Is there something distinctive about humanity that justifies the idea that humans have moral status while non-humans do not? Providing an answer to this question has become increasingly important among philosophers as well as those outside of philosophy who are interested in our treatment of non-human animals. For some, answering this question will enable us to better understand the nature of human beings and the proper scope of our moral obligations. Some argue that there is an answer that can distinguish (...) humans from the rest of the natural world. Many of those who accept this answer are interested in justifying certain human practices towards non-humans—practices that cause pain, discomfort, suffering, and death. This latter group expects that in answering the question in a particular way, humans will be justified in granting moral consideration to other humans that is neither required nor justified when considering non-human animals. In contrast to this view, an increasing number of philosophers have argued that while humans are different in a variety of ways from each other and other animals, these differences do not provide a philosophical defense for denying non-human animals moral consideration. The article discusses the relation between the concepts of unfair trade, exploitation, and below-subsistence wages with regard to individual economic transactions. Starting from the common notion that exploitation involves some kind of unfair advantage taking, it asks how “unfair” is to be understood, and what it is that is taken advantage of in exploitative exchanges. On this basis it then explores a line of argument for grounding the claim that below-subsistence wages are exploitative, focusing on the condition of morally transformative (...) voluntary consent to transactions. By analyzing the structure of coercion with regard to threats, offers, and circumstances it comes to the conclusion that consent to an offer is morally non-transformative with regard to legitimizing the outcome of a transaction if the person giving the “consent” has only unacceptable options in absolute terms to choose from, since this reduces “consent” to a mere act of rationality devoid of any normative content. Accordingly, it argues that insofar as below-subsistence wages are unacceptable options in absolute terms, they are to be considered exploitative and an instance of unfair trade. (shrink)

As knowledge about the devastating consequences of human action on the environment grows, so does the urgency of finding answers to questions about how we ought to think about and act toward the natural world. Over the last twenty-five years, philosophers have attempted to develop an environmental ethic that can answer these questions. The most common articulations of environmental ethics set out to establish the value of nature beyond its mere usefulness to humans, a value referred to in the literature (...) as intrinsic value. I critically examine two of the leading versions of environmental ethics which attempt to establish the intrinsic value of nature and find them wanting. I then turn to an alternative, ecofeminist approach to thinking about our obligations to the non-human world that is not preoccupied with establishing the intrinsic value of nature. I highlight some of the strengths and weaknesses of such an approach. In the end, I point in a new direction for answering questions about our relationship to the environment and for solving some of the most pressing global environmental problems; one that I call an ecofeminist contextualist approach to valuing nature. International treaties, conventions and declarations have been developed in an attempt to establish a world in which people s basic rights and needs are provided for. An increasing number of states have ratified and incorporated them into their national legislations. But are such norms and values truly universal? And with states no longer being the only actors that shape global developments, what can be said about the role of social contracts between state and society for shaping the agenda of international (...) cooperation? And how do these social contracts develop in heterogeneous societies? If people themselves are the main drivers behind development, what does this imply for foreign aid?These and other questions are addressed in "Global Values in a Changing World," the 2010-2011 lecture series organized by the Netherlands Chapter of the Society for International Development. Continuing to develop work on environmental justice and eco-justice both theoretically and practically is one rich (...) way to promote interdisciplinary engagement and expand the possibilities for environmental thinking more broadly. For example, environmental justice inquiry often attracts students to environmental philosophy and environmental science who would not ordinarily be interested in philosophy or science. Environmental justice issues also provide significant service-learning opportunities that can encourage students and faculty to develop more sophisticated ways of integrating theory and practice while working with local communities. Integrating service-learning projects into environmental philosophy/studies classrooms inevitably encourages the development of interdisciplinary skills that will serve faculty and students and allows for greater discussions of local environmental problems to be addressed both inside and outside the classroom.As discussions of global justice, human rights, transnational feminism, and egalitarianism continue to gain prominence in philosophy, political science, feminist studies, and law, it is important that environmental philosophers continue developing ways to contribute to the dialogue. Environmental philosophers can certainly help enliven and deepen the practical as well as theoretical significance of these discussions. The new area of "cultural environmental studies" is one place this might happen, but it is certainly possible for environmental philosophers to engage in these analyses in other contexts.Environmental philosophers have a tendency to look at large systemic issues, and as climate change becomes increasing pressing it is important not to ignore the particularity of risks and potential harms for different human communities as well as non-human animals who may be disproportionately impacted. Val Plumwood urged us to attend to earth others in non-dualistic ways. In this essay I suggest that such attention be promoted through what I call "engaged empathy." Engaged empathy involves critical attention to the conditions that undermine the well being or flourishing of those to whom empathy is directed and this requires moral agents to attend to things they might not have otherwise. Engaged empathy requires gaining wisdom and perspective and, importantly, motivates the empathizer to act ethically.

