So ordinary objects are not included in the right ontology; and hence thought and talk about them cannot be accommodated via fully ontological vindication. A case is made here for a secular interpretation of spirituality to place against more orthodox religious versions which are currently gaining ground in English education as part of the government policy designed to encourage schools to apply for ‘academy’ status independent of local authority control. Given the rise of faith-based ‘free’ schools, it is important to provide a secular alternative as a foundation for morality and spirituality in the interests of maintaining state-funded institutions characterised by rationality and autonomy rather (...) than a commitment to nurturing specific religious beliefs. After considering arguments against faith-based education, I go on to suggest a secular approach to spirituality founded on mindfulness theory and practice originating in Buddhist traditions. In Chapters 4 and 5 of his 1998 book From Metaphysics to Ethics: A Defence of Conceptual Analysis, Frank Jackson propounds and defends a form of moral realism that he calls both ‘moral functionalism’ and ‘analytical descriptivism’. Here we argue that this metaethical position, which we will henceforth call ‘analytical moral functionalism’, is untenable. We do so by applying a generic thought-experimental deconstructive recipe that we have used before against other views that posit moral properties and identify them with certain (...) natural properties, a recipe that we believe is applicable to virtually any metaphysically naturalist version of moral realism. Pressures are mounting upon Australian retailers including their ability to grow profit. Price deflation for many items, a lack of wage growth, and, the rise of huge online platforms is just some of the factors now creating difficulties for retailers. In the absence of sales growth, profit can only be improved with a focus on the cost side of the business. And, it is this focus that has brought about the potential for unethical decision making. This case study examines the (...) role of accountants in influencing this decision making. Accountants are often seen as the experts when it comes to cost control. Consequently, they have a unique opportunity to use their position to help ensure that when governance processes surrounding cost (and profit) management are established, or when key decisions are made, these are undertaken on an ethical basis. This teaching case explores this issue within three scenarios relevant to the current Australian retail industry. Firstly, the ethical concerns of the use of power by the big retailers to reduce costs within international and domestic supply chains are examined. Secondly, recent instances of questionable practices to inflate profits through rebate, and other, accounting methods are analysed. Finally, the design of remuneration systems is discussed within the context of whether these are creating unethical biases within organisational decision making. (shrink)

This paper will describe the methodology for teaching legal English used at the Fordham University School of Law’s Legal English Institute, a one-semester program for law students and attorneys. Reasonable minds may disagree about the most effective methodology for teaching legal English, or for that matter any other form of academic English, but we have developed an approach that is informed by both theory and practice. At LEI, we use a “modified CLIL” format, with four substantive classes on topics in (...) U.S. law that run in parallel with a core class on legal English. All four substantive classes use authentic reading materials that are similar to those used in an LL.M. program, and these materials are recycled in the legal English class and form the basis of discussions about language issues. Our use of content classes to elicit language issues has proven to be effective and it also helps keep students motivated, as students tend to have more intrinsic interest in legal topics than in language study per se. Deleuze’s philosophical method is analyzed and positioned against the background of the intellectual/religious tradition of practical mysticism that has been traveling the globe across times, places, languages, and cultural barriers. The paper argues that Deleuze’s unorthodox ontology of the virtual enables a naturalistic interpretation of the functioning of mysticism when the triad of concepts, percepts and affects is formed in accordance with the logic of the included middle.

There is no other published work in English devoted to analyzing the political and intellectual dimensions of black Cuban women’s thought across the island’s history. This text is essential reading for students of Afro-Latin American studies, Caribbean history, or courses focussing on black women in the Atlantic region.

The base rate fallacy is directly dependent on a particular judgment paradigm in which information may be unambiguously designated as either “base rate” or “individuating,” and in which subjects make two-stage sequential judgments. The paradigm may be a poor match for real world settings, and the fallacy may thus be undefined for natural ecologies of judgment.

This essay introduces a cluster of articles titled “Devalued Currency: An Elegiac Symposium on Paradigm Shifts.” Eagleton's piece addresses, from a perspective indebted to Walter Benjamin, the notion of Thomas Kuhn that “shifts” in the controlling paradigms of disciplines and practices are entirely transformative not only of their futures but also of their pasts. Benjamin argued that a work of art is a set of potentials that may or may not be realized in the vicissitudes of its afterlife. The true (...) significance of works might be said, therefore, to emerge only after some as-yet-unexpected event or upheaval makes their significance apparent. In this sense, we might argue that historical events make full sense only in the light of “judgment day”; until then, history remains an incoherent chronicle. But the totality that will one day be revealed cannot be anticipated. The past is open-ended because the present is, and meanwhile, the meaning of history is in our hands to change. Since we have that power, Eagleton suggests that we recycle figures of the past as characters in a comedy rather than tragedy. Still, it is never possible to say which figures of the past and which works are ultimately important and which are not, because we cannot say which mutations will result in major developments to come. No work or person is important or peripheral in itself or himself; it is the critic and historian who render them so. (shrink)

