The study of law and information technology comes with an inherent contradiction in that while technology develops rapidly and embraces notions such as internationalization and globalization, traditional law, for the most part, can be slow to react to technological developments and is also predominantly confined to national borders. However, the notion of the rule of law defies the phenomenon of law being bound to national borders and enjoys global recognition. However, a serious threat to the rule of law is looming (...) in the form of an assault by technological developments within artificial intelligence (AI). As large strides are made in the academic discipline of AI, this technology is starting to make its way into digital decision-making systems and is in effect replacing human decision-makers. A prime example of this development is the use of AI to assist judges in making judicial decisions. However, in many circumstances this technology is a ‘black box’ due mainly to its complexity but also because it is protected by law. This lack of transparency and the diminished ability to understand the operation of these systems increasingly being used by the structures of governance is challenging traditional notions underpinning the rule of law. This is especially so in relation to concepts especially associated with the rule of law, such as transparency, fairness and explainability. This article examines the technology of AI in relation to the rule of law, highlighting the rule of law as a mechanism for human flourishing. It investigates the extent to which the rule of law is being diminished as AI is becoming entrenched within society and questions the extent to which it can survive in the technocratic society. The Epistemology and Technologies of Shamanic States of Consciousness Shamanism can be described as a group of techniques by which its practitioners enter the ‘spirit world', purportedly obtaining information that is used to help and to heal members of their social group. The shamans’ epistemology, or ways of knowing, depended on deliberately altering their conscious state and/or heightening their perception to contact spiritual entities in ‘upper worlds', ‘lower worlds’ and ‘middle earth’ . For the shaman, the totality of inner and (...) outer reality was fundamentally an immense signal system, and shamanic states of consciousness were the first steps toward deciphering this signal system. Homo sapiens sapiens was probably unique among early humans in the ability to symbolize, mythologize and, eventually, to shamanize. This species’ eventual domination may have been due to its ability to take sensorimotor activity and use it as a bridge to produce narratives that facilitated human survival. Shamanic technologies, essential for the production and performance of myths and other narratives, interacted with shamanic epistemology, reinforcing its basic assumptions about reality. (shrink)

This article discusses preliminary data on advancing what we know about “sacred sites” and their effects on dreaming. Thirty‐five volunteers spent between one and five nights in one of four unfamiliar outdoor sacred sites in England and Wales. Another volunteer awakened them following the observation of rapid eye movement and asked for dream recall. The same volunteers monitored their own dreams in familiar home surroundings, keeping dream diaries. Equal numbers of site dreams and home dream reports were obtained for each (...) volunteer. The 204 dream reports had previously been subjected to inspection for bizarre and paranormal content, with no significant differences. This analysis used the Hall—Van de Castle Scale, and several differences were found, most notably more aggressive content in site dreams and more friendly content in home dreams. In addition, home dream reports contained more incidences of failure, striving, and success. A number of explanations were proposed for these differences, including expectancy, suggestion, the effect of unfamiliar surroundings, and possible anomalous properties of the sacred sites. (shrink)

Religion’s persistent and new visibility in political life has prompted a significant global debate. One of its key features concerns the nature and impact of secularization. This book intervenes in two ways. Firstly, it provides summative accounts of the history, culture and legal interactions that have informed Australia’s unique example. Secondly, it critically analyzes secular political theory concerning the public sphere, deliberative politics and democratic practices. Brazilian spiritistic religions have developed along elaborate historical and cultural trajectories with spirit mediumship as a central feature of ritual practice in Candomblé, Umbanda, Kardecismo, and similar groups. In these studies, several Brazilian spiritistic practitioners who worked as mediums were interviewed and, in some cases, tested with psychological measures for dissociation using the Dissociative Experiences Scale, for absorption using the Tellegen Absorption Scale, and for sexual orientation using the Kinsey Scale. Few significant gender differences were noted in these measures. In (...) two cases, psychophysiological measures were employed including electroencephalography, heart rate, skin conductance, and electromyography. In general, the research participants scored highly on measures of dissociation while scoring in the average range on absorption (using U.S. norms). The psychophysiological results indicated that for the two spiritistic practitioners investigated overall peripheral autonomic nervous system activation was negatively associated with sympathetic cortical level deactivation. The data suggested a psychophysiological incongruence between the central nervous system and the peripheral nervous system functioning on the part of the two practitioners. However, the two variables were positively associated and congruent in data obtained from a control subject. Interview data identified five ways in which mediums received their "call to heal," visions, dreams, and unexpected incorporations being the most frequent factors cited. One medium who engages in surgical procedures was observed; tissues were collected from ten clients and were found to be consistent with the site of the surgery. In conclusion, it is apparent that mediumship is a complex phenomenon, one deserving of further investigation by anthropologists, psychologists, and sociologists interested in human consciousness, in indigenous health care, and in the psychophysiology of practitioners who claim to work under the direction of spirit entities. Ervin Laszlo has used the ancient concept of the Akashic Records for the basis of his "Akashic Field" (A-field) model, one that has obvious implications for parapsychology, the scientific study of anomalous human-human and human-environment interactions, that is, "psi." Experiments with "telepathic" and "precognitive" dreams are one example of parapsychological research that may fit the A-field model because of its information-carrying potential. Psi appears to be a complex system, one that may reflect the connective "web" posited by the A-field model. (...) This paper approaches dreaming consciousness through an examination of the self-organizing properties of the sleeping brain. This view offers a step toward reconciliation between brain-based and content-based attempts to understand the nature of dreaming. Here it is argued that the brain can be understood as a complex self-organizing system that in dreaming responds to subtle influences such as residual feelings and memories. The hyper-responsiveness of the brain during dreaming is viewed in terms of the tendency of complex chaotic-like systems to (...) respond to small variations in initial conditions and to the amplification of subtle emotional and cognitive signals through the mechanism of stochastic resonance, all in combination with psychophysiological changes in the brain during both slow wave sleep and REM sleep dreaming. Such changes include the active inhibition of extroceptive stimulation and, especially in REM sleep, alterations in the brain's dominant neuromodulatory systems, bombardment of the visual cortex with bursts of PGO activity, increases in limbic system activity, and a reduction of activity in the prefrontal regions. Enigmatic, anomalous dream reports challenge the Western philosophical worldview, hence they are ignored or derided by most mainstream philosophers and scientists. Nevertheless, there is compelling evidence from research in parapsychology that at least some of these reports have consensual validation and waking life consequences. Shamanic models of reality (which reflect shamanic philosophies) provide anecdotal evidence, congruent with parapsychological data, and need to be reconsidered by the dominant Western academies because these model encompass anomalous dreams, and because they furnish provocative data.

