The focus of this article is the analysis of generative mechanisms, a basic concept and phenomenon within the metatheoretical perspective of critical realism. It is emphasized that research questions and methods, as well as the knowledge it is possible to attain, depend on the basic view – ontologically and epistemologically – regarding the phenomenon under scrutiny. A generative mechanism is described as a trans empirical but real existing entity, explaining why observable events occur. Mechanisms are mostly possible to grasp only (...) indirectly by analytical work, based however on empirical observations. In order to achieve such an explanatory analysis, five methodological steps are suggested and discussed, among them abduction and retroduction. These steps are illustrated throughout by examples drawn from empirical research regarding social work practice. The article is concluded with a discussion of the need for knowledge of generative mechanisms. (shrink)

This book evaluates the widespread preference in philosophy of mind for varieties of property dualism over other alternatives to physicalism. It takes the standard motivations for property dualism as a starting point and argues that these lead directly to nonphysical substances resembling the soul of traditional metaphysics. In the first half of the book, the author clarifies what is at issue in the choice between theories that posit nonphysical properties only and those that posit nonphysical substances. The crucial question, he (...) argues, is whether one posits nonphysical things that satisfy an Aristotelian-Cartesian independence definition of substance: nonphysical things that could exist in the absence of anything else. In the second half, the author argues that standard and Russellian monist forms of property dualism are far less plausible than we usually suppose. Most significantly, the presuppositions of one of the leading arguments for property dualism, the conceivability argument, lead by parity of reasoning to the view that conscious subjects are nonphysical substances. He concludes that if you posit nonphysical properties in response to the mind-body problem then you should be prepared to posit nonphysical substances as well. Mainstream philosophy of mind must take nonphysical substances far more seriously than it has done for the best part of a century. The article analyses the common notion that the consumer society is a reflection of those principles in the market that also provide the ideas of democracy and liberal constitutionalism with legitimacy in the political realm. The inalienable right to self-development and self-determination makes the individual the starting and ending point of life, rendering all spheres of market and society a ‘republic of choice’. But if consumer society shares the essentials of liberal constitutionalism and the rational, processual nature of democratic representation, (...) then its ontology needs to be investigated for the same reason and in the same manner as legal and political philosophy dissects the legitimacy and validity of the parliamentary institutions of modern democracy. Just as in the political philosophy of the constitutional structure of the democratic state, the question of who is sovereign is key to understanding the ontology of consumer society. But rather than simply placing sovereignty into the hands of the independent, self-determined consumer, the earliest ontologists of the consumer society took recourse to medieval political theology and presented the consumer market as a new corpus mysticum. Thus, it is medieval political theology, not modern liberal thought, which provided for an ontologization of the consumer. This, in turn, directly pertains to the questions of the legitimacy of consumer society per se, of consumer decisions in particular and of their sources of legitimacy. (shrink)

Austrian economics focuses on markets but has much to say about organizations. In particular, Austrian insights on the structure of production, the heterogeneity and subjectivity of resources, the nature of uncertainty, the role of monetary calculation, and the function of the entrepreneur provide solid foundations for a distinctly Austrian theory of organizations. This chapter reviews these insights, discusses recent literature on Austrian economics and the theory of the firm, and suggests new directions for developing and extending an Austrian approach to (...) organizations. In doing so it answers the following questions: Why, do organizations, large and small, emerge and persist? How do they avoid the problem of economic calculation faced by socialist economies? Why do organizations take the shapes they do, why do their characteristics vary over time and across industries, and why do they succeed or fail? Are most organizations stable over time, or do organizations, like markets, adapt and learn? and How do entrepreneurs arrange assets and manage individuals within organizations? (shrink)

German law is commonly assumed to be strongly influenced by legal scholarship. This was certainly true in the past, and this article explores whether it is still the case today. But what is actually meant by ‘influence’ in the context of law? Who exerts it on whom, and how? These questions are analysed in the first part of the article. It is then shown, by drawing on biographical material, legislative history and case law, how legal scholarship contributes to both the (...) legislative and the judicial lawmaking process in Germany—and where it does not. Finally it is asked how the specific relationship between legal academics and lawmakers in the German legal system can be explained and whether this model can be transferred to other systems. We share the authors' general approach to the study of perception and action, but rather than singling out a particular level of “late perceptual” and “early motor” processing for sensorimotor interactions, we argue that these can arise at multiple levels during action preparation and execution. Recent data on action-perception transfer are used to illustrate this perspective.

States of emergency are declared frequently in all parts of the world. Their declaration routinely implies a suspension of basic constitutional rights. In the last half century, it has become the norm for constitutions to contain an explicit ‘emergency constitution’, i.e., the constitutionally safeguarded rules of operation for a state of emergency. In this paper, I ask whether inclusion of an emergency constitution can be legitimized by drawing on social contract theory. I argue that there are important arguments, both against (...) and in favor of constitutionalized emergency provisions, and that social contract theory—as applied by economists—can be of some help when deciding whether to have, or not to have an emergency constitution. This paper introduces a novel argument for justifying emergency constitutions. It argues that they can serve as a commitment mechanism protecting both citizens and politicians from overreacting to rare but significant threats. (shrink)