By Sanitsuda Ekachai. Edited by Nick Wilgus. Bangkok: Post Books, 2001. 192 pp. Sanitsuda Ekachai, editorial columnist and features section editor of the Bangkok Post, writes this book in the Menckanian tradition of muckraking journalism. A collection of columns from the past decade, the book has an angry goal—the reform of a (...) corrupt Thai Buddhist sangha. Somehow, however, the author manages to accomplish the task without an angry or bitter tone. One suspects that this is because she has the goods. In thirty-six short features and twenty-one even shorter editorials, Ekachai paints a damning picture of a corrupt Theravada Buddhist sangha that has lost touch with both its religious tradition and its lay constituency.She presents overwhelming evidence of the corruption. She tells several well-publicized stories of sexual scandals involving bhikkhus and mentions a dozen more. She carefully tallies the possessions of rich bhikkhus and richer temples. She makes clear the unrepentant patriarchy of the authoritarian Buddhist hierarchy and reminds us of the un-Buddhist character of a sangha that will not allow the ordination of bhikkhunis. And she argues that the root cause of much of this drifting from Buddhist ideals is a buying into the consumerism that has gripped much of modern Thai culture.This last point—consumerism—is important. If the book has a theme—always a tall order for a collection of articles—it is the economic enslavement of Thai culture and the sangha to capitalistic values. Of course, the West is the culprit here. Since Thailand, strictly speaking, has never been colonialized, the West managed to corrupt Thailand (or Siam as some prefer) simply by being in the area. As one of Ekachai's key informants, Sulak Sivaraksha succinctly put it, "Siam is culturally and intellectually colonized because the country identifies itself closely with the West" (161). [End Page 181]A close second as a theme, however, is patriarchy. Patriarchy, not Buddhism, is the root of the gender imbalance in the sangha. The Buddha embraced (a bit reluctantly to be sure) the order of bhikkhunis and made it clear his reluctance was an upayic or strategic matter, not a question of the spiritual status of women. Women are as able as men when Enlightenment is the question. Patriarchy is also at the root of Thailand's shameful sex industry—one in thirty women in Thailand is a prostitute. The culture is at fault here, a culture that sees women as objects rather than persons.Sivaraksha ties consumerism and patriarchy together when he says, "In a consumer society, the seeking for endless sensory pleasures and possessions has become the ultimate quest while Buddhism teaches about letting go" (75). The combination of testosterone-blocking celibacy and baht- driven greed has been too much for the modern bhikkhus of Thailand.Not all bhikkhus, however. Ekachai's book rises above the level of pure muckraking through the simple expedient of offering hope. She tells a dozen or more stories of enlightened (small "e") bhikkhus who are taking steps at reform. By "ordaining" (and thereby protecting) endangered trees in a forest. By teaching the dhamma instead of occultism. By showing economic restraint in the face of runaway rapaciousness. These are inspiring stories of bhikkhus named Buddhadasa, Dhammapitika, Udompatanakorn, Kutajitto, Supajarawat,Visalo, and Kabilsingh. Hope is personalized in these reformers.Reading between the lines, one can imagine a response to Ekachai's overwhelming case: the traditional Thai sangha is organized to serve rural village folk. Although the traditional village still exists in Thailand, it is becoming an endangered species in the face of the urbanized juggernaut. The sangha simply hasn't discovered the keys to reaching a changed constituency. Reading between the lines, one suspects that the author would wholeheartedly agree with this defense. Only she wouldn't consider it a defense but a reason, and a well-known reason at that. Her rejoinder would be that the current leadership must know it is out of touch, but still refuses any move... But the meaning of each of those traveling lives has been the subject of great debate, both within and without their respective religious traditions. Disagreements abound. In fact, in one of those [End Page 105] odd quirks of human cantankerousness, the deeper one gets into each of the traditions, Buddhism and Christianity, the more diverse and passionate are the views about the Buddha and the Christ.The diversity of views deep within each tradition can be stunning to the average Buddhist and Christian on the street, who tend to have a rather homogenized view of each other—kind of a standard life story that could be easily summarized in the pages and pictures of a comic book. But deep within the traditions, Buddhists argue about Buddha nature, Buddha veneration, and the role the Buddha plays in human liberation. Operant psychologists are looking for alternatives to radical behaviorism. Rachlin offers teleological behaviorism, but it may pose as many difficulties as radical behaviorism. There is, however, a less drastic way to defend Rachlin's thesis of It portrays operant principles as relating distal efficient causes to behavioral effects.

In his PhD proposal, now published as Seeing Sociological, Garfinkel [2006] formulated action in terms of a mutually constitutive structure—the Noesis-Noema Structures. This structure can be traced to Aaron Gurwitsch’s gestalt psychology and Law of Good Gestalt which theorises how participants prioritise functional Gestalts over other possible meanings of what is perceivable in their surroundings. While Gurwitsch illustrated his theory using images, in this paper we revisit Gurwitsch’s theory in light of the advances in recording real-time interaction to consider Gestalt (...) in spatio-temporality of real-time interaction. We consider the Law of Good Gestalt in terms of the dimensions of time and space, and postulate two analytical principles—the Principle of Good Momentary Gestalt and the Principle of Good Temporal Gestalt—for analysing a multi-angle video segment of a monologue taken from a training event. The analysis examines how the monologue was embedded in a multi-layer projection structure, so that during the time of the monologue, the trainer and trainees can be seen as achieving a transition between one activity to another while sustaining the frame of the training event. Through this, the analysis highlights the multi-layered structure of participants’ field of perception that constitutes their experience of the social activity, and explores a “method” to reconstruct such a structured field of perception through re-coupling meanings to the assemblages of multimodal resources recoverable on video.
