The legal risks associated with health research involving human subjects have been highlighted recently by a number of lawsuits launched against those involved in conducting and evaluating the research. Some of these cases have been fully addressed by the legal system, resulting in judgments that provide some guidance. The vast majority of cases have either settled before going to trial, or have not yet been addressed by the courts, leaving us to wonder what might have been and what guidance future (...) cases may bring. What is striking about the lawsuits that have been commenced is the broad range of individuals/institutions that are named as defendants and the broad range of allegations that are made. The research community should take this early experience as a warning and should reflect carefully on practices where research involving human subjects is concerned. (shrink)

The Department of Health and Human Services, Office for Civil Rights enforces Section 504 of the 1973 Rehabilitation Act and Title II of the Americans with Disabilities Act. OCR works through complaint investigations and compliance reviews, as well as outreach, technical assistance, and public education to promote voluntary compliance. In the Olmstead decision of June 1999, the Supreme Court held that the ADA’s “integration regulation” requires state and local government to administer services, programs, and activities in the most integrated setting (...) appropriate to the needs of qualified individuals with disabilities. The decision changed the focus from whether a right to more integrated services exists, to under what circumstances and how services will be provided. The New Freedom Initiative announced by President Bush in February 2001 is a broadbased initiative to remove barriers to community living for people with disabilities and promote swift implementation of the Olmstead decision. Malcolm Budd speaks for many when he locates the "principal weakness" of Hume's account of the standard of taste in Hume's "blithe optimism about the uniformity of response of his true judges of artistic value". I argue that Hume's optimism is not blithe. I argue, in particular, that it follows from Hume's definition of a true judge that true judges will never disagree, and that it follows from his appeal to the test of time that true judges will agree often (...) enough to support the kind of standard Hume has in mind. Critics of animal modeling have advanced a variety of arguments against the validity of the practice. The point of one such form of argument is to establish that animal modeling is pointless and therefore immoral. In this article, critical arguments of this form are divided into three types, the pseudoscience argument, the disanalogy argument, and the predictive validity argument. I contend that none of these criticisms currently succeed, nor are they likely to. However, the connection between validity and morality is (...) important, suggesting that critical efforts would be instructive if they addressed it in a more nuanced way. (shrink)

In attempting to learn more about the relationship between social structure and behavior, this chapter identifies the transforming conditions that promote an actor's acquisition of a noninstitutionalized role. The role concept is modified to be seen not only as an aspect of social structure, but connected to the life situation of a performer, constituting a person-role formula. Being defined according to the degree of involvement an actor will have with the proffered role, a person-role formula may be based on embracement, (...) integration, downgrading, or avoidance. Roles are transformed into one of these possible relationships through three stages (1) role discrepancy, (2) role typification, and (3) role validation. (shrink)

The recent financial crisis and Great Recession have been compared to other historical moments during which significant shifts in regimes of market governance have occurred. Here, we engage with the pieces that follow in this special section of Politics & Society as we consider three dimensions along which global market governance might be transformed in the direction of greater democracy. First, given that problems of market governance often extend across national boundaries, enhanced intergovernmental coordination could play a key role in (...) promoting the public interest. Second, broader country representation would help to ensure that the interests of different national publics are more fully addressed. Third, wider social participation would expand the definition of the public interest at both the national and global levels, allowing a range of social groups to enhance the quality of their representation by governments and IGOs, and to engage more directly in the project of market governance. The second edition of Foucault and the Government of Disability considers the continued relevance of Foucault to disability studies, as well as the growing significance of disability studies to understandings of Foucault. A decade ago, this international collection provocatively responded to Foucault’s call to question what is regarded as natural, inevitable, ethical, and liberating. The book’s contributors draw on Foucault to scrutinize a range of widely endorsed practices and ideas surrounding disability, including rehabilitation, community care, impairment, normality and abnormality, inclusion, (...) prevention, accommodation, and special education. Consider the following three propositions: (R) Artworks necessarily have aesthetic properties that are relevant to their appreciation as artworks. (S) Aesthetic properties necessarily depend, at least in part, on properties perceived by means of the five senses. (X) There exist artworks that need not be perceived by means of the five senses to be appreciated as artworks. The independent plausibility and apparent joint inconsistency of these three propositions give rise to what I refer to as ‘the problem of non-perceptual art’. (...) Assuming that the propositions are independently plausible and jointly inconsistent, there will be three ways of solving the problem: you may affirm (R) and (S) while denying (X); you may affirm (S) and (X) while denying (R); or you may affirm (R) and (X) while denying (S). The first of these, once the orthodox solution, has been displaced in recent years by the second. The third has never really been defended. I defend it here. If successful, my defence will have shown that there is reason to deny the existence of non-aesthetic art and no reason to believe that art is not essentially aesthetic. (shrink)

