Der Band dokumentiert eine Tagung, die sich am 11. und 12.10.2011 in der Carl Friedrich von Siemens Stiftung dem Umgang der deutschen Staatsrechtslehre mit Hans Kelsen (1881-1973) gewidmet hat. Funf diskursleitende Annaherungsweisen wurden fur ein Urteil uber Rezeption und Rejektion von Lehre und Person Kelsens in der und durch die deutsche Staatsrechtslehre gewahlt: Kelsen als Diskurspartner wahrend der Weimarer Zeit, Kelsen als Stein des Anstosses in den ersten Jahrzehnten der bundesrepublikanischen Staatsrechtslehre, Kelsen durch die autobiographische Brille herausragender Nachkriegsstaatsrechtslehrer, die Wiederentdeckung (...) Kelsens seit Mitte der Achtziger Jahre sowie der heutige Umgang der Staatsrechtslehre mit einem ihrer Klassiker. Equal Justice explores the role of the idea of equality in liberal theories of justice. The title indicates the book’s two-part thesis: first, I claim that justice is the central moral category in the socio-political domain; second, I argue for a specific conceptual and normative connection between the ideas of justice and equality. This pertains to the age-old question concerning the normative significance of equality in a theory of justice. The book develops an independent, systematic, and comprehensive theory of equality (...) and egalitarianism. The principal question is about the importance of equality in a theory of justice. More precisely, we should pose questions in four contracting circles: 1. Is justice the supreme value guiding our setup of the basic structure of society, or are there other, equally important values, such as recognition, care, communal belonging? 2. If justice is the highest guiding principle, which competing ideals—especially equality and freedom—ought to have precedence in a policy oriented toward justice? What status does the ideal of equality have in that framework? 3. If equality is a basic ideal of just policy, how should it be practically realized? What sort of equality (equal opportunity, equality of welfare, resource equality) should be demanded? 4. What patterned distribution of which specific goods does the ideal of equality demand? Which principles of distribution can be justified according to our justice ideal? To conclude and summarize: 5. What is the essential core of an egalitarian theory of justice, as opposed to an inegalitarian theory? These five questions structure the work’s order of argumentation. Part A elaborates the conceptual foundations and basic moral principles of justice and equality. Chapter I sets out to install justice as the central moral category in the socio-political domain. At the beginning of the first chapter, the conceptual foundations of justice are clarified. While not eliminating the classical distinctions between different forms of justice, I argue that the distributive paradigm is of primary importance. The primacy of justice in the socio-political domain is developed out of a confrontation with alternative positions, those which maintain either that justice generally, or distributive justice in particular, are subsidiary virtues. At the end of Chapter I, the first of the questions mentioned above is answered in a way that establishes justice as the guiding normative concept for the foundation and evaluation of any social order. To clarify the role of equality in a theory of justice, Chapter II separates the idea of equality into four different principles. They are organized in a way that begins with the most general and uncontroversial principle of equality, and progresses towards increasingly detailed and contested principles. There are two theses that articulate and defend the significance of equality for justice: First there is a conceptual connection between justice and equality, in that principles of formal and proportional equality are necessary in order to explicate the concept of justice. These two principles establish an unbreakable bond between justice and equality. Justice can only be explained—or so I argue—by reference to these and other (normative) principles of equality. The second thesis posits a normative relationship between justice and equality, which is disclosed by three substantive principles of equality: moral equality, the presumption of equality, and the principle of responsibility. I argue that the normative core of an egalitarian theory of justice is expressed by the latter two principles, which are themselves based on the first principle, that of moral equality. When we view one another as persons, what form of equality or equal treatment is normatively demanded? I argue that the answer to this question is given by the procedural principle of the presumption of equality: regardless of their apparent differences, all persons deserve strictly equal treatment, unless certain kinds of differences have whatever particular relevance would justify, on generally acceptable grounds, unequal treatment or unequal distribution. The justification of the presumption of equality is central to this work and has considerable importance. If the presumption principle’s validity can be justified by enlisting the principle of general justification, then the primacy of equality, and the essential argument for an egalitarian theory of justice, is established. This would likewise provide a procedure for the construction of a material theory of justice. The second question is answered thereby at the end of Chapter II: Equality should have primacy over competing ideals within a justice-oriented policy. The presumption of equality establishes this primacy and, at the same time, offers an appropriate metric and guideline for the construction of a material theory of distributive justice. The presumption of equality in Part B offers an elegant