I argue that zombies are inconceivable. More precisely, I argue that the conceivability-intuition that is used to demonstrate their possibility has been misconstrued. Thought experiments alleged to feature zombies founder on the fact that, on the one hand, they _must_ involve first-person imagining, and yet, on the other hand, _cannot_. Philosophers who take themselves to have imagined zombies have unwittingly conflated imagining a creature who lacks consciousness with imagining a creature without also imagining the consciousness it may or may not (...) possess. The book approaches law from the legal-linguistic perspective. Its aim is to clarify the processes in which the meaning of law emerges in legal discourses. In order to enable the understanding of law as a discursive practice, professional and non-professional discourses are analyzed. With this aim in mind, the author focuses on the epistemological consequences of the discursiveness of law. Other relevant legal-linguistic operations such as legal interpretation or legal translation are scrutinized in terms of their theoretical prerequisites and their (...) practical consequences. Their analysis also shows the potential and the limits of law as a social and as a linguistic phenomenon that is determined by its discursiveness. Der Einsatz empirischer Forschungsmethoden in der Medizinethik hat zu Forderungen nach einem gewandelten Selbstverständnis der Medizinethik geführt, die sich mehr als eine integrierte Disziplin aus Sozialwissenschaften und Ethik verstehen solle. Dagegen wird hier die These vertreten, dass über Sinn und Unsinn des Einsatzes empirischer Methoden zunächst eine moralphilosophische Diskussion erforderlich ist. Medizinethiker müssen ausweisen können, welche empirischen Forschungsresultate zur Beantwortung normativer Fragen erforderlich sind. Ein solcher Ausweis beruht seinerseits jedoch auf normativen Annahmen, die ihrerseits moralphilosophischer Legitimation bedürfen. Der Beitrag untersucht (...) daher den Einsatz empirischer Methoden in der Medizinethik im Hinblick auf Verhältnis von ethischem Grundlagendiskurs und Methodologie der angewandten Ethik. This book challenges the conventional wisdom that improving democratic politics requires keeping emotion out of it. Marcus advances the provocative claim that the tradition in democratic theory of treating emotion and reason as hostile opposites is misguided and leads contemporary theorists to misdiagnose the current state of American democracy. Instead of viewing the presence of emotion in politics as a failure of rationality and therefore as a failure of citizenship, Marcus argues, democratic theorists need to understand that emotions (...) are in fact a prerequisite for the exercise of reason and thus essential for rational democratic deliberation and political judgment. Attempts to purge emotion from public life not only are destined to fail, but ultimately would rob democracies of a key source of revitalization and change. Drawing on recent research in neuroscience, Marcus shows how emotion functions generally and what role it plays in politics. In contrast to the traditional view of emotion as a form of agitation associated with belief, neuroscience reveals it to be generated by brain systems that operate largely outside of awareness. Two of these systems, "disposition" and "surveillance," are especially important in enabling emotions to produce habits, which often serve a positive function in democratic societies. But anxiety, also a preconscious emotion, is crucial to democratic politics as well because it can inhibit or disable habits and thus clear a space for the conscious use of reason and deliberation. If we acknowledge how emotion facilitates reason and is "cooperatively entangled" with it, Marcus concludes, then we should recognize sentimental citizens as the only citizens really capable of exercising political judgment and of putting their decisions into action. Although occasionally there may be certain imperfections with these old texts, we feel they deserve to be made available for future generations to enjoy.

A wide range of non-pharmaceutical interventions (NPIs) have been introduced to stop or slow down the COVID-19 pandemic. Examples include school closures, environmental cleaning and disinfection, mask mandates, restrictions on freedom of assembly and lockdowns. These NPIs depend on coercion for their effectiveness, either directly or indirectly. A widely held view is that coercive policies need to be publicly justified—justified to each citizen—to be legitimate. Standardly, this is thought to entail that there is a scientific consensus on the factual propositions (...) that are used to support the policies. In this paper, we argue that such a consensus has been lacking on the factual propositions justifying most NPIs. Consequently, they would on the standard view be illegitimate. This is regrettable since there are good reasons for granting the state the legitimate authority to enact NPIs under conditions of uncertainty. The upshot of our argument is that it is impossible to have both the standard interpretation of the permissibility of empirical claims in public justification and an effective pandemic response. We provide an alternative view that allows the state sufficient room for action while precluding the possibility of it acting without empirical support. (shrink)