The default theory of aesthetic value combines hedonism about aesthetic value with strict perceptual formalism about aesthetic value, holding the aesthetic value of an object to be the value it has in virtue of the pleasure it gives strictly in virtue of its perceptual properties. A standard theory of aesthetic value is any theory of aesthetic value that takes the default theory as its theoretical point of departure. In response to the concern that ethnically diverse immigrants are not being sufficiently integrated into receiving liberal democratic societies, liberal nationalists have offered two specific naturalization policy proposals. The first would require naturalizing immigrants to assimilate the national culture of the receiving society; the second would encourage newcomers to adopt the prevailing civic national identity. This paper rejects these proposals. In contrast to liberal nationalists, I deny that good citizenship presupposes a common culture or civic national identity and I develop (...) a non-nationalist naturalization model that would encourage immigrants to become integrated into liberal democratic societies by participating in their major socio-economic and political institutions and practices. In 2008, over 400 children living on the Yearning for Zion Ranch, a rural Texas polygamist community of the Fundamentalist Church of Jesus Christ of the Latter Day Saints (FLDS), were forcibly removed from their mothers’ care by State troopers responding to allegations of child abuse. This essay examines the role of neoliberal ideologies and, more specifically, what some queer theorists have identified as ‘metronormativity’ in solidifying a widespread caricature of FLDS mothers as ‘bad’ mothers. The intersections of these ideologies (...) with neocolonialist discourses, I argue, positions the FLDS mother as a subaltern subject unable to effectively speak in her own defense. (shrink)

Serena Olsaretti brings together new essays by leading moral and political philosophers on the nature of desert and justice, their relations with each other and with other values.

The current U.S. health care system, with both rising costs and demands, is unsustainable. The combination of a sense of individual entitlement to health care and limited acceptance of individual responsibility with respect to personal health has contributed to a system which overspends and underperforms. This sense of entitlement has its roots in a perceived right to health care. Beginning with the so-called moral right to health care, the issue of who provides health care has evolved as individual rights have (...) trumped societal rights. The concept of government providing some level of health care ranges from limited government intervention, a ‘negative right to health care’, to various forms of a ‘positive right to health care’. The latter ranges from a decent minimum level of care to the best possible health care with access for all. We clarify the concept of legal rights as an entitlement to health care and present distributive and social justice counter arguments to present health care as a privilege that can be provided/earned/altered/revoked by governments. We propose that unlike a ‘right’, which is unconditional, a ‘privilege’ has limitations. Going forward, expectations about what will be made available should be lowered while taking personal responsibility for one’s health must for elevated. To have access to health care in the future will mean some loss of personal rights and an increase in personal responsibility for gaining or maintaining one’s health. (shrink)

Biographical studies have shown that visual mental imagery plays a significant role in the conduct of scientific research, particularly in the generation of hypotheses. But the nature of visual mental imagery and its participation in abductive inference is not systematically understood. This paper discusses examples of visual abductive reasoning by archaeologists, analyzing them according to the visual information and the process of inference employed. This work supports the conclusion that visual abduction is useful to scientists under certain conditions and that (...) it is amenable to detailed study. (shrink)

How does civic disengagement develop? This article examines the theory that the dissatisfaction and disengagement citizens develop toward one government agency can extend to an alternative agency. Leveraging police precinct-level data on 311 calls and criminal complaints from 2004 to 2012 in New York City, it investigates whether government responsiveness to municipal issues predicts citizens’ willingness to submit criminal complaints to the police. The study finds that predictors of disengagement with law enforcement extend beyond negative interactions with law enforcement alone. (...) Rather, the time it takes local government officials to fix a 311 request for services, such as filling potholes and abating noise, shapes the likelihood that residents will file misdemeanor criminal complaints. Thus policymakers must account for the policy environment beyond their agency’s domain to alleviate citizens’ dissatisfaction and disengagement with government overall. (shrink)

