A new theory about the origins of consciousness that finds learning to be the driving force in the evolutionary transition to basic consciousness. What marked the evolutionary transition from organisms that lacked consciousness to those with consciousness—to minimal subjective experiencing, or, as Aristotle described it, “the sensitive soul”? In this book, Simona Ginsburg and Eva Jablonka propose a new theory about the origin of consciousness that finds learning to be the driving force in the transition to basic consciousness. After presenting the historical, neurobiological, and philosophical foundations of their analysis, Ginsburg and Jablonka propose that the evolutionary marker of basic or minimal consciousness is a complex form of associative learning, which they term unlimited associative learning (UAL). UAL enables an organism to ascribe motivational value to a novel, compound, non-reflex-inducing stimulus or action, and use it as the basis for future learning. Associative learning, Ginsburg and Jablonka argue, drove the Cambrian explosion and its massive diversification of organisms. We suggest a teleological approach to subjective experiencing or phenomenal consciousness. Like living, subjective experiencing is a teleology-constituting mode of being, which is made up of coupled, functional processes. We explicate our notion of a 'teleological mode of being' and distinguish between three different modes: a living (non-sentient) mode of being, a sentient mode of being, and a rational-symbolic (human) mode of being, which correspond to the three levels of soul suggested by Aristotle. These evolved teleological modes of being are (...) characterized by the possession of distinct, hierarchically nested goals and value systems. We argue that the functions of parts and processes within living systems have to be situated within the appropriate teleological frame of reference. Our evolutionary and comparative approach to the mode of being of subjectively experiencing animals clarifies why functions are best attributed to the parts that constitute sentience. Our proposal resolves the problem of attributing functions to phenomenal consciousness, resonates with basic teleological intuitions and distinctions, and corresponds to the modern broad understanding of selection and evolution. We discuss the evolutionary transition from animals with limited experiencing to animals with unlimited experiencing and basic consciousness. This transition was, we suggest, intimately linked with the evolution of associative learning and with flexible reward systems based on, and modifiable by, learning. During associative learning, new pathways relating stimuli and effects are formed within a highly integrated and continuously active nervous system. We argue that the memory traces left by such new stimulus-effect relations form dynamic, flexible, and varied global sensory (...) states, which we call categorizing sensory states . These CSSs acquired a function: they came to act as internal “evaluators” and led to positive and negative reinforcement of new behavior. They are therefore the simplest, distinct, first-person motivational states that an animal can have. They constitute what we call basic consciousness, and are the hallmark of animals that can experience. Since associative learning has been found in many invertebrate taxa that first appeared during the Cambrian era, we propose that the processes underlying basic consciousness are phylogenetically ancient, and that their emergence may have fueled the Cambrian explosion. This is the first of two papers in which we propose an evolutionary route for the transition from sensory processing to unlimited experiencing, or basic consciousness. We argue that although an evolutionary analysis does not provide a formal definition and set of sufficient conditions for consciousness, it can identify crucial factors and suggest what evolutionary changes enabled the transition. We believe that the raw material from which feelings were molded by natural selection was a global sensory state that we call (...) overall sensation, which is a by-product of the incessant activity of the highly interconnected nervous systems that characterize all neural animals. We argue that global sensory states generated limited experiencing once they became coupled to the simplest kinds of nervous-system-mediated learning, a coupling that occurred in the most ancient taxa of neural animals, which were similar to present-day cnidarians and ctenophores. In such animals, limited experiencing involves a small number of persistent global sensory states. These sensory states, however, do not have a function and do not act as motivational states. As we argue in the next paper, with the evolution of associative learning they evolved into systems that gave animals basic consciousness. (shrink)

The attribution of sentience or consciousness to plants is currently a topic of debate among biologists and philosophers. The claim that plants are conscious is based on three arguments: (i) plants, like all living organisms, are sentient (biopsychism); (ii) there is a strong analogy between the phloem transport system of plants and the nervous system of animals; and (iii) plants are the cognitive equals of sentient animals. On the basis of a model of consciousness that spells out criteria for assigning (...) sentience to a living organism and presents a diagnostic evolutionary marker of consciousness, we argue that these arguments are flawed and discuss some of the ethical issues they raise. Over the past two decades, Ginsburg and Jablonka have developed a novel approach to studying the evolutionary origins of consciousness: the Unlimited Associative Learning framework. This book presents the first accessible analysis of Spinoza's Tractatus Theologico-politicus, situating the work in the context of Spinoza’s general philosophy and its 17th-century historical background. According to Spinoza it is impossible for a being to be infinitely perfect and to have a legislative will. This idea, demonstrated in the Ethics, is presupposed and further elaborated in the Tractatus Theologico-politicus. It implies not only that on the level of truth all revealed religion is false, but also that all authority is (...) of human origin and that all obedience is rooted in a political structure. The consequences for authority as it is used in a religious context are explored: the authority of Scripture, the authority of particular interpretations of Scripture, and the authority of the Church. Verbeek also explores the work of two other philosophers of the period - Hobbes and Descartes - to highlight certain peculiarities of Spinoza's position, and to show the contrasts between their theories. We think of consciousness as a thing. Observation of our experience indicates that we are actually consciousing, and that experiencing is closely related to movement and the muscular sense. The position of this paper is that mind and body are not two entities related to each other but an inseparable whole while functioning. From concrete examples from the Feldenkrais Method, it is shown that changes in the organization of movement and functioning are intimately related and that one cannot change without (...) conscious experience. Implications for the resolution of controversies in the field of consciousness studies and the neurosciences are suggested. (shrink)