Chapter 1 of this book argued that moral philosophy should be based on seven principles of theory selection adapted from the sciences. Chapter 2 argued that these principles support basing normative moral philosophy on a particular problem of diachronic instrumental rationality: the ‘problem of possible future selves.’ Chapter 3 argued that a new moral principle, the Categorical-Instrumental Imperative, is the rational solution to this problem. Chapter 4 argued that the Categorical-Instrumental Imperative has three equivalent formulations akin to but superior to (...) Kant’s formulations of the Categorical Imperative. Chapter 5 argued that my principle’s three formulations make it rational to adopt a Moral Original Position to derive moral principles. The present chapter derives Four Principles of Fairness from the Moral Original Position--principles of coercion minimization, mutual assistance, fair negotiation, and virtue—and unifies them into a single principle of rightness: Rightness as Fairness. Finally, this chapter argues that Rightness as Fairness entails a novel approach to applied ethics called ‘principled fair negotiation’, illustrating how the theory provides a plausible new framework for addressing applied cases including lying, suicide, trolleys, torture, distribution of scarce resources, poverty, and the ethical treatment of animals. Anscombe famously argues that to act intentionally is to act under a description, and that “it is the agent's knowledge of what he is doing that gives the descriptions under which what is going on is the execution of an intention.” Further, she takes ‘knows’ to mean that the agent can give these descriptions herself. It would seem to follow that animals cannot act intentionally. However, she denies this, insisting that although animals cannot express intentions, they can have them. But (...) how can we speak without equivocation of humans and animals acting intentionally while maintaining that linguistic expressibility is an essential characteristic of only human action? The human capacity for articulation, I argue, transforms animal intention in the following way: Whereas animal intentions are immanent in their behavior, human action is an actualization of the power to make judgments about what is to-be-done; this confers on human intentions a distinctive sort of independence from behavior. Patients with advanced dementia suffer from severe cognitive and functional impairment, including eating disorders. The focus of our research is on the issue of life-sustaining treatment, specifically on the social and ethical implications of tube feeding. The treatment decision, based on values of life and dignity, involves sustaining lives that many people consider not worth living. We explore the moral approach to caring for these patients and review the history of the debate on artificial nutrition and hydration showing the impact (...) of the varying perceptions of the value of these patients' lives on changing norms. We argue that in light of the value of solidarity, decisions about life-sustaining treatment for patients with advanced dementia should be made on a case by case basis, as with any other patient, in consideration of the medical implications of the intervention which might best serve the goals of care for the individual patient. Cognitive scientists must understand not just what the mind does, but how it does what it does. In this paper, I consider four aspects of cognitive architecture: how the mind develops, the extent to which it is or is not modular, the extent to which it is or is not optimal, and the extent to which it should or should not be considered a symbol‐manipulating device (as opposed to, say, an eliminative connectionist network). Jigsaw lessons, initially developed in the 1970s by Elliot Aronson for elementary schools in the wake of desegregation, are perfect for active learning in philosophy classrooms, fostering collaboration and interdependence. This essay describes how to use jigsaw lessons in philosophy classrooms and presents, as an example, instructions and materials for a jigsaw lesson for translation using identity in first-order logic.

The new explanatory or enhanced indispensability argument alleges that our mathematical beliefs are justified by their indispensable appearances in scientific explanations. This argument differs from the standard indispensability argument which focuses on the uses of mathematics in scientific theories. I argue that the new argument depends for its plausibility on an equivocation between two senses of explanation. On one sense the new argument is an oblique restatement of the standard argument. On the other sense, it is vulnerable to an instrumentalist (...) response. Either way, the explanatory indispensability argument is no improvement on the standard one. (shrink)