Preoperative mapping of language and declarative memory functions in temporal lobe epilepsy patients is essential since they frequently encounter deterioration of these functions and show variable degrees of cerebral reorganization. Due to growing evidence on language and declarative memory interdependence at a neural and neuropsychological level, we propose the GE2REC protocol for interactive language-and-memory network mapping. GE2REC consists of three inter-related tasks, sentence generation with implicit encoding and two recollection memory tasks: recognition and recall. This protocol has previously been validated (...) in healthy participants, and in this study, we showed that it also maps the LMN in the left TLE. Compared to healthy controls, left TLE showed widespread inter- and intra-hemispheric reorganization of the LMN through reduced activity of regions engaged in the integration and the coordination of this meta-network. We also illustrated how this protocol could be implemented in clinical practice individually by presenting two case studies of LTLE patients who underwent efficient surgery and became seizure-free but showed different cognitive outcomes. This protocol can be advantageous for clinical practice because it is short and easy to perform; allows brain mapping of essential cognitive functions, even at an individual level; engages language-and-memory interaction allowing to evaluate the integrative processes within the LMN; provides a more comprehensive assessment by including both verbal and visual modalities, as well as various language and memory processes. Based on the available postsurgical data, we presented preliminary results obtained with this protocol in LTLE patients that could potentially inform the clinical practice. This implies the necessity to further validate the potential of GE2REC for neurosurgical planning, along with two directions, guiding resection and describing LMN neuroplasticity at an individual level. Despite a paucity of psychological research exploring the interface between lesbian and gay issues and human rights, a human rights framework has been widely adopted in debates to gain equality for lesbians and gay men. Given this prominence within political discourse of human rights as a framework for the promotion of positive social change for lesbians and gay men, the aim of this study was to explore the extent to which rights‐based arguments are employed when talking about lesbian and gay (...) issues in a social context. An analysis of six focus group discussions with students showed that when lesbian and gay issues are discussed, rights‐based reasoning is employed intermittently, and in relation to certain issues more so than others. The implications of these findings for moral education aimed at promoting positive social change for lesbians and gay men are discussed. (shrink)

Bloch himself left for West Germany following the construction of the Berlin Wall. After the end of World War II, he had returned from his New York exile by invitation in 1948 to accept the chair of philosophy at the University of Leipzig. Whats human rights got to do with it? That is, whats human rights got to do with the June 2004 report of the Social Sciences and Humanities Research Ethics Special Working Committee to the Inter-Agency Advisory Panel on Research Ethics. The disturbing answer is not enough. Certain key recommendations of the working committee, it is suggested, would unacceptably weaken the researchers legal and moral accountability to research participants. Those particular recommendations rely on misguided references to academic freedom and the nature (...) of the non-medical research context. In fact, universal human rights, and the legal instruments in which they are embodied ought to inform the research endeavor at every stage; from problem selection to analysis and conclusions. This will lead us closer to shared truths rather than simply to the academic elites vision of truth. Without sufficient regard for the human rights of research participants academic freedom itself is not possible. (shrink)

If public self-expression is a crucial feature of democracy, how might it work on the democratic – or at least, mass – medium par excellence, television? Television talk shows often allow ‘ordinary’ participants the opportunity to express themselves, i.e. deploy identities, feelings and opinions, presumably to further their own ends. This article uses speech act theory and Bakhtinian genre theory to analyze the talk on Jan Publiek, a Flemish talk show. This close reading helps to determine how two of the (...) 20 ‘ordinary’ participants co-created shifting and even contradictory identities with other participants, the host, the producers, the conventions of television talk shows and larger discourses such as those of gender and class. In these two cases, the participants seem mostly to fail in employing the medium of Jan Publiekto achieve their stated aims. The authors claim that while discourses may never be completely transparent, their means of functioning can still be better understood. All participants of television – producers, actors, viewers, media scholars – can benefit from the kind of media literacy to which this article contributes. (shrink)

This book examines the role Plato accords to imagination in the ancient quarrel between poetry and philosophy. Claiming that the function of imagination evokes a realm of praxis within Plato's dialogues heretofore largely unrecognized, this book offers an interpretation of Plato that challenges the more orthodox view in which poetry and the arts are denigrated, and indeed, seen as eradicable from the dialogues altogether.

The Protagoras exhibits several traits of metatheatrical comedy. Through the use of role-playing and intertextual reference, I argue that the Protagoras exhibits metatheatrical comedy which Socrates uses to expose the pretension at the heart of philosophical dialogue itself. In this way, Socrates pulls back the curtain of philosophical dialogue to expose the theatricality of such dialogue and, in doing so, offers the audience a unique opportunity to laugh at ourselves.

