In her insightful and stimulating article, The Mind of a Moral Agent, Professor Susanna Blumenthal traces the influence of Scottish Common Sense philosophy on early American law. Among other things, Blumenthal argues that the basic model of moral agency upon which early American jurists relied, which drew heavily from Common Sense philosophers like Thomas Reid, generated certain paradoxical conclusions about legal responsibility that later generations were forced to confront. "Having cast their lot with the Common Sense philosophers in the (...) "formative era" of American law," she explains, "early republican jurists thus bequeathed to future generations of lawyers a problem of responsibility of no small proportions." In this invited comment for Law and History Review, I first argue that the problems of responsibility on which Blumenthal focuses our attention are not specific to Scottish Common Sense, but rather descend straight from the core of the Western legal and moral tradition. The same problems would arise if Common Sense philosophy had never existed. Second, even if it is true that Common Sense exerted a powerful influence on American academic life in the antebellum period, it still must be shown that this influence extended to specific features of American law, which remained at the time almost entirely the product of English common law. Blumenthal has not met this burden, however, because she does not identify any specific doctrines or judicial opinions that might support the conclusion that early American jurists "were steeped in Common Sense philosophy" or sought to construct "an indigenous legal tradition, built on the universalistic premises of Common Sense." Rather, her defense of this interesting claim is highly selective, resting mainly on the writings of Wilson and Hoffman. Third, although Blumenthal claims that there is something puzzling or paradoxical from a Common Sense perspective about the diversity of moral opinion, the existence of irrational or evil actors, or the fact that individuals often disregard the dictates of their moral sense, she does not adequately explain what exactly that paradox is, nor why Common Sense adherents should be troubled by it. Locke had made objections like these familiar as a result of his attack on innate practical principles in his Essay Concerning Human Understanding. Yet already by the eighteenth century, critics like Shaftesbury, Hutcheson, Reid, and their followers had rejected Locke's arguments as based on mere confusion and fallacy. Finally, a key point that Blumenthal neglects, as does John Witt in his elegant chapter on Wilson, is that Common Sense philosophers also supplied positive scientific arguments for innate moral knowledge, based on observation and induction rather than introspection, whose intellectual worth has proved remarkably durable. We risk misunderstanding Scottish Common Sense and its place in the history of ideas if we overlook contributions like these, or remain content to think of it merely as an unduly optimistic philosophy, which relied mainly on introspection to affirm the innate goodness of humankind, but which gave way to a more accurate theory of human nature as the nineteenth century unfolded. Certainly there is some truth to this description, but it is only part of the story, and a potentially misleading one. (shrink)

This paper defends the Content View: the thesis that all visual experiences have contents.

What do we see? We are visually conscious of colors and shapes, but are we also visually conscious of complex properties such as being John Malkovich? In this book, Susanna Siegel develops a framework for understanding the contents of visual experience, and argues that these contents involve all sorts of complex properties. Siegel starts by analyzing the notion of the contents of experience, and by arguing that theorists of all stripes should accept that experiences have contents. She then introduces (...) a method for discovering the contents of experience: the method of phenomenal contrast. This method relies only minimally on introspection, and allows rigorous support for claims about experience. She then applies the method to make the case that we are conscious of many kinds of properties, of all sorts of causal properties, and of many other complex properties. She goes on to use the method to help analyze difficult questions about our consciousness of objects and their role in the contents of experience, and to reconceptualize the distinction between perception and sensation. Siegel's results are important for many areas of philosophy, including the philosophy of mind, epistemology, and the philosophy of science. They are also important for the psychology and cognitive neuroscience of vision. (shrink)