Elected politicians—legislators and, in some systems, members of the executive—can choose to exercise authority themselves or to delegate that authority to any number of agencies. Such delegation of power can occur at the constitutional stage, but is most common at the post-constitutional stage. Two categories of delegation can be distinguished: domestic delegation to agencies within the legislators’ jurisdiction, and international delegation to supranational or international bodies. While some research has been done on domestic delegation, especially in the context of delegation (...) to administrative agencies in the U.S., as well as on delegation to supranational bodies, especially with regard to the E.U., these activities have not been analyzed within a unified framework. This paper attempts to inquire into these issues and provide a general picture of the decision-making process regarding whether to delegate authority and to which body to transfer the authority. The past decade has been a period of rapid change in Central and Eastern Europe. Almost all of these countries have either passed entirely new constitutions or substantially modified the old ones. This is a unique situation in which constitutional delegation of powers can be performed almost simultaneously with post-constitutional delegation. The constitutional process in Israel is very different. It has been underway for fifty years. However, it can also be characterized by simultaneous constitutional and post-constitutional choices. In this paper, we examine such delegation choices in nine countries. We describe the main differences among these countries with regard to delegation of power, try to trace their origins and analyze their effects on delegation of powers. One question raised is what are the ramifications of a quasi-simultaneous constitutional and post-constitutional choice? Have constitutional rules been chosen in anticipation of the necessary compatibility with the rules of international organizations that one wants to join? Has membership in international organizations led to a boost in credibility of those governments concerned? (shrink)

Spatestens seit dem emotional turn in den Kulturwissenschaften zu Anfang dieses Jahrhunderts ist die Leibphanomenologie von Hermann Schmitz kein Geheimtipp mehr. Die Zahl der Studien, die sich mit ihr auseinandersetzen, ist heute kaum uberschaubar. Der Band versucht nach knapp einem halben Jahrhundert Wirkungsgeschichte eine Art Zwischenbilanz zu ziehen. Er fragt, inwiefern und in welchen Kontexten sich die von Schmitz erarbeiteten Kategorien des eigenleiblichen Spurens bewahrt haben. Die Beitrage erortern die gespurte Leiblichkeit in ihrer Verflechtung mit Sachverhalten wie Geschichte, Kultur, Person, (...) Geschlecht sowie als Aktionsfeld leiblicher Kommunikation und zeugen davon, dass das von Schmitz begonnene Projekt uber die Philosophie hinaus auch von anderen Wissenschaften stetig erganzt und weiterentwickelt wird. Vor dem Hintergrund eines sich am Leitmodell des sicht- und tastbaren Korpers orientierenden Denkens konnten sprachliche Ausdrucke fur leibliches Erleben nur als Skandal der Metapher (Strub) begriffen werden. Die Leibphanomenologie bietet dagegen einen alternativen Zugang, dem aber der Korper, wie Schmitz sagt, zum Skandal wird. Diesem schwierigen Verhaltnis von Leib und Korper geht der Band nach, um das Skandalose theoretisch einzuholen. Zusammenfassung Oftmals wird Fairness mit einer ethischen Haltung in Verbindung gebracht. Demnach ist ein Sportler fair, wenn er aufgrund bestimmter moralischer Einsichten handelt. Diese Vorstellung ist kaum empirisch nachprüfbar. Andere, nichtethische Motive können stattdessen für die Individuen handlungsleitend sein. Nimmt man als Extremfall rein egoistische Handlungsmotive der Individuen an, lässt sich dann noch faires Verhalten beobachten? Dieser Frage wird im vorliegenden Aufsatz nachgegangen. Aufbauend auf einer Kritik deontologischer Konzeptionen von Fairness, wird ein utilitaristischer Ansatz entwickelt, der faires Verhalten als wechselseitige (...) Kooperation versteht. Auf Grundlage dieses Ansatzes werden Bedingungen herausgearbeitet, unter denen faires Handeln im Sport erwartbar wird. Zugleich zeigt sich, dass sich aus einer Fairnesskonzeption als wechselseitige Kooperation deutlich mehr Maßnahmen zur Förderung von Fair Play im Sport ableiten lassen. (shrink)

Quantum mechanics of a particle in an infinite square well under the influence of a time-dependent electric field is reconsidered. In some gauge, the Hamiltonian depends linearly on the momentum operator, which is symmetric but not self-adjoint when defined on a finite interval. In spite of this symmetric part, the Hamiltonian operator is shown to be self-adjoint. This follows from a theorem by Kato and Rellich which guarantees the stability of a self-adjoint operator under certain symmetric perturbations. The result, which (...) has been assumed tacitly by other authors, is important in order to establish the equivalence of different Hamiltonian operators related to each other by quantum gauge transformations. The article analyses practices, perceptions and political dramatizations of bone marrow donation in Cyprus. Based on empirical data from an ethnographic study on practices of organ and bone marrow transplantation in postcolonial Cyprus, forms of oppositional biopolitics are analysed that are not bound by the modern, étatist regime of governing populations but capitalize on new developments in biomedicine, on new political movements, as well as on transformations in the political sphere. These reconfigurations are interpreted as instances of an emerging bio-subpolitics (...) that transcends national borders and produces new complexities, interrelations, associations and social forms that come into being alongside biomedicine. At the same time, these developments co-produce cosmopolitan citizens and new subjectivities, transcending nationally bound regimes of political deliberation and identification. These forms of biopolitics mobilize local historical experiences and take advantage of affordances provided by biomedical platforms operating on a global scale that make available an opportunity structure for a cosmopolitan bio-subpolitics. This chapter discusses Wittgenstein's early account of intentionality in his Tractatus Logico‐Philosophicus as a sophisticated attempt to avoid Sellars's dilemma for relationist theories of thought. Wittgenstein suggests that a picture also includes a “pictorial relationship” to what it depicts. This pictorial relationship “consists of the correlations of the picture's elements with things”. While the picture theory goes a long way towards providing a general account of intentionality in terms of linguistic representation and does so in a way that prima facie (...) avoids both horns of Sellars's dilemma for relationist theories of thought, on closer scrutiny, the early Wittgenstein does not seem to be entirely successful at meeting either of these explanatory goals. The idea of a pictorial relationship between thought and language on the one hand and states of affairs on the other is an essential element of the Tractarian explanation of how thought and language reach “right out to reality”.