In Ockham's Assumption of Mental Speech: Thinking in a World of Particulars, Sonja Schierbaum offers a detailed philosophical reconstruction of William Ockham's (1287-1349) conception of mental speech. Ockham's conception provides a rich account of cognition and semantics that binds together various philosophical issues and forms a point of departure for many later and even contemporary debates. The book analyses the role of mental speech for the semantics and the use of linguistic expressions as well as its function within Ockham's (...) cognitive theory and epistemology. Carefully balancing Ockham's position against contemporary appropriations in the light of Fodor's LOTH, it allows us to understand better Ockham's view on human thought and its relation to language. In June 2010, Rosie, a descendant of the chimpanzees sent into space, and thirteen others were shipped from New Mexico to a laboratory in Texas for possible use in hepatitis research. They were to be the first group of approximately two hundred chimpanzees to be reintroduced to invasive research. These chimpanzees had been in semiretirement for a decade after being removed from an enormous laboratory that was in egregious violation of the Animal Welfare Act. I, along with many bioethicists, scientists, (...) primatologists, and others, have long been arguing against the use of chimpanzees in invasive research on ethical grounds. The United States is now poised to join the rest of the world in ending invasive research on our closest primate relatives. (shrink)

Consciousness, understood as an awareness of what is going on that helps shape one’s experiences, is one of the ways that scholars have distinguished animal life from the rest of the natural world. Beings that have interests in having good experiences and avoiding bad ones deserve our moral attention, and this quality is an important feature of ethical engagement with other sentient beings, both human and nonhuman. What interests matter and why they matter is a subject of disagreement that has (...) affected what we judge to be permissible or impermissible treatment of other animals. Empathy toward and respect for other animals takes us beyond attention to their suffering and has us focus on what counts as well-being for others, by their own lights. (shrink)

En este artículo se estudian historias sobre gobernantes y príncipes de tres dinastías - ‛abbāsí, normanda y timurí – y su representación narrativa como conocedores de las ciencias matemáticas, la geografía y la historia. Se argumenta que constituyen un conjunto de formas positivas de aprobar o impugnar el conocimiento en esas sociedades, prescribiendo jerarquías de formas de conocimiento y jerarquías de gentes e instituciones que deciden acerca de la veracidad del conocimiento. Se sugiere que esas historias comparten su origen y (...) significado en un contexto de propaganda legitimadora para varios gobernantes y príncipes. También se afirma que el valor y la posición del conocimientocientífico en esas historias difieren, empezando por lo que en apariencia eran los intereses personales de un gobernante hasta su integración en lo que se consideraba necesario para la educación de un príncipe y la conducta cultivada de un gobernante. Por tanto, esas historias sobre conocimiento y gobernantes presentan imágenes del conocimiento que delinean el status de los sabios en esas tres sociedades, definiendo posibilidades y estableciendo límites para el aprendizaje y los campos de estudio que se podían practicar. « The form within which contractions can move ». The case for a reconstruction of the materialist theory of law The article begins with an appraisal of the legacy of Marxist legal theory in the last century as the starting-point from which to update the various attempts to grasp the connection between the capitalist mode of production and modern law. By way of a critical inquiry of its merits and failures, the article tries to re-construct the findings of Marxist legal (...) theory and thus propose an updated version of a materialist legal theory. The main argument is that law in capitalist societies takes the form of a technology of cohesion which possesses its own logic of self reproduction. Law’s ´relational autonomy` is both an effect of its autonomisation from social relations, behind the back of its producers, and the main condition for a deferral of power. Under the structural conditions of the legal form, juridical intellectuals organise hegemony via the infrastructure of a seemingly neutral legal argumentation. (shrink)

On the basis of a reconstruction of legal theory in the tradition of Marx - a current that has been more or less silenced since the end of the 1970s - Subjectivation and Cohesion develops a critical counter-pole to the theories of law that predominate in social theory today. To this end, the works of Franz Neumann, Otto Kirchheimer, Evgeny Pashukanis, Oskar Negt, Isaac D. Balbus, the so-called 'State-derivation School', Antonio Gramsci, Nicos Poulantzas and Michel Foucault are first analysed for (...) their strengths and weaknesses, and then combined to form a new construction: a materialist legal theory that is up to date and can avoid the shortcomings of existing theories - above all their disregard for gender relations and the reductive consequences of functionalist, economic or politicist approaches to law. This article investigates the contribution of Spinoza and authors of his circle (Antistius Constans, Van den Enden and Koerbagh) on the modern conception of tolerance. In his Tractatus theologico-politicus (1670), Spinoza launches the libertas philosophandi-question integrating two kinds of freedom between which there is a tension: freedom of thought and speech and freedom of religious conscience. As freedom means living and acting in society in light of one’s own interests, tolerance becomes a political issue that depends from political perspectives and (...) priorities. This insight leads Spinoza to bringing together the control of political authority on religious affairs and a political regime of religious plurality and toleration. These ideas seem to be reminiscent of texts published in his immediate circle: the anonymus De jure ecclesiasticorum (1665); the political pamphlets Kort verhael (1662) and Vrye Politijke Stellingen (1665) of his teacher Van den Enden; the subversive dictionary Een Bloemhof (1668) and the systematic philosophical Een Ligt (1668) of Koerbagh. In these texts the question of religion and religious authority shifts to the question of the nature and origin of political authority. The authors all criticize the abuse of power in light of the idea that there is no freedom without equality and no equality without freedom. Together with Spinoza’s Tractatus politicus (1677), they thereby form an anomaly within the anomaly of the Calvinist Low Countries that regards specifically this radical democratic view. They are not so much talking about tolerance but about everyone’s active participation in political life which is necessary for the rescue of the republic. (shrink)