This course book serves an undergraduate course in introduction to legal reasoning. It is designed to initiate students in the legal methods of case law analysis and statutory interpretation, prompting students to take a critical distance from the wielding of the methods. It helps students acquire or refine the techniques of close reading, analogizing, distinguishing, positing related fact patterns, and criticizing judicial and legislative exposition and logic.

It is hard for most people to appreciate how little they know of themselves in regards to basic aspects of living, or how these simple and apparently uninteresting aspects of ourselves can have an influence on the higher aspects of human life and culture. As Alain Berthoz, in his groundbreaking book, The Brain's Sense of Movement, points out, 'Plato forgot the body.' It is a huge omission that continues into today and affects thinking in all our attempts to understand such (...) aspects of ourselves as perception, cognition, emotion, and that major topic of this journal, consciousness. Theo C. Meyering, in “Mind Matters: Physicalism and the Autonomy of the Person,” takes yet a third approach to the issue of reduction. He states that “if (true, downward) mental causation implies nonreducibility [as Stoeger and Murphy argue] and physicalism implies the converse, it is hard to see how these two views could be compatible.” Meyering distinguishes three versions of reductionism: radical (industrial strength) physicalism; ideal (regular strength) physicalism, and mild or token physicalism. Radical physicalism asserts that all special (...) sciences are reducible to physics in the sense that their laws can be deduced via bridge laws from those of physics. Ideal physicalism asserts that while it is practically impossible to reduce the special sciences, such reduction would be possible were there an ideally complete physics" (Note: This distinction parallels Stoeger’s recognition that epistemological reducibility is relative to the meaning of “laws of nature). Token physicalism is ontologically reductionist: there are no events that are not “token-identical” with some physical event or other (Note: See above, sec. 3.3). However, there are no identities between higher-level and lower- level types of events; consequently some events described by the special sciences have no physical explanation at all. -/- All of these reductionist positions are to be contrasted with compositional (milder than mild) physicalism, which asserts that some higher-level events are not even token-identical with physical events because the higher-level event (say, a crash in the stock market) is constituted by innumerable physical particulars in all sorts of states and interactions. -/- Meyering then surveys some of the existing arguments for the nonreducibility of the special sciences. One of the most important is the argument from multiple realizability. The claim is that economics, for example, is not reducible to physics because economic concepts (for example, monetary exchange) are “wildly multiply realizable” (for example, using coins, strings of wampum, signing a check). Thus, there can be no bridge laws and no reduction. Such an argument, however, only cuts against radical physicalism, not the weaker (and a priori more plausible) ideal physicalism. -/- A stronger argument for the indispensability of special-science explanations is based on the role of functional explanations. For example, the functional description of aspirin as an analgesic is in some instances a more useful explanation of its causal role (relieving a headache) than is its description as the chemical level. -/- Meyering’s own contribution focuses neither on multiple realizability of supervenient properties nor on multiple “fillers” of functional roles, but on “multiple supervenience.” In particular, a single subvenient state of affairs (for example, a cloud of free electrons permeating the metal of which a ladder is constructed) may realize a variety of supervenient dispositional properties (in this case, electrical conductivity, thermal conductivity, opacity). An explanation (say, of the cause of a deadly accident) requires reference to the dispositional property (electrical conductivity), not merely to the subvenient property. Meyering argues that it is this possibility of multiple supervenience, not multiple realizability, that gives arguments against reduction based on functional properties their real force. Downward causation, then, can be understood in terms of selective activation of one of several dispositional properties of a lower-level state, and thus can be assigned a stable place in our picture of how the world is organized without upsetting our conception of physics as constituting a closed and complete system of physical events. This is a response to the nine commentaries on our target article “Unlimited Associative Learning: A primer and some predictions”. Our responses are organized by theme rather than by author. We present a minimal functional architecture for Unlimited Associative Learning that aims to tie to together the list of capacities presented in the target article. We explain why we discount higher-order thought theories of consciousness. We respond to the criticism that we have overplayed the importance of learning and underplayed the (...) importance of spatial modelling. We decline the invitation to add a negative marker to our proposed positive marker so as to rule out consciousness in plants, but we nonetheless maintain that there is no positive evidence of consciousness in plants. We close by discussing how UAL relates to development and to its material substrate. (shrink)