procedure for the development of a theory of distributive justice. Chapter III clearly sets out the necessary prerequisites that a theory of distribution must satisfy in order to determine a liberal-egalitarian distributional framework. We need to specify in which situation the distribution takes place; which goods are and are not to be distributed; in which respect the presumptive equality is to be produced; and by and to whom, and for what period, the relevant goods are to be distributed. The distribution is based on resources understood as general-purpose means. It is necessary to divide goods into different categories, since the justification for unequal treatment in one domain will not carry over into another. This makes presumptive equality necessarily complex. To that end, four spheres of justice are distinguished: (1) the political sphere, which involves allocating rights through the distribution of civil liberties; (2) the democratic sphere, in which political power and the rights of political participation are regulated; (3) the economic sphere, in which income and property are distributed; (4) the social sphere, in which social positions and opportunities are distributed. This framework of distributive justice answers the third of our guiding questions, about the nature of equality, in terms of equality of resources. Chapters IV and V set out the egalitarian distributive criteria for each sphere. I argue that the generally accepted, fundamental rights of classical liberalism are more effectively reconstructed by reference to the equal resource distribution presumptively required in those spheres. Chapter IV shows that when it comes to the first two spheres, those involving basic rights and freedoms and entitlement political participation, there can be no justified exceptions to the equal distribution of the relevant goods. That section argues, contrary to what we commonly find in theories of freedom or popular sovereignty, that the value of freedom and self-determination as the political basis of autonomy is best realized through the presumption of equal distribution. Chapter V deals with the other two spheres, those of economic goods and social positions, and argues for justified exceptions to equal distribution. In the economic sphere we find one principal reason favouring unequal distribution of resources, and three restrictions and compensations limiting that inequality. The basic exception to equal economic distribution arises from the unequal consequences of personal responsibility. From a suitably egalitarian standpoint, the principle of responsibility is the normative principle that determines which reasons justify economic inequality. Here the basic idea is that unequal shares of social goods are fair if they result from the choices and deliberate actions of the relevant parties. That individuals have to bear the costs of their own choices is a condition of autonomy. However, benefits or disadvantages arising from arbitrary and unmerited differences in social circumstances or natural endowments is unfair. The unequal consequences of independent decision-making and action must therefore be limited by compensating first for preferences, secondly for disadvantages, and thirdly by redistributing wealth in aid of the worse-off. I situations of emergency, compensating for disadvantages has priority over all other claims, owing to the urgency of the situation. Social inequalities go beyond the permissible limit if it is possible to improve the long-term social or economic situation of the worse-off by redistributing wealth to them. These exceptions lead to a complex system of free economic action within a framework of compensatory tax and transfer mechanisms. Finally, in the social sphere, the distribution of social positions, offices and opportunities must be structured to ensure that equally talented and motivated citizens have roughly equal chances of obtaining those offices or positions, irrespective of their economic or social class backgrounds. This compromise is permissible for reasons of freedom and prudence, and it makes a certain measure of inequality acceptable. The fourth of our guiding questions is answered accordingly. There are five principles of justice for the basic structure of society, and five legal principles that govern the special distribution of goods in the respective spheres—all are ranked according to their most defensible grounds of priority, ensuring that everyone is accorded equal justice. Chapter VI recapitulates the initial question of equality’s value. The conception of equal justice developed in this work postulates five principles of equality and five principles of law; these constitute an egalitarian framework because they support and promote social justice. Equality has value with respect to them, but is not given any independent, intrinsic value. That is why I call the account developed here a form of constitutive egalitarianism: justice is realized through the realization of equality, itself accomplished by applying the five postulates of equality and five distributive principles of law. This is an egalitarianism on two levels. The first level is involves the claim that morality or justice is conceptually connected with equality. The second level gives equality a substantial weight in what is conceptually validated at the first level, namely the presumption of equality, and constructs an appropriate interpretation and conception of distributive justice through principles of distribution for the individual spheres. The weight and importance of equality is shown by the distributive criteria applied to those spheres. This answers our final guiding question about the nature of an egalitarian theory. (shrink)

