This article explores areas of law loosely within English equity and trusts law that have not conventionally been subject to feminist debate, and within the context of a discussion about feminist method. The particular areas examined are whistleblowing and trustees’ powers of investment, each of which calls for consideration of decision-making processes which have an ethical content. These sites are chosen because they take debate outside the all too familiar locations of woman or ‘the body of woman’, including the family (...) home, where feminist analysis in relation to equity and trusts tends to stray. In exploring these chosen fields, Hobby’s (Feminist Perspectives on Equity and Trusts, Cavendish Publishing, 2001, pp. 219–255) critique of gender dimensions in relation to whistleblowing and Dunn’s (Feminist Perspectives on Equity and Trusts, Cavendish Publishing, 2001, pp. 179–196) account of women trustees’ investment decisions are evaluated and developed. The debate within feminist legal criticism of the possibility of integrating an ‘ethics of care’ and an ‘ethics of rights’ is acknowledged. Whilst acknowledging of the difficulty of adopting an approach that recognises ‘mixed logics’, it is concluded that women (and men) do integrate the ethics of care and the ethics of rights in their decision-making. It is argued that the effort should be made to trace the specific weave in particular circumstances, thereby paying suspicious attention to the values that underlie courts’ analyses of ethical choices. The question posed in the title of this article requires us to indicate exactly what we mean by medieval India. Does there exist in general an Indian Middle Ages? Or rather are the Middle Ages a purely European category, and the extension of it to include India involve extrapolations that are devoid of sense?

All the languages of the world, I believe, have words to distinguish, among men, between intellectuals and manual workers: the former use their brains more than their hands; the latter use their hands more than their brains. Since the beginning of time, many men could easily be classified in one or the other of these groups (and certainly many others could fall into the intermediate zones between the two poles). For example, “ intellectuel “ and “manoeuvre“ are very old words (...) in the French language, direct heirs of Latin words designating the brain and the hand. (shrink)

Illegitimacy in a historic, single community at Penrith, Cumbria (1557–1812), has been studied using aggregative analysis, family reconstitution and time series analysis. This population was living under extreme conditions of hardship. Long, medium and short wavelength cycles in the rate of illegitimacy have been identified by time series analysis; each represents a different response to social and economic pressures. In a complex interaction of events, the peaks of the cycles in wheat prices were associated with rises in adult mortality which (...) promoted an influx of migrants and a concomitant rise in illegitimacy. The association between immigration and illegitimacy was particularly noticeable after the mortality crises of the late sixteenth and early seventeenth centuries. Children of immigrant families also tended to produce illegitimate offspring. Native and immigrant families responded differently to extrinsic fluctuations, and variations in their reproductive behaviour were probably related to access to resources. (shrink)

Heterogeneity within MDD has hampered identification of biological markers (e.g., intermediate phenotypes, IPs) that might increase risk for the disorder or reflect closer links to the genes underlying the disease process. The newer characterizations of dimensions of MDD within Research Domain Criteria (RDoC) domains may align well with the goal of defining IPs. We compare a sample of 25 individuals with MDD compared to 29 age and education matched controls in multimodal assessment. The multimodal RDoC assessment included the primary IP (...) biomarker, positron emission tomography (PET) with a selective radiotracer for 5-HT1A ([11C]WAY-100635), as well as event-related functional MRI with a Go/No-go task targeting the Cognitive Control network, neuropsychological assessment of affective perception, negative memory bias and Cognitive Control domains. There was also an exploratory genetic analysis with the serotonin transporter (5-HTTLPR) and monamine oxidase A (MAO-A) genes. In regression analyses, lower 5-HT1A binding potential (BP) in the MDD group was related to diminished engagement of the Cognitive Control network, slowed resolution of interfering cognitive stimuli, one element of Cognitive Control. In contrast, higher/normative levels of 5-HT1A BP in MDD (only) was related to a substantial memory bias toward negative information, but intact resolution of interfering cognitive stimuli and greater engagement of Cognitive Control circuitry. The serotonin transporter risk allele was associated with lower 1a BP and the corresponding imaging and cognitive IPs in MDD. Lowered 5HT 1a BP was present in half of the MDD group relative to the control group. Lowered 5HT 1a BP may represent a subtype including decreased engagement of Cognitive Control network and impaired resolution of interfering cognitive stimuli. Future investigations might link lowered 1a BP to neurobiological pathways and markers, as well as probing subtype-specific treatment targets. (shrink)

The social ecological model (SEM) is a conceptual framework that recognizes individuals function within multiple interactive systems and contextual environments that influence their health. Medical Legal Partnerships (MLPs) address the social determinants of health through partnerships between health providers and civil legal services. This paper explores how the conceptual framework of SEM can be applied to the MLP model, which also uses a multidimensional approach to address an individual’s social determinants of health.