Fueled by ever-growing amounts of (digital) data and advances in artificial intelligence, decision-making in contemporary societies is increasingly delegated to automated processes. Drawing from social science theories and from the emerging body of research about algorithmic appreciation and algorithmic perceptions, the current study explores the extent to which personal characteristics can be linked to perceptions of automated decision-making by AI, and the boundary conditions of these perceptions, namely the extent to which such perceptions differ across media, (public) health, and judicial (...) contexts. Data from a scenario-based survey experiment with a national sample (N = 958) show that people are by and large concerned about risks and have mixed opinions about fairness and usefulness of automated decision-making at a societal level, with general attitudes influenced by individual characteristics. Interestingly, decisions taken automatically by AI were often evaluated on par or even better than human experts for specific decisions. Theoretical and societal implications about these findings are discussed. (shrink)

This monograph presents new ideas in nomic truth approximation. It features original and revised papers from a philosopher of science who has studied the concept for more than 35 years. Over the course of time, the author's initial ideas evolved. He discovered a way to generalize his first theory of nomic truth approximation, viz. by dropping an unnecessarily strong assumption. In particular, he first believed to have to assume that theories were maximally specific in the sense that they did not (...) only exclude certain conceptual possibilities, but also that all non-excluded possibilities were in fact claimed to be nomically possible. Now, he argues that the exclusion claim alone, or for that matter the inclusion claim alone, is sufficient to motivate the formal definition of being closer to the nomic truth. The papers collected here detail this generalized view of nomic truthlikeness or verisimilitude. Besides this, the book presents, in adapted form, the relation with several other topics, such as, domain revision, aesthetic progress, abduction, inference to the best explanation, pragmatic aspects, probabilistic methods, belief revision and epistemological positions, notably constructive realism. Overall, the volume presents profound insight into nomic truth approximation. This idea seeks to determine how one theory can be closer to, or more similar to, the truth about what is nomically, e.g. physically, chemically, biologically, possible than another theory. As a result, it represents the ultimate goal of theory oriented empirical science. The scientific study of consciousness or subjective experiencing is a rapidly expanding research program engaging philosophers of mind, psychologists, cognitive scientists, neurobiologists, evolutionary biologists and biosemioticians. Here we outline an evolutionary approach that we have developed over the last two decades, focusing on the evolutionary transition from non-conscious to minimally conscious, subjectively experiencing organisms. We propose that the evolution of subjective experiencing was driven by the evolution of learning and we identify an open-ended, representational, generative and recursive form of associative (...) learning, which we call Unlimited Associative Learning (UAL), as an evolutionary transition marker of minimal consciousness. This evolutionary marker provides evidence that the evolutionary transition to consciousness has gone to completion and allows reverse-engineering from this learning capacity to the system that enables it – making possible the construction of a toy model of UAL. The model allows us to identify some of the key processes and structures that constitute minimal consciousness, points its taxonomic distribution and the ecological context in which it first emerged, highlights its function and suggests a framework for exploring developmental and evolutionary modifications of consciousness. We point to ways of experimentally testing the relationship between UAL and consciousness in human and in non-human animals and discuss the theoretical and ethical implications of our approach. The framework we offer allows the exploration of the evolutionary changes in agency, value systems, selective processes and goals that were involved in the transition to subjective experiencing from a perspective that resonates with the approaches of bio-semioticians. Of course, this implies that, if one succeeds in demonstrating convincingly the pseudo-character of a problem by giving its 'solution', the time spent on it need not be seen as wasted. We conclude this section with a brief statement of the criteria for concept explication as they have been formulated in several places by Carnap, Hempel and Stegmiiller. Hempel's account is still very (...) adequate for a detailed introduction. The process of explication starts with the identification of one or more vague and, perhaps, ambiguous concepts, the so-called explicanda. Next, one tries to disentangle the ambiguities. This, however, need not be possible at once. Ultimately the explicanda are to be replaced by certain counterparts, the so-called explicata, which have to conform to four requirements. They have to be as precise as possible and as simple as possible. In addition, they have to be useful in the sense that they give rise to the formulation of theories and the solution of problems. _Clinical Interaction and the Analysis of Meaning_ evinces a therapeutic vitality all too rare in works of theory. Rather than fleeing from the insights of other disciplines, Dorpat and Miller discover in recent research confirmation of the possibilities of psychoanalytic treatment. In Section I, "Critique of Classical Theory," Dorpat proposes a radical revision of the notion of primary process consonant with contemporary cognitive science. Such a revised conception not only enlarges our understanding of the analytic process; it also provides analysis (...) with a conceptual language that can articulate meaningful connections with a growing body of empirical research about the development and nature of human cognition. In Section II, "Interactional Theory," Miller reverses the direction of inquiry. He begins with the literature on cognitive development and functioning, and proceeds to mine it for concepts relevant to the clinical process. He shows how a revised understanding of the operation of cognition and affect can impart new meaning to basic clinical concepts such as resistance, transference, and level of psychopathology. In Section III, "Applications and Exemplifications," Dorpat concludes this exemplary collaboration by exploring select topics from the standpoint of his and Miller's new psychoanalytic theory. At the heart of the authors' endeavor it "meaning analysis," a concept that integrates an up-to-date model of human information processing with the traditional goals of psychoanalysis. The patient approaches the clinical encounter, they argue, with cognitive-affective schemas that are the accumulatice product of his life experience to date; the manifold meanings ascribed to the clinical interaction must be understood as the product of these schemas rather than as distortions deriving from unconscious, drive-related fantasies. The therapist's goal is to make the patient's meaning-making conscious and thus available for introspection. (shrink)

