Abortion is a controversial and divisive topic. The paper gives a short review of the main approaches throughout the history of European thinking to this complex problem. Moral concerns about abortion often turn on the questions of when human life can be said to has began and what is the moral status of human embryo and fetus. The paper gives also an outline of several scientific and religious attempts to solve the problem.

Avant de configurer «un monde», l’art humain configure un lieu et même l’élit et le transfigure en le métamorphosant, faisant de milieux donnés des «lieux» habitables voire mémorables aux multiples formes de délimitations, d’échanges et de devenir. La notion de milieu habité est mise en perspective et pensée en termes de limites, passages, liens et métamorphoses.

Einstein, in his “Zur Elektrodynamik bewegter Körper”, gave a physical (operational) meaning to “time” of a remote event in describing “motion” by introducing the concept of “synchronous stationary clocks located at different places”. But with regard to “place” in describing motion, he assumed without analysis the concept of a system of co-ordinates.In the present paper, we propose a way of giving physical (operational) meaning to the concepts of “place” and “co-ordinate system”, and show how the observer can define both the (...) place and time of a remote event. Following Einstein, we consider another system “in uniform motion of translation relatively to the former”. Without assuming “the properties of homogeneity which we attribute to space and time”, we show that the definitions of space and time in the two systems are linearly related. We deduce some novel consequences of our approach regarding faster-than-light observers and particles, “one-way” and “two-way” velocities of light, symmetry, the “group property” of inertial reference frames, length contraction and time dilatation, and the “twin paradox”. Finally, we point out a flaw in Einstein’s argument in the “Electrodynamical Part” of his paper and show that the Lorentz force formula and Einstein’s formula for transformation of field quantities are mutually consistent. We show that for faster-than-light bodies, a simple modification of Planck’s formula for mass suffices. (Except for the reference to Planck’s formula, we restrict ourselves to Physics of 1905.). Hua-yen Buddhism, the pre-eminent philosophical form of Buddhism in early T'ang dynasty the China, was instrumental in laying the conceptual foundations for virtually all subsequent East Asian Buddhism. This Hua-yen legacy includes Ch' an/Zen and Pure Land, the non-philosophical forms of Buddhism that came to dominance in the centuries to follow. In this sense, Fa-tsang (643-712), the third patriarch and foremost philosopher of Hua-yen, can be considered one of the forefathers of East Asian Buddhism today. By focusing on one element (...) in Fa-tsang's thought, this essay attempts to articulate the overall character of Hua-yen thought and, in the process, to shed light on its connection to other dimensions of the Buddhist tradition. -/- In Fa-tsang's monumental Wu-chiao chang (Treatise on the Five Teachings ), the mental image of a house is taken to model the dharmakãya universe as a whole. On Fa-tsang's account, since any one part of the house - his example is a rafter - is a condition for the house as a whole, that one part through its complex relations encompasses the whole house and is therefore able to reveal it comprehensively. What he calls the "one flavor" of the dharmakãya can be fully tasted in any one part. Adopting Fa-tsang's sytematic principle and taking the concept of bodhicitta as the focal point study, this essay attempts to show the "one flavor" of Fa-tsang's Buddhist thought through the treatment he gives to the traditional idea of the "thought of enlightenment.". Health professionals do not always have the luxury of making “right” choices. This article introduces the “devil's choice” as a metaphor to describe medical choices that arise in circumstances where all the available options are both unwanted and perverse. Using the devil's choice, the paper criticizes the principle of double effect and provides a re-interpretation of the conventional legal and ethical account of symptom relief in palliative care.

