The study of law and information technology comes with an inherent contradiction in that while technology develops rapidly and embraces notions such as internationalization and globalization, traditional law, for the most part, can be slow to react to technological developments and is also predominantly confined to national borders. However, the notion of the rule of law defies the phenomenon of law being bound to national borders and enjoys global recognition. However, a serious threat to the rule of law is looming (...) in the form of an assault by technological developments within artificial intelligence (AI). As large strides are made in the academic discipline of AI, this technology is starting to make its way into digital decision-making systems and is in effect replacing human decision-makers. A prime example of this development is the use of AI to assist judges in making judicial decisions. However, in many circumstances this technology is a ‘black box’ due mainly to its complexity but also because it is protected by law. This lack of transparency and the diminished ability to understand the operation of these systems increasingly being used by the structures of governance is challenging traditional notions underpinning the rule of law. This is especially so in relation to concepts especially associated with the rule of law, such as transparency, fairness and explainability. This article examines the technology of AI in relation to the rule of law, highlighting the rule of law as a mechanism for human flourishing. It investigates the extent to which the rule of law is being diminished as AI is becoming entrenched within society and questions the extent to which it can survive in the technocratic society. Bourdieu suggested that the habitus contains the ‘genetic information’ which both allows and disposes successive generations to reproduce the world they inherit from their parents’ generation. While his writings on habitus are concerned with embodied dispositions, biological processes are not a feature of the practical reason of habitus. Recent critiques of the separate worlds of biology and culture, and the rise in epigenetics, provide new opportunities for expanding theoretical concepts like habitus. Using obesity science as a case study we attempt (...) to conceptualise the enfolding of biological and social processes (via a Deleuzian metaphor) to develop a concept of biohabitus – reconfiguring how social and biological environments interact across the life course, and may be transmitted and transformed intergenerationally. In conclusion we suggest that the enfolding and reproduction of social life that Bourdieu articulated as habitus is a useful theoretical frame that can be enhanced to critically develop epigenetic understandings of obesity, and vice versa. Journalism and media ethics texts commonly invoke Aristotle's Golden Mean as a principal ethical theory that models such journalistic values as balance, fairness, and proportion. Working from Aristotle's text, this article argues that the Golden Mean model, as widely understood and applied to media ethics, seriously belies Aristotle's intent. It also shortchanges the reality of our moral agency and epistemic responsibility. A more authentic rendering of Aristotle's theory of acting rightly, moreover, has profound implications for communication ethicists and media practitioners.