Those who model doxastic states with a set of probability functions, rather than a single function, face a pressing challenge: can they provide a plausible decision theory compatible with their view? Adam Elga and others claim that they cannot, and that the set of functions model should be rejected for this reason. This paper aims to answer this challenge. The key insight is that the set of functions model can be seen as an instance of the supervaluationist approach to vagueness (...) more generally. We can then generate our decision theory by applying the general supervaluationist semantics to decision-theoretic claims. The result: if an action is permissible according to all functions in the set, it’s determinately permissible; if impermissible according to all, determinately impermissible; and – crucially – if permissible according to some, but not all, it’s indeterminate whether it’s permissible. This proposal handles with ease some difficult cases ) on which alternative decision theories falter. One reason this view has been overlooked in the literature thus far is that all parties to the debate presuppose that an acceptable decision theory must classify each action as either permissible or impermissible. But I will argue that this thought is misguided. Seeing the set of functions model as an instance of supervaluationism provides a compelling motivation for the claim that there can be indeterminacy in the rationality of some actions. (shrink)

In this paper, I argue that certain perceptual relations are represented in visual experience.

There is an important division in the human mind between perception and reasoning. We reason from information that we have already, but perception is a means of taking in new information. Susanna Siegel argues that these two aspects of the mind become deeply intertwined when beliefs, fears, desires, or prejudice influence what we perceive.

Evidentialists and Pragmatists about reasons for belief have long been in dialectical stalemate. However, recent times have seen a new wave of Evidentialists who claim to provide arguments for their view which should be persuasive even to someone initially inclined toward Pragmatism. This paper reveals a central flaw in this New Evidentialist project: their arguments rely on overly demanding necessary conditions for a consideration to count as a genuine reason. In particular, their conditions rule out the possibility of pragmatic reasons (...) for action. Since the existence of genuine pragmatic reasons for action is common ground between the Evidentialist and the Pragmatist, this problem for the New Evidentialist arguments is fatal. The upshot is that the deadlock between these two positions is restored: neither side can claim to be in possession of an argument that could convince the other. As it happens, I myself favor Pragmatism about reasons for belief, and although I don't claim to be able to convince a committed Evidentialist, I do make a prima facie case for Pragmatism by describing particular scenarios in which it seems to be true. I then go on to develop my own preferred version of the view: Robust Pragmatism, according to which a consideration never constitutes a reason for believing a proposition purely in virtue of being evidence for it. In discussions of perception and its relation to knowledge, it is common to distinguish what one comes to believe on the basis of perception from the distinctively perceptual basis of one's belief. The distinction can be drawn in terms of propositional contents: there are the contents that a perceiver comes to believe on the basis of her perception, on the one hand; and there are the contents properly attributed to perception itself, on the other. Consider the content.

