Achieving a good clinical trial design increases the likelihood that a trial will take place as planned, including that data will be obtained from a sufficient number of participants, and the total number of participants will be the minimal required to gain the knowledge sought. A good trial design also increases the likelihood that the knowledge sought by the experiment will be forthcoming. Achieving such a design is more than good sense—it is ethically required in experiments when participants are at (...) risk of harm. This paper argues that doing a power analysis effectively contributes to ensuring that a trial design is good. The ethical importance of good trial design has long been recognized for trials in which there is risk of serious harm to participants. However, whether the quality of a trial design, when the risk to participants is only minimal, is an ethical issue is rarely discussed. This paper argues that even in cases when the risk is minimal, the quality of the trial design is an ethical issue, and that this is reflected in the emphasis the Belmont Report places on the importance of the benefit of knowledge gained by society. A growing literature testifies to the persistence of place as an incorrigible aspect of human experience, identity, and morality. Place is a common ground for thought and action, a community of experienced particulars that avoids solipsism and universalism. It draws us into the philosophy of the ordinary, into familiarity as a form of knowledge, into the wisdom of proximity. Each of these essays offers a philosophy of place, and reminds us that such philosophies ultimately decide how we make, use, and (...) understand places, whether as accidents, instruments, or fields of care. In this paper I will develop a lambda-term calculus, lambda-2Int, for a bi-intuitionistic logic and discuss its implications for the notions of sense and denotation of derivations in a bilateralist setting. Thus, I will use the Curry-Howard correspondence, which has been well-established between the simply typed lambda-calculus and natural deduction systems for intuitionistic logic, and apply it to a bilateralist proof system displaying two derivability relations, one for proving and one for refuting. The basis will be the natural deduction (...) system of Wansing's bi-intuitionistic logic 2Int, which I will turn into a term-annotated form. Therefore, we need a type theory that extends to a two-sorted typed lambda-calculus. I will present such a term-annotated proof system for 2Int and prove a Dualization Theorem relating proofs and refutations in this system. On the basis of these formal results I will argue that this gives us interesting insights into questions about sense and denotation as well as synonymy and identity of proofs from a bilateralist point of view. Restorative or Retributive Justice South African Episcopal Archbishop Desmond Mpilo Tutu's account of the gritty practicality of reconciliation versus retribution in his book, No Future Without Forgiveness, focuses long overdue attention on Restorative Justice, a law reform movement probably better known in international than in American legal circles. A persuasive assertion of Restorative (...) Justice advocates in their critique of increasingly retributive practices such as mandatory minimum sentencing, mandatory arrest, death penalty, juvenile incarceration, "three strikes" legislation, no parole, diminished prisoner services, to name a few, is that reintegrating offenders back into a community is a much more effective deterrence to anti-social violence than punishment alone. They have also observed that communitarian ideals and practices, more visible in traditional cultures1 are more conducive to Restorative goals ofreconciliation and reintegration than are practices of retributive justice rooted in ideals of individual rights. Therefore, such adjudicatory practices should serve as models for preferable alternatives. 1An examination ofrestorative justice under code-based systems of law (European, Roman Law) might also reveal more affinities since the focus ofthese systems is to define the permissible, rather than the impermissible. Code-based law begins with the commons; rightsbased law begins with the individual. 80Sara Osborne However, Western-style retributive justice remains the primary model for international law and Restorative Justice is the prophetic "outsider" voice. So, it is appropriate to ask to what extent and under what conditions are Western retributive justice systems able to incorporate or accommodate adjudicatory practices ofnon-Western or traditional cultures? How critical a factor is religion? These questions will appear wherever Western Law struggles to bring more cultural diversity under a unifying umbrella and they deserve close scrutiny. René Girard's insights into the relationship between law, religion, culture and violence are helpful in identifying practical implications ofthe restorative vision and systemic weaknesses ofretribution, and perhaps illuminating a third way. The metaphor of an organ transplant may be useful: without a genetic match between host and donor both risk destruction. It is the thesis of this paper that that genetic material is a very inclusive conceptualization of "religion" which I have named "Ultimate Authority," drawing on Girard's mimetic theory for the theoretical analysis. In other words, "religion" is indeed, always and everywhere, a critical factor in culture-specific institutions ofjustice. A Girardian understanding ofthe relationship between Ultimate Authority and criminaljustice systems indicates that while there are valuable lessons to be learned from trans-cultural dialogue, wholesale transplants may not be possible, or even advisable because conditions essential for comparable success do not exist in Western legal culture. This paper first presents some background about Restorative Justice, followed by an outline ofRené Girard's mimetic theory to define "Ultimate Authority." The second half of the paper describes alternative adjudicatory processes which have attracted the attention of Restorative Justice advocates and concludes with suggestions about future directions for criminal justice policy discussion. Restorative Justice is a movement which drew its initial energy from Civil Rights era non-violent social action. It has found avid supporters among those whose activism for socialjustice is faith-based as well as those whose activism is rooted in more secular communitarian ideologies. Perhaps because of its international following, a significant contribution ofthe movement has been to initiate trans-cultural dialogue about criminal justice, fostering an increased use of alternative dispute resolution techniques, primarily mediation. Restorative Justice doctrine insists that all crime is personal, evidence ofa broken relationship between victim, offender, and community. Restoring "right relationship" between all parties is both a moral and legal obligation; "justice" to be just must go well beyond addressing the specifics of the act which effected the break. In contrast, the focus of The Role ofAn Ultimate Authority81 retributive justice appears abstract, procedural, and narrow in pursuit of impartiality or neutrality, the ideal of Blind Justice.2 Howard Zehr, a consultant on criminal justice and a Canadian Mennonite who wrote the classic Restorative Justice primer, Changing Lenses: A New Focusfor Crime andJustice, describes the retributive criminaljustice process as "a drama between two abstractions," meaning a criminal and a victim, where the "victim" is even further abstracted... Sara T. Fry maintains that care is a central concept for nursing ethics. This requires, among other things, that care is a virtue rather than a mode of being. But if care is a central virtue of ethics and medical ethics then the claim that care is a central concept for nursing ethics is trivial. Otherwise, it is implausible.