The entropy-reduction hypothesis claims that the cognitive processing difficulty on a word in sentence context is determined by the word's effect on the uncertainty about the sentence. Here, this hypothesis is tested more thoroughly than has been done before, using a recurrent neural network for estimating entropy and self-paced reading for obtaining measures of cognitive processing load. Results show a positive relation between reading time on a word and the reduction in entropy due to processing that word, supporting the entropy-reduction (...) hypothesis. Although this effect is independent from the effect of word surprisal, we find no evidence that these two measures correspond to cognitively distinct processes. (shrink)

In der Auseinandersetzung mit Nietzsches Kritik der Menschenwürde nimmt dieses Buch zugleich Stellung zur aktuellen Diskussion. Wie ist die gegenwärtige Norm der Menschenwürde, wie sie auch im Grundgesetz enthalten ist, vor dem Hintergrund der Theorien des vehementen Moralkritikers Nietzsche einzuschätzen? Welchen Stellenwert hat die Würde des Menschen im Zeitalter des Posthumanismus überhaupt? Im ersten Teil skizziert der Autor zunächst die wichtigsten philosophischen Konzeptionen der Menschenwürde von Cicero bis Kant. Dabei macht er deutlich, welche Probleme die gegenwärtige Rezeption historischer Konzeptionen aufwirft. (...) Der zweite Teil ist der ausführlichen Darstellung von Nietzsches Kritik der Menschenwürde gewidmet. I argue that difference-making should be a crucial element for evaluating the quality of evidence for mechanisms, especially with respect to the robustness of mechanisms, and that it should take central stage when it comes to the general role played by mechanisms in establishing causal claims in medicine. The difference- making of mechanisms should provide additional compelling reasons to accept the gist of Russo-Williamson thesis and include mechanisms in the protocols for Evidence- Based Medicine (EBM), as the EBM+ research group (...) has been advocating. Previous studies suggest in line with dual process models that interoceptive skills affect controlled decisions via automatic or implicit processing. The “framing effect” is considered to capture implicit effects of task-irrelevant emotional stimuli on decision-making. We hypothesized that cardiac awareness, as a measure of interoceptive skills, is positively associated with susceptibility to the framing effect. Forty volunteers performed a risky-choice framing task in which the effect of loss versus gain frames on decisions based on identical information was assessed. The results (...) show a positive association between cardiac awareness and the framing effect, accounting for 24% of the variance in the framing effect. These findings demonstrate that good interoceptive skills are linked to poorer performance in risky choices based on ambivalent information when implicit bias is induced by task-irrelevant emotional information. These findings support a dual process perspective on decision-making and suggest that interoceptive skills mediate effects of implicit bias on decisions. (shrink)

