A provocative ontological-cum-semantic position asserting that the right ontology is austere in its exclusion of numerous common-sense and scientific posits and that many statements employing such posits are nonetheless true. The authors of Austere Realism describe and defend a provocative ontological-cum-semantic position, asserting that the right ontology is minimal or austere, in that it excludes numerous common-sense posits, and that statements employing such posits are nonetheless true, when truth is understood to be semantic correctness under contextually operative semantic standards. Terence (...) Horgan and Matjaz Potrc argue that austere realism emerges naturally from consideration of the deep problems within the naive common-sense approach to truth and ontology. They offer an account of truth that confronts these deep internal problems and is independently plausible: contextual semantics, which asserts that truth is semantically correct affirmability. Under contextual semantics, much ordinary and scientific thought and discourse is true because its truth is indirect correspondence to the world. After offering further arguments for austere realism and addressing objections to it, Horgan and Potrc consider various alternative austere ontologies. They advance a specific version they call "blobjectivism"--the view that the right ontology includes only one concrete particular, the entire cosmos, which, although it has enormous local spatiotemporal variability, does not have any proper parts. The arguments in Austere Realism are powerfully made and concisely and lucidly set out. The authors' contentions and their methodological approach--products of a decade-long collaboration--will generate lively debate among scholars in metaphysics, ontology, and philosophy. (shrink)

Existence monism is defended against priority monism. Schaffer's arguments for priority monism and against pluralism are reviewed, such as the argument from gunk. The whole does not require parts. Ontological vagueness is impossible. If ordinary objects are in the right ontology then they are vague. So ordinary objects are not included in the right ontology; and hence thought and talk about them cannot be accommodated via fully ontological vindication. Partially ontological vindication is not viable. Semantical theorizing outside the ontology room (...) and semantical theorizing in the doorway. How is it possible for human subjects who are socially constructed to engage in effective and authoritative acts of resistance to the social norms and institutions within which they were formed? Judith Butler, in her engagement with the work of Pierre Bourdieu, locates this possibility in the nature of `speech acts', and in resistance to social norms emanating from the abjected margins of social life. She criticizes Bourdieu for undermining the promise of agency contained in habitus by reducing it to (...) the social field in which it was constituted, thus re-closing `the iron cage' of structural/institutional determination. For Butler, social norms and institutions, dependent as they are on reiterative performance, are intrinsically open to disruption. It is possible, she claims, using as her example Rosa Parks's historical act of resistance in Montgomery, Alabama in 1955, to resist with authority, yet without prior institutional authorization. This article argues that Butler's theory of iterability works to endow the capacity to authorize against the grain of institutional authority with individuals and their acts and hence neglects the social contexts that inform and de-limit this capacity. `Resisting with authority' is possible precisely because it is not endowed by individuals or their acts, but is collective and interactional. In Chapters 4 and 5 of his 1998 book From Metaphysics to Ethics: A Defence of Conceptual Analysis, Frank Jackson propounds and defends a form of moral realism that he calls both ‘moral functionalism’ and ‘analytical descriptivism’. Here we argue that this metaethical position, which we will henceforth call ‘analytical moral functionalism’, is untenable. We do so by applying a generic thought-experimental deconstructive recipe that we have used before against other views that posit moral properties and identify them with certain (...) natural properties, a recipe that we believe is applicable to virtually any metaphysically naturalist version of moral realism. A case is made here for a secular interpretation of spirituality to place against more orthodox religious versions which are currently gaining ground in English education as part of the government policy designed to encourage schools to apply for ‘academy’ status independent of local authority control. Given the rise of faith-based ‘free’ schools, it is important to provide a secular alternative as a foundation for morality and spirituality in the interests of maintaining state-funded institutions characterised by rationality and autonomy rather (...) than a commitment to nurturing specific religious beliefs. After considering arguments against faith-based education, I go on to suggest a secular approach to spirituality founded on mindfulness theory and practice originating in Buddhist traditions. It considers three controversial Hegelian ideas: dialectic, alienation, and actuality. The discussion of Marx's views includes his thoughts about Hegel's philosophy, capitalism, and bourgeois moral theory.

This article explores the crucial moments of scientists’ research activities when they decide to shift to a radical new domain or to perpetuate a project. We introduce what we have called the “respiration model” which describes and analyses key cognitive components which occur in this complex process. Respiration either privileges epistemic expectations which are rooted in socio-cognitive metrics of “concentration” or in a functionality-multiple horizon context which we refer to as “extension”. Fix an integer $r \ge 3$. We consider metric spaces on n points such that the distance between any two points lies in $\left\{ {1, \ldots,r} \right\}$. Our main result describes their approximate structure for large n. As a consequence, we show that the number of these metric spaces is $\left\lceil {{{r + 1} \over 2}} \right\rceil ^{\left + o\left}.$Related results in the continuous setting have recently been proved by Kozma, Meyerovitch, Peled, and Samotij [34]. When r is even, our (...) structural characterization is more precise and implies that almost all such metric spaces have all distances at least $r/2$. As an easy consequence, when r is even, we improve the error term above from $o\left$ to $o\left$, and also show a labeled first-order 0-1 law in the language ${\cal L}_r $, consisting of r binary relations, one for each element of $[r]$. In particular, we show the almost sure theory T is the theory of the Fraïssé limit of the class of all finite simple complete edge-colored graphs with edge colors in $\left\{ {r/2, \ldots,r} \right\}$.Our work can be viewed as an extension of a long line of research in extremal combinatorics to the colored setting, as well as an addition to the collection of known structures that admit logical 0-1 laws. The chorion genes of Drosophila are amplified in response to developmental signals in the follicle cells of the ovary prior to their transcription. Their expression is regulated both temporally and spatially within this tissue. They thus serve as models both for the regulation of DNA replication and of developmental transcription. The regulatory elements for DNA amplification have been delineated. Their analysis reveals that amplification is mediated by several regulatory regions and initiates at defined origins within the chorion cluster. Proteins involved (...) in amplification are being identified both by mutations affecting amplification and by DNA binding studies. Regulatory elements for temporal as well as spatial control of chorion gene, expression have been characterized, and two candidate transcription factor genes have been cloned. (shrink)