Introduced into the philosophical lexicon during the Eighteenth Century, the term ‘aesthetic’ has come to be used to designate, among other things, a kind of object, a kind of judgment, a kind of attitude, a kind of experience, and a kind of value. For the most part, aesthetic theories have divided over questions particular to one or another of these designations: whether artworks are necessarily aesthetic objects; how to square the allegedly perceptual basis of aesthetic judgments with the fact that (...) we give reasons in support of them; how best to capture the elusive contrast between an aesthetic attitude and a practical one; whether to define aesthetic experience according to its phenomenological or representational content; how best to understand the relation between aesthetic value and aesthetic experience. But questions of more general nature have lately arisen, and these have tended to have a skeptical cast: whether any use of ‘aesthetic’ may be explicated without appeal to some other; whether agreement respecting any use is sufficient to ground meaningful theoretical agreement or disagreement; whether the term ultimately answers to any legitimate philosophical purpose that justifies its inclusion in the lexicon. The skepticism expressed by such general questions did not begin to take hold until the later part of the 20th century, and this fact prompts the question whether (a) the concept of the aesthetic is inherently problematic and it is only recently that we have managed to see that it is, or (b) the concept is fine and it is only recently that we have become muddled enough to imagine otherwise. Adjudicating between these possibilities requires a vantage from which to take in both early and late theorizing on aesthetic matters. (shrink)

According to the perspective developed in this article, widely shared, hegemonic cultural beliefs about gender and their impact in what the authors call “social relational” contexts are among the core components that maintain and change the gender system. When gender is salient in these ubiquitous contexts, cultural beliefs about gender function as part of the rules of the game, biasing the behaviors, performances, and evaluations of otherwise similar men and women in systematic ways that the authors specify. While the biasing (...) impact of gender beliefs may be small in any one instance, the consequences cumulate over individuals’ lives and result in substantially different outcomes for men and women. After describing this perspective, the authors show how it sheds newlight on some defining features of the gender system and illustrate its implications for research into specific questions about gender inequality. Feminist philosophical approaches to migration justice typically employ nonideal methodologies and relational normative frameworks to theorize the complex relationships among intersecting social identities, structural injustice, and global migration. This chapter discusses three such feminist approaches. The first investigates the connections between structural injustice and migration policy, focusing on immigrant admissions and refugee determination. The second explores the feminization of labor migration, with an emphasis on global care chains. Finally, the third feminist approach employs intersectional methodologies to argue that specific US (...) immigration policies work to the detriment of migrant women, particularly women of color. This chapter employs an intersectional, transnational feminist lens to examine the uneven impacts of paid domestic labor. I argue that the practice contributes to the exploitation of domestic workers by employers, migrants by US citizens, and ultimately, the global South by the global North. I recommend several policy reforms to remedy these injustices.

Given his representationalism how can Locke claim we have sensitive knowledge of the external world? We can see the skeptic as asking two different questions: how we can know the existence of external things, or more specifically how we can know inferentially of the existence of external things. Locke's account of sensitive knowledge, a form of non-inferential knowledge, answers the first question. All we can achieve by inference is highly probable judgment. Because Locke's theory of knowledge includes both first order (...) psychological and second order normative conditions, sensitive knowledge can be non-inferential and less certain than intuitive and demonstrative knowledge. Bridging the gap between feminist studies of motherhood and queer theory, Mothering Queerly, Queering Motherhood articulates a provocative philosophy of queer kinship that need not be rooted in lesbian or gay sexual identities. Working from an interdisciplinary framework that incorporates feminist philosophy and queer, psychoanalytic, poststructuralist, and postcolonial theories, Shelley M. Park offers a powerful critique of an ideology she terms monomaternalism. Despite widespread cultural insistence that every child should have one—and only one—“real” mother, many contemporary family constellations do (...) not fit this mandate. Park highlights the negative consequences of this ideology and demonstrates how families created through open adoption, same-sex parenting, divorce, and plural marriage can be sites of resistance. Drawing from personal experiences as both an adoptive and a biological mother and juxtaposing these autobiographical reflections with critical readings of cultural texts representing multi-mother families, Park advocates a new understanding of postmodern families as potentially queer coalitional assemblages held together by a mixture of affection and critical reflection premised on difference. Recent debates about the most appropriate political agents for realising social justice have largely focused on the potential value of national political parties on the one hand, and trade unions on the other. Drawing on the thought of Murray Bookchin, this article suggests that democratic municipalist agents – democratic associations of local residents that build and empower neighbourhood assemblies and improve the municipal provision of basic goods and services – can often also make valuable contributions to projects of just social (...) change. I identify a long-term and a more short-term argument for the value of democratic municipalist agency in Bookchin's thought and claim that the latter provides a compelling case for the valuable contributions this form of action can make to the achievement of a wide variety of visions of social justice. This provides a useful partial corrective to recent political theorising about the nature of the partisanship and trade unionism necessary to secure social justice. (shrink)

