It begins with an overview of conducting empirical legal research, discussing its research design, implementation, and challenges faced. Theorizing in empirical legal scholarship comes in different forms: in some projects theories seek to provide insight into a wide range of phenomena, others are tailored to fit particular situations. In the clarification process the researcher translates abstract notions into concrete ones. To convert the data (...) into an analyzable form, empirical legal researchers make use of a variety of data-generation mechanisms. Researchers can implement random sampling in various ways depending on the nature of the problem. Data analysis enables researchers to compare their overlap. The goal of empirical legal research is to find facts about the unknown. The last step of empirical legal research is to present its results, for which, documentation is a requisite. (shrink)

Something you can't know. Something that's hidden in plain sight. And Johnson, though never possessing that knowledge, indicates, time and time again, both its utter impossibility and the impossibility of ceasing to utter it—the impossibility that generates time as always already time again, as allegorical temporality, as the compulsion (implicit in the phrase "you (...) should know") to repeat our failure to know it and to call that failure knowledge itself. There's something you should know about Barbara Johnson, and it's something I'm here not to tell you. For telling, as Johnson allows us to see, obscures the unmasterable relation between what's told and the act of telling it. It distracts our attention, in other words, from something else always at work in its words to complicate or confound it, something we've come to identify as the rhetorical, the performative, or the literary, but something to which Johnson, by way of reference to Freud, gives another name as well: "Freud called this something the death instinct, but this death instinct is to be understood as what ceaselessly escapes the mastery of understanding and the binary logic of opposition by exhibiting some 'other' logic one can neither totally comprehend nor exclude." To which she then goes on to add: "Any statement that affirms, while using a logic different from the logic of binary opposition, will necessarily not conform to binary notions of 'clarity'" ["Nothing Fails Like Success" 13].Now consider the opening sentences of the headnote to the Norton Anthology of Criticism's selection from Barbara Johnson's work, a headnote that situates Johnson with the anonymous authority of a knowledge from on high, of the sujet supposé savoir, though that subject here, like its object, is Barbara Johnson, who wrote it herself: "Barbara Johnson is known as a translator in various senses of the word. She is the celebrated translator of Jacques Derrida's Dissemination; and she is also one of the earliest and most interesting translators of structuralist and poststructuralist theory into literary insights. Often praised for her 'lucidity' and 'clarity,' she has nevertheless emphasized, again and again, the unavoidability and necessity of linguistic complexity and difficulty in formulating intractable problems."1 Though this seems, on the face of it, clear enough, don't let that obscure its obscurity. For Johnson acknowledges—or confesses, or laments—that she's "often praised" for a "clarity" to which, as the earlier passage makes clear, the statements in deconstructive texts "will necessarily not conform." Are Johnson's texts not deconstructive then? Is her logic really binary? Or is some "other" logic operative here when she clearly affirms that deconstructive affirmations necessarily won't seem clear?To see this obscurity more clearly—to see it more clearly, that is, as obscurity—let me translate Johnson's comments into the logical pattern of a syllogism, although Johnson herself reminds us that "what is most radical in deconstruction" is precisely its incompatibility with familiar structures of binary logic ["Nothing" 12]. Describing that incompatibility, she writes, "while traditionalists say that a thing cannot be both A and not-A, deconstructors open up ways in which A is necessarily but unpredictably [End Page 89] already different from A" [14]. Let me frame this account of deconstruction as the major premise of a syllogism: "All deconstructive statements or texts affirm through a logic different from that of binary opposition.'" Johnson, in discussing the death instinct, has already provided our minor premise: "All statements or texts that affirm through a logic not that of binary opposition 'will necessarily not conform to binary notions of "clarity."'" This article explores the connection between critical reading and Jurgen Habermas’s theory of communicative action. It proposes that Habermas’s criteria used for evaluating validity claims in communicative action can be applied in reading texts critically. Analyses of different types of texts are presented to show how critical reading is done in a Habermasian way. This article ends with a discussion of the application of Habermas’s theory in addressing educational issues.

This article gives an overview of Buddhist-oriented meditation techniques that were integrated with art projects for four and five year old kindergarten children at Dong Guk Kindergarten, Gyeongju City, South Korea. The article assesses the effect of this program on the creatvitiy levels of the children.