In this paper I offer an anti-Humean critique to Williamson and Russo’s approach to medical mechanisms. I focus on one of the specific claims made by Williamson and Russo, namely the claim that micro-structural ‘mechanisms’ provide evidence for the stability across populations of causal relationships ascertained at the (macro-) level of (test) populations. This claim is grounded in the epistemic account of causality developed by Williamson, an account which—while not relying exclusively on mechanistic evidence for justifying causal judgements—appeals nevertheless to (...) mechanisms, and rejects their anti-Humean interpretation in terms of capacities, powers, potencies, etc. By using (and expanding on) Cartwright’s basic critique against Humean mechanisms, I suggest that, in order to move beyond the level of plausibility, Williamson and Russo’s position is in need of a clarification as to the occurent reading of the components, functioning and interferences of mechanisms. Relatedly, as concerns Williamson’s epistemic account of causation, I argue that this account is in need of a more straightforward answer as to what truth-makers its causal claims should have. Research on patients with damage to ventromedial frontal cortices suggests a key role for emotions in practical decision making. This field of investigation is often associated with Antonio Damasio’s Somatic Marker Hypothesis—a putative account of the mechanism through which autonomic tags guide decision making in typical individuals. Here we discuss two questionable assumptions—or ‘myths’—surrounding the direction and interpretation of this research. First, it is often assumed that there is a single somatic marker hypothesis. As others have noted, however, Damasio’s ‘hypothesis’ (...) admits of multiple interpretations (Dunn et al. [2006]; Colombetti [2008]). Our analysis builds upon this point by characterizing decision making as a multi-stage process and identifying the various potential roles for somatic markers. The second myth is that the available evidence suggests a role for somatic markers in the core stages of decision making, that is, during the generation, deliberation, or evaluation of candidate options. On the contrary, we suggest that somatic markers most likely have a peripheral role, in the recognition of decision points, or in the motivation of action. The pivotal role of the relation part-of in the description of living organisms is widely acknowledged. Organisms are open systems, which means that in contradistinction to mechanical artifacts they are characterized by a continuous flow and exchange of matter. A closer analysis of the spatial relations in biological organisms reveals that the decision as to whether a given particular is part-of a second particular or whether it is only contained-in the second particular is often controversial. We here propose a rule-based (...) approach which allows us to decide on the basis of well-defined criteria which of the two relations holds between two anatomical objects, given that one spatially includes the other. We discuss the advantages and limitations of this approach, using concrete examples from human anatomy. (shrink)

In a recent paper, Philip Kremer proposes a formal and theory-relative desideratum for theories of truth that is spelled out in terms of the notion of ‘no vicious reference’. Kremer’s Modified Gupta-Belnap Desideratum (MGBD) reads as follows: if theory of truth T dictates that there is no vicious reference in ground model M, then T should dictate that truth behaves like a classical concept in M. In this paper, we suggest an alternative desideratum (AD): if theory of truth T dictates (...) that there is no vicious reference in ground model M, then T should dictate that all T-biconditionals are (strongly) assertible in M. We illustrate that MGBD and AD are not equivalent by means of a Generalized Strong Kleene theory of truth and we argue that AD is preferable over MGBD as a desideratum for theories of truth. On the basis of an earlier contribution to the philosophy of computer science by Amnon Eden, this essay discusses to what extent Eden’s ‘paradigms’ of computer science can be transferred or applied to software engineering. This discussion implies an analysis of how software engineering and computer science are related to each other. The essay concludes that software engineering can neither be fully subsumed by computer science, nor vice versa. Consequently, also the philosophies of computer science and software engineering—though related to (...) each other—are not identical branches of a general philosophy of science. This also implies that not all of Eden’s earlier arguments can be directly mapped from the domain of computer science into the domain of software science. After the discussion of this main topic, the essay also points to some further problems and open issues for future studies in the philosophy of software science and engineering. (shrink)

