When Congress passed HIPAA, it did not intend to constrain public health's data sharing in the same way as clinical or payers. In fact, HIPAA recognizes data sharing with public health as a matter of national priority and shields this function from its reach. However, a health department may offer services that bring it within HIPAA's purview, such as running a Children's Health Insurance Program or a laboratory that bills electronically. When this is the case, HIPAA requires all information and (...) departments be subject to HIPAA unless the public health authority chooses to hybridize. Health departments might re-assess their coverage and elect to become a hybrid entity, thereby restricting HIPAA to only where required and removing barriers to information sharing with communities. The diversity of state confidentiality laws governing public health data presents a significant challenge for public health initiatives. This challenge is further complicated by the array of confidentially laws that are relevant within a state as disclosure and usage standards vary depending upon data holder, type, and source. These laws often have not been updated to address modern confidentiality risks such as unlawful data linkage or breach, leaving many public health organizations without clear guidance in the contentious area of individual (...) privacy. To address these challenges, public health organizations have increasingly turned to the science of de-identification, but whether de-identification adequately meets the many and varied state confidentiality legal requirements remains an unanswered question. In this article, we apply the literature on the ethics of choice-architecture (nudges) to the realm of virtual reality (VR) to point out ethical problems with using VR for empathy-based nudging. Specifically, we argue that VR simulations aiming to enhance empathic understanding of others via perspective-taking will almost always be unethical to develop or deploy. We argue that VR-based empathy enhancement not only faces traditional ethical concerns about nudge (autonomy, welfare, transparency), but also a variant of the semantic variance problem (...) that arises for intersectional perspective-taking. VR empathy simulations deceive and manipulate their users about their experiences. Despite their often laudable goals, such simulations confront significant ethical challenges. In light of these goals and challenges, we conclude by proposing that VR designers shift from designing simulations aimed at producing empathic perspective-taking to designing simulations aimed at generating sympathy. These simulations, we claim, can avoid the most serious ethical issues associated with VR nudges, semantic variance, and intersectionality. (shrink)

Using process philosophy, especially its view of nature and its ethic, we develop a process-based environmental ethic embodying minimalism and beneficience. From this perspective, we criticize the philosophy currently underlying public policy and examine some alternative approaches based on phenomenology and ethnomethodology. We conclude that process philosophy, minus its value hierarchy, is a powerful tool capable of supporting both radical and n10derate changes in environmental policy.

The idea of self-forgiveness poses a serious challenge to any philosopher interested in giving a general account of forgiveness. On the one hand, it is an uncontroversial part of our common psychological and moral discourse. On the other, any account of self-forgiveness is inconsistent with any general account of forgiveness which implies that only the victim of an offense can forgive. To avoid this conclusion, one must either challenge the particular claims that preclude self-forgiveness or offer an independently plausible account (...) of self-forgiveness. I deploy both strategies in this article, explaining what self-forgiveness is and how it is possible. (shrink)