On Sunday morning, 23 February 1997, the world awoke to a technological advance that shook the foundations of biology and philosophy. On that day, we were introduced to Dolly, a 6-month-old lamb that had been cloned directly from a single cell taken from the breast tissue of an adult donor. Perhaps more astonished by this accomplishment than any of their neighbors were the scientists who actually worked in the field of mammalian genetics and embryology. Outside the lab where the cloning (...) had actually taken place, most of us thought it could never happen. Oh, we would say that perhaps at some point in the distant future, cloning might become feasible through the use of sophisticated biotechnologies far beyond those available to us now. But what many of us really believed, deep in our hearts, was that this was one biological feat we could never master. New lifemust have its origins in an embryo formed through the merger of gametes from a mother and father. It was impossible, we thought, for a cell from an adult mammal to become reprogrammed, to start all over again, to generate another entire animal or person in the image of the one born earlier. This article argues humanities scholarship is often dismissive of the quantitative, and that there is scope for worthwhile interdisciplinary research into the way everyday life is given tone and texture by experiences and cultures of number. Following the work of Mary Poovey (2008) and Steven Connor (2016), it challenges the view, particularly influential in the humanities, that number and associated ideas to do with data, objectivity, mathematics, and the rational, are parasitic upon life. In contrast to this view, this article (...) suggests that even if the idea of ‘the human’ is defined in opposition to number, the relation between the two is more usefully understood as an interweaving of differential tensions, rather than two poles separated by an uncrossable distance. Examples from literary fiction and two smartphone apps are analysed with the intent of initiating a dialogue between different cultural objects that share a concern with number and human experience. In the current era of the Sustainable Development Goals, many countries are attempting to strengthen their health system and achieving Universal Health Coverage. The Korean National Health Insurance system functions as a core element of health financing, contributing to achieving UHC by promoting public health and social security through insurance benefits for prevention, diagnosis, treatment, rehabilitation, childbirth, and health promotion. The Republic of Korea achieved 100% NHI coverage of the target population in 1989, 12 years after the introduction of the (...) social insurance system. However, poor coverage of health services and lack of financial protection are major obstacles to achieving UHC. Therefore, the Korean government announced and implemented ‘Moon Jae-in Care’ in August 2017 to enhance the coverage rate of NHI by 70%. First, this study reviews the existing health insurance system in Korea from the perspective of health financing and UHC. Second, it analyses ‘Moon Jae-in Care’, based on the main framework of UHC. Third, it considers the ethical implications of these developments, with focus on the principles of equity, fairness, autonomy, and solidarity. Although the NHI reform is expected to propel Korean health care closer to UHC, many ethical, social, and political issues remain. (shrink)

We suggest that there are two coordination games when it comes to understanding kin terminology. Jones' article focuses on the linguistic coordination inherent in developing meaningful kin terminologies, alluding briefly to the benefits of these kin terminologies for coordination in other domains. We enhance Jones' discussion by tracing the links between the structure of kin terminologies and their functions.

As employee assistance programs (EAPs) have evolved and expanded their scope in the past decade, many factors have contributed to meeting the demands of conflicting client constituencies in a multifaceted client environment. This article enumerates several of these factors, notes consequences of ensuing conflicts, and ultimately proposes some methods to counter some of these ethical dilemmas in the future. It is the hope that greater recognition and understanding of ethical conflicts in client loyalty within a host organization will foster increased (...) sensitivity on the part of the EAP practitioner toward resolving these conflicts. We are happy to present the Fall 2017 issue of Constellations journal. Included within are four diverse undergraduate papers ranging vastly in topic. We made a conscious effort to encourage submissions from a wide range of disciplines, provided the work could be broadly considered “historical” in scope. In the following essay, I argue for an alternative anthropocentrism that, eschewing failed appeals to traditional moral principle, takes (a) as its point of departure the cognitive, perceptual, emotive, somatic, and epistemic conditions of our existence as members of Homo sapiens, and (b) one feature of our experience of/under these conditions particularly seriously as an avenue toward articulating this alternative, the capacity for aesthetic appreciation. To this end, I will explore, but ultimately reject philosopher Allen Carlson's ecological aesthetics, and I (...) will adopt with modification aspects of the work of Ronnie Hawkins, Val Plumwood, and Donna Haraway. My central claim is that, equipped with a better understanding of our interdependent relationship to/within human and nonhuman nature, an understanding made especially available to those who occupy situations imbued by subjugation, we can come to understand our human-centeredness not as a justification of entitlement, but as an opportunity for critical self-reflection upon those actions which endanger the ecological conditions of human and nonhuman being. I suggest, then, that developing criteria for an aesthetic appreciation ground in such a centeredness can make a vital contribution to a more ecologically defensible moral and political activism.