In the last two decades, philosophy of neuroscience has predominantly focused on explanation. Indeed, it has been argued that mechanistic models are the standards of explanatory success in neuroscience over, among other things, topological models. However, explanatory power is only one virtue of a scientific model. Another is its predictive power. Unfortunately, the notion of prediction has received comparatively little attention in the philosophy of neuroscience, in part because predictions seem disconnected from interventions. In contrast, we argue that topological predictions (...) can and do guide interventions in science, both inside and outside of neuroscience. Topological models allow researchers to predict many phenomena, including diseases, treatment outcomes, aging, and cognition, among others. Moreover, we argue that these predictions also offer strategies for useful interventions. Topology-based predictions play this role regardless of whether they do or can receive a mechanistic interpretation. We conclude by making a case for philosophers to focus on prediction in neuroscience in addition to explanation alone. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:74 HUME'S DIALOGUES ON EVIL Only two sections of Hume's Dialogues Concerning Natural Religion are concerned with the topic of the benevolence of the designer of the world (Parts X and XI), and the conclusion reached is stated by Philo in an unambiguous manner: The true conclusion is, that the original source of all things is entirely indifferent to all these principles, and has no more regard to good (...) above ill than to heat above cold, or to drought above moisture, or to light above heavy. (D 212) In light of the fact that much of the Dialogues is concerned with setting out sceptical or Pyrrhonian objections to positions in natural theology which reveal our ignorance in this area, it is important for an understanding of Parts X and XI to ask whether we are meant to take Philo's conclusion seriously; that is, does Hume intend Philo's conclusion in Part XI to be a truth in natural theology? Nelson Pike answers this negatively: Philo claims that there is an 'original Source of all things' and that this source is indifferent with respect to matters of good and evil. He pretends to be inferring this conclusion from observed data. This represents a departure from Philo's much professed skepticism in the Dialogues.... I think the center of Philo's remarks in this passage must be located in their skeptical rather than their metaphysical import. Philo has proposed a hypothesis which is counter to the one offered by Cleanthes. And he claims that this hypothesis is the 'true conclusion' to be drawn from the observed data. But the point is not, I think, that Philo's new hypothesis is true, or even probable. The conclusion is, rather, that the hypothesis advanced by Cleanthes is false, or very 75 improbable. when claiming that evil in the world supports a hypothesis which is counter to the one offered by Cleanthes, I think Philo simply means to be calling attention to the fact that evil in the world provides evidence against cleanthes' theological position. It is true that at certain points in the Dialogues Philo does profess to be a sceptic (Pyrrhonian), and he often attempts to show Cleanthes that his hypothesis is false by generating an hypothesis from the available data which is as plausible as Cleanthes' hypothesis (e.g., Part IV, where they debate Cleanthes' view that God is external to the world which He has designed), or which has greater plausibility than Cleanthes' hypothesis (e.g., Parts VI and VII where Philo argues against Cleanthes' claim that the available data support the hypothesis of an intelligent designer for the world). However, whenever Philo proceeds in this manner, he makes it clear that he has no hypothesis on the matter under discussion (e.g., D 164) which he is willing to defend, and that he has proceeded in this manner, not to argue for a position — he maintains that the available data are not adequate to do so — but to argue against the position Cleanthes is defending (see, for example, D 177). In fact, at one stage in the discussion, Philo urges against embracing any religious system, because of the victory which awaits the sceptic: All religious systems, it is confessed, are subject to great and insuperable difficulties. Each disputant triumphs in his turn; while he carries on an offensive war, and exposes the absurdities, barbarities, and pernicious tenets of his antagonist. But all of them, on the whole, prepare a complete triumph for the sceptic; who tells them, that no system ought ever to be embraced with 76 regard to such subjects: For this plain reason, that no absurdity ought ever to be assented to with regard to any subject. A total suspense of judgment is here our only reasonable resource. (D 186-187) This passage, which appears toward the end of Part VIII, is reminiscent of the point Philo made in Part I, when he warned of arguments which "run wide of common life." AN 'INCONVENIENCE' OF ANTHROPOMORPHISM In Part II of Hume's Dialogues Concerning Natural Religion Cleanthes maintains that the similarities between the works of nature and those of human contrivance, namely, the presence of means to ends relations and a coherence of parts, are sufficient to enable us to reason analogically to the conclusion that the cause of the design of the world resembles human intelligence. Cleanthes insists in Part (...) IV that the ideas which -we have of mind are 'just and adequate and correspondent' to God's nature. Philo, who throughout the discussion has insisted on 'the adorable mysteriousness ' of the divine nature, responds to Cleanthes by saying that he will endeavour to show the inconveniences of that anthropomorphism, which you have embraced; and shall prove, that there is no ground to suppose a plan of the world to be formed in the divine mind, consisting of distinct ideas, differently arranged; in the same manner as an architect forms in his head the plan of a house which he intends to execute. (D160) It is the aim of this paper to explicate this 'inconvenience of Cleanthes' anthropomorphism. Philo begins by claiming that nothing is gained by Cleanthes' position whether it is assessed by 'reason' or by 'experience'. The judgment of reason is that a mental world or universe of ideas requires a cause as much as does a material world or universe of objects ; and if similar in its arrangement must require a similar cause. For what is there in this subject, which should occasion a different conclusion or inference? In an ahi: L ra.-t view, they are entirely alike; and no difficulty attenda the one supposition, which is not common to both of them. (D160) Similarly, experience cannot perceive any material difference in this particular, between these two kinds of worlds, but finds them to be governed by similar principles, and to depend upon an equal variety of causes in their operations. (D161-162) In suggesting that it is better never to look beyond the material world, what precisely is it that Philo is 2 advocating? George Nathan maintains that "Cleanthes is unaware that Philo is trying to eliminate only the externality of the cause. He is not trying to deny its intelligence ". (Chappell 410) Pike, on the other hand, interprets Philo' s position as eliminating the requirement for a causal account of the order present in the world: If we introduce an ordered mind in an effort to explain the existence of an ordered world, must we not provide a similar explanation of the ordered mind? But if we accept this demand, we shall have to introduce yet another intelligent being as the creator of the first. This explanatory chain can end only in an infinite regress. We would probably do better to assume that order in the material world is an ultimate fact that does not require explanation. We first present a realistic framework for quantum probability theory based on the path integral formalism of quantum mechanics and illustrate this framework by constructing a model that describes a quantum particle evolving in a discrete space-time lattice. We then present a finite model for describing the internal dynamics of “elementary particles” and show that this model gives the standard particle classification scheme and successfully predicts particle masses.