Let us by ‘first-order beliefs’ mean beliefs about the world, such as the belief that it will rain tomorrow, and by ‘second-order beliefs’ let us mean beliefs about the reliability of first-order, belief-forming processes. In formal epistemology, coherence has been studied, with much ingenuity and precision, for sets of first-order beliefs. However, to the best of our knowledge, sets including second-order beliefs have not yet received serious attention in that literature. In informal epistemology, by contrast, sets of the latter kind (...) play an important role in some respectable coherence theories of knowledge and justification. In this paper, we extend the formal treatment of coherence to second-order beliefs. Our main conclusion is that while extending the framework to second-order beliefs sheds doubt on the generality of the notorious impossibility results for coherentism, another problem crops up that might be no less damaging to the coherentist project: facts of coherence turn out to be epistemically accessible only to agents who have a good deal of insight into matters external to their own belief states. In this paper, I examine the question of the scope of justice, in a not unusual distributive, egalitarian, and universalistic framework. Part I outlines some central features of the egalitarian theory of justice I am proposing. According to such a conception, justice is – at least prima facie – immediately universal, and therefore global. It does not morally recognize any judicial boundaries or limits. Part II examines whether, even from a universalistic perspective, there are moral or pragmatic grounds for rejecting (...) or limiting the global scope of justice. In particular, I scrutinize five universalistic objections: (1) the principle of “moral division of labor”; (2) the connection between cooperation and distributive justice; (3) the primacy of democracy; (4) the dangers of a world state; and (5) political‐pragmatic reasons. I intend to show that these objections cannot undermine the strong normative claims of global justice. At the most, political‐pragmatic reasons speak in favor of initially striving for somewhat less, in order to receive more general backing. (shrink)

The article is mainly based on Tadeusz Czeżowski’s publication – “Metaethical considerations”, prepared to be printed but never published. This publication, however, is not a handbook of classical metaethics but a kind of generalization of ethical theories ordering in a way, all known until now ethical systems within philosophy. Thus, Czeżowski does not offer his metaethics as a section of traditional ethics but also as a kind of generalization of all ethics until now, and therefore, all systems worked out within (...) itself. In its essence “Metaethical considerations” is the concept of scientific ethics, regardless of anything that does not pass verification, subject of which are e.g. empirical science research results. „Ruch Filozoficzny” and the freedom of scientific research in Poland (in 1947-1957 years). Presented article refers to the situation in the Polish philosophy, which took place between 40-50 of the twentieth century. Author’s reflections are carried on the example of attempts to reactivate in the realities of war, the polish philosophical journal “Ruch Filozoficzny” founded in 1911 by Kazimierz Twardowski. Political conditions have made the magazine was renewed twice, at each time was the greatest merit of Tadeusz Czeżowski. He was (...) assisted by the other representatives of the Lvov-Warsaw School, who worked in various academic centers in Poland. The reconstruction of the history of the magazine in the postwar years, will be based on previously unpublished archival material. In its conclusions, the author tries to point out of great importance of independent from the political authorities publishers on development of Polish philosophy. (shrink)

Dem Autor geht es in erster Linie darum, einen in Deutschland weitgehend vergessenen Philosophen in den Mittelpunkt des Wissenschaftsdiskurses zu stellen. Der Thuringer Karl Christian Friedrich Krause, Schuler von Fichte und Schelling in Jena, entwickelte eine eigenstandige Philosophie, die sich einerseits der epochalen abendlandischen Geistestradition verpflichtet weiss, zugleich aber auch von der Kantischen Philosophie und ihrem kritischen Geist beeinflusst wurde. Krause ist einerseits Systemphilosoph, der immer wieder die Thematik des Absoluten oder Gottes in den Vordergrund stellt - in dieser Hinsicht (...) ist er spekulativer Idealist. Andererseits muss alle Philosophie beim Ich beginnen, sofern zeigt er sich als Denker des Transzendentalen. Krauses Philosophie ist zweistrahlig aufgebaut: Zum einen will er die endliche Welt aus Gott ableiten, andererseits soll das Ich zur Erkenntnis Gottes aufsteigen. Ausgehend von der Metaphysik wird dieser Aufstieg des Ich zum Absoluten in den verschiedenen Regionalphilosophien, in der Religion, Ethik und Asthetik thematisiert.". (shrink)

Körper, Seele und Geist. Aus welchen Teilen besteht der Mensch? Mit dieser Fragestellung hat sich die Anthropologie schon seit Jahrhunderten beschäftigt. Vorliegendes Buch arbeitet diese Frage anhand der Epoche der Romantik und des damaligen wissenschaftlichen Diskurses der Anthropologie auf. Zwischen den Anthropologen gab es große Meinungsunterschiede. Die Schule der Dualisten behauptete, dass der Mensch aus einer Seele und einem Körper bestehe. Die genuin christlich inspirierten Trinitarier gingen hingegen von einem Gott analogen Menschenbild mit den Merkmalen Geist, Seele und Körper aus.