In several avenues of contemporary research, much attention is devoted to the contrast between the real authority of institution and their formal power, in the analysis of institutional funtionings; also in the study of the relationships between institutions on the one hand, rules, principles or norms on the other hand. Such a contrast appears to be based on familiar observations: the capacity of institutions to get their preferred outcomes is sometimes loosely connected with the hierarchical prerogatives of the considered institutions. (...) More particularly, current studies of the „migration authority” bring out possible shitts in real authority while there is no changein the formal structure of power. This article will partly consist in the explanation of recent results of common reaserch in project „Delicom”, in which a formal treatment of the distinction has been put foward. This approach will be set against the background of recent contributions in political science or economics. The revelance of the problematic for the study of competence delegation among institutions will be stressed all along. (shrink)

The confusion between cognitive states and the content of cognitive states that gives rise to psychologism also gives rise to reverse psychologism. Weak reverse psychologism says that we can study cognitive states by studying content – for instance, that we can study the mind by studying linguistics or logic. This attitude is endemic in cognitive science and linguistic theory. Strong reverse psychologism says that we can generate cognitive states by giving computers representations that express the content of cognitive states and (...) that play a role in causing appropriate behaviour. This gives us strong representational, classical AI (REPSCAI), and I argue that it cannot succeed. This is not, as Searle claims in his Chinese Room Argument, because syntactic manipulation cannot generate content. Syntactic manipulation can generate content, and this is abundantly clear in the Chinese Room scenano. REPSCAI cannot succeed because inner content is not sufficient for cognition, even when the representations that carry the content play a role in generating appropriate behaviour. (shrink)

The factors preventing registered nurses from failing students in practice are multifaceted and have attracted much debate over recent years. However, writers rarely focus on what is needed to fail an incompetent pre-registration nursing student in their final placement. This hermeneutic study explored the mentor experience of failing a pre-registration nursing student in their final placement. A total of 19 mentors were recruited from 7 different healthcare organisations in both inner city and rural locations in the southeast of England. Participants (...) took part in individual reflective interviews about their experience of failing a pre-registration nursing student in their final placement. These experiences were interpreted through a hermeneutic discovery of meaning. The new horizon of understanding which developed as a result of this research is framed within the context of moral stress, moral integrity and moral residue with the overall synthesis being that these mentors’ stories presented a new horizon of moral courage. This paper is an overview of my philosophical work. It follows closely the structure of the handout I used as the basis for a talk on this topic at the 2000 meeting of the Austro-Slovene Philosophical Association. The ABA has adopted four model policies that address, in one way or another, the issue of foreign lawyer mobility. These policies are the ABA Model Foreign Legal Consultant Rule, which is commonly known as the FLC rule, the ABA Model Rule for Temporary Practice by Foreign Lawyers, which is commonly known as the FIFO rule, ABA Model Rule of Professional Conduct 5.5, which permits foreign lawyers to serve as in-house counsel, and the ABA Model Rule on Pro Hac Vice (...) Admission. All four of the ABA's foreign lawyer mobility recommendations include a requirement that the mobile foreign lawyer is “ subject to effective regulation and discipline by a duly constituted professional body or a public authority .” In other words, these rules set forth requirements regarding the nature of the regulatory system in the foreign lawyer's home jurisdiction. A number of US states have included this requirement in their foreign lawyer mobility provisions, but a number have not. Although the ABA model rules and a number of state rules include this requirement, neither the ABA Model Rules nor any of the state rules have defined what it means for a foreign lawyer to come from a system with “effective regulation and discipline.” Nor is there any evidence that this requirement has been enforced in those states that have included this requirement. This article suggests that the “effective regulation and discipline” requirement has been an elephant in the room that no one has been willing to talk about. The article argues that the time has come to confront this issue head-on. It asserts that either efforts should be undertaken to define and enforce this requirement or that the requirement should be abandoned. The article reviews two “threshold” issues that jurisdictions might want to consider when deciding whether to adopt or retain an “effective regulation and discipline” requirement. It also identifies cross-cultural and cross-professional resources that might be consulted for “benchmarking” purposes if and when US regulators decide to add “meat to the bones” by defining and enforcing the “effective regulation and discipline” requirement found in foreign lawyer mobility provisions. Health care reforms, in particular the expansion of public and/or private health care benefit coverage to some or all population groups, is becoming an increasingly hot topic for discussion—and in some cases for action—at all levels of government. With almost 16% of Americans estimated to be uninsured for at least part of the year, opinion polls show health care near the top of the general public’s list of concerns. Little wonder that presidential candidates for the 2008 election are incorporating ‘‘universal (...) health care coverage’’ proposals in their campaign platforms. Will ‘‘cradle-to-grave’’ coverage for all become a reality or will they just experience cradle-to-grave debates over this issue? That is essentially one of the questions posed in the following discussion on the role of nonprofit health care organizations in promoting, and operating under, universal health care coverage.