Originally published in 1984, this book broke new ground in assessing Freud as both an exemplary late-Victorian and as a pivotal figure in the creation of modern thought and culture. In his close reading of various of Freud’s theoretical and clinical texts, including two of the most famous case histories, Steven Marcus uncovers the steps in the development of Freud’s thought, the dynamics and contradictions and ‘the intellectual and emotional urgings, forces and conflicts that were at work… as the (...) first original insights and discoveries that constituted the inception of psychoanalysis as a theory, discipline of inquiry, and new kind of therapy, came suddenly, often unexpectedly and without being bidden, upon Freud’. Central to Professor Marcus’ inquiry is the relationship of Freud’s work to cultural change and to the very process of disclosure, formation and construction in the transition to modernity. Freud’s writings, and the psychoanalytic discipline of which they are the foundations, are placed in the context of their contribution to modern modes of thought, and of their influence on our notions of the centres of significance of each existence as a whole. Freud and the Culture of Psychoanalysis is a major contribution to our understanding of how ideas and theories become internalized into the intellectual framework of our lives and affect the way we think about the world. By moving backward and forward from pre-Freudian to post-Freudian thinkers, Professor Marcus takes us on a journey through cultural transition that is also an exploration of how the individual interacts with his own moment in history to forge new modes of consciousness. In environmental ethics, many approaches are searching for a justification of the protection of nature and biodiversity via an account of the intrinsic or inherent value of non-human nature, i. e. a justification that does not rely on the perspective of human beings. This leads to intricate problems regarding value theory. This paper proposes to avoid those problems by investigating explicitly anthropocentric pathways. It discusses what kinds of reasons for the protection of nature can be developed from the consistent practical (...) self-understanding of agents. First, it is argued that the practical commitments of agents necessarily involve some normative commitments to the protection of the generic conditions of agency, which are particularly relevant for the ecological conditions that enable us to act and to realise goals. Second, it is discussed whether the presence of non-human nature is particularly relevant from the perspective of philosophical anthropology. Is it not important for human beings to experience non-human nature as an environment that is not fully planned and designed by human beings? The general aim is to show that it is worthwhile to search for justifications of the protection of nature and biodiversity from the practical self-understanding of human beings. (shrink)

Connectionist networks excel at extracting statistical regularities but have trouble extracting higher-order relationships. Clark & Thornton suggest that a solution to this problem might come from Elman, but I argue that the success of Elman's single recurrent network is illusory, and show that it cannot in fact represent abstract relationships that can be generalized to novel instances, undermining Clark & Thornton 's key arguments.

We sought to evaluate whether health care professionals’ viewpoints differed on the role of ethics committees and hospitals in the resolution of clinical ethical dilemmas based on practice location. We conducted a survey study from December 21, 2013 to March 15, 2014 of health care professionals at six hospitals. The survey consisted of eight clinical ethics cases followed by statements on whether there was a role for the ethics committee or hospital in their resolution, what that role might be and (...) case specific queries. Respondents used a 5-point Likert scale to express their degree of agreement with the premises posed. We used the ANOVA test to evaluate whether respondent views significantly varied based on practice location. 240 health care professionals completed the survey. Only three individual queries of 32 showed any significant response variations across practice locations. Overall, viewpoints did not vary across practice locations within question categories on whether the ethics committee or hospital had a role in case resolution, what that role might be and case specific queries. In this multicenter survey study, the viewpoints of health care professionals on the role of ethics committees or hospitals in the resolution of clinical ethics cases varied little based on practice location. In der deutschen medizinethischen Debatte spielen Verweise auf Menschenbilder eine große Rolle. Dabei haben diese Verweise ganz unterschiedliche argumentative Funktionen: Bisweilen sollen mit Bezug auf ein Menschenbild direkt moralische Normen begründet werden, aber Verweise auf Menschenbilder können auch andere Funktionen haben. Problematisch erweist sich jedoch, dass der Verweis auf ein „Bild“ vom Menschen voraussetzt, dass in einem einzigen Bild alle Aspekte, die für das Verständnis des Menschen wesentlich sind, erfasst werden können und damit die Vermittlung zwischen deskriptiven und normativen Dimensionen (...) als unproblematisch angesehen wird. Eine normative Begründungsfunktion des Menschenbildes ist jedoch aus verschiedenen moralphilosophischen Erwägungen heraus problematisch. Dagegen könnte eine Thematisierung eines umfassenden Verständnisses vom Menschen uns in der Tat helfen, metaphysische und ontologische Voraussetzungen moralischer Diskurse sichtbar und diskutierbar zu machen, die Bedingungen des menschlichen Handlungsraumes zu verstehen und das Moralische in einem weiteren Kontext praktischen Selbstverständnisses zu interpretieren. Die Mehrdimensionalität des Begriffs „Menschenbild“ lässt es fraglich erscheinen, ob der Begriff geeignet ist, medizinethische Fragen adäquat zu verstehen; zur Begründung von Handlungsnormen sind Menschenbilder eher ungeeignet. This fascinating study explores the difficulties faced by modern Westerners in their search for a meaningful life. It sheds light on this enduring cultural dilemma through a close reading of four popular film and television narratives: Pixar's animated feature film, Toy Story; Christopher Nolan's Batman Begins and The Dark Knight; the television romantic comedy, Sex and the City; and, finally, the mobster drama, The Sopranos. The readings are guided by a number of inter-related questions. First, in what ways do these (...) popular stories speak to the modern West's meaning dilemma? What do they have to say about contemporary culture, and its capacity to illuminate the fundamental human? What are the core problems faced by the central characters and how are they resolved?