This systematic review identified and evaluated instruments measuring patients' perceptions of patient‐centred nursing care. Of 2629 studies reviewed, 12 were eligible for inclusion. Four instruments were reported: The Individualized Care Scale, the Client‐Centred Care Questionnaire, the Oncology patients' Perceptions of the Quality of Nursing Care Scale and the Smoliner scale. These instruments cover themes addressing patient participation and the clinician–patient relationship. Instruments were shown to have satisfactory psychometric properties, although not all were adequately assessed. More research is needed regarding test–retest (...) reliability, convergent and discriminant validity, validity with known groups and structural validity using confirmatory factor analysis. (shrink)

The article aims to put on the table the ongoing works of the United Nations Organization and others like World Trade Organization being focused in their current and future challenges to build an effective and useful Multilateral Trading System. Apart from achievements and reforms undertaken, further ones - based on another approach: considering the diversity principle - are proposed in order to reach equitable and fair trading negotiations outcomes in benefits of all members.

For 50 years, Star Trek has been an inspiration to its fans around the world, helping them to dream of a better future. This inspiration has entered our culture and helped to shape much of the technology of the early 21st Century. The contributors to this volume are researchers and teachers in a wide variety of disciplines; from Astrophysics to Ethnology, from English and History to Medicine and Video Games, and from American Studies to the study of Collective Computing Systems. What the authors have in common is that some version of Star Trek has inspired them, not only in their dreams of what may be, but in the ways in which they work - and teach others to work - here in the real world. Introduced with references to Star Trek films and television shows, and illustrated with original cartoons, each of the 15 chapters included in this volume provides insights into research and teaching in this range of academic fields. This article discusses the influence that Schopenhauer’s thought had on Mihai Eminescu’s work with reference to the idea of “pessimism.” It also considers Schopenhauer’s influence on Romanian philosophy and literature at the end of the nineteenth century. We shall examine Eminescu’s alleged “Schopenhauerian pessimism,” considering firstly “pessimism” as a part of Eminescu’s “myth.” Secondly, we shall cover the critical reception of Eminescu’s “Schopenhauerian pessimism,” discussing the existing literary and philosophical scholarship. Finding that there are issues for debate regarding Schopenhauer’s alleged (...) influence upon Eminescu, we argue that Eminescu’s “Schopenhauerian pessimism” may be a “legend.” The article examines the connection between Eminescu and one of Schopenhauer’s most influential followers, Eduard von Hartmann. In my paper, I comment on Rainer Forst's paper in this issue. I raise doubts as to whether the justification of democracy emerges from a fundamental moral right to reciprocal and general justification, as Forst claims. His basic argument appears questionable because democracy is different from a “hypothetical‐consent‐conception” of moral legitimacy, which limits as well as enables democratic legitimacy. The former cannot, however, justify the latter through an argument centered on self‐government: Such an argument relies heavily on the possibility of (...) consensus, thus neglecting the crucial phenomenon of disagreement or dissent. As a result of not adequately dealing with this phenomenon, the argument is unable to account for the basic democratic principle of majority rule as the remedy at hand. (shrink)

The thesis that the probability of a conditional`if A, C' is the corresponding conditional probability of C, given A, enjoys wide currency among philosophers and growing empirical support in psychology. In this paper I ask how a probabilisitic account of conditionals along these lines could be extended to unconditional sentences, i.e., conditionals with interrogative antecedents. Such sentences are typically interpreted as equivalent to conjunctions of conditionals. This raises a number of challenges for a probabilistic account, chief among them the question (...) of what the probability of a conjunction of conditionals should be. I offer an analysis which addresses these issues by extending the interpretation of conditionals in Bernoulli models to the case of unconditionals. (shrink)

This paper is an attempt to explain Wittgenstein’s remark that „It is always by favor of Nature that one knows something.“ In this regard, two positions are distinguished. The first one is the standard interpretation within analytic epistemology. Alternatively, I will suggest another possibility to interpret Wittgenstein’s remark, which is inspired by John McDowell’s epistemological disjunctivism. As I am going to show, the alternative is the better choice.