This latest philosophical text by John Sallis is inspired by the work of contemporary Chinese painter Cao Jun. It carries out a series of philosophical reflections on nature, art, and music by taking up Cao Jun's art and thought, with a focus on questions of the elemental. Sallis's reflections are not a matter of simply relating art works to philosophical thought, as theoretical insights and developments run throughout Cao Jun's writings and inform many of his artistic works. Sallis maintains abundant (...) points of contact with Chinese philosophical traditions but also with Western philosophy. In these reflections on art, Sallis poses a critique of mimesis and considers the relation of painting to music. He affirms his conviction that the artist must always turn to nature, especially as reflections on the earth and sky delimit the scale and place of what is human. Once relegated to the margins of the responsibility debate, moral influence theories have recently been rehabilitated. This paper offers a moral influence theory with two parts: a theory of responsibility as influenceability and an act-consequentialist justification of blame. I defend this account against six concerns commonly raised both by opponents and by advocates of similar views. Some concerns target act consequentialism, claiming that it 1) permits blaming innocents; 2) permits coercion, manipulation, and other objectionable forms of influence; and 3) fails (...) to capture intuitions about desert. Other concerns target responsibility as influenceability, claiming that influenceability accounts are 4) unsophisticated, 5) make ascriptions of responsibility dependent on assessments of permissible blame, and 6) have various counterintuitive implications. There is some irony that they have won this award named after Fred Streng, one of the founders of the Society for Buddhist-Christian Studies, for a volume that is a essentially a festschrift honoring the work of Fred Streng. Following is an edited interview with both of the winners.Buddhist-Christian Studies: What made each of you want to put together this collection of essays?Paul Ingram: Before I met Fred at the first "East-West Religions in Encounter" meeting organized by David Chappell in 1980 in Hawai'i, I was well acquainted with his work in history of religions. Fred by this time was recognized as one of the most important scholars in the field, and I deeply admired his work, particularly his book on Nagarjuna. As it turns out, he had read some of my work on Pure Land Buddhism and was as interested in meeting me as I was in meeting him. We became friends and colleagues. Because of our mutual interest in interreligious dialogue in general and in Buddhism in particular, he suggested that we should co-edit a volume of selected papers from the 1980 conference. This volume, Buddhist-Christian Dialogue: Mutual Renewal and Transformation, was subsequentlypublishedby the Universityof Hawai'i Press in 1986 and is still in print.Sallie King: I had long admired Fred's book on Nagarjuna, which uniquely and powerfullyopenedup the religiousmeaningof Nagarjuna'swork.I later metFred through the Society for Buddhist-Christian Studies and discovered that this admirable scholar was also a most admirable human being. We had lengthy, in-depth conversations when our paths crossed at various conferences. After Fred died, David Chappell, who had become the president of the Society for Buddhist-Christian Studies, suggested to Paul and me that we edit a volume of this kind in honor of Fred. Neither Paul nor I hesitated. Research evidencing the consequences of the experience of ‘calling’ have multiplied in recent years. At the same time, concerns have been expressed about the conceptual coherence of the notion as studies have posited a wide variety of senses in which both workers and scholars understand what it means for workers to be called, what they are called to do and who is doing the ‘calling’. This paper makes both conceptual and empirical contributions to the field. We argue that Bellah et (...) al.’s (Habits of the heart: Individualism and commitment in American life, University of California Press, 1996) contrast between tradition-based and expressivist understandings of ‘calling’ highlights a fundamental but neglected fissure in the literature. Expressivist accounts amongst both scholars and research participants require only that ‘calling’ be deeply felt by those who experience it. However, tradition-based accounts require an external caller. Exemplifying this, workers who attest to a divine call and scholars who write about ‘calling’ in the context of particular Christian traditions understand ‘calling’ in terms of a relationship with God. These accounts cannot but be in radical tension. We suggest that this conceptual confusion can be understood in terms of MacIntyre’s notion of ‘tradition-constituted rationality.’ The implications of this argument for practice are evidenced in our report of a study of adherents to one such tradition, workers at a Christian organization that supports people in poverty. Through in-depth interviews with long-term volunteers, we seek to assess if tradition-based ‘calling’ can be evidenced in unpaid work for the lack of pay and career progression opportunities strongly suggest the presence of ‘calling.’ This study demonstrates that even in the context of work that exhibits duty and altruism associated with expressivist accounts of ‘calling,’ these workers’ understanding of the relationships between themselves, their clients and Jesus Christ dominate their work choices. It is the meaning derived from a divine caller, understood in terms of Christian tradition, that accounts for their decision to begin and to continue this work. (shrink)

Most philosophers acknowledge ways of overcoming blame, even blame directed at a culpable offender, that are not forgiving. Sometimes continuing to blame a friend for their offensive comment just isn't worth it, so we let go instead. However, despite being a common and widely recognised experience, no one has offered a positive account of letting go. Instead, it tends to be characterised negatively and superficially, usually in order to delineate the boundaries of forgiveness. This paper gives a more complete and (...) systematic account of this important practice. We argue that the basic distinction between forgiving and letting go of blame follows from distinctions that many philosophers already accept. We then develop a positive account in terms of the reasons one has to let go rather than forgive and show that letting go is as valuable a part of our shared moral lives as forgiveness. (shrink)

Theorists analyzing the concepts of race and gender disagree over whether the terms refer to natural kinds, social kinds, or nothing at all. The question arises: what do we mean by the terms? It is usually assumed that ordinary intuitions of native speakers are definitive. However, I argue that contemporary semantic externalism can usefully combine with insights from Foucauldian genealogy to challenge mainstream methods of analysis and lend credibility to social constructionist projects.

A philosophically useful account of social structure must accommodate the fact that social structures play an important role in structural explanation. But what is a structural explanation? How do structural explanations function in the social sciences? This paper offers a way of thinking about structural explanation and sketches an account of social structure that connects social structures with structural explanation.