In The Problem of Perception, A.D. Smith’s central aim is to defend the view that we can directly perceive ordinary objects, such as cups, keys and the like.1 The book is organized around the two arguments that Smith considers to be serious threats to the possibility of direct perception: the argument from illusion, and the argument from hallucination. The argument from illusion threatens this possibility because it concludes that indirect realism is true. Indirect realism is the view that we perceive (...) mind-independent ordinary objects, but can only do so indirectly, by perceiving mind-dependent objects: objects whose existence depends on being perceived or thought about. The argument from hallucination draws a similar conclusion: if we perceive mindindependent ordinary objects at all, then our perception of them is indirect in the same way. In responding to these arguments, Smith develops an account of percep- tual consciousness. Perceptual consciousness is a kind of experience, distinct from what Smith calls ‘mere sensory experiences’, or equivalently, ‘mere sensation’. Perceptual consciousness is experience that is properly percep- tual, in which one has the phenomenology of perceiving things in the external world (including one’s body) that exist independently of one’s mind. Perceptual consciousness on its own does not suffice for actually being in perceptual contact with mind-independent reality, although it suffices for it to seem as if one i s . It follows that perceptual consciousness does not suffice for direct perception of ordinary objects, or for direct realism. Nevertheless, Smith holds that the correct account of perceptual consciousness is a crucial element in blocking the arguments from illusion and hallucination, and therefore in supporting the possibility of direct perception. This is an extraordinarily engaging book. Situated in a period that witnessed the genesis of institutions that have lasted to this day, this path-breaking study looks at how ancient Christian women, particularly in Asia Minor and Egypt, initiated ascetic ways of living, and how these practices were then institutionalized. Susanna Elm demonstrates that--in direct contrast to later conceptions--asceticism began primarly as an urban movement, in which women were significant protagonists. In the process, they completely transformed and expanded their roles as wife, mother, or widow: as (...) Christian ascetics, they became `virgin wives', `virgin mothers', and `virgin widows' - with all the legal and economic implications of such a dramatic shift. As importantly, though, Christian men and women ascetics lived together. As `virgins of God' they created new families `in Christ'. No longer determined by their human bonds or human sexuality, they were `neither male nor female'. Finally, the book demonstrates how ascetic bishops - today known as saints - eventually `reformed' these early models of communal, ascetic life by dividing the `virgins of God' into monks and nuns and thus laid the foundation for the monasticism we know today. Ethical evaluation of deep brain stimulation as a treatment for Parkinson’s disease is complicated by results that can be described as involving changes in the patient’s identity. The risk of becoming another person following surgery is alarming for patients, caregivers and clinicians alike. It is one of the most urgent conceptual and ethical problems facing deep brain stimulation in Parkinson’s disease at this time. In our paper we take issue with this problem on two accounts. First, we elucidate what is (...) meant by “becoming another person” from a conceptual point of view. After critically discussing two broad approaches we concentrate on the notion of “individual identity” which centers on the idea of “core attitudes”. Subsequently we discuss several approaches to determine what distinguishes core attitudes from those that are more peripheral. We argue for a “foundational-function model” highlighting the importance of specific dependency relations between these attitudes. Our second aim is to comment on the possibility to empirically measure changes in individual identity and argue that many of the instruments now commonly used in selecting and monitoring DBS-patients are inappropriate for this purpose. Future research in this area is advised combining a conceptual and an empirical approach as a basis of sound ethical appraisal. (shrink)

Fatigue and increased fatigability occur as symptoms in almost every medical and psychiatric condition, as well as being common reactions to non pathological physical and psychological strain and stress. We will attempt to clarify the semantics of the terms "fatigue" and "fatigability", and we will put forward the hypothesis that the special kind of mental fatigability which characterises many cases of mild to moderate dysfunction of the brain is functional in a sense that it represents an overload of pathological information (...) The eighteenth-century American founders believed that religion is special and deserves special constitutional protection, and that all peaceable faiths must be drawn into the constitutional process and protection. The founders introduced six constitutional principles for the protection of religious freedom: freedom of conscience, free exercise of religion, religious pluralism, religious equality, separation of church and state, and no state establishment of religion. Since the 1940s, the United States Supreme Court has upheld these religious freedom principles in more than 170 cases, (...) albeit unevenly of late. Moreover, in recent years religious freedom has come under sharp popular and academic attack, particularly as religious pathologies have come to light and religious freedom claims have clashed with sexual liberty claims. This article calls for a return to the first principles of religious freedom for all, at home and abroad, and for a new balance between religious freedom and other fundamental rights claims. In this paper I argue that certain type of first-personal causal property, efficacy, is represented in perceptual experience.

This paper makes the case that when wishful thinking ill-founds belief, the belief depends on the desire in ways can be recapitulated at the level of perceptual experience. The relevant kinds of desires include motivations, hopes, preferences, and goals. I distinguish between two modes of dependence of belief on desire in wishful thinking: selective or inquiry-related, and responsive or evidence-related. I offers a theory of basing on which beliefs are badly-based on desires, due to patterns of dependence that can found (...) in the relationship between experiences and desires as well. This conclusion brings us a large part of the way to the conclusion that like beliefs, experiences can be ill-founded by depending on a desire. (shrink)