This study examines ethics-related learning outcomes that emerged from an experience-based project in a personal selling and sales management course. Using qualitative research methods, we classified students’ experiences according to domains of ethical issues associated with personal selling and according to conceptualizations of learning identified in the education literature. Patterns we observed in our data suggest that the experience-based project encouraged learners to employ higher-order thinking about business ethics. Higher order problem-solving about ethical issues helps ensure that lessons students learn (...) about ethical decision making carry forward to their professional careers. Based on our findings, we recommend ways instructors can formulate ethics-related learning objectives, develop learning assessments that measure ethics-related learning outcomes, and design teaching and learning activities that help ensure students learn ethical concepts in a way that will carry forward to their careers. The SERVE Program at Ignatius University seeks to foster the ethical development of its participants by combining academic study of philosophy and theology with a year-long community service project. This study considered the impact of the SERVE Program upon Ignatius University students majoring in business in comparison to students pursuing majors in the liberal arts, education, and nursing. Findings from this study offer insight into the response of business students to ethical content in comparison to students pursuing degrees in other (...) disciplines. Such findings hold significant implications for business school faculty and administrators committed to the civic and ethical development of individuals pursuing careers in business and private industry. The effect of nutrition on fertility and its contribution thereby to population dynamics are assessed in three social groups (elite, tradesmen and subsistence) in a marginal, pre-industrial population in northern England. This community was particularly susceptible to fluctuations in the price of grains, which formed their basic foodstuff. The subsistence class, who formed the largest part of the population, had low levels of fertility and small family sizes, but women from all social groups had a characteristic and marked subfecundity in (...) the early part of their reproductive lives. The health and nutrition of the mother during pregnancy was the most important factor in determining fertility and neonatal mortality. Inadequate nutrition had many subtle effects on reproduction which interacted to produce a complex web of events. A population boom occurred during the second half of the 18th century; fertility did not change but there was a marked improvement in infant mortality and it is suggested that the steadily improving nutritional standards of the population, particularly during crucial periods in pregnancy (i.e. the last trimester), probably made the biggest contribution to the improvement in infant mortality and so was probably the major factor in triggering the boom. Sex-biased investment in children has been explored in a historic population in northern England, 1600 to 1800, following a family reconstitution study. An examination of the wills and other available data identified three social groups: the elite, tradesmen, and subsistence farmers. The community lived under marginal conditions with poor and fluctuating levels of nutrition; infant and child mortalities were high. Clear differences were found between the social groups, and it is suggested that the elite wetnursed their daughters whereas the elite (...) mother breast-fed her sons for only a short period and introduced supplementary feeding early. The wives of the tradesmen probably breast-fed both sexes for the same length of time. Subsistence farmers may have weaned their sons earlier than daughters. The results are discussed in terms of possible differences in investment strategies. The investment strategy of the elite group was probably male-biased but may, in practice, have favored the female offspring. (shrink)

The exogenous cycles and population dynamics of the community at Penrith, Cumbria, England, have been studied (1557-1812) using aggregative analysis, family reconstitution and time series analysis. This community was living under marginal conditions for the first 200 years and the evidence presented is of a homeostatic regime where famine, malnutrition and epidemic disease acted to regulate the balance between resources and population size. This provides an ideal historic population for an investigation of the direct and indirect effects of malnutrition. Throughout (...) the period studied, a short wavelength oscillation in grain prices was apparently the major external factor that drove exogenous cycles in mortality, birth rate, and migration. In particular, the different responses of children to variations in food supply are emphasised; fluctuations in poor nutrition correlated significantly with the variations in mortality rates for infants (probably indirectly during pregnancy and directly during the first year of life) and for young children (via susceptibility to lethal infectious diseases). Migratory movements contributed to the maintenance of homeostasis in the population dynamics. A medium wavelength cycle in low winter temperatures was associated with a rise in adult mortality which, in turn, promoted an influx of migrants into this saturated habitat. A model incorporating these interacting associations between vital events and exogenous cycles is presented: grain prices were an important density-dependent factor and constituted the major component of the negative feedback of this population and drove the exogenous, short wavelength mortality cycles. Cycles of births and immigration provide a positive feedback for the build-up of susceptibles and the initiation of smallpox epidemics and increased population size. (shrink)