Urban centers are being transformed into consumer tourist playgrounds made possible by dense networks of surveillance. The safety and entertainment however, come at an unseen price. One of the historical roots of surveillance can be connected to the modern information base of tracking individuals for economic and political reasons. Though its antecedents can be traced via Foucault's account of panoptic discipline which walled in society's outcasts for rehabilitation, the following essay explores the shift to the urban panopticism of today where (...) society's outcasts are subtly filtered out of "public" view. Juxtaposing a sociological account of the concentration camp with urban Disneyization fosters a greater understanding of how surveillance creates certain categories of citizenship. Peter McHugh was an internationally known sociologist within the field of anti-positivist social theory. As the only collection of McHugh's sole-authored writings, Redefining the Situation presents a comprehensive yet surprising view of this key theorist's influence in his field. Although the question of religion did not feature prominently in Jürgen Habermas’s early political theory, his more recent work has continuously addressed the topic. This later interest in religion is grounded in what one commentator in a volume on The Power of Religion in the Public Sphere, cited as the urgent need to integrate religious voices in the workings of public reason in order to avoid social disharmony and to thwart potential violence. However, the following paper argues that the hermeneutic (...) procedures Habermas develops for the public sphere cannot bear the weight that his later understanding of religion demands of them. Such an insight validates Paul Ricoeur’s earlier argument that Habermas’s “depth hermeneutics,” were themselves utopic in nature. It is from this vantage point that a return to Ricoeur's thought is justified, through which a more productive understanding of the public potential of religious discourse can be understood. It is argued that a reformulation of classical measure theory is necessary if the theory is to accurately describe measurements of physical phenomena. The postulates of a generalized measure theory are given and the fundamentals of this theory are developed, and the reader is introduced to some open questions and possible applications. Specifically, generalized measure spaces and integration theory are considered, the partial order structure is studied, and applications to hidden variables and the logic of quantum mechanics are given.

We construct a quantum logic which generates the usual quark states. It follows from this model that quarks can combine only in quark-antiquark pairs and quark (and antiquark) triples. The ground meson and baryon states are also generated and gluons are discussed.

We develop the concept of quantum probability based on ideas of R. Feynman. The general guidelines of quantum probability are translated into rigorous mathematical definitions. We then compare the resulting framework with that of operational statistics. We discuss various relationship between measurements and define quantum stochastic processes. It is shown that quantum probability includes both conventional probability theory and traditional quantum mechanics. Discrete quantum systems, transition amplitudes, and discrete Feynman amplitudes are treated. We close with some examples that illustrate previously (...) defined concepts. (shrink)

Descartes and Hume share at least one fundamental philosophical belief, and that is the proper mindset required in order to begin philosophizing in an orderly manner. Each holds that, once this mindset is achieved, the reader will readily accept the procedures and conclusions that follow.