In this work, Professors Rosenfeld and Mancini have brought together an impressive group of authors to provide a comprehensive analysis on the greater demand for religions exemptions to government mandates. Traditional religious conscientious objection cases, such as refusal to salute the flag or to serve in the military during war, had a diffused effect throughout society. In sharp contrast, these authors argue that today's most notorious objections impinge on the rights of others, targeting practices like abortion, LGTBQ adoption, and same-sex (...) marriage. The dramatic expansion of conscientious objection claims have revolutionized the battle between religious traditionalists and secular civil libertarians, raising novel political, legal, constitutional and philosophical challenges. Highlighting the intersection between conscientious objections, religious liberty, and the equality of women and sexual minorities, this volume showcases this political debate and the principal jurisprudence from different parts of the world and emphasizes the little known international social movements that compete globally to alter the debate's terms. This book breaks new ground in our understanding of how we perceive and represent the space around us - one of the central topics in cognitive psychology. It presents a new view of development and spatial cognition by reversing the usual focus on vision and examining the evidence on representation in the total absence of vision without specific brain damage. Findings from the author's work with congenitally totally blind and with sighted children, together with studies from a wide variety of (...) other areas, are set in the context of intersensory and spatial development. Touch and movement are considered as converging sources of reference information with and without vision. The findings have important implications for future work in many fields, particularly developmental pscychology; cognition, cognitive neuroscience and visual handicap, and make this new work essential reading for students and researchers in these fields. In this paper I argue that it's possible that the contents of some visual experiences are influenced by the subject's prior beliefs, hopes, suspicions, desires, fears or other mental states, and that this possibility places constraints on the theory of perceptual justification that 'dogmatism' or 'phenomenal conservativism' cannot respect.

We are all immersed in a sea of social norms, but they are sometimes tricky to observe with any clarity. They are often invisible to us and emerge only when they are not observed. Social norms are important to understand because they are both limiting of our freedom, such as gendered and racialized norms, and at the same time the very conditions of our agency. Social Goodness presents an original, externalist answer to the question of the source or origin of (...) social role normativity. Rather than grounding social normativity in the attitudes of persons, the book argues for an externalism that roots social role normativity in the social world itself: in its positions, institutions, and larger architecture. The core insight of externalism is that the function or structural feature of an enterprise or activity can bring with it normative demands quite independently of the attitudes of those who engage with it. According to the artisanal model, just as a carpenter, ceramicist, or chef is responsive to and evaluable under a set of artisanal norms or techniques, so too is a mother and or an academic or a President. The source of normativity is this technique or expertise, independent of the preferences, endorsements, or recognitive attitudes of individuals. The artisanal model for social role normativity has resources to explain both the "stickiness" or persistence of social norms and our ability to criticize existing norms and to engage in normative self-creation--to create new normative selves. The artisanal model also has resources to capture and express the social situatedness, locality, and materiality of social roles. The relational ontology of social roles, implicit in the artisanal model, provides a useful frame to consider both hierarchical and oppressive social relations. (shrink)

I offer an explanation of how subjects are able to perceive the intrinsic spatial properties of objects, given that subjects always perceive from a particular location. The argument proceeds in two steps. First, I argue that a conception of space is necessary to perceive the intrinsic spatial properties of objects. This conception of space is spelled out by showing that perceiving intrinsic properties requires perceiving objects as the kind of things that are perceivable from other locations. Second, I show that (...) having such a conception of space presupposes that a subject represent her location in relation to perceived objects. More precisely the thesis is that a subject represents her location as the location from which she both perceives objects and would act in relation to objects were she to act. So I argue that perception depends on the capacity to know what it would be to act in relation to objects. (shrink)

Recently, the thesis that experience is fundamentally a matter of representing the world as being a certain way has been questioned by austere relationalists. I defend this thesis by developing a view of perceptual content that avoids their objections. I will argue that on a relational understanding of perceptual content, the fundamental insights of austere relationalism do not compete with perceptual experience being representational. As it will show that most objections to the thesis that experience has content apply only to (...) accounts of perceptual content on which perceptual relations to the world play no explanatory role. With austere relationalists, I will argue that perceptual experience is fundamentally relational. But against austere relationalists, I will argue that it is fundamentally both relational and representational. (shrink)

We reconstruct recent work on macrosocial stress as if it were an instance of a research strategy that tests point-alternative hypotheses within a full-fledged research program. Because this strategy is free of various deficits that beset dominant strategies, our article demonstrates one way in which the confidence crisis may be overcome.