The newest innovation in assisted reproduction is oocyte cryopreservation, more commonly known as egg freezing, which has been developed as a method of fertility preservation. Studies emerging from around the world show that highly educated professional women are turning to egg freezing in their late thirties to early forties, because they are still searching for a male partner with whom to have children. For these women, egg freezing may be a new “hope technology” for future romance; but it may also (...) be a “technology of despair,” as women navigate the ends of a failing relationship. Based on the largest ethnographic study to date, undertaken with 150 women who froze their eggs for nonmedical reasons in the United States and Israel, we examine egg freezing at the end of romance. Relationship dissolution—involving divorce, separation, broken engagements, and relationship breakups from men who are unfaithful, controlling, rejecting, uncommitted, or unready for fatherhood—is one of the major pathways to egg freezing. When such relationship dissolution ruptures a woman’s reproductive life course, egg freezing may become a “technology of repair,” allowing women to find new strengths and opportunities as well as new visions for the future. Locke defines knowledge as the perception of the agreement or disagreement of ideas. Nevertheless, he claims that we know particular things: the identity of our ideas, our own existence, and the existence of external objects. Although much has been done to reconcile the definition of knowledge with our knowledge of external objects, there is virtually nothing in the scholarship when it comes to knowing ideas or our own existence. I fill in this gap by arguing that perceptions of ideas are (...) complex mental states that convey propositional knowledge due to agreeing elements therein. (shrink)

Witty, sexy and radiantly beautiful, the Shelley translationof Plato's great Dialogue on Love is by far the best in theEnglish language. It has been described as conveying "much of the vivid life, the grace of movement, and the luminous beauty of Plato" -- "the poetry of a philosopher rendered by the prose of a poet." Although a masterpiece in its own right, the Shelley translation was suppressed and then bowdlerized for well over a century. In 19th century Britain, (...) male love -- at the heart of the dialogue -- was unmentionable. The Banquet and Shelley's accompanying essay, "A Discourse on the Manners of the Antient Greeks," were not published in their entirety until 1931, and then in an edition of 100 copies intended "for private circulation only." The Pagan Press edition is complete, authentic and readable. For the first time this work has received the editing and typography it deserves. (shrink)

We live in anagewhere"progressive" intellectualspresuppose that true democracy demands the affirmation of "global values" and the drive toward a world government, a"universal and homogenous state." Intellectuals, journalists, and educators bemoan the effects of "globalization" even as they uncritically endorse cosmopolitanism and dismissnational attachments as parochial and outdated. They confuse thoughtful patriotism - and commitment to the self-governing nation - with the narrowest form of nationalism. In a wonderfullylucid and learned essay, Trevor Shelley recovers a humane liberal tradition, from Montesquieu (...) to Manent, that takes the political seriously and does full justice to the legitimate claims of both universality and particularity. In “Why Should Liberals Care about Equality?,” Ronald Dworkin distinguishes between two forms of liberalism, one form based on neutrality, and the other one based on equality. As Dworkin explains it, proponents of both forms argue against legal incursion into private morality, and argue in favour of increased sexual, political, racial, and economic equality; however, they disagree about which of these traditionally liberal values is the fundamental one, and which is its derivative. Liberalism based on neutrality takes as its fundamental (...) value that one which holds that government must remain neutral with respect to moral issues, and it supports egalitarian measures only insofar as they can be shown to derive from that constitutive principle. For liberalism based on equality, the fundamental value is that one which holds that government must treat each of its citizens as an equal; egalitarian liberalism insists upon moral neutrality only to the extent that equality requires it. The logical empiricists held that an analogical hypothesis does not gain any acceptability from the analogy on which it is founded. On this view, the acceptability of a hypothesis cannot be discounted by criticizing the foundational analogy. Yet scientists commonly appear to level exactly this sort of criticism. If scientists are able to discount the acceptability of analogical hypotheses in this way, then the logical empiricist view is mistaken. I analyze four forms of analogy counterargument, disanalogy, misanalogy, counteranalogy, and false (...) analogy, with examples from the debate over the asteroid impact hypothesis. Global migration raises important ethical issues. One of the most significant is the question of whether liberal democratic societies have strong moral obligations to admit immigrants. Historically, most philosophers have argued that liberal states are morally free to restrict immigration at their discretion, with few exceptions. Recently, however, liberal egalitarians have begun to challenge this conventional view in two lines of argument. The first contends that immigration restrictions are inconsistent with basic liberal egalitarian values, including freedom and moral equality. The (...) second maintains that affluent, liberal democratic societies are morally obligated to admit immigrants as a partial response to global injustices, such as poverty and human rights violations. This article surveys the main philosophical arguments for these positions on immigration and discusses the critical responses to these arguments. (shrink)
