenngleich Green Nietzsches letze Schlussforlgerungen falsch interpretiert. Schließlich zeige ich, dass hill die vorherrschenden Missdeutungen der Moralphilosophie von Kant und Nietzsche wiederholt, während Green Nietzsches wachsende Kritik an den Kantischen Vorstellungen vom moralisch handelnden Subjekt beleuchtet.