Ziel dieses Aufsatzes ist es, Robert Brandoms Begriff des Explizit-Machens explizit zu machen. Zu diesem Zweck werden zunächst verschiedene Formen des Explizit-Machens unterschieden. Dabei erweist sich allein der Begriff des logischen Explizit-Machens als haltbar. Anschließend wird gezeigt, dass diesem Begriff eine Schlüsselstellung im Rahmen von Brandoms Philosophie zukommt. Sowohl seine philosophische Methodologie als auch sein zentrales philosophisches Projekt einer Zurückführung von Semantik auf Pragmatik lassen sich höchstens soweit verständlich machen wie der Begriff des logischen Explizit-Machens. Dieser weist allerdings ein erhebliches (...) Defizit auf: Im Rahmen einer Inferentialistischen Semantik lässt sich die expressive Funktion wichtiger Teile des logischen Vokabulars nicht verständlich machen. Das Ergebnis ist, dass sich zwei der Grundpfeiler von Brandoms Sprachphilosophie, die Inferentialistische Semantik einerseits und deren Zurückführung auf eine normative Pragmatik andererseits, nicht gleichzeitig konsequent durchhalten lassen. We study satisfiability and infinite-state model checking in ICPDL, which extends Propositional Dynamic Logic (PDL) with intersection and converse operators on programs. The two main results of this paper are that (i) satisfiability is in 2EXPTIME, thus 2EXPTIME-complete by an existing lower bound, and (ii) infinite-state model checking of basic process algebras and pushdown systems is also 2EXPTIME-complete. Both upper bounds are obtained by polynomial time computable reductions to ω-regular tree satisfiability in ICPDL, a reasoning problem that we introduce specifically (...) for this purpose. This problem is then reduced to the emptiness problem for alternating two-way automata on infinite trees. Our approach to (i) also provides a shorter and more elegant proof of Danecki's difficult result that satisfiability in IPDL is in 2EXPTIME. We prove the lower bound(s) for infinite-state model checking using an encoding of alternating Turing machines. (shrink)

This paper examines how competition and competitive strategy influence companies’ propensity to engage in socially and environmentally responsible procurement processes (SERP). We interview 141 British procurement managers, on their perception of their company’s competitive strategy and the competitive environment in which they operating in. In addition, participants were asked how important responsible procurement was for their overall business and their strategy.Our results suggest that companies that produce a differentiated product engage in relatively proactive SERP process, compared to their counterparties, who (...) aimed to produce a product at the lowest price possible. “Narrativity and the Symbolic Vacuum” examines the descriptive and the prescriptive narrativity claim in the context of a claim that there are narratives in the biblical literature that resist both. The descriptive narrativity claim maintains that it is not an option for a person to conceive of their life without narrative coherence. The prescriptive claim holds that narrativity is a necessary condition for a good and successful human life. Phenomenological thought and Aristotelian virtue ethics, expressing a critical stance towards modernity (...) (modernity with its desire for objective, narrative-free criteria for truth), encourage narrativity claims. Biblical theology, despite its pervasive use of narrative strategies, offers a space in which narrativity claims are relativized. It is especially in confrontation with death where human life cannot be narratively managed. That is why it is in particular the cross in the New Testament which defies both descriptive and prescriptive narrativity claims. (shrink)

They are inspired principally by the vigorous polemic aroused by the publication several years ago of a work which caused a great uproar in epistemological circles; I am speaking of The Structure of Scientific Revolution by T.S. Kuhn. One could thus consider this essay, as well as my book, as an element to be added to that polemic's dossier. We elucidate the conditions under which any hypothesis is explanatorily relevant by analyzing several tests of explanatory relevance and explanations based on those tests. A new causal criterion of explanatory relevance is developed and defended. We show how the causal criterion succeeds in establishing, at the very least, a very strong presumption against moral facts.