Sandra Laugier has long been a key liaison between American and European philosophical thought, responsible for bringing American philosophers such as Ralph Waldo Emerson, Henry David Thoreau, and Stanley Cavell to French readers—but until now her books have never been published in English. _Why We Need Ordinary Language Philosophy_ rights that wrong with a topic perfect for English-language readers: the idea of analytic philosophy. Focused on clarity and logical argument, analytic philosophy has dominated the discipline in the United States, Australia, (...) and Britain over the past one hundred years, and it is often seen as a unified, coherent, and inevitable advancement. Laugier questions this assumption, rethinking the very grounds that drove analytic philosophy to develop and uncovering its inherent tensions and confusions. Drawing on J. L. Austin and the later works of Ludwig Wittgenstein, she argues for the solution provided by ordinary language philosophy—a philosophy that trusts and utilizes the everyday use of language and the clarity of meaning it provides—and in doing so offers a major contribution to the philosophy of language and twentieth- and twenty-first-century philosophy as a whole. Veit suggests that the challenge of coordinating movement in multicellular organisms led to the evolution of a prioritizing value system, which rendered organisms complex enough to be sentient and drove the Cambrian explosion, while the absence of this evaluation system led to the demise of Ediacaran animals. In this commentary we criticize Veit’s terminology and evolutionary proposals, arguing that his terminology and evolutionary scenarios are problematic, and put forward alternative proposals. We suggest that sentience is a system property, and that (...) the evolution of sentience was the outcome of the evolution of open-ended associative learning, which included the coevolution of sensory, motor, memory, and value subsystems. We suggest that these coevolutionary system dynamics were a factor in the Cambrian explosion and contributed to the extinction of the Ediacaran biota. (shrink)

Heyes argues that human metacognitive strategies (“cognitive gadgets” or “mills”) are the products of cultural evolution based on domain‐general cognition with few simple biases. Although like Heyes, we believe that the evolution of domain‐general cognitive processes played a crucial role in the evolution of human cognition, we argue that Heyes' distinction between mills and grist is too sharp, that associative learning evolved gradually to become more complex and hierarchical, something that is not captured by the system 1/system 2 distinction, and (...) that human cognitive plasticity required the genetic accommodation of gadget‐specific processes that led to more plasticity‐enhancing human‐specific biases. The Knowledge-Based Bio-Economy has gained prominence as an agricultural R&D agenda of the European Union. Specific research policies are justified as necessary to create a KBBE for societal progress. Playing the role of a master narrative, the KBBE attracts rival visions; each favours a different diagnosis of unsustainable agriculture and its remedies in agro-food innovation. Each vision links a technoscientific paradigm with a quality paradigm: the dominant life sciences vision combines converging technologies with decomposability, while a marginal one combines agro-ecology (...) with integral product integrity. From these divergent visions, rival stakeholder networks contend for influence over research policies and priorities, especially within the Framework Programme 7 on Food, Agriculture, Fisheries and Biotechnology, which has aimed to promote a Knowledge-Based Bio-Economy. Although the FAFB programme has favoured a life sciences vision, agro-ecological approaches have gained a presence, thus overcoming their general lock-out from agricultural research agendas. In their own way, each rival paradigm emphasises the need for collective systems to gather information for linking producers with users, as a rationale for the public sector to fund distinctive research priorities.