It is always awkward when someone asks me informally what I’m working on and I answer that I’m trying to figure out what gender is. For outside a rather narrow segment of the academic world, the term ‘gender’ has come to function as the polite way to talk about the sexes. And one thing people feel pretty confident about is their knowledge of the difference between males and females. Males are those human beings with a range of familiar primary and (...) secondary sex characteristics, most important being the penis; females are those with a different set, most important being the vagina or, perhaps, the uterus. Enough said. Against this background, it isn’t clear what could be the point of an inquiry, especially a philosophical inquiry, into “what gender is”. (shrink)

When we forgive, we do so for reasons. One challenge for forgiveness theorists is to explain which reasons are reasons to forgive and which are not. This paper argues that we forgive in response to a perceived change of heart on the part of the offender. The argument proceeds in four steps. First, I show that we forgive for reasons. Second, I argue that forgiveness requires the right kind of reason. Third, I show that these two points explain a common (...) distinction between forgiving and letting go and, in doing so, solve a problem facing many accounts of forgiveness. Finally, I consider candidate reasons to forgive and argue that all of them are either the wrong kind of reason or are instances of a more general reason of the right kind, namely, a perceived change of heart. Non-moral blame seems to be widespread and widely accepted in everyday life—tolerated at least, but often embraced. We blame athletes for poor performance, artists for bad or boring art, scientists for faulty research, and voters for flawed reasoning. This paper argues that non-moral blame is never justified—i.e. it’s never a morally permissible response to a non-moral failure. Having explained what blame is and how non-moral blame differs from moral blame, the paper presents the argument in four steps. First, it argues (...) that many (perhaps most) apparent cases of non-moral blame are actually cases of moral blame. Second, it argues that even if non-moral blame is pro tanto permissible—because its target is blameworthy for their substandard performance—it often (perhaps usually) fails to meet other permissibility conditions, such as fairness or standing. Third, it goes further and challenges the claim that non-moral blame is ever even pro tanto permissible. Finally, it considers a number of arguments in support of non-moral obligations and argues that none of them succeed. (shrink)

It is often claimed both that forgiveness is elective and that forgiveness is something that we do for reasons. However, there is a tension between these two central claims about the nature of forgiveness. If forgiving is something one does for reasons, then, at least sometimes, those reasons may generate a requirement to forgive or withhold forgiveness. While not strictly inconsistent with electivity, the idea of required forgiveness strikes some as antithetical to the spirit of the concept. They argue that (...) forgiveness is essentially elective. In this paper, I dispute these arguments. I argue that the intuitive plausibility of the position diminishes upon reflection and that the best arguments fail to explain why reasons to forgive, unlike most other reasons for action, cannot generate requirements. Abolitionism is the view that if no one is responsible, we ought to abandon the reactive attitudes. This paper defends abolitionism against the claim, made by P.F. Strawson and others, that abandoning these attitudes precludes the formation and maintenance of valuable personal relationships. These anti-abolitionists claim that one who abandons the reactive attitudes is unable to take personally others’ attitudes and actions regarding her, and that taking personally is necessary for certain valuable relationships. I dispute both claims and argue that (...) this objection exaggerates the role of the reactive attitudes and underestimates the importance of non-reactive moral emotions. (shrink)

[Sally Haslanger] In debates over the existence and nature of social kinds such as 'race' and 'gender', philosophers often rely heavily on our intuitions about the nature of the kind. Following this strategy, philosophers often reject social constructionist analyses, suggesting that they change rather than capture the meaning of the kind terms. However, given that social constructionists are often trying to debunk our ordinary (and ideology-ridden?) understandings of social kinds, it is not surprising that their analyses are counterintuitive. This article (...) argues that externalist insights from the critique of the analytic/synthetic distinction can be extended to justify social constructionist analyses. /// [Jennifer Saul] Sally Haslanger's 'What Good Are Our Intuitions? Philosophical Analysis and Social Kinds' is, among other things, a part of the theoretical underpinning for analyses of race and gender concepts that she discusses far more fully elsewhere. My reply focuses on these analyses of race and gender concepts, exploring the ways in which the theoretical work done in this paper and others can or cannot be used to defend these analyses against certain objections. I argue that the problems faced by Haslanger's analyses are in some ways less serious, and in some ways more serious, than they may at first appear. Along the way, I suggest that ordinary speakers may not in fact have race and gender concepts and I explore the ramifications of this claim. (shrink)