The author suggests that a synchronic reading of Bonhoeffer's major works yields a typology of the two main images around which Bonhoeffer's political ethics orbit: disciple and citizen. Concentrating on the latter, the author shows the centrality of the question of power for Bonhoeffer's political ethics, and how it relates to responsibility and vocation. He argues that Bonhoeffer's ethics follows a christological grammar which constitutes its specific realism and provides its focus on institutions and good works. The essay concludes that (...) the call to citizenship, the vocation of co-operative, representative and vicarious action, forms the central idea of Bonhoeffer's political ethics, which is still highly relevant for political ethics today. This book argues that there is a complex logical and epistemological interplay between the concepts of metaphor, narrative, and emotions. They share a number of important similarities and connections. In the first place, all three are constituted by aspect-seeing, the seeing-as or perception of Gestalts. Secondly, all three are meaning-endowing devices, helping us to furnish our world with meaning. Thirdly, the threesome constitutes a trinity. Emotions have both a narrative and metaphoric structure, and we can analyse the concepts of metaphors (...) and narratives partly in each other's terms. Further, the concept of narratives can partly be analysed in the terms of emotions. And if emotions have both a narrative structure and a metaphoric one, then the concept of emotions must to some extent be analysable through the concepts of narratives and metaphors. But there is more. Metaphors (especially poetic ones) are important tools for the understanding of the tacit sides of emotions, perhaps because of the metaphoric structure of emotions. The notion that narrations can be tools for understanding emotions follows from two facts: narrations are devices for explanation and emotions have a narrative structure. Fourthly, the threesome has an impact on our rationality. It has become commonplace to say that emotions have a cognitive content, that narratives have an explanatory function, and that metaphors can perform cognitive functions. This book is the first attempt to articulate the implications that these new ways of seeing the three concepts entail for our concept of reason. The cognitive roles of the threesome suggest a richer notion of rationality than has traditionally been held, a rationality enlivened with metaphoric, narrative, and emotive qualities. Legal scholars, privacy advocates and major tech corporations all coalesce around one single idea. Data should be considered property. Legal analysts point to the ability of governments to regulate property, privacy advocates argue that personal rights would be better protected through a property model, and large tech companies want to claim ownership over data as a proprietary trade secret. I argue that the tendency to view data as property is a result of the long legacy of enlightenment philosophy surrounding property. (...) In particular, John Locke has a special hold on the public imaginary, and his twin concepts of self-ownership and the labor theory of accumulation lead us to conceptualize data as a special form of property. However, the property model of data has significant drawbacks. By commodifying data, we commodify ourselves and allow for colonial theories of enclosure to dominate the discourse. Instead, I propose an alternative framing of data, drawn from the work of Judith Butler, whose ideas allow us to see data as an extension of the performance of identity. Drawing on both Gender Trouble and Bodies that Matter I argue that viewing data as part of the performance of identity allows us to mitigate the harms of a property model and reconsider our relationship with our data. Visual neglect has been associated with an imbalance in the level of activity in the saccadic system: activity in the contralesional field is suppressed, which makes target selection unlikely. We recorded eye movements of a patient with hemispatial neglect and a group of healthy participants during an oculomotor distractor paradigm. Results showed that the interfering effects of a distractor were very strong when presented in her ipsilesional visual field. However, when the distractor was presented in her contralesional field, there were (...) no interfering effects when the target was presented in her ipsilesional field. These findings could not be explained by the presence of a visual field defect as revealed by the results of two hemianopic patients. Our results are in line with an imbalance in the level of activity in the saccadic system in visual neglect because visual elements presented in the contralesional field did not compete for saccadic selection.