Perception is our key to the world. It plays at least three different roles in our lives. It justifies beliefs and provides us with knowledge of our environment. It brings about conscious mental states. It converts informational input, such as light and sound waves, into representations of invariant features in our environment. Corresponding to these three roles, there are at least three fundamental questions that have motivated the study of perception. How does perception justify beliefs and yield knowledge of our (...) environment? How does perception bring about conscious mental states? How does a perceptual system accomplish the feat of converting varying informational input into mental representations of invariant features in our environment? -/- This book presents a unified account of the phenomenological and epistemological role of perception that is informed by empirical research. So it develops an account of perception that provides an answer to the first two questions, while being sensitive to scientific accounts that address the third question. The key idea is that perception is constituted by employing perceptual capacities - for example the capacity to discriminate instances of red from instances of blue. Perceptual content, consciousness, and evidence are each analyzed in terms of this basic property of perception. Employing perceptual capacities constitutes phenomenal character as well as perceptual content. The primacy of employing perceptual capacities in perception over their derivative employment in hallucination and illusion grounds the epistemic force of perceptual experience. In this way, the book provides a unified account of perceptual content, consciousness, and evidence. (shrink)

This paper defends a principle I call Equal Treatment, according to which the rationality of a belief is determined in precisely the same way as the rationality of any other state. For example, if wearing a raincoat is rational just in case doing so maximizes expected value, then believing some proposition P is rational just in case doing so maximizes expected value. This contrasts with the popular view that the rationality of belief is determined by evidential support. It also contrasts (...) with the common idea that in the case of belief, there are two different incommensurable senses of rationality, one of which is distinctively epistemic. I present considerations that favor Equal Treatment over these two alternatives, reply to objections, and criticize some arguments for Evidentialism. I also show how Equal Treatment opens the door to a distinctive kind of response to skepticism. (shrink)

Because of the intellectual attraction of the neo-Darwinian theory of evolution, its conccpts are often borrowed to conceptualized evolutionary change also in non-biological domains. However, a heuristic strategy like that is problematic. An attempt is therefore made to identify generic features of evolution which transcend domain-specific characteristics. Epistemological, conccptual, and methodological implications are discussed, and the ontological question is raised how non-biological evolutionary theories can be accommodated within the Darwinian world view of modern sciences.

Stress is increasingly being recognized as one of the main factors that is negatively affecting our health, and therefore there is a need to regulate daily stress and prevent long-term stress. This need seems particularly important for adults with mild intellectual disabilities who have been shown to have more difficulties coping with stress than adults without intellectual disabilities. Hence, the development of music therapy interventions for stress reduction, particularly within populations where needs may be greater, is becoming increasingly important. In (...) order to gain more insight into the practice-based knowledge on how music therapists lower stress levels of their patients with MID during music therapy sessions, we conducted focus group interviews with music therapists working with adults with MID from different countries and clinical institutions in Europe. Results provide an overview of the most-used interventions for stress reduction within and outside of music. Data-analysis resulted in the further specification of therapeutic goals, intervention techniques, the use of musical instruments, and related therapeutic change factors. The main findings indicate that music therapists used little to no receptive interventions for stress reduction, but preferred to use active interventions, which were mainly based on musical improvisation. Results show that three therapy goals for stress relief could be distinguished. The goal of “synchronizing” can be seen as a sub goal because it often precedes working on the other two goals of “tension release” or “direct relaxation,” which can also be seen as two ways of reaching stress reduction in adults with MID through music therapy interventions. Furthermore, the tempo and the dynamics of the music are considered as the most important musical components to reduce stress in adults with MID. Practical implications for stress-reducing music therapy interventions for adults with MID are discussed as well as recommendations for future research. (shrink)

German philosophy as it is today can best disprove the various theories of "Historical Reason." Philosophic thought seems to go its necessary way regardless of immediate historical and social situations.