The introduction of the Diagnostic and statistical manual of mental disorders in May 2013 is being hailed as the biggest event in psychiatry in the last 10 years. In this paper I examine three important issues that arise from the new manual: Expanding nosology: Psychiatry has again broadened its nosology to include human experiences not previously under its purview . Consequence-based ethical concerns about this expansion are addressed, along with conceptual concerns about a confusion of “construct validity” and “conceptual validity” (...) and a failure to distinguish between “disorder” and “non disordered conditions for which we help people.” The role of claims about societal impact in changes in nosology: Several changes in the DSM-5 involved claims about societal impact in their rationales. This is due in part to a new online open comment period during DSM development. Examples include advancement of science, greater access to treatment, greater public awareness of condition, loss of identify or harm to those with removed disorders, stigmatization, offensiveness, etc. I identify and evaluate four importantly distinct ways in which claims about societal impact might operate in DSM development. Categorisation nosology to spectrum nosology: The move to “degrees of severity” of mental disorders, a major change for DSM-5, raises concerns about conceptual clarity and uniformity concerning what it means to have a severe form of a disorder, and ethical concerns about communication. Li Zehou stands among the most influential Chinese philosophers in the post-Mao era. His notion of subjectality is of paramount importance for current developments in contemporary Chinese philosophy. It belongs to the central concepts in Li's theoretical framework, around which his entire philosophical system is constructed. With his elaboration of this concept, Li expanded the problem of the self in post-revolutionary modernism. The present article analyzes the theoretical bases of this concept, exposes its importance in the scope of contemporary Chinese (...) theory and shows why and how it represents a call for a new humanism. Through a multidimensional comparative perspective, the author also explains why the human subject, which is based upon Li's notion of subjectality, has the potential not only to transform modern alienation into a real “human condition,” that is, into spiritually fulfilled society of autonomous individuals but also to fill up the prevailing “vacuum of values.”. Yaffe's handling of two general questions is assessed in this review. The first question is why mere attempts (as opposed to successful wrongdoing) should be made punishable in a well-conceived criminal code. The second question is how attempt liability should be conceived in such a code. As to the first question, Yaffe's nonsubstantive mode of answering it (in terms of his ) is contrasted to answers based on some more substantive desert-bases; Yaffe's own more substantive kind of answer (in terms (...) of a desert-base of ) is examined in light of the implication that the traditional requirements of trying and intending are mere proxies for faulty reason recognition and response as the basis for blaming and punishing attempts. As to the second question, Yaffe's analysis of trying in terms of a is examined in some detail. Canvassed here are the subquestions of: (1) whether appropriate assessibility by certain norms of rationality can give the nature of intending and thus of trying; (2) whether the externally de dicto intent requirements of criminal law statutes can easily be interpreted and applied by standard, extensional methods; (3) whether the distinctions between various kinds of elements within the content of intentions, can be justified ontologically or only practically; (4) whether actors necessarily intend results of their actions that are to other results that clearly are intended, and if not, whether such actors are nonetheless just as blameworthy for those results as if they did intend them; and (5) whether intention with respect to circumstance-elements differ (in either their psychology or in their moral effect) from beliefs with respect to such circumstance-elements. Background: Little is known about U.S. healthcare provider views and practices regarding evidence, counseling, and shared decision-making about in-hospital versus out-of-hospital birth settings. Methods: We conducted 19 in-depth, semistructured, qualitative interviews of eight obstetricians, eight midwives, and three pediatricians from across the United States. Interviews explored healthcare providers’ interpretation of the current evidence and their personal and professional experiences with childbirth within the existing medical, ethical, and legal context in the United States. Results: Themes emerged concerning risks and benefits, decision-making, (...) and patient-provider power dynamics. Collectively, the narratives illuminated fundamental ideological tensions between in- and out-of-hospital providers arising from divergent assignment of value to described risks and benefits. The majority of physicians focused on U.S.-specific data demonstrating increased neonatal morbidity and mortality associated with delayed access to hospital-based interventions, thereby justifying hospital birth as the standard of care. By contrast, midwives emphasized data demonstrating fewer interventions and superior maternal and neonatal outcomes in high-income European countries, where out-of-hospital birth is more common for low-risk birthing people. A key gap in counseling was revealed, as no interviewees offered anticipatory counseling regarding birth setting options. Providers directly and indirectly illustrated the propensity for asymmetric power relations between birth providers and pregnant people, especially in hospital settings. Conclusions: The narratives highlight the common goal of optimizing maternal and neonatal outcomes despite tensions arising from divergent prioritization of specific maternal and neonatal risks. Our findings suggest opportunities to foster collaboration and optimize outcomes via mutual respect and improved integration of care. (shrink)

The loss of his principal source of income meant the beginning of permanent penury and a lifelong struggle to find gainful employment. His key achievement during these years is his celebrated Monist metaphysical project, which consists of five classic articles on evolutionary cosmology. Also included are reviews and essays from The Nation in (...) which Peirce critiques Paul Carus, William James, Auguste Comte, Cesare Lombroso, and Karl Pearson, and takes part in a famous dispute between Francis E. Abbot and Josiah Royce. Peirce's short philosophical essays, studies in non-Euclidean geometry and number theory, and his only known experiment in prose fiction complete his production during these years. Unlike his other fictional works Blanchot’s 1953 narrative Celui qui ne m’accompagnait pas has received comparatively little attention. The reasons for this would seem to lie in the intense abstraction of his writing in this work, which is forbidding even by his own standards, but as I will show, this intensity can be understood as comprising a singular topography of the experience of writing. Blanchot’s narrative thereby becomes a very precise and concrete form of aesthetics, which can be usefully compared (...) to the understandings of melancholy developed by Benjamin and Adorno, but transposed into a more stringent modernist context. As Leibniz had hoped, the publication of his ‘Système nouveau de la nature et de la communication des substances...’ in 1695 provoked discussion of his metaphysics. Amongst the reactions was that of the French Benedictine, François Lamy, in his De la Connaissance de soi-même. It is not unusual to find the different editions of this work being confused, to the detriment of a proper understanding of the relation between Lamy’s texts and Leibniz’s. No doubt the rarity of copies of De (...) la Connaissance is at least partly responsible for this confusion, and it is because of that rarity that Lamy’s discussion of Leibniz is made available and reprinted here. This thesis is neither e page to page commentary nor en assessment of Hume's place in the history of Philosophy. It mainly consists in an attempt at justifying a certain approach to the Interpretation of his theory of value with special reference to morals.

This paper is an historical study of Tarski's methodology of deductive sciences (in which a logic S is identified with an operator Cn S, called the consequence operator, on a given set of expressions), from its appearance in 1930 to the end of the 1970s, focusing on the work done in the field by Roberto Magari, Piero Mangani and by some of their pupils between 1965 and 1974, and comparing it with the results achieved by Tarski and the Polish school (...) (Łoś, Suszko, Słupecki, Pogorzelski, Wójcicki). In the last section of the paper we will then compare these works with some recent developments in algebraic logic: this will lead to a better understanding of the results of the methodology of deductive science, but at the same time will show some intrinsic limits to such an approach to logic. Even if Magari's work on diagonizable algebras and universal algebra and Mangani's axiomatization of MV-algebras and results in model theory are rather famous, the articles on closure operators, published in the 1960s, are almost totally unknown outside Italy (mainly because of a linguistic limitation, the papers we analyse having been written and published in Italian). This paper aims to fill the gap in the literature and to enable the international community to get acquainted with this part of Italian logic. The same applies to some works published in Barcelona (in Catalan) at the end of the 1970s, analysed in the last section. (shrink)