ABSTRACTWe trace Susan Moller Okin’s reception of Mary Wollstonecraft with respect to the relationship between religion and feminist liberalism, by way of manuscripts housed at Somerville College, Oxford and Harvard University. These unpublished documents – dated from 1967 to 1998 – include her Somerville advising file, with papers dated from 1967 to 1979; her 1970 Oxford B.Phil. thesis on the feminist political theory of Wollstonecraft, William Thompson, and J.S. Mill; her teaching notes on Wollstonecraft originating in 1978, for her (...) course ‘Gender and Political Theory’ held at Brandeis and Stanford in the 1980s and 1990s; and her correspondence with John Rawls, dated from 1985 to 1998. A consistently secular feminist liberal, Okin had a blind spot with regard to religion, which led her to misinterpret Wollstonecraft’s theology as contradictory to her consequentialist arguments for women’s rights. Wollstonecraft virtually disappeared from Okin’s published corpus, overshadowed by the secular utilitarian feminist liberal J.S. Mill. Wollstonecraft nevertheless remained a deep philosophical source for both the method and the principle behind Okin’s distinctive brand of feminist liberalism. Okin’s reception of Wollstonecraft suggests that the fissures caused by religious conflict in modern politics have not only generated multiple liberalisms, as Rawls argued, but also multiple feminist liberalisms. Suggestions for future scale development are also provided.

Those who advocate higher out-of-pocket spending, especially high deductibles, to keep health care costs better controlled without losing quality use market language to talk about how people should think about health care. Consumers—that is, patients—should hunt for bargains. Clip coupons. Shop around. Patients need to have more “skin in the game.” Consumer-patients will then choose more carefully and prudently and use less unnecessary health care. Unfailingly, “skin” refers to having money at stake. Usually, those arguing for high deductibles express (...) dismay or frustration that patients do not face the full cost of the health services they receive. Unfortunately, a lack of price transparency, the need to unbundle bundled groups of services to discover total price, and the challenge of validly and reliably measuring and disclosing quality make shopping for health care a challenge for even the savviest patient. Urgency, fear, and sickness that impairs peak cognitive function and other aspects of emotionally laden decision-making, even when “shared” with a physician, add obstacles to coupon clipping and tire kicking. Who has more at stake in health decisions than patients? Whose flesh is literally, not just figuratively, at risk? (shrink)