It has been argued that reduction procedures are closely connected to the question about identity of proofs and that accepting certain reductions would lead to a trivialization of identity of proofs in the sense that every derivation of the same conclusion would have to be identified. In this paper it will be shown that the question, which reductions we accept in our system, is not only important if we see them as generating a theory of proof identity but is also (...) decisive for the more general question whether a proof has meaningful content. There are certain reductions which would not only force us to identify proofs of different arbitrary formulas but which would render derivations in a system allowing them meaningless. To exclude such cases, a minimal criterion is proposed which reductions have to fulfill to be acceptable. (shrink)

pSara Ahmed’s emWillful Subjects/em develops an account of willfulness as a site of simultaneous oppression and resistance: a diagnosis attributed to particular (not-quite-)subjects and to modes of behavior that are thereby diminished, pathologized, and controlled, and a “diagnosis” that may be positively affirmed as a way of living and doing otherwise. This essay puts Ahmed’s work on willfulness in conversation with María Lugones’ decolonial feminism, particularly her theory of active subjectivity. With Lugones, we offer, one can better understand the resistant (...) potential of willfulness, not simply as the willful subject possessing an oppositional “will of her own” (which risks reinscribing a unitary notion of the self), but rather, as exercising a different kind of subjectivity altogether—one that relies on multiplicity and arises through relationships across non-dominant difference. Extending the connections that Ahmed herself draws between willfulness and “madness,” we further explore the willful elements in experiences relating to mental illness and cognitive disability, categories of experience that we understand to be important (and undertheorized) aspects of what Aníbal Quijano has termed “the coloniality of power.”/p. Some philosophers have suggested that, instead of attempting to arrive at a satisfactory definition of the physical, we should adopt the ‘via negativa.’ That is, we should take the notion of the mental as fundamental, and define the physical in contrast, as the non-mental. I defend a variant of this approach, based on some information about how children form concepts. I suggest we are hard-wired to form a concept of intentional agency from a very young age, and so there’s some (...) reason to believe that our concept of the physical does include, as part of its content, a contrast with the mental. Kim argues that we can never have more than one complete and independent explanation for a single event. The existence of both mental and physical explanations for behavior would seem to violate this principle. We can avoid violating it only if we suppose that mental causal relationships supervene on physical causal relationships. I argue that although his solution is attractive in many respects, it will not do as it stands. I propose an alternate understanding of supervenient causation which preserves the (...) advantages of Kim's account while avoiding the problems. My analysis involves appeal to counterfactuals. Any counterfactual analysis must confront the problem that mental states appear to be screened off from causal relevance by physical states. I argue that screening off is not a problem, because cases in which mental states appear to be screened off are cases in which background conditions are not held constant. (shrink)

