To what extent can humorism be a legitimate disposition toward the Absurd? The Absurd is born from the insurmountable contradiction between one’s ceaseless striving and the absence of an ultimate resolution – or, as I prefer to call it, the ‘dissolution of resolution’. Humoristic Absurdism is the commitment to a pattern of humorous responses to the Absurd, which regard this absurd condition, as well as its manifestation in absurd situations, as a comical phenomenon. Although the humoristic disposition seems promising, by (...) virtue of humor’s recognition of incongruity and its denial of an ultimate resolution, and succeeds in countering three major objections, it falls prey to the claim that comprehensive humorism portrays as frivolous what is earnest, thereby renouncing the gravity of the desire for ultimate resolution, which is fundamental to the notion of the Absurd. In an attempt to explore alternative roles for humor in a legitimate disposition toward the Absurd, Metamodern Absurdism is suggested, which revolves around a post-ironic oscillation between humor and earnestness. In short, only in a role limited to one pole of an oscillatory pattern of responses can humor be integrated in a legitimate disposition toward the Absurd. (shrink)

Anthony Ellis attempts to offer a deterrence theory of punishment that overcomes a number of common criticisms of deterrence theories in general. While his discussion does suggest many interesting responses that proponents of deterrence theories might use, the theory he defends is problematic for several reasons.

Taking organs from dead people seems, prima facie, to raise fewer ethical complications than taking organs from other sources. There are, however, serious ethical problems in taking organs from the dead unless there is premortem evidence that this is what the deceased would have wanted, or at least, not have objected to. In this paper we will look at a “strong” opting out policy as proposed by John Harris. We will argue that people can be harmed after their death and (...) that the posthumous removal of organs against their expressed wishes is one form that such harm might take. We also argue that Harris’s claim that we show “equality of concern” between the donor and recipient requires too much. (shrink)

Common sense assures me I am free and responsible for my actions, but on the other hand it is admitted that my way of acting is determined by temperament, heredity and environmental conditioning. Is man an autonomous centre of consciousness expressing himself in feeling-revealing behaviour, or is ‘man’ a short-hand expression for a bundle of heterogeneous phenomena? Ryle believes that the conceptual geography of ‘I’, ‘you’ and ‘he’ is not yet satisfactorily established. But in his view such mental perplexities are (...) growing pains that merely indicate one is in a healthy state. We are familiar with the concrete, but unsure about the abstract, and it is very rare that we are fully aware of all the logical powers of the expressions that we use. (shrink)

The criminal defendant is presumed innocent and his guilt must be proved beyond reasonable doubt for conviction. On some issues, however, the defendant must prove his innocence on the balance of probabilities to avoid conviction. Commentators have despaired of reconciling reverse burdens with the presumption in a principled way. Andrew Stumer has made a fresh attempt; however, his solution is overly rigid and rule bound. The presumption is engaged in a dynamic enterprise—minimizing the expected cost of error, mistaken acquittals as (...) well as wrongful convictions. Stumer’s fixed criminal standard and stringent restrictions on reverse burdens work against this goal. A more flexible approach is required, reflecting the calculus of error management. Where the cost or probability of wrongful conviction is relatively low, and the cost or probability of mistaken acquittal relatively high, it may be necessary to lower the standard of proof, or even to reverse the burden of proof. To inhibit these strategies is to increase the expected cost of error at trial. (shrink)

Aristotle's logical and metaphysical works contain elements of three distinct types of formal theory: an ontology, a theory of consequences, and a theory of reasoning. His formal ontology (unlike that of certain later thinkers) does not require all propositions of a given logical form to be true. His formal syllogistic (unlike medieval theories of consequences) was guided primarily by a conception of logic as a theory of reasoning; and his fragmentary theory of consequences exists merely as an adjunct to the (...) syllogistic. When theories of consequences took centre stage in the Middle Ages, the original motivation for the theory of the syllogism was forgotten. (shrink)