Inextricably intertwined with song itself in the context of the aristocratic feast, meat-eating in excess becomes a weapon of the Suitors in (...) Ithaca as part of a three-year effort “literally to eat Odysseus’ house to ruin” (xi). In the “Otherworld” through which Odysseus and his Companions venture, meat and meat-eating are further problematized: there is too much or not enough of it; what they come across is forbidden; one may become meat oneself, filling the belly of another.This book traces the theme of meat in the Odyssey through a series of case studies that reveal a web of associations between Odysseus’ account of his adventures in the Otherworld and the poet’s account of events in Ithaca. Using a variety of approaches (narratological, folkloric, anthropological, philological), Bakker investigates the numerous “paradigmatic relationships” existing between the “matrix narrative” of the Odyssey, the aoide\, and the epos, the “embedded utterance” or part of the poem narrated by Odysseus himself (3). The theme of meat also allows Bakker to bring the related topics of dining and hospitality, sacrifice and hunting to bear on his exploration of the interconnections, thematic and linguistic, of the aoide\ and the epos. Although this book is weakest where Bakker roams farthest from meat, it nevertheless contains some choice cuts. In particular, he provides fascinating analyses of the Cyclops and Circe episodes and of hunting in the Otherworld (chaps. 4 and 5).We must begin with the “Epilogue: On ‘Interformularity,’” because, for passionate advocates of a particular school of thought on the composition of Homeric poetry, understanding Bakker’s approach to repetitions and allusions within the Odyssey is a prerequisite for accepting the claims he makes throughout the preceding chapters. Bakker favors an approach to the Homeric poems that involves the integration of intertextuality and orality, which he terms “interformularity.” Rather than randomly repeated traditional formulas, Bakker suggests that the repetitions and allusions within the Homeric poems are the result of “a poet’s judgment as to the (degree of) similarity between two contexts” (159). In other words, Bakker argues for meaningful repetition. Situations and similarity of situations determine the appropriate utterance; when similar situations evoke the same utterance or the same utterance gives rise to a similar situation, the language of the utterance becomes formulaic. In the first chapter, Bakker defines and describes, as noted above, the epos and aoide\ of the Odyssey and makes two crucial points regarding the relationship between these on which much of his overall argument depends: first, epic is itself a ravening genre insatiable in its swallowing up of so-called “minor” genres; and, thus, second, the epos does not occupy a secondary position vis-à-vis the aoide\, but “competes with its ‘container,’ shaping the narrative tension within the Odyssey” (3).The second chapter is concerned more with structure than with meat. Ethical sensitivity triggers the entire ethical decision-making process (i.e., recognition of ethical content in work situations). In this article, five factors are examined that affect tax practitioners' professional ethical sensitivity. The five factors that were examined include role conflict, role ambiguity, job satisfaction, professional commitment, and ethical orientation. Ethical content in work situations is examined in relation to professional ethics as enumerated by the American Institute of Certified Public Accountant's (AICPA) Statements on Responsibilities in Tax Practice (SRTP). Utilizing Hunt (...) and Vitell's (1986, 1993) General Theory of Ethics, a model of ethical sensitivity was constructed and empirically tested. Role conflict negatively and job satisfaction positively influenced tax practitioners' ethical sensitivity. Also, the covariates of the tax practitioner's professional risk level and type of employer were found to be significant. The significant factors are job specific. The tax firm may have the best opportunity to positively change a tax practitioner's ethical recognition abilities. Professional accounting organizations may need to evaluate if resources should be used to formulate, maintain, and publicize codes of conduct because of the lack of significance of professional commitment. Whereas for the three million years during which he had to provide for his needs exclusively through hunting, fishing (...) and gathering, his progress was extremely slow, the adoption of a new way of life based on agriculture and animal husbandry allowed man to transform himself in less than twelve thousand years from deer hunter into astronaut. Joan Scott’s ‘fantasy echo’ is deployed to analyse the trope of the mother/daughter relationship in contemporary laments about feminism’s failures, exemplified by Susan Faludi’s ‘American Electra: Feminism’s Ritual Matricide’ (2010). I demonstrate that Faludi’s primary argument – that young feminists do not respect the generations that precede them and therefore halt feminist progress – unreflectively relies upon a feminist maternal fantasy and ignores the prominent role spectacle culture plays in the circumscription of contemporary feminism. Building upon Scott’s (...) attention to literature to interrupt fantasy echoes and their inert visions of how feminism should appear, the article interprets The Portrait of a Lady (1908) through the tools of Scott’s historiography. I argue that Henry James’s novel, focused on an American ‘New Woman’, is an early account of how young women are sold fantasies of feminist freedom through spectacle culture and troubles the assumption that older women only forge benevolent relationships with younger women out of generosity. Do contemporary big-budget blockbuster films like Gravity move something in us that is fundamentally the same as what avant-garde and experimental films have done for more than a century? In a powerful challenge to mainstream film theory, Cinema's Bodily Illusions demonstrates that this is the case. Scott C. Richmond bridges genres and periods by focusing, most palpably, on cinema's power to evoke illusions: feeling like you're flying through space, experiencing 3D without glasses, or even hallucinating. He argues that cinema (...) is, first and foremost, a technology to modulate perception. He presents a theory of cinema as a proprioceptive technology: cinema becomes art by modulating viewers' embodied sense of space. It works primarily not at the level of the intellect but at the level of the body. Richmond develops his theory through examples of direct perceptual illusion in cinema: hallucinatory flicker phenomena in Tony Conrad's The Flicker, eerie depth effects in Marcel Duchamp's Anémic Cinéma, the illusion of bodily movement through onscreen space in Stanley Kubrick's 2001, Godfrey Reggio's Koyaanisqatsi, and Alfonso Cuarón's Gravity. In doing so he combines insights from Maurice Merleau-Ponty's phenomenology of perception and James J. Gibson's ecological approach to perception. The result is his distinctive ecological phenomenology, which allows us to refocus on the cinema's perceptual, rather than representational, power. Arguing against modernist habits of mind in film theory and aesthetics, and the attendant proclamations of cinema's death or irrelevance, Richmond demonstrates that cinema's proprioceptive aesthetics make it an urgent site of contemporary inquiry.