This paper intends to illustrate the monuments of the Periklean building programme as embodying acts of temporal configuration; organizing synoptic episodes into an ethno-cultural continuum. A required element to this process is the issue of space, both in its experienced and imagined aspects, as the framework by which temporality is fixed and recounted. By viewing the monuments and accompanying iconography as spatio-temporal configurations, we can see the generation of those elements necessary for the formation of cultural identity via memory. This (...) includes the provision of axial points in time, set in space and wider temporal chronologies, and the election of totemic, and semioticized personages. Moreover, as the configurative action is both framed and informed by its enunciative context, the monuments indicate the promotion of biographical memory, as relating to the Persian Wars, into the register of Athenian cultural memory and temporality. This article presents and compares various algebraic structures that arise in axiomatic unsharp quantum physics. We begin by stating some basic principles that such an algebraic structure should encompass. Following G. Mackey and G. Ludwig, we first consider a minimal state-effect-probability (minimal SEFP) structure. In order to include partial operations of sum and difference, an additional axiom is postulated and a SEFP structure is obtained. It is then shown that a SEFP structure is equivalent to an effect algebra with an (...) order determining set of states. We also consider σ-SEFP structures and show that these structures distinguish Hilbert space from incomplete inner product spaces. Various types of sharpness are discussed and under what conditions a Brouwer complementation can be defined to obtain a BZ-poset is investigated. In this case it is shown that every effect has a best lower and upper sharp approximation and that the set of all Brouwer sharp effects form an orthoalgebra. (shrink)

This study examined the impact of ethics training engagement on unethical decision-making in the workplace. Participants were randomly assigned to one of the two conditions. Next, a baseline measurement of ethical ideology was collected using the Ethics Position Questionnaire and participants then engaged in ethics training based on the condition to which they were randomly assigned. They then had the option to read along or listen to a hypothetical scenario about an employee faced with the opportunity to make an unethical (...) decision, and completed the Unethical Decision Questionnaire. Results showed that participants in the passive learning condition were significantly more likely to perceive an unethical situation as ethical compared to participants in the active learning ethics training condition. Additionally, participants in the passive learning condition were significantly more likely to engage in unethical decision-making than participants in the active learning condition. The current findings contribute to the existing literature by providing evidence that active learning in ethics training programs could reduce unethical decision-making within the workplace. Political theology has multiple provenances. One less cited is the seventeenth century irenic dictum: “and we would all embrace a mutual unity in things necessary; in things non necessary liberty; in all things charity.” While aimed at ecumenical peace, this call for mutual unity implied a deliberative context that went beyond sectarian Christian concerns. Abstract Our Hong Kong-based study used interviews with volunteers and other stakeholders to investigate the perceived integrity and commitment of firms’ adoption of actively managed corporate volunteerism (AMCV), to examine whether AMCV was removing barriers against voluntary community service work and to identify volunteers’ motives for AMCV involvement. Interviewees perceived that firms were adopting strategically instrumental approaches to AMCV, combining community service provision with corporate image promotion and/or with organisational development. They indicated that although AMCV was mobilizing people, who would (...) not otherwise have chosen to volunteer, instances of ‘conscription’ were uncommon. Those who had served as volunteers described positive motives for their own involvement, such as altruism, principlism, self-development, loyalty to the firm and relationship building with colleagues and service recipients. Some expressed that volunteering had been a highly rewarding self-transformation experience. Our study also used the career orientations inventory (COI) to examine career anchors. COI scores indicated that non-governmental organisation (NGO)-based employees and some firm-based paid AMCV organisers preferred the service/dedication to a cause anchor and that firm-based unpaid organisers-cum-participants preferred the lifestyle anchor. Volunteers without organiser roles had miscellaneous preferences but leaned toward the security anchor. From our findings, we argue that it would benefit all parties if firms, in close collaboration with NGOs, were to expand the range of volunteering opportunities that are available to employees and help them to choose activities and roles that are congruent with their career anchors, if they so wish. In 1843 he laid aside, unfinished, a lengthy manuscript - known since its publication in 1927 as the Kritik des Hegelschen Staatsrechts - containing a detailed criticism of §§ 261–313 of The Philosophy of Right. In 1844 he published a short article, “Zur Kritik der Hegelschen Rechtsphilosophie. Einleitung”, proclaiming the imminence of a proletarian revolution in Germany.