ABSTRACT I contend that Miranda Fricker’s ambitious new pluralist account of forgiveness is too inclusive and counts as forgiveness practices that are psychologically and normatively quite different. I raise three worries: First, her account of proleptic Gifted Forgiveness as temporally displaced Moral Justice Forgiveness seems to allow for Preemptive Forgiveness. Second, proleptic Gifted Forgiveness seems to resemble communicative blame more than forgiveness. Finally, an alternative account of forgiveness—explained in terms of reasons to forswear blame—seems capable of meeting Fricker’s desiderata for (...) an adequate theory (e.g., giftedness, pluralism, ambivalence, and genealogy), while avoiding the inclusivity worry. Violent video games (VVGs) are a source of serious and continuing controversy. They are not unique in this respect, though. Other entertainment products have been criticized on moral grounds, from pornography to heavy metal, horror films, and Harry Potter books. Some of these controversies have fizzled out over time and have come to be viewed as cases of moral panic. Others, including moral objections to VVGs, have persisted. The aim of this paper is to determine which, if any, of the (...) concerns raised about VVGs are legitimate. We argue that common moral objections to VVGs are unsuccessful, but that a plausible critique can be developed that captures the insights of these objections while avoiding their pitfalls. Our view suggests that the moral badness of a game depends on how well its internal logic expresses or encourages the players’ objectionable attitudes. This allows us to recognize that some games are morally worse than others—and that it can be morally wrong to design and play some VVGs—but that the moral badness of these games is not necessarily dependent on how violent they are. Across the humanities and social sciences it has become commonplace for scholars to argue that categories once assumed to be “natural” are in fact “social” or, in the familiar lingo, “socially constructed”. Two common examples of such categories are race and gender, but there many others. One interpretation of this claim is that although it is typically thought that what unifies the instances of such categories is some set of natural or physical properties, instead their unity rests on social features (...) of the items in question. Social constructionists pursuing this strategy—and it is these social constructionists I will be focusing on in this paper—aim to “debunk” the ordinary assumption that the categories are natural, by revealing the more accurate social basis of the classification.2 To avoid confusion, and to resist some of the associations with the term ‘social construction’, I will sometimes use the term ‘socially founded’ for the categories that this sort of constructionist reveals as social rather than natural. In a congressional hearing in the spring of 1996, talk show host Kathie Lee Gifford was charged with endorsing clothing made in Honduran sweatshops by exploited children. Resulting media coverage focused public attention on a seamy underside of the "global economy." Redemption strategies used by Gifford and her public relations consultant, and repeated and promoted through the mass media, fed a larger controversy over the meaning of the concept of the global economy and its ethical implications for the American public.

This essay proposes a design perspective on argumentation, intended as complementary to empirical and critical scholarship. In any substantive domain, design can provide insights that differ from those provided by scientific or humanistic perspectives. For argumentation, the key advantage of a design perspective is the recognition that humanity’s natural capacity for reason and reasonableness can be extended through inventions that improve on unaided human intellect. Historically, these inventions have fallen into three broad classes: logical systems, scientific methods, and disputation frameworks. (...) Behind each such invention is a specifiable “design hypothesis”: an idea about how to decrease error or how to increase the quality of outcomes from reasoning. As problems in contemporary argumentation practice become more complex, design thinking rises in relevance and importance. A design research agenda in argumentation would focus on theorizing design innovations and on evaluating design hypotheses. (shrink)

Abolitionism is the view that if no one is responsible, then we ought to abandon the reactive attitudes. Proponents suggest that reactive attitudes can be replaced in our emotional repertoire by non-reactive analogues. In this paper, I dispute and reject a common challenge to abolitionism according to which the reactive attitudes are necessary for protesting unfairness and maintaining social harmony. While other abolitionists dispute the empirical basis of this objection, I focus on its implications. I argue that even if non-reactive (...) analogues cannot perform the interpersonal and social functions of reactive attitudes, it does not follow that the losses of abandoning them outweigh the gains of retaining them. The force of the challenge rests on a mistake, identified by John Stuart Mill among others, that is common when evaluating entrenched social practices. (shrink)

ABSTRACTPerception of emotion in the face is a key component of human social cognition and is considered vital for many domains of life; however, little is known about how this ability differs across the lifespan for men and women. We addressed this question with a large community sample of persons ranging from younger than 15 to older than 60 years of age. Participants were viewers of the television show “Tout le Monde Joue”, and the task was presented on television, with (...) participants responding via their mobile devices. Applying latent variable modeling, and establishing measurement invariance between males and females and across age, we found that, for both males and females, emotion perception abilities peak between the ages of 15 and 30, with poorer performance by younger adults and declining performance after the age of 30. ABSTRACT Although “naturalistic fallacy” is a term coined in the twentieth century, scholars have long voiced myriad anxieties over the mechanisms by which their contemporaries have derived moral, social, and political lessons from natural phenomena—often as gambits for advancing their own alternative explanations. The essays in this Focus section explore five episodes in the history of such concerns with naturalistic reasoning in order to shed new light on the persistence of naturalism itself.
