Comparative law is a subject always in motion. Scholarly discussion about its methodology is always vivid, in search of better tools to make the different possible comparative endeavors. The paper explores the concept of lawscape and its link with comparative legal methodology. The concept of lawscape will be linked with other relevant concepts in comparative law, like those of legal pluralism, legal transplants, legal formants and legal fluxes to make the necessary connections and find its space within the tools of (...) comparative law. After a brief outline of Enoch’s defense of robust realism in his Taking Morality Seriously, I focus on Enoch’s taking-morality-seriously thought by making explicit the assumptions I see involved in it. Enoch’s argument from impartiality is then reconstructed to show how these assumptions are at work. Next, I explain the reasons why Enoch does not succeed in converting these assumptions into a positive argument for the thesis implied by robust realism that there is a moral objectivity. Finally, I conclude that (...) the critical analysis provided casts a shadow on the reliability of the taking-morality-seriously thought as a basis of a theoretical inquiry into the nature of morality. The study of intellectual humility (IH), which is gaining increasing interest among cognitive scientists, has been dominated by a focus on individuals. We propose that IH operates at the collective level as the tendency of a collective’s members to attend to each other’s intellectual limitations and the limitations of their collective cognitive efforts. Given people’s propensity to better recognize others’ limitations than their own, IH may be more readily achievable in collectives than individuals. We describe the socio-cognitive dynamics that can (...) interfere with collective IH and offer the solution of building intellectually humbling environments that create a culture of IH that can outlast the given membership of a collective. Plural expressions found in natural languages allow us to talk about many objects simultaneously. Plural logic — a logical system that takes plurals at face value — has seen a surge of interest in recent years. This book explores its broader significance for philosophy, logic, and linguistics. What can plural logic do for us? Are the bold claims made on its behalf correct? After introducing plural logic and its main applications, the book provides a systematic analysis of the relation between (...) this logic and other theoretical frameworks such as set theory, mereology, higher-order logic, and modal logic. The applications of plural logic rely on two assumptions, namely that this logic is ontologically innocent and has great expressive power. These assumptions are shown to be problematic. The result is a more nuanced picture of plural logic's applications than has been given thus far. Questions about the correct logic of plurals play a central role in the final chapters, where traditional plural logic is rejected in favor of a "critical" alternative. The most striking feature of this alternative is that there is no universal plurality. This leads to a novel approach to the relation between the many and the one. In particular, critical plural logic paves the way for an account of sets capable of solving the set-theoretic paradoxes. (shrink)

This biography sheds new light on the life and work of physicist Ettore Majorana (including unpublished contributions), as well as on his mysterious disappearance in March 1938. Majorana is held by many, including Nobel Laureate, Enrico Fermi, to have been a genius of the rank of Galilei and Newton. In this intriguing story, the author, himself a leading expert on the work of Majorana, supplements the existing literature with new insights, anecdotes and personal accounts of contemporaries of Majorana.

This paper discusses Max Scheler’s early works, written between 1899 and 1906 in a neo-Kantian context. The very little attention the literature paid to them was almost always guided by the only aim to single the themes out which can be used as signs of Scheler’s future „conversion“ to phenomenology. In consequence of this predominant approach, the neo- Kantianism that characterizes Scheler’s early works has been treated as a vague notion and never examined as such. The paper specifies this notion (...) through an examination of Scheler’s early works which shows their most significant theoretical debts (to R. Eucken, W. Windelband and particularly to H. Cohen) and the questions they deal with, i.e. the relation between knowledge and morality as different kinds of objective forms of experience; the methodological problem in philosophy; the development of a transcendental logic as general science of objectivity. In this paper, I try to identify the reasons why the dialogue between sociocultural anthropology and animal rights theories and movements continues to be difficult and scarce. At first sight this weakness of communication is surprising, if one looks at the amount of anthropological studies on human/animal relationships, in most cases pointing to how animals are considered in many cultures as non-human subjects or persons. For understanding the roots of this state of affairs, I compare the ways anthropologists and animal (...) rights theorists and activists have engaged with the issue of the differences and commonalities between human beings and nonhuman animals. For this aim, I contrast the search, among philosophers and activists, for a universal rational ethical foundation of animal rights, to which natural sciences’ findings can give support, with sociocultural anthropologists’ focus on the embeddedness of human/animal relationships in symbolic systems and in political relationships. In spite of the paradigmatic shifts intervened in a century and half of sociocultural anthropology, I show, through a critical review of the recent works of Ingold, Descola, Viveiros de Castro and Kohn, that even today this difference in approach is far to be overcome. In linguistics, the dominant approach to the semantics of plurals appeals to mereology. However, this approach has received strong criticisms from philosophical logicians who subscribe to an alternative framework based on plural logic. In the first part of the article, we offer a precise characterization of the mereological approach and the semantic background in which the debate can be meaningfully reconstructed. In the second part, we deal with the criticisms and assess their logical, linguistic, and philosophical significance. We identify four (...) main objections and show how each can be addressed. Finally, we compare the strengths and shortcomings of the mereological approach and plural logic. Our conclusion is that the former remains a viable and well-motivated framework for the analysis of plurals. (shrink)