This dissertation focuses on an exploration of the use of parables in the works of Soren Kierkegaard. While some work has been done on Kierkegaard’s poetic style, very little attention has been paid to his metaphors, despite their prevalent use in his works. Much of the scholarship instead treats his parables as mere examples of philosophical concepts. In this work, I argue that Kierkegaard’s parables function primarily to cause the reader to see him or herself truly. The parables work like (...) mirrors, reflecting our true selves back onto ourself. In this way, the parables prompt Kierkegaard’s readers to overcome the illusion of Christendom and to instead recognize the requirements that authentic Christianity places upon them. My dissertation begins with an examination of the purpose that Kierkegaard saw for his authorship. By focusing on his later works, I argue that Kierkegaard primarily wanted to bring the religious forward in his readers. He thought that in order to accomplish this he needed to start with works describing the life that he thought most of his readers lived, a life of pleasure seeking, and to slowly move them towards the religious. I then present Kierkegaard’s view of what Christianity essentially consists of, subjectivity, and of the style of communication that is tied to subjectivity. Kierkegaard claims that when communicating subjective truths that we must employ an indirect style. I go on to argue that parables very much fit into this style and that they work to cause tension on the part of the reader. The reader of the parable must choose between various competing interpretations that the parable presents, and in choosing how to interpret the parable, the reader reveals and discloses him or herself. I follow this up with an examination of a number of parables from different works of Kierkegaard, showing how they function in this manner. I end by arguing that Kierkegaard’s parables are designed to function like mirrors, revealing ourselves to us. (shrink)

The punishment of criminals is a topic of long-standing philosophical interest since the ancient Greeks. This interest has focused on several considerations, including the justification of punishment, who should be permitted to punish, and how we might best set punishments for crimes. This entry focuses on the most important contributions in this field. The focus will be on specific theoretical approaches to punishment including both traditional theories of punishment (retributivism, deterrence, rehabilitation) and more contemporary alternatives (expressivism, restorative justice, hybrid theories, (...) unified theories) with an additional section on capital punishment, perhaps the particular form of punishment that has received the most sustained philosophical attention. These theories of punishment address two important questions: first, who should be permitted to punish and, secondly, who should be permitted to be punished. This chapter explores the ethics of Robert Daly's actions in the episode “USS Callister”. We consider issues of privacy that relate to him stealing his co‐workers DNA in order to scan them into the game, as well as the ethics of how he treats the digital avatars of his co‐workers within the game. Examining Daly's actions from a few different approaches, we argue that Daly's actions towards his co‐workers avatars are very likely immoral, though ultimately we cannot know without knowing (...) Daly's thoughts. Finally, we end the chapter with some considerations relating to video games in general and the ways in which we must act when we play video games. (shrink)