This book brings a new perspective—mainly out of German intellectual discussions rooted in Hegel—to bear on the problems of equality as discussed in Anglo-American conceptions of liberalism. Menke argues that the idea of equality is at the heart of political modernity. At the same time, political modernity is characterized by an attitude of critical reflection on the notion of equality in view of its consequences for the lives of individuals. This book explores the sources and legitimacy as well as the (...) limitations and problems of this attitude toward equality in the work of such thinkers as Adorno, Habermas, Derrida, Hegel, Luhmann, Nietzsche, Rawls, and Schmitt. Looking at key texts in modern political philosophy, the author develops the claim that there is a basic and irreconcilable conflict in justice: between general demands of equality and attention to the individual. In a debate with contemporary Anglo-American liberal philosophy’s concepts of rights, the political process is thereby understood as an interminable strife and negotation between equality and individuality. Gray's account is remarkable in its depth and scope but too little attention is paid to poor correspondences with the literature on hippocampal/subicular damage, the theta rhythm, and novelty detection. An alternative account, focusing on hippocampal involvement in organizing memories in a way that makes them accessible to conscious recollection but not in access to consciousness per se, avoids each of these limitations.

Parallel to Koriat & Goldsmith's accounting of human memory, there are two distinct approaches in animal learning. Behaviorist approaches focus on quantitative aspects of conditioned response probability, whereas cognitive and ethological approaches focus on qualitative aspects of how memory is used in real life. Moreover, in animal research these distinguishable measures of memory are dissociated in experimental amnesia.

Marxist historiography has always claimed to be "conceptually" rooted in the natural sciences and has therefore been concerned with the function of laws, the structure of theories, and the logical relations between hypotheses and empirical data. Minimal criteria for the identification of a scientific research program as developed by Lakatos and Laudan include: a negative heuristic; explanatory or predictable scientific theories; a central model or paradigm; identification and solution of internal problems; self-conscious awareness by researchers of a common tradition; and (...) the internal dynamics of conflict and convergence. Less than a generation ago, Marxist scholarship seemed to offer the most innovative methodologies in history. More recently, however, Marxist scholarship seems to be reliving old glories while other approaches have advanced more innovative research programs. (shrink)

Stories and legends in which animals teach ethical behavior from a Jewish perspective.

ABSTRACT Our discussion of Niccolò Tornioli's The Astronomers questions some of the traditional identifications of its characters, although we cannot claim to have solved these figures’ identities and several remain a mystery. We do present new iconographic interpretations of particular scientific instruments, diagrams, and natural phenomena in the canvas. These novel readings occasionally remain conjectural in part because Tornioli represents these entities in a way that makes it clear that he did not fully comprehend them. The errors and obscurities in (...) Tornioli’s painting lead us to two conclusions. First, that his erudite patron Virgilio Spada was unlikely to have been involved in the definition of the painting’s iconographies, as he would have objected to Tornioli’s crass mistakes and obscure imagery. Second, that these errors and indistinct details should be taken at face value, insofar as they accentuate the difficulties of astronomical observation. Beyond highlighting these challenges, we argue that the painting also visualizes techniques for countering them. Specifically, the canvas would have focused early modern observers’ attention on the edifying powers of civil conversations and communal observations with scientific instruments as well as images—including diagrams, celestial maps, and paintings. Pragmatic competence includes the capacity to express illocutionary force and successfully achieve perlocutionary effects, in order to guarantee fully functional communication exchanges. Alzheimer’s Disease is characterized by a constellation of limitations derived from progressive cognitive impairment, which is usually viewed as a global uniform phenomenon. In this paper it is argued that looking independently at the loss and recovery of pragmatic function related to illocutionary and perlocutionary abilities can be a productive way of understanding the progressive deterioration of communicative capacities (...) by patients or their improvement under targeted treatment.