L’ipotesi è che quando usiamo il vocabolariodella credenza diciamo qualcosa di specifico e irriducibile adaltre nozioni. Alla ricerca del nucleo di irriducibilità e specificitàdella credenza Giuseppe Di Salvatore scarta tutte quelle forme dicredenza che dipendono in maniera più o meno diretta da unaconsiderazione in termini di conoscenza o da un’implicazione dellaverità. Se alcuni tipi di giustificazione della credenza possono essereutili (...) a individuarne l’irriducibilità, solo le credenze primitive, unacomplessa nozione di “credenza soggettiva” e un originale modellofiduciario della credenza fungono da buoni candidati per difenderela specificità della credenza. Dopo la discussione di alcune tesi diLudwig Wittgenstein e il ricorso a fonti eterogenee, da William Jamesa Henry Habberley Price fino a Niklas Luhmann, l’autore proponela nozione originale di “credenza progressiva” come il migliorcandidato che confermi l’ipotesi di partenza. In essa una precisaidea di rischio e la fiducia, al cui dibattito è dedicata un’ampiaattenzione, contribuiscono a delineare la credenza progressivainsieme ad alcuni suoi aspetti soggettivi, così profilandola comeuna postura sperimentale. Il saggio si completa con una riflessionesulla peculiarità della questione filosofica della credenza religiosa,la quale viene approcciata nella sua preliminare generalità, quindiconfrontata con la credenza progressiva. Semantic theories based on a hierarchy of types have prominently been used to defend the possibility of unrestricted quantification. However, they also pose a prima facie problem for it: each quantifier ranges over at most one level of the hierarchy and is therefore not unrestricted. It is difficult to evaluate this problem without a principled account of what it is for a quantifier to be unrestricted. Drawing on an insight of Russell’s about the relationship between quantification and the structure of (...) predication, we offer such an account. We use this account to examine the problem in three different type-theoretic settings, which are increasingly permissive with respect to predication. We conclude that unrestricted quantification is available in all but the most permissive kind of type theory. (shrink)

What is the relation between some things and the set of these things? Mathematical practice does not provide a univocal answer. On the one hand, it relies on ordinary plural talk, which is implicitly committed to a traditional form of plural logic. On the other hand, mathematical practice favors a liberal view of definitions which entails that traditional plural logic must be restricted. We explore this predicament and develop a “critical” alternative to traditional plural logic.

Liberal theory seems to be caught in an impasse. On the one hand, since it has social order as its object, it appears to be committed to resolving the problem of disagreement between the various conceptions; on the other, insofar as it is philosophical theory, it seems destined to cause conflict. How, then, can liberalism offer a solution which guarantees the duration in time of a society, without, however, proposing a theory that would merely be one among others? And how (...) can it do this without adopting reductionist strategies, and by trying to remain faithful to the idea that a society should be ordered by a conception of justice? This is the paradox of liberal political philosophy. And this same paradox is the theme that Rawls confronts in Political Liberalism. (shrink)

Plural logic is widely assumed to have two important virtues: ontological innocence and determinacy. It is claimed to be innocent in the sense that it incurs no ontological commitments beyond those already incurred by the first-order quantifiers. It is claimed to be determinate in the sense that it is immune to the threat of non-standard interpretations that confronts higher-order logics on their more traditional, set-based semantics. We challenge both claims. Our challenge is based on a Henkin-style semantics for plural logic (...) that does not resort to sets or set-like objects to interpret plural variables, but adopts the view that a plural variable has many objects as its values. Using this semantics, we also articulate a generalized notion of ontological commitment which enables us to develop some ideas of earlier critics of the alleged ontological innocence of plural logic. World-systems analysis is a well-established but poorly-defined critical research tradition in the social sciences. Its undisputed progenitor, Immanuel Wallerstein, steadfastly maintains that world-systems analysis is not a theory, yet it is widely referred to as such by commentators, critics, and practitioners alike. The resolution to this conundrum is to identify the defining elements of world-systems analysis as a perspective for understanding human society, then to evaluate propositions based on these defining elements as theories that have been conceptualized from a world-systems (...) perspective. In this paper five defining elements of world-systems analysis are identified that together support a central theorem that the core-periphery hierarchy of the modern world-system can best be understood in terms of state strength and cultural integration. A further conjecture is made that the successor world-system to the current capitalist world-economy is more likely to be an American world-empire than the socialist world-government craved by many world-systems analysts. A realist approach to learning is what I propose here. This is based on a non-epistemic dimension whose presence is a necessary assumption for a concept of learning of a life-world as complementary to learning within a life-world. I develop my approach in opposition to Jürgen Habermas' pragmatic approach, which seems to lack of something from a realist point of view.

This article considers historical facts and investigates the particular relationship between a factual and a valuative dimension within them. The operation is an autopsy of a particular historical fact, which works as an example. On this basis, the article will elucidate the similarities and the differences between historical facts and natural facts, with an emphasis on the observation that the former are more subject to the influence of interpretation than the latter.