Throughout his works, especially his pseudonymous ones, he often breaks from philosophical prose and instead uses extended metaphors, fairy tales, parables, and allegories. Human expression is open-ended, versatile, and diverse, ranging from ordinary language use to painting, from exaggerated displays of affection to micro-movements that aid coordination. Here we present and defend the claim that this expressive diversity is united by an interrelated suite of cognitive capacities, the evolved functions of which are the expression and recognition of informative intentions. We describe how evolutionary dynamics normally leash communication to narrow domains of statistical mutual benefit, and how expression is unleashed in humans. The relevant (...) cognitive capacities are cognitive adaptations to living in a partner choice social ecology; and they are, correspondingly, part of the ordinarily developing human cognitive phenotype, emerging early and reliably in ontogeny. In other words, we identify distinctive features of our species' social ecology to explain how and why humans, and only humans, evolved the cognitive capacities that, in turn, lead to massive diversity and open-endedness in means and modes of expression. Language use is but one of these modes of expression, albeit one of manifestly high importance. We make cross-species comparisons, describe how the relevant cognitive capacities can evolve in a gradual manner, and survey how unleashed expression facilitates not only language use, but also novel behaviour in many other domains too, focusing on the examples of joint action, teaching, punishment, and art, all of which are ubiquitous in human societies but relatively rare in other species. Much of this diversity derives from graded aspects of human expression, which can be used to satisfy informative intentions in creative and new ways. We aim to help reorient cognitive pragmatics, as a phenomenon that is not a supplement to linguistic communication and on the periphery of language science, but rather the foundation of the many of the most distinctive features of human behaviour, society, and culture. THE mind is the locus of various dispositions, of developed sources and motives of action, which are not mere reflex habits but trained abilities and bents, tendencies, liabilities or inhibitions. Human knowing is more an intending of facts or states of affairs than a relation to them. Knowledge is not a predicamental relation. Consciousness is related to its object not as North Pole to South Pole, nor as container to contained, but as matter to form, and to the physical form (...) of the object of consciousness there corresponds the intentional form of the consciousness itself. To know reality is not to acquire it, grasp it, have it, possess it, contemplate it or dwell in it; it is to be informed by it i.e. intentionally to become it. Knowledge is the form rather than the cause of rational behaviour: technique, method, knack, skill, expertise, know-how, flair, strategic sense, prudence, taste, discretion, caution, judiciousness, decorum, conscientiousness, style, discipline, sagacity, discrimination, wisdom, respect for sense. Such principles operate not by description of nor prescription for, but by incarnation in and information of performance. It is, for instance, man’s respect for sense that is the form of a logically clear expression, and ideas are skills in the use of words. This human capacity and achievement is an intentional becoming, an actuation of the subject, bringing him to act. Yet, properly speaking, it is not action but passion. For knowing is an effect of which reality is the cause, and this causality is not a relation: actio est in passo—not in the agent, nor between the agent and the patient, but in the patient as from the agent, an actuation of the subject in dependence on the object. Of course it may be argued that non datur actio in distans, but far from requiring some intellectual ether, this only means that action and passion are not candidates for the application of spatial or temporal predicates. The known need not be close to the knower. True knowledge is the form of our reason when it is truly about matters of fact. It is not, then, a relation between subject and object, but a knowledge of states of affairs or facts constituted by interrelated objects which, to be known, must comprise some states of affairs of whose constituent objects some, at least, are knowing subjects. Inquiry is related to insight as searching to finding, or as trying to succeeding. Knowing is the second act or actualization of the intellect Thomists regard as second potency, first act, or accidental passive potency. But knowing is not a transitive activity. It is an achievement of intention, not an episode. It is a capacity, disposition, proneness or inclination, in so far as it connotes the abiding possibility of its contents’ polymorphic propositional and non-propositional expression in rational behaviour, which is an effect of knowing as an achievement, though it is also rightly said to be informed by know-how rather than caused by it. The act of self-knowledge consciously intends the self, but the self is intended as known and not as conscious. Thus, though true of consciousness, the distinction between consciously judging and consciously being tickled is not in consciousness but in knowledge of consciousness. Knowledge should be studied not in its products, but in its various expressions, especially in linguistic ones. For words and sentences are the most easily inspected class of things that we think in. This book explores noteworthy approaches to modal syllogistic adopted by medieval logicians including Abélard, Albert the Great, Avicenna, Averröes, Jean Buridan, Richard Campsall, Robert Kilwardby, and William of Ockham. The book situates these approaches in relation to Aristotle's discussion in the Prior and Posterior Analytics, and other parts of the Organon, but also in relation to the thought of Alexander of Aphrodisias and Boethius on the one hand, and to modern interpretations of the modal syllogistic on the other. Problems explored (...) include: Aristotle's doctrine of modal conversion, the pure and mixed necessity-moods, modal ecthesis, the pure and mixed contingency-moods, and Aristotle's use of counter-examples. Medieval logicians brought various concepts to bear on these problems, including the distinction between per se and per accidens terms, the notion of essential predication, the distinction between ut nunc and simpliciter propositions, the distinction between de dicto and de re modals, and the notion of ampliation. In recent years, a growing body of work has emerged in legal theory that focuses on the relationship between law and virtue. Part of this virtue jurisprudence literature deals with the role of virtue in adjudication and judicial decision-making, with leading authors claiming that virtue plays a central explanatory and normative role. This article engages with this literature on virtue in adjudication, and connects it with a contemporary phenomenon that poses a risk for courts and judges, namely the politicisation of (...) judiciaries. In particular, the question emerges whether virtue jurisprudence is able to provide practical guidance to judges and courts in order to help them avert such politicisation. I sketch the outlines of two contrasting answers to this question, by exploring two alternative approaches to understanding the politicisation of judiciaries from within a broadly virtue-ethical framework. On the first approach, it appears that judges may help prevent politicisation, by becoming more attentive to the tragic character of particular cases and by deciding as civic friends. However, on the other approach, which builds on Alasdair MacIntyre’s critique of modern moral discourse, politicisation appears to be intractable, and the practical recommendations following from the first perspective may even aggravate it.
